ITEM 3: SCHEDULED PUBLIC COMMENT -- None, ITEM 4: CONSIDERATION OF PLATS 4-a. PZ09-16 -Tracts D 1-A & D 1-B Hollier Subdivision No. 6 (A replat of Tract D-1, Hollier SD #5). Plat submitted by Tinker Creek Surveys, PO Box 2342, Soldotna, Alaska. City Planner Kebschull reviewed the staff report which was included in the packet, noting the following: • The request was for a preliminary subdivision plat to subdivide a large parcel into two tracts. • The resulting parcels would meet the minimum lot size for the Rural Residential zone. • City water and sewer were not available. • The parcels would be accessed from Hollier Street, off Beaver Loop Road. • Because Hollier Street was platted, but not developed, the City would need to verify if the street would meet City road standards. • It appeared the plat would meet the requests of Borough and State waiver requirements and if so, the City could not require an installation agreement to bring the street to city standards. • The owner would need to recognize that if the street was not built to minimum city standards, the City could not issue building permits. • Staff recornrnended approval of the plat with the stipulations that when weather permits, the City would verify the status of Hollier Street and if Hollier Street was not built to City Standards, the City would not issue building permits on the tracts of land. The floor was opened for public hearing with rules of public hearing stated by Twait. Gary Hollier, 43680 Ross Street, Soldotna -- Hollier noted the following: • He was representing his mother, owner of the property, and spoke in support of the resolution. • He understood and agreed with the statements Kebschull made with regard to Hollier Street. ~ It was the intent one of the parcels would be deeded to his daughter for her to build a home. There being no one else wishing to speak, the public hearing was closed. Kebschull reviewed the staff report included in the packet and noted the following: • The application was for a conditional use permit to operate an assisted living facility. City became aware of the business being run from the property and notified the property owner of requirements; the applicant then applied for the conditional use permit. • Although the business is licensed to care for two individuals, the owner is in the process of licensing for a maximum of five individuals. • The business was low impact to the neighborhood. • The pictures added to the packet indicated adequate parking was available. • Staff recommended approval with the requirements including the facility be inspected by the Fire Marshal for compliance with the fire code prior to approval of the permit and thereafter, be inspected every other years; occupancy be limited to the number of occupants permitted by the State, with a maximum of five (5} occupants; copies of the State of Alaska license(s) be provided to the City; and, the applicant provide proof of Borough sales tax registration. The floor was opened for public hearing. Charles Obendorf, Soldotna -- Spoke in support of the resolution, noting a family member was a resident of the facility and he and his wife were very impressed with the care provided. Commissioner comments included: • Commissioner Koester noted she owned property adjacent to the subject property but had no financial or monetary relationship to the property or property owners. Borough Planning -- Commissioner Bryson reviewed the March 23, 2009 Borough Planning Commission meeting agenda which was included in the packet, and noted actions taken. 9-c. Administration -- City Planner Kebschull reported the following items: • Reminded commissioners to indicate to the City Clerk whether they would be able to attend the Apri14, 2009 effective meetings training. • Reminded the Commission their City Financial Disclosure Forms were due to the City Clerk on or before April 15, 2009. • She met with representatives of the Russian Orthodox Church regarding restoration of the Church. The issue would came before the Commission in the future for approval of permitting. • There would be a public hearing at the next scheduled meeting as well as a work session related to suggested amendments to the Limited Commercial (LC) Zone. • She would be out of town from April 9-20, back for a few days and then to a conference. Winegarden 100 Trading Bay, Suite 8 283-5774 Kenai, AK 9961 1 Requested Action: Amendment to Kenai Municipal Cade Title 14 ANAL ys~s General Information: Kenai Municipal Code KMC 14.20.270 provides procedures for amendments to the Kenai Zoning Code {Title 14} and the Official Zoning Map. One of the methods for initiation of an amendment is submission of a petition bearing the signatures of fifty [50) registered voters within the City of Kenai. On March 10, 2009, a rezoning petition was submitted by the applicant. On March 17, 2009, City Clerk Carol Preas certified the petition as being sufficient to meet the requirements of KMC 14.270{b}{D). Based on that certification, a public hearing was scheduled as required in KMC 14.20.270(c}(1). On March 25, 2009, notices were placed in three public places (Kenai Courthouse, Kenai City Hall, and Kenai Post Of#ice). Notices were published in the Peninsula Clarion on April 1 & 3, 2009. Evaluation of A lication: The petition is titled, "Petition to Establish MAPS Special Zoning District" and states, "WHEREAS, the Kenai Zoning Code, KMC 14.20.270(b)(1}{p} provides that amendments to the Kenai Zoning Code and Official Map may be initiated by submission of a petition bearing the signatures of fifty {50} registered voters within the City of Kenai to amend the ordinance text; Now Therefore, we the undersigned registered voters within the City of Kenai petition the City of Kenai to amend the Kenai Zoning Code to establish the MAPS Special Zoning District, as provided in the attached proposed Kenai Zoning Code amendments. The application includes a description of the proposed zone including features, 9 PZ09-18 Comments Page 2 area defined, intent, principal permitted uses, conditional uses, accessory uses, home occupations, development requirements, and parking requirements. Under the section fior principal permitted uses, six (6) parcels are identified within the proposed zone area and provided special rules for development within the proposed zone. A copy of the petition is attached. At my request, City Attorney Graves reviewed the petition. Attached is a copy of Mr. Graves' review of the petition and legal opinion. In Mr. Graves' opinion, the petition does not meet the "Uniformity Rule" in zoning. RECDMMENDA TI4NS Historically, the City of Kenai Planning and Zoning Commission has developed and recommended the creation of zones within the City. The process for developing these zones has taken extensive time and discussion wherein the public has been invited to participate in the process. Any new zone created in the City should go through a similar process to ensure that the zoning is consistent, all sections of the code that require updating are reviewed, the public is provided sufficient opportunity to participate, that individual properties are reviewed to determine if the proposed zone will create non-conforming uses, and to notify property owners within the proposed area of the proposed zone. Introduction You requested that I research the applicability of the "uniformity rule" in zoning to the MAPS Special Zoning District. My analysis follows. 2. Background On March 10th, 2009 a petition was submitted to the City seeking to establish a new zone. ~ The zone would be called the "MAPS Special Zoning District {MSZD}." The proposed zone would consist of seventy-eight (78) parcels located roughly across the Kenai Spur Highway from the Kenai Central High School. In general the MSZD would be a tightly regulated residential zone, allowing single, two and three family residences as principal permitted uses. However, the zone would have special rules regarding use of six of the parcels. They would be: 1}Borough Parcel No. 44501007 consists of 1.37 acres and is owned by the I~enai Peninsula Borough. That parcel would be allowed some principal permitted uses that would only be allowed in that parcel in the MSZD. The principal permitted uses unique to that parcel in the MSZD would include colleges, elementary, schools, government buildings, high schools, museums, parks and recreation, boarding houses and public parking lots. Additionally a dormitory would be allowed as a secondary use on that one parcel. 2) Borough Parcel No. 04506025 consists of 297 acres and is owned by Franklin T. Wortham. This parcel would allow professional offices (with strict conditions) as a principal permitted use ' The petition was submitted pursuant to KMC 14.20,270 (Amendment Procedures). 12 in the MSZD. No other parcel in the MSZD would be allowed to have professional offices as a principal permitted use, 3}Borough Parcels 04506013 {D.5 acres owned by Robert Gonzalez), 0456014 {0.4 acres awned by Dennis Dustin), 0456015 (0.4 acres owned by Steven Rickman) and 045601 b (0:44 acres owned by Scott Anderson) would be the only lots in the MSZD allowed to have four family dwellings as a principal permitted use. 3. The "Uniforanity Rule" in .Zoning One of the basic provisions of zonin~ law is that zoning regulations should be the same for each class of uses within a zoning district. This provision is called the "uniformity rule." The uniformity rule provides that, "cities and counties may create rules and they may create zones; the rules should be the same for each parcel within a zone but may be different for parcels in different zones." 3 A court in New York has noted that zoning, "regulations shall be uniform for each class or kind of buildings, throughout such district but the regulations in one district may differ from those in other districts."4 The Alaska Planning Commission Handbook notes that zoning districts should contain uniform regulations.5 Restrictions within a zone must apply uniformly to all properties within the zone or the rules are arbitrary and illegaL6 4. Summary Assigning different special rules to one group of four lots and two individual lots within the MSZD violates the uniformity rule and as such constitutes illegal arbitrary zoning. (2) Amendments to the Official Zoning Map sha[1 be considered only if the area to be rezoned contains a minimum of one (l) acre (excluding street or alley rights- of-ivay)uoless the amendrr~ent enlarges an adjacent district boundary. (3) A proposed amendment to the zoning ordinance which is substantially tl~e same as any other proposed amendment submitted within the previous nine (9) months and which was not approved shall not be considered. (4) The zoning amendment request shall include the names and addresses a#' the applicant, a map showing the area involved, the present and proposed zoning, a. nornrefirndable deposit/advertising tree one hundred dollars ($ i 44.04) and any other pertincnt information requested by the City, (c) Amendment Procedure: (l) A cvrnpleted application, as described in this section, shall bs submitted to the administrative official. The administrative official shall schedule a public hearing and make noti~ieation arrangements.
