The subject property is zoned Central Mixed Use and a storage yard is a conditional use in said zone. On June 12, 2013, the Planning & Zoning Commission granted a Conditional Use Permit PZ13-27 to the applicant for a storage yard. Applicant provides support to the oil industry by providing storage of large D.O.T. bags that are filled with used thread protectors. Currently, there are two 38x15x60 temporary membrane storage buildings (Building 1 and 2 on drawing attached hereto as Exhibit "A) located on the property. Due to an increase in production and development in the oil industry, it has become necessary for the applicant to add a third storage building (Building 3 on drawing attached hereto as Exhibit "A"). The addition of Building 3 is problematic in that applicant has only 11.5 feet between the building and the property line. The building set back is 20 feet because the property fronts Granite Point Street. KMC 14.20.180 details the intent and application process for Variance Permits. The Code also outlines the review criteria that should be used by the Planning and Zoning Commission to determine if a variance should be granted. The Commission shall establish a finding that all of the following conditions exist as a prerequisite to issuance of a variance permit: 1. Special conditions or circumstances are present which are peculiar to the land or structures involved which are not applicable to other lands or structures in the same zoning district. Staff Comment: Since this is a corner lot there is a 20 foot setback on the property that fronts Trading Bay (westerly boundary) and Granite Point Street (southerly boundary). The existing Building 1 is located 11.5 feet from the northerly boundary of the property to accommodate the side yard setback of ten feet. There is an allowance of nine feet between each building for maintenance and snow removal. The traffic pattern for deliveries and pick-up prevents the temporary structure from being located elsewhere on the property (see drawing attached hereto as Exhibit "A"). Building 3 is proposed to be located 11.5 feet from the southerly boundary, consistent with the placement of Building 1 on the northerly boundary. 2. The special conditions or circumstances have not been caused by actions of the applicant and such conditions and circumstances do not merely constitute a pecuniary hardship or inconvenience. Staff Comment: If this property did not front Granite Point Street, this side of the property would have a side yard setback that would be ten feet. The 20 foot building setback is hindering the development of this property and not the actions of the property owner. 3. The granting of the variance shall not authorize a use that is not a permitted principal use in the zoning district in which the property is located. Staff Comment: The applicant was granted a Conditional Use Permit PZ13-27 to allow a storage yard; therefore, the staff considers the use to be a permitted principal use. 4. The granting of a variance shall be the minimum variance that will provide for the reasonable use of the land and/or structure. Staff Comment: The distance from Building 3 to the southerly property line is 11.5 feet. Applicant is asking for a variance of 8.5 feet, which is the minimum variance necessary to allow the use while maintaining necessary space between buildings and for vehicle circulation. 5. The granting of a variance shall not be based upon other non- conforming land uses or structures within the same land use or zoning district. Staff Comment: This variance request is not based on other nonconforming land uses or structures related to this particular property and zoning district. The applicant could store the uncovered materials on -site within the entire setback area. The proposed structure protects the materials and provides a better site appearance. RECOMMENDATIONS The staff recommends the granting of this variance because the storage yard is a permitted conditional use in the Central Mixed Zone. The addition of Building 3 will provide covered storage as opposed to having bags stacked several feet high and visible to other businesses and people passing by the area (see pictures attached hereto as Exhibit "B"). Applicant has installed a site obscuring fence along Trading Bay Rd. and Granite Point Street to further obstruct the view from the streets. "Airports and Related Uses" are currently listed in the Land Use Table, KMC Section 14.22.010, as a Principal Permitted Use in the Central commercial (CC), General Commercial (CG), Light Industrial (IL) and the Heavy Industrial (IH) zone districts. As defined in our code, "Airport" means a location where aircraft such as fixed -wing aircraft, helicopters, and blimps take off and land. Aircraft may be stored or maintained at an airport. An airport consists of at least one (1) surface such as a runway for a plane to take off and land, a helipad, or water for takeoffs and landings, and often includes buildings such as control towers, hangars and terminal buildings." Amending the Land Use Table to make airports a Conditional Use in the Central Commercial, General Commercial and Industrial zone districts would be an appropriate mechanism to provide for some public safeguards for any new airport development in these areas. The Planning Commission agreed that the City can and should regulate airport development in these zones and that we would use the standard conditional use permit (CUP) process to accomplish this. As part of that process, we would work with the City Airport staff, Airport Commission and the FAA as appropriate. Typical conditional use issues that would be reviewed would include conformance with adopted plans, hours of operation, lighting, frequency of use, noise, approaches, neighborhood compatibility, accessory structures, and wildlife impacts. The staff opinion is that amending the Land Use Table to refer to only Airports and deleting Related Uses would be appropriate given that Airport is defined in the code; whereas, Related Uses is not defined. Deleting the Related Uses wording would allow related uses to occur as they would otherwise be allowed by other zoning provisions such as Retail, Warehouse, Storage Yard, etc. without unnecessarily burdening the business community with needless conditional use reviews for the related uses.
