RESOLUTION PZ $4-93
A RESOLUTION OF THE ADVISORY PLANNING & ZONING COMMISSION OF THE CITY OF
KENAI MODIFYING THE REQUIRED SIDE YARD REQUIREMENTS OF THE KENAI ZONING
CODE FOR LOT 12A, BLOCK 2, 1963 REPEAT MOMMSENS SUBDIVISION ADDITION5 1
AND 2.
WHEREAS,there is a house presently under construction on Lot 12A, Block 2,
1963 Replat Mommsens Subdivision Additions 1 & Z, and
WHEREAS, an encroachment to the required side yard setback has been
discovered by Charles L. Parker, R.L.S., per as-built survey dated
September 11, 198G, and
WHEREAS, the as-built verifies that the described house is located 4.5
feet from an adjoining property line, and
WHEREAS, the required side yard setback for a one-story residential
structure is 5.0 feet, and
WHEREAS, the Uniform Building Code allows the location of said structure to
be within 3.0 feet of the property line.
NOW, THEREFORE, BE IT RESOLVED THAT THE KENAI ADVTSORY PLANNING & ZONLNG
COMMISSION, OF THE CITY OF KENAI, that the portion of the 5 foot minimum
side yard requirement which results in the existing encroachment on Lot
12A, Block 2, 1963 Replat Mommsens Subdivision Additions 1&2 shall be
eliminated.
