PZ09-13 -Kenai Cemetery Expansion (A replat of Government Lots 123, 1.73 & 174.) Plat submitted by Integrity Surveys, 8195 Kenai Spur Highway, Kenai, Alaska. Kebschull reviewed the staff report included in the packet, noting a cemetery would require a conditional use permit. Twait opened the meeting to public hearing. There being no comments, the public hearing was closed. MOTION: Commissioner Bryson MOVED to approve PZ09-13 including staff comments. Commissioner Brookman SECONDED the motion. Commissioner comments included: • The high pressure gas line in the area was a concern. The slope of the lot was an issue. • It was suggested Administration vacate the easement lines along First and Second Avenue and Float Plane Road. Discussion/Recommendation -- Alaska Historical Commission Geographic Name Proposal Kebschull reviewed the memorandum included in the packet, noting the creek had a Dena'ina name and recommended the Commission support the Kenaitze request to maintain the tribal name. MOTION: Commissioner Rornain MOVED to recommend supporting the Kenaitze request and support the Tribe's request to keep the creek's name as "Shk'ituk'tnu." Commissioner Bryson SECONDED the motion. Box 2342 Soldotna, AK 99669 Requested Action: Legal Description: Street Address: KPB Parcel No.: Existing Zoning: Current Land Use; Land Use Plan: ANALYSIS Preliminary Subdivision Plat -Hollier Subdivision No. 6 A Subdivision of Tract D-1 Hollier Subdivision No. 5 750 Hollier Street 04904095 RR -Rural Residential Vacant Rural Residential This plat subdivides a large parcel into two tracts, Tract D1-A {5.017 acres) and Tract D1-B (23.476 acres). The resulting parcels meet the minimum lot size for the Rural Residential zone. City water and sewer are not available. The parcels are accessed from Hollier Street off Beaver Loop Road. According to the City's information, Hollier Street is platted and not developed. According to aerial photography there is developed access to the new Tract D 1-A. Until weather conditions permit, the City is unable to verify if Hollier Street meets City's standards. It appears this plat may meet the requirements of KPB 20.04.040 and AS 29.40.490(B}. If the plat meets this waiver requirement, the City cannot require an installation agreement to bring Hollier Street up to City standards. However, the owner must recognize that if the street is not built to minimum City standards the City does not issue building permits far parcels that are not accessible for public safety vehicles. Building pfiicial: Undeveloped - no building code issues. RECOMMENDATIONS This is a preliminary plat to subdivide a large parcel into two tracts. The property is Pz09-16 Comments Page 2 located in the Rural Residential zone. The resulting tracts meet the minimum lot size for the Rural Residential zone. City water and sewer are not available to serve the lots and any development will require on-site services. The property is accessed off Beaver Loop Road via Hollier Street. The City is unable to verify the condition of Hollier Street. When weather permits, the City will inspect the street and determine if the street meets the minimum City standards for access. Because this plat appears to meet the requirements for a plat waiver under KPB 20.04.040 and AS 29.40.090(B), the City cannot require an installation agreement for Hollier Street construction. However, if the street does not meet City standards, building permits will not be issued for the parcels. Recommend approval with the following stipulations noted: 1. When weather permits, the City will verify the status of Hollier Street. 2. If Hollier Street is not built to City standards, the City will not issue building permits on these tracts of land. The property is owned by the applicant's grandmother, who resides at the facility. The property is located in the Rural Residential zone. Qnce the City became aware of the business, Ms. Balduf was notified and proceeded to apply for the Conditional Use Permit to bring the property into compliance. New River is an Assisted Living Facility for compromised adults aver SS. Currently New River operates the referenced property as an assisted living home far up to 2 individuals with 24 hour care available. New River is in the process of getting licensed with the State of Alaska for a maximum of S occupants. When that license is approved and if the facility is fully occupied, there will be S care providers, 2 per shift plus the applicant. RECQMMENDATIQNS New River is an Assisted Living Facility for compromised adults over S5. Currently New River operates the referenced property as an assisted living home for up to 2 individuals with 24 hour care available. An effective landscaping plan should utilize a variety of techniques for achieving the intent of this section. The appropriate placement or retention of vegetation in sufficient amount will provide the best results. Perimeter, interior, street right-of- way, and parking lot landscaping must be included as components of the overa111andscaping plan. (b} Perimeter/Buffer Landscaping. Perimeterlbuffer landscaping involves the land areas adjacent to the lot lines within the property boundary. This buffer Landscaping serves to separate and minimize the impact between adjacent uses. Buffer landscaping maybe desirable along the perimeter of the property to shield vehicular or building lights from adjacent structures and to provide a visual separation between pedestrians and vehicles and commercial and residential uses. Landscaping adjacent to residential zones shall have landscaping beds/buffers that meet all of the following minimum standards: 1. Landscaping Beds. Interior landscaping is desirable to separate uses or activities within the overall development. Screening or visual enhancement landscaping is recommended to accent or complement buildings, to identify and highlight entrances to the site, and to provide for attractive driveways and streets within the site. Landscaping may include landscaping beds, trees, and shrubs. (d) Parking Lot Landscaping. Parking lot landscaping involves the land areas adjacent to or within all parking lots and associated access drives. Parking lot landscaping serves to provide visual relief between vehicle parking areas and the remainder of the development. It also is desirable for the purpose of improving vehicular and pedestrian circulation patterns. As noted, this is an established site. The as-built survey identifies existing pavement and trees along the perimeter of the lot. Some areas are paved past the 10-foot requirement. It is not reasonable to request the pavement to be removed. This property abuts three streets; Kenai Spur Highway, Seward Avenue, and Seldovia Avenue. Seward and Seldovia Avenue are platted and not developed. The developer plans to retain existing vegetation at the rear of the lot along Seldovia Avenue to meet the 10-foot requirement. Existing vegetation will be retained along a portion of Seward Avenue. The developer plans to place a fence along the section where existing trees are removed and has asked that in lieu of landscaping that slates be placed in planned fencing. The following are required in the site plan: • Parking - o The as-built identifies the parking area. Sixteen parking spaces are provided; one space is identified as handicap accessible. This meets the parking requirements for the planned building. o Parking Lot. o This parcel is outside of the area identified as requiring paving. The site plan shows the area in front of the entrance where the handicapped parking space is located as paved. No additional paving will be required. Snow storage. o Identified at the rear of the lot adjacent to the planned cell tower site. • Dumpster. o Code requires any dumpster on the site must be screened with a sight-obscuring structure made of wood or concrete.
