5-a. Discussion - Library e~pansion
Chair Peters reported on a conversation he had with Representative Olson related to
the use of the old courthouse for a library; that he believed it would be cost effective
and preferred the location; and that Olson requested the City Councll pass a resolution
noting the request for the building. Discussion followed related to the advantages and
disadvantages for using the building as a library site.

Comnussioner Brenckle MOVED the Commission request Council Member Molloy to
notify the Council the Conunission would like a resolution forwarded for their
consideration which states the city is interested in acquiring the State Office Buffding
for library e7cpansion and to submit it to the Legislature. Conuiiissioner Cook

5-b. Discussion - KMC 1.56, Kenai Municipal Library Department and Library
Regulations and Policies/Review and Possible Updates
Library Director Joiner reviewed the informarion requested at the July 11 meeting.
Coriunissioner Bryson excused herself from the remainder of the meeting.
ITEM 6: NEW BUSINESS -- None.
ITEM 7: REPORTS
7-a. Disector -- Joiner reviewed information presented in the monthly activity
report. She also reported her attendance at a meeting on uses of the internet.
7-b. Commissioner Chair -- No report.
7-c. Friends of the Library -- Commissioner Heus reported the book sale as
very successful; raffle tickets have been distributed; the Friends have one new member
and a one-year term vacancy on its board; and she thanked the Fire Deparhnent for
use of the tables.
7-d. City Council Liaison -- CouncIl Member Molloy reviewed actions taken
at the July 19 councff meeting and reported the resignation of Councff Member Ciiff
Massie.

Heus -- Glad they are moving forwarding on an option for a library addition.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING
PORTIONS OF KMC 1.56 (KENAI MUNICIPAL LIBRARY DEPARTMENT) AND KMC 1.57
(LIBrtARY COMMIS5ION) REGARDING LENDING ROLICIES, AND REPLACING THE
TERM °LIBRARIAN" WITH "LIBRARY DIRECTOR."
WHEREAS, KMC 1.56 and KMC 1.57 contains the city ordinances relating to the
Kenai Community Library and the Kenai Library Commission; and,
WHEREAS, the Kenai Library Coininission has recommended amendments to KMC
1.56 regarding lending policies and changing the terxn "Librarian" to "Library
Director"; and,
WHEREAS, the Kenai Library Cormtiission is charged under KMC 1.56.010(c) to make
recommendations to the Kenai City Council regarding library matters: and,
WHEREAS, it is in the best interest of the City of Kenai to amend the Kenai Municipal
Code as shown in Attachment A.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
AI.ASKA, that KMC 1.56 and KMC 1.57 are amended as shown in Attachment A.

Chapter 1.56
KENAI MUNICIPAL LIBIZARY DEPARTMENT
1.56.010 Creation.
There shall be a Municipal Library Department, the head of which shall be the Librarian,
appointed by the City Manager for an indefinite Cersn. The [LIBRARIAN] Librarv Director shall
be an oFficer of the City and have supervision and control of the Kenai CommuniCy Library.
1.56.020 AuEhority for adoption of rules, regulations, and ~nes.
The [LIBRARIAN] Librarv Directar shali establish rules and regulations for conduct on the
property of, and use of, the Kenai Community Library and library materials and a fine or penalty
charge schedule for overdue, damaged, or failure to return loaned library property, which rules
and regulations sha11 be effective after approvai by City Council and after being posted in a
location wiThin the library readily visible by library patrons.
1.56.025 Library cards.
No materials will be loaned from the library except to parties having a valid library
identification card which is not subject to any unpaid fines or penalties in excess of $10. Such
library identification card will be issued to any resident of the area making appiication therefor
and upon a form prepazed by the Librarian and containing an ab eement to be responsible for ail
matei~als bon~owed fhereon and to pay any fines, charges, or penalties imposed by misuse of
library property. However, no such card will be issued to a minor (under the age of 18) unless the
appiication for said card is also signed by a parent of such child or one standing in piace of the
parent who is willing to assume responsibility for the child and for any misuse of library
privileges.
1.56.030 Sleeping and resting prohibited.
No one shall sleep within Che library or outside the library upon library property at any time
nor shall anyone lie in a reclined position wiYhin or outside the library or library grounds. To lie
in a reclined position means to position one's body parallel to the floor or ground whether one is
on the floor, ground, a table, bench, chairs, couch, counter, shelves, card cases, or any other item
of furniture.
L56.040 Refusing to return loaned material.
No person, finn, or corporation shall lrnowingly refuse to return any reading material,
including books, periodicals, newspapers, maps, atlases, or any non-reading material including
cassettes, record players, screens, and projectors loaned to said person, firm, or cotporation
within thirty (30) days after said reading or non-reading material becomes overdue. (Ord. 536)
1.56.045 Lending policy where loaned material not returned.
Lending privileges for any library materials will be suspended on any library card on which
materials have been loaned and have not been returned when due or on which any fines, charges,
or penalties in excess of $10 have been assessed which are in arrears. [WHERE PRIVILEGE OF
ANY MEMBER OF A FAMII.Y GROUP WHO IS A HOLDER OF A LIBRARY CARD HAS

1.56.050 Penalty.
In addition to any fine levied or other penalty imposed pursuant to this ordinance or
regulations imposed thereunder, any person, firm, or coxporation who shall violate any provision
of this chapter including any rules and regulacions as herein set forth, or fail to compiy therewith
upon conviction thereof shall be punished by a fine as provided for violations in KMC
13.05.010.

LIBRARY COMNIIS5ION
1.57.010 Duties and powers.
The Commission sha11 be required to do the following:
(a) Develop, adopt, alter, or revise subjecC to approval by the City Council, a masCer plan for the
physical developmant of library faciliYies for the City;
(b) Submit annually to the City Manager and Council a list of recommended capital and other
improvemenfs in regards to the library;
(c) Make recommendations regarding any matter related to library service;
(d) Serve as the liaison between the public and the City Council in rega~•ds Yo library service;
(e) Work closely with the Friends of the Kenai Community Library [BOARD] for the betteiment
of the Kenai Community Library;
(f~ Shall act in an advisory capacity in the selection of the [CPPY LIBRARIAN] Librarv
Director.
1.57.020 Library regulations.
The Library Regulations shall be as ]isted under the regulations section in the Kenai Code,
Supplement #18, adopted on September 20, 1982, and all future updates.

i. BORROWERS' CARDS
a. AIl transactions wi11 require the presence of a valid library identificataon card which will
be issued to a resident filing an application, and accepting responsibility for the usage thereof.
No cazd will be issued to a minor under eighteen (18) years of age uniess Che application; and
acceptance of responsibility, is signed by the minor and also by a parent or legal guardian. The
responsible adult must be a current cardholder and be willing to assume the responsibility for the
minor for misuse or abuse of the privileges of library usage.
b. Upon application for a card, the borrower will be permitted to check out [ON~ (i)] 2wo

MAY CHECK OUT AS MANY AS FOUR (4) ITEMS ~ACH LIBRARY VISIT IF ALL

writfen notice of suspension to such parent or a legal guardian at the address on the library
record, and will remain in effect until the overdue materials have been returned, and/or the fines,
charges, or penalties on the suspended card have been paid in full.
2. [FINES] LATE FEES
a. Ten cents ($010) per day on four (4) week books.

3. SERVICE CHARGES
a. Ten dollars ($10.00) handling charge for books or other materials That are lost or
damaged beyond repair. This is in addition to full replacement costs. If the current price of the
ifem is uuavailable, default repiacement costs are as foIlows:

5. DAMAGES
a. Two dollazs ($2.00) per page for torn or defaced pages or covers. (Pages or covers
containing scribbling, writing or pages that have been mended with scotch tape or like material

are considered defaced.) The char~e should not exceed the actual cost or replacement cost of the
item.
b. If library materials are damaged to the extent that any parts of them are illegible, chazges
under paragraph 3(a) above will be applicable.

The Kenai Communitu Library will endeavor to:
a. Provide service to every resident in the communitv;
b. Provide non-residents tl~e same services•

The librarv supports the Library Bill of Rights of the American Libraz~v Association Freedom to
Read stafement. The library's mandate is to provide the nublic with access to information on al]
sides of an issue.
MATERIALS
Sooks and other library materials will be added to the present collection to provide
information, entertainment, intellectual development and enrichment to aii the people of the
community.
PERSONNEL
Salary schedule, holidays, vacation and sick leave shall conform to ihose rules outlined in the
Personnel Regulations of the City of Kenai.
BUDGET, OPERATIONAL
The budget shall be presented to the City by the Library stafP.
BUDGET, CAPTTAL IMPROVEMENTS
The initiation of a budget for Capital Improvements shall be done by the Library Commission
and the Library Staff.
BOOK SELECTION
The Libraiy Commission recognizing the pluralistic nature of this community and the varied
backgrounds and the needs of the citizens, declares as a matter of book selection policy that:

a. Books andlor oTher library material selection are and shall be vested in the libxarian. Any
' book and/or library material so selected shall be held to be selected by the Commission.
b. Selection of books and/or other library material shall be made on the basis of their value
of interest, information, and enlightenment of a11 the people of the community. No book and/or
library material sha11 be exeiuded because of the race, nationality or the political or social views
of the author.
c. This Commission believes fhat censorship is a purely individual matter and declares that
while anyone is free to reject for himself books of which he does not approve, he cannoC exercise
this right of censorship to resirict the freedom to read to others.
d. This Commission defends the principles of the freedom to read and declares that
whenever censorship is involved no book and/or library material shall be reinoved from the
library save under the arders of a court or competent jurisdiction.
This Commission adopCs and declares tl~at it will adhere to and suppoi-~:

which are made a part hereof.
Gifts will be accepted with provisions as to addition Yo the collection upon examination of

Cooperation will be given to other libraries to advance the usage of all libraries and to provide
additional services to the readers of our eommunity, and to publicize the value of librazy services
to all.
