Commissioner Knackstedt called the meeting to order at 7:00 p.m.

MOTION:
Commissioner Peterson MOVED to approve the agenda and Commissioner Kiel SECONDED

a. PZ14-15 — Application for Variance Permit for a side yard setback variance for the
property known as 308 Rogers Rd., Lot 8, Block 5, Inlet View Subd., Third Addn.,
Part One, submitted by Brad Frates, 308 Rogers Rd., Kenai, AK 99611.
City Planner Krizmanich reviewed the staff report included in the packet dated July 9, 2014
noting that staff could not recommend the granting of the variance because the current
conditions which exist are not peculiar to the property and the need for the proposed building
has been created by the applicant. Further, the adjacent property would be negatively impacted
by the close proximity of the proposed structure to the property line and the requested variance
did not appear to be the minimum necessary to allow the reasonable use of the property.
MOTION:
Commissioner Kiel MOVED to approve Resolution No. PZ14-15 and Commissioner Bryson
SECONDED the motion.
Chairman Knackstedt opened the public hearing.
Brad Frate , Kenai resident spoke in favor of his variance application.
Melisa Frates, Kenai resident spoke infavor of the variance.
The Commission and the Frates discussed the options for reduced dimensions.
Peter Mantovie, Kenai resident spoke in favor of the variance as long as it didn't affect the
value or potential sale of his home.
Mr. Frates stated that he would consider not making the shed a permanent fixture therefore it
could be moved if another individual were to purchase the neighboring house and was not in
favor of the shed.

that the annual Comprehensive Plan review will being soon.
11. INFORMATIONAL ITEMS:
Krizmanich advised of the. neighborhood cleanup that was completed in conjunction with the
Parks & Recreation Department. Noted he would like to see this as an annual event to keep the
City clean.

Bryson, noted that Council overturned a variance in the past that the Commission granted.

ANALYSIS
This plat reconfigures two lots into one larger lot. The subdivision is located in the Rural
Residential zone. The parcel is accessed off Juliussen Street which is a City maintained
gravel road. Onsite water and sewer are not available. A installation agreement is not
required. According to Kenai Peninsula Borough assessment records, the property is
served by a private well and septic system. A building permit was issued in 1988 for the
garage located on Tract A, Quandt Tract "A" Revised; however, a building permit and
site plan were not submitted to the City of Kenai for the residence located on
Government Lot 3 as conveyed in Warranty Deed recorded in Book 101 at Page 969,
Section 1, Township 5 North, Range 11 West, Seward Meridian. The assessment records
from the Kenai Peninsula Borough indicate that the residence was constructed in 1974.
It does appear that the residence located on a portion of Government Lot 3 may
encroach into the side yard setback between the two properties. If an encroachment

exists, the removal of the property line between Tracts A, Quandt Tract "A" Revised and
Government Lot 3 will eliminate any side yard setback violations between the two
properties.
Currently the garage located on Tract A, Quandt Tract "A" Revised, is considered to be
non -conforming because it is an accessory building without a principal structure on the
parcel as provided in KMC14.20.200.
RECOMMENDATIONS
The replat will eliminate any side yard setback violations that may exist between the
two properties.
The platting of the two lots into one larger lot will eliminate the"rion-conformity that
currently exists because the garage and residence will be located on the same parcel.
Recommend approval with the following conditions:
a. Further development of the property shall conform to all Federal, State and local
regulations.
b. Utility easements, if required, shall be shown.

RECOMMENDING THAT THE ATTACHED SUBDIVISION PLAT BE APPROVED SUBJECT TO THE

WHEREAS, the attached plat QUANDT SUBDIVISION 2014 REPLAT as referred to the City of
Kenai Planning and Zoning Commission on August 13, 2014, and received from Integrity
Surveys.
WHEREAS, the City of Kenai Planning and Zoning Commission finds:
