A RESflL11TI0N OF THE ApVI50RY PLANNING & ZONING GUMMISSIflN flF THE GITY OF
KENAI REVISING CERTAIN SECTIONS OF THE KENAI MUNICIPAL ZONING GOpE.
WHEREAS, several sections of the Zoning Code have development requirements
which refer to the pevelopment Requirements Table and no such table is so
designated in the code, and; C•)
WHEREAS, the table which Iists development requirements contains no
requirements for the RR-I zone far minimum lot width, minimum frant yard,
side yard, and rear yard, maximum lot coverage, and maximum height, and; (a)
WHEREAS, the the table which lists development requirements requires a 5
foot side yard for a one story structure and footnote I requires a 15 foot
side yard fc:r a structure more than one story but does not dive a side yard
far a daylight basement type structure, and; Cs)

WHEREAS, the same table refers to a one half story and there is no such
building classification, and; (~/)
WHEREAS, the "Additional Requirements: Minimum Yards: A" (pages 14-62}
would seem to be better addressed by the landscape Review Berard, and; Cs)
WHEREAS, "Additional Requirements; Maximum Heights:" (pages 14-62) is
incarrect, and; ~~)
WHEREAS, Section 14.20.24Q (b} is vague, and C7~
WHEREAS, "Additional Requirements; Street Setbacks:" are not enforced, and; C ~~
WHEREAS, Section 14.20.050 (g}(3} conflicts with Section 14.20.150 (c)(3),
and; (4)
WHEREAS, Section I4.20.150(c)(3) may not require a Certificate of
Occupancy, and; Cio)
WHEREAS, Section 14.20.180 (e} may not require a Certificate of IIccupancy,
and; Cr ~)
WHEREAS, Section 14.20.250 "Off Street Parking and Loading Requirements"
is in conflict with the Land Use Table, and C~a~

WHEREA5, farm livestock are a continuing nuisance in subdivisions with

NOW, THEREFORE, BE IT RESOLVED BY THE ADVISORY PLANNING ~ ZONING COMMISSION
Of THE CITY OF KENAI, that:
I) The table containing development requirements located on pages 14-61
of the Kenai Zoning Code sha11 be labeled "Development Requirements Table",

3) The Development Requirements Table, footnote 1 shall read, ''for
structures with a daylight basement the minimum side yard shall be 10 feet
and for structures two or more full stories in height, the side yard shall
be l5 feet. Far the purposes of this table only, a "Daylight basement"
shall mean a structure where the ground floor is ~0 or more inches below
grade and a structure where the ground floor is less than 3R inches below
grade as set out above shall be considered a full story."
4) The "Development Requirements Table" footnote 2 shall read, "Except
that far each story aver two stories each side and rear yard shall be
increased three feet, but need not exceed 14 feet for each side yard and 19
feet for the rear yard."
5) The "Additional Requirements: Minimum Yards - A" is hereby deleted.
Reletter remaining requirements.
b) "Additional Requirements; Maximum Heights" the last phrase shall read,
....."map entitled 'Obstruction Criteria', on file with the Airport
Managers' .
~} Section 14.2R.24p Mobile Homes: {b} shall read: "Mobile Names fflr
residential use may be established only in mobile hams parks as permitted
in the Land Use Table".
8} "Additional Requirements: Street setbacks:" are deleted.
9) Section 14.20.050(g)(3) is deleted,
10} Section 14.20.150 (c)(3) shall read: "An approved conditional use
permit shall lapse 12 months from the date of approval if the
non-conforming use for which the conditional use permit was approved has
not been implemented.

ll) Section 14.20.18D(e) Permit Expiration: an approved variance permit
shall lapse 12 months from the date of approval if the variance for which
the permit was issued has not been implemented."
22) The Land llse Table under Miscellaneous Uses: Parking, Off-Street,
shall allow off-street parking in all zones.
13) Add a new subsection (h) to Section 14.20.090 to read: "Farm livestock
are not allowed to be kept in the Suburban Residential Zones. Livestock
which are being kept in these zones at the time this ordinance takes effect
~ may continue to be kept there indefinitely."
Add a new subsection (h} to Section 14.20.090 to read: "Farm livestock
are not allowed to be kept in the Urban Residential Zone. Livestock which
are being kept in this zone at the time this ordinance takes effect may
continue to be kept there indefinitely."
Add a new definition to read:
"(29) Farm Livestock shall include by not be limited to the following:
horses, donkeys, caws, pigs, and similar animals; poultry,and bees, which
are normally found on a farm and are normally kept or sheltered outside of
a residence."
Renumber the definitions that follow,
