PZ 83-9 A Resolution of the Advisory Planning and Zoning Commission of the City of Kenai (granting)(denying) a request for a CONDITIONAL USE PERMIT, as .authorized by 21.76.220 of the Kenai Zoning Code, for Restaurant - office space Townsite to Cate d Lot 7 Block 20, Original Kenai by Daniel R. Hakkinen WHEREAS, the Commission finds that Section 21.76.140 establishes that . there are uses which may be compatible with principal uses in specified zones if certain conditions are met, and that the Commission shall permit this compatible type of use if the requirements and conditions so specified are met, and WHEREAS, the Commission finds: 1. That an application meeting the requirements of Section 21.76.140( ) has been submitted and received on 3/7/83 2. That this request is located on land zoned Urban Residential (RiJ) 3. That this proposed use is (permitted) (not permitted) as a Conditional Use in this zone, as specified in Section 21.76.140G-? 4. That the applicant has demonstrated with plans and other documents that he can and will meet the following specific requirements and conditions as required by Section 21.76.140E-1. a. Such uses must be similar to principal uses permitted in the zone b. Such uses must be in harmony with the intent of the zone 5. That a duly advertised public hearing meeting the requirements of Section 21.76.140(C2) has been held by the Commission on March 23. 1983 6. That the following additional facts have been found to exist: petitioner desires to construct a 2 story building with a restaurant on the lower floor and office spaces on the top floor. Hakkinen NO~V, THEREFORE, BE IT RESOLVED, by the Advisory Planning and Zoning Commission of the City of Kenai that the applicant (has) (has not) demonstrated that the proposed development meets the conditions required for said proposal, and therefore the .Commission (does not permit said proposal to be constructed) (permits said proposal to be constructed in accordance with the specified conditions, ,and authorizes the administrative official of the Kenai Zoning Code to issue a Certificate of Zoning Compliance for said proposal).
