HomeMy WebLinkAboutPZ1987-07CITY OF KENAI .~ PLANNING & ZONING COMMISSION RESOLUTION PZ_~~~ A RESOLUTION OF THE PLANNING & ZONING COMMISSION OF GRANTING A REQUEST FOR AN ENCROACHMENT PERMIT AS AU 14.20.185, for: /40~a~ l~~S ~~ ~. located: L~ ~ ~ a ~~~ ~. fb ~o (legal description and/or street address) by: ~ ~, WHEREAS, the Commission finds that all requirements Section 14.20.185 (d)(1 - 4) have been met, and WHEREAS, the Commission finds: 1. That an application meeting all stated re irements has been received on 7//0~(~( 2. That the Commission has held a hearing on ~~~/~'~ 3. And that the following special conditi ns exist: Mrs. Koerber applied for a variance on my 23, 1986. The variance was not approved, however, the Commission issued a statement of approval to the Borough to proceed with the platting and a letter was sent to the bank stating the Commission's position regarding both the variance and the encroachment situation. Mrs. Koerber has informed the City of Kenai that the bank has not accepted the letter of intent issued by the Commission. The Borough finds no problem and has stated that the replatting may proceed without returning to the City of Kenai unless it is filed with substantial changes. This Encroachment Permit is being issued to further substantiate the exemption from the Development Requirements Table which deals with setbacks in a Suburban Residential (RS) zone which was granted by the Commission on July 23, 1986. RESOLUTION PZ87- NOW, THEREFORE, BE IT RESOLVED by the Planning & Zoning Commission of the City of Kenai that this Encroachment Permit be issued to Mrs. Artha L. (Bonnie} Koerber for Lot 57-A2, Peter S/D, located at 309 N. Gill, Kenai Alaska and that this permit is issued at this time for the sole purpose of satisfying the financial institution.
