RESOLUTION N0. 80-,5
Whereas, Kenai Peninsula Borough Ordinance No. 80-14, re-
garding the mandatory permitting of schools in any zoning
district which allows churches, has been referred to this
Commission for recommendation; and
Whereas, the Commission finds the following:
1. the existing Kenai Zoning Code permits churches in
three residential and conditionally in one commercial
zone, but permits schools only conditionally in three
zones,
20 that. churches and schools are completely different
uses of land,
3. that the churches and schools have different site and
space requirements and have different impacts on ad-
jacent properties,
4. that a site suitable for a church is not necessarily
suitable for a school; and a site suitable for a school
may not be suitable for a church,
5, that a revised zoning code under review by the commission
further recognizes the differences between secondary
schools. and elementary schools, and will. regulate these
differently,
6. that traffic, safety, adequate recreation area and pro-
tection of adjacent property. values and property rights
require different zoning requirements for churches, for
secondary schools and for elementary schools..
NOW THEREFORE, BE IT RESOLVED BY THE KENAI ADVISORY PLANNING
AND ZONING COMMISSION that;
1, Ordinance 80-14 be rejected
2. that the .imposition of such a zoning regulation on a
Borough - wide basis is in direct conflict with past
practice and policy;
3. that such a regulation ignores different situations in
different cities and undermines local planning processes.
