RESOLUTION N0. PZ83-50
A RESOLUTION OF THE ADVISORY PLANNING AND ZONING COMMISSION OF
THE CITY OF KENAI RECOMMENDING THE ELIMINATION OF CERTAIN MINIMUM
YARD REQUIREMENTS OF KENAI PENINSULA BOROUGH CODE OF ORDINANCES
21.76.070 C-3 FOR LOT 6, BLOCK 4, HIGHLANDS SUBDIVISION.
WHEREAS, there is an existing house located on Lot 6, Block 4,
Highlands Subdivision which violates the 20 foot minimum
rear yard setback; and,
WHEREAS, the encroachment was discovered by McLane and
Associates, Inc., through an as-built survey performed on
the subject property on June 15, 1983; and,
WHEREAS, this zoning ordinance violation constitutes an
encumberance affecting the conveyance of the property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF KENAI ADVISORY
PLANNING AND ZONING COMMISSION that. the portion of the 20 foot
minimum rear yard setback requirement which creates the existing
encroachment on Lot 6, Block 4, Highlands Subdivision shall be
eliminated.
PASSED BY THE PLANNING & ZONING COMMISSION OF THE CITY OF KENAI,
ALASKA this 31st day of August., 1983.
