A RESOLUTION OF THE ADVISORY PLANNING & ZONING COMMISSION OF THE CITY OF
KENAI (GRANTING) (DENYING) A REQUEST FOR A VARIANCE AS AUTHORIZED BY
14.20.180 OF THE KENAI ZONING CODE,

WHEREAS, the Commission finds that Section 14.20.180 provides that a
variance from the strict provisions of the zoning code may be granted by
the Commission if all conditions specified in 14.20.180 (b ~~1(ii) are met,
and
WHEREAS, the Commission finds:
1. That an application meeting the requirements of Section 14.20.180 (,b X~,~ii~
has been submitted and received on a~~1~S
2. That this request is located on land zoned ~.~,e~~~e~~~
3. That the applicant seeks a variance from the strict provisions of
14.20.E from the requirement of:
"No sign except roof signs shall be higher than 16' above the adjacent
ground or pavement level"
4. a. That there (are) (are not) exceptional physical circumstances or
conditions applicable to this property or to its intended use or
development which do not apply generally to other properties
within the same land use district:

b. That the strict application of 14.20.E (would) (would not)
result in practical difficulties or unnecessary hardships:

c. That the granting of this variance (will) (will not} result in
material damage to other properties in the vicinity and (will)
(will not) be detrimental to the public health, or welfare:
5. That a duly advertised Public Hearing, meeting the requirements of
Section 14.20.280 has been held by the Commission on ~?,/j ~~~~
6. That the following additional facts have been found to exist:
NDW, THEREFORE, BE IT RESOLVED, by the Advisory Planning & Zoning
Commission of the City of Kenai that the conditions specified in 14.20.180
(b)(1)(ii) (have} (have not) been shown to exist, and, therefore, the
Commission (denies) grants this request for variance as specified herein,
and authorizes the adminzs rative official of the Kenai Zoning Code to
issue a Certificate of Zoning Compliance.
