SUBJECT: Shoreline Heights — PZ14-21
The purpose of this correspondence is to convey comments received by the City of Kenai,
Public Works Department.
In a review of the revised Preliminary Plat, submitted for the proposed project, "Note 3" states:
"Front 15 feet adjacent to the rights -of -way is a utility easement. No permanent structure shall
be constructed or placed within a utility easement which would interfere with the ability of a
utility to use the easement."
Pursuant to KMC 14.10.070(c) utility easements shall be limited to a width of 10 feet. Thus,
staff recommends that this note be changed to allow for a 10-foot wide utility easement instead
of a 15-foot wide utility easement.

The purpose of this correspondence is to convey comments received by the City of Kenai,
Public Works Department.
In a discussion with the Applicant and the Department of Public Works, staff is also
recommending that "Note 3" be revised to state "This easement is for above ground
transformers and pedestals only. All underground utilities within this easement must be
installed perpendicular to the rights -of -way."
As of this writing, letters of non -objection have been received from HEA, GCI, Enstar Natural
Gas, and ACS. This additional language may be added at the pleasure of the Planning and
Zoning Commission.

I have completed the review of the proposed amendment to Note 3 of Shoreline Heights 2014 Addition. The proposed
amendment to Reduce 15' to 10' and add the following "This easement is for above ground transformers and pedestals
only. All underground utilities within this easement must be installed perpendicular to the rights -of -way."
Similar to the sentiments of Enstar Natural Gas Company, HEA has no objection to this amendment given that this
consent applies to this case only. HEA asks that further discussion of this matter take place prior to approval of this
language on future plats filed with the Kenai Peninsula Borough Planning Commission as it has the potential to create
future implications on HEA's standard design practices for placement of underground facilities.

SUBJECT: American Planning Association Conference & September 17, 2014 Kenai City Council
Meeting
American Planning Association Conference
The Alaska Chapter of the American Planning Association (APA) will hold its annual State Planning
Conference in Anchorage, November 16 — 18, 2014 at the Hotel Captain Cook. According to the
schedule of events, the APA will be offering a Planning Commissioner Training workshop on Sunday,
November 16, 2014. Registration and Breakfast are anticipated to begin at 8:30 AM, with the first session
taking place at 9:00 AM. Lunch appears to be provided and the training is anticipated to conclude at 5:00
PM. The Conference will continue on Monday, November 17, 2014 with registration beginning at 7:30
AM and an Introduction and Welcome beginning at 8:00 AM. The Conference concludes on Tuesday,
November 18, 2014 at 5:45 PM.
Staff would like to inquire as to which Commissioners would like to attend the Conference, and which
day(s) they would like to attend.
Kenai City Council Meeting
On September 17, 2014 the Kenai City Council held its Regular Meeting. Among the Public Hearing
items to be considered, two proposed Ordinances were proposed, which were continued from the Kenai
City Council meeting of August 6, 204.
Ordinance No. 2782-2014 — Enacting KMC 14.20.171 — Group Care Faciliites, and Amending
KMC 14.20.320 — Definitions, and KMC 14.22,010 — Land Use Table, to Define and Provide
Zoning Regulations for Group Care Facilties.
2. Ordinance No. 2783-2014 - Enacting KMC 14.20.172 — Emergency Shelters, and Amending
KMC 14.20.320 — Definitions, and KMC 14.22.010 — Land Use Table, to Provide Zoning
Regulations for Emergency Shelters that Provide Temporary Housing for Homeless and Others in
Need of Safe Accommodations.;
The City Council voted to Postpone Indefinitely the above two referenced Ordinances to allow the
scheduling of a joint -work -session with the Planning and Zoning Commission in the November to January
time -frame.

Acting City Planner Koch reviewed the staff report included in the packet recommending
approval with the following conditions:
• The lots on the preliminary plat must be reconfigured so that lot 47 meets the minimum
lot size of 20,000 square feet.
• If lots are sold prior to construction of all required improvements, an installation
agreement will be required pursuant to KMC 14.10.080(b).
• It is the intent of the owner to develop this project in phases. The City of Kenai and the
developer will enter into an installation agreement for each phase and the developer
will provide the City of Kenai with a bond guaranteeing completion of the improvements
for each phase of development. The paving of the streets will not be required until the
final phase of development of the subdivision.
• When streets are constructed, they must meet the minimum requirements as set
forth in KMC 14.10.080.
• The access easements for the cul-de-sacs located at the north and south end of "New
Street Drive" should be executed and recorded concurrently with the recorded plat.
• Road design must be stamped by an engineer licensed in the State of Alaska.
• Surveyor and property owner must work with the City of Kenai and the Kenai
Peninsula Borough when designating street names to ensure names meet with City
and Borough regulations.
• A note should be added to the preliminary plat, as follows: "Lots 1 through 21,
inclusive, are subject to bluff erosion.
• When water mains are extended into the subdivision, the plans must be approved by
the Alaska Department of Environmental Conservation.
• The septic systems must meet the regulatory requirements of the Kenai Peninsula
Borough and be approved by the Alaska Department of Conservation.
• An engineering plan is required to show fire hydrant locations and line sizes for flow
rates per the Kenai (MOA) standard.

Koch and the Commission discussed the details of the lease and it was noted that the Airport
Commission recommended approval of the lease at their last meeting.

ANALYSIS
This plat subdivides two parcels containing approximately 48 acres into a subdivision
containing 48 dots. The subdivision is located in the Rural Residential zone, which
requires a minimum lot size of 20,000 square feet. The lots range in size from 24,200
square feet to 50,685 square feet; therefore, all the lots meet the minimum lot size
requirement for the zone. The minimum lot width for the Residential Zone is ninety feet
with the exception of corner lots which require an additional ten feet as set forth in
KMC 14.10.70(e)(4). The lots within the subdivision meet the minimum lot width
requirement.
The plat also dedicates a 60 foot right of way for Ninilchik Street, "Pey Drive" and "Bree
Avenue". An additional ten foot is being dedicated to increase the width of the right-of-
way for Wells Way from fifty (50) feet to sixty (60) feet, pursuant to KMC
14.10.070(b)(2). The southeasterly portion of Ninilchik Street indicates a 30 foot right-
of-way which does not meet the minimum width required in KMC 14.10.070(b)(2). The
PZ14-21 Page 2
Planning and Zoning Commission, may, in its discretion by majority vote of its members,
lessen this distance to not less than 50 feet. The Planning & Zoning Administration has
no objection to the 30 foot right-of-way. It is likely that this right-of-way will be vacated
in the future by the owner of Lott-A2, R. M. Thompson Subd., 2012 Addn., Amended.
Dead end streets over 150 feet in length must provide a vehicle turn around 100 feet in
diameter. The City of Kenai has requested that temporary cul-de-sacs be placed at the
north and south end of "Pey Drive"; however, the Kenai Peninsula Borough has asked
that a public access easement be dedicated through a separate document and not by
the plat. This would allow the Kenai Peninsula Borough to release the easement when,
and if it was no longer needed without going through the platting procedure to remove
the cul-de-sacs, while allowing for the construction of temporary cul-de-sacs until
further development occurs on adjacent properties to the north and south.
When streets are constructed, they must meet the minimum requirements set forth in
KMC 14.10.080. The City will require an installation agreement for development of the
rights -of -way within the subdivision.
City water lines are located within the right of way of Wells Way and can be extended to
the subdivision. The water mains being extended into the subdivision must be approved
by the Alaska Department of Environmental Conservation. The City will require an
installation agreement for installation of City water.
The City sewer line is greater than a distance of 200 feet from the subdivision;
therefore, the developer has elected to install individual septic systems to each lot. The
septic systems must meet the regulatory requirements of the Kenai Peninsula Borough
and be approved by the Alaska Department of Conservation.
The right-of-way access easement and utility easements which were dedicated on the
plat of Tract Al -A Shoreline Heights No. 3 are being vacated by the plat of Shoreline
Heights 2014 Addition (refer to notes 6 & 7 of preliminary plat). The plat of Shoreline
Heights 2014 Addition also vacates the 30 foot right-of-way for Dation Drive; the 20 foot
alleyway adjacent to Lot 1A-2 R. M. Thompson Subd., 2012 Addition Amended; and a
ten foot portion of Ninilchik Drive (southern entrance).
A portion of SHORELINE HEIGHTS 2014 ADDITION is a subdivision of Block One (1) and
Two (2), Radar Subdivision. During the review by the Kenai Peninsula Borough of the
plat of SHORELINE HEIGHTS 2014 ADDITION, it was discovered that the utility
easements and right-of-way (street shown as Anchor Way on the plat of Radar
Subdivision, Plat No. K-706) had not been vacated; therefore, the Borough requested
that plat of SHORELINE HEIGHTS 2014 ADDITION be revised to vacate this right-of-way
and utility easements (refer to notes 6 & 7 of preliminary plat).
RECOMMENDATIONS
This is a preliminary plat that subdivides two parcels into a 48 lot subdivision. The
property is located in the Rural Residential zone, which requires a minimum lot size of

developer will enter into an installation agreement pursuant to KMC 14.10.080(b) for each

This plat subdivides two parcels containing approximately 48 acres into a subdivision
conta,i✓✓ g 49 lots. The subdivision is located in the Rural Residential zone, which
req 'rjes inimum lot size of 20,000 square feet. The lots range in size from 18,907
squar f to 56,694 square feet; therefore, all the lots with the exception of Lot 47
mee the minimum lot size for the zone. The lots on the preliminary plat should be
reconfigured so that lot 47 meets the minimum lot size of 20,000 square feet. The
minimum lot width for the Residential Zone is ninety feet with the exception of corner
lots which require an additional ten feet as set forth in KMC 14.10.70(e)(4). The lots
within the subdivision meet the minimum lot width requirement.
The plat also dedicates a 60 foot right of way for Ninilchik Street, "New Street Drive"
and "New Name Avenue". The southeasterly portion of Ninilchik Street indicates a 30
foot right-of-way which does not meet the minimum width required in KMC
14.10.070(b)(2). The Planning and Zoning Commission, may, in its discretion by majority

vote of its members, lessen this distance to not less than 50 feet. The Planning & Zoning
Administration has no objection to the 30 foot right-of-way.
Dead end streets over 150 feet in length must provide a vehicle turn around 100 feet in
diameter. The City of Kenai has requested that temporary cul-de-sacs be placed at the
north and south end of "New Street Drive"; however, the Kenai Peninsula Borough has
asked that a public access easement be dedicated through a separate document and not
by the plat. This would allow the Kenai Peninsula Borough to release the easement
when, and if it was no longer needed without going through the platting procedure to
remove the cul-de-sacs, while allowing for the construction of temporary - acs

ANALYSIS
General Information:
The applicant would like to construct an unoccupied accessory structure,
hereinafter referred to as "shed", on the lot adjacent to his primary residence
located at 1207 Portside Drive. Kenai Municipal Code 14.20.200(b) and (c)
provide that unoccupied accessory structures may be allowed as a conditional
use, as follows:
b) Unoccupied accessory structures may be allowed as a conditional use
on a residential parcel that does not have a main building or use of the
land only when the parcel on which the unoccupied accessory structure
proposed is adjacent to and shares a common lot line with a parcel
owned by the same owner and a main building or use is constructed or
used on the adjacent parcel. The conditional use for an unoccupied
accessory structure on an adjacent parcel shall expire upon transfer of
either parcel to a third party and all accessory buildings on adjacent
parcels without a main building or main use must be removed.

(c) Unoccupied accessory structures allowed as a conditional use on
residential parcels adjacent to a parcel owned by the same owner with
a main structure or use of the land shall be limited to structures without
a permanent foundation and less than four hundred (400) square feet.
KMC 14.20.150 details the intent and application process for conditional uses.
The code also specifies the review criteria that must be satisfied prior to issuing
the permit. The criteria are:
The use is consistent with the purpose of this chapter and the purposes
and intent of the zoning district.
o Staff finds the proposed development meets this standard.
The property is located within the Suburban Residential zone. The
intent of the Suburban Residential zone is to provide for medium density
residential development in areas which will be provided with common
utility systems. The specific intent in establishing this zone is:
(1) To separate residential structures to an extent which will allow for
adequate light, air, and privacy;
(2) To prohibit uses which would:
(A) Violate the residential character of the environment; and
(B) Generate heavy traffic in predominantly residential areas.
The applicant proposes to construct a 16 x 20 storage shed on the gravel
pad that is located on the property. The applicant indicates that the shed
will be used for storage of personal belongings. The reason applicant
wishes to place the shed on the adjacent lot and not on the lot with the
main building is that "the home on it is all lawn and the lot next door has a
nice pad already on it. This will be less traffic through my lawn and I won't
have to decrease my yard size."
The provisions set forth in KMC 14.20.200(b) have been met because the
lot containing the main building and the lot for the shed are in the same
ownership and the lots share a common lot line. The shed will be less
than four hundred (400) square feet and it will not be on a permanent
foundation; therefore, it is in compliance with KMC14.20.200(c).
Further, the addition of the shed to the applicant's parcel does not violate
the residential character of the Suburban Residential zone; nor would the
addition of the shed increase the traffic flow in the neighborhood.
The value of the adjoining property and neighborhood will not be
significantly impaired.

o Staff finds the proposed development meets this standard.
The applicant must apply for a building permit for the construction of
this shed; therefore; the City will be able to assure that the shed will be
constructed with quality materials and comply with current building
codes. The shed will be painted to match the color of the residence
located on the adjacent lot. Applicant states that many homes in the
area also have sheds on their property.
The proposed shed will not impair the value of the adjoining
neighborhood.
• The proposed use is in harmony with the Comprehensive Plan.
o Staff finds the proposed development meets this standard.
The 2003 Comprehensive Plan defines the Neighborhood Residential
district as a district consisting of single-family and multi -family
residential areas that are urban or suburban in character.
The addition of the shed for storage of personal belongings is
consistent with the single-family and multi -family residential area.
• Public services and facilities are adequate to serve the proposed use.
o Staff finds the proposed development meets this standard.
City water and sewer hookup are available to this lot; however, the
applicant will not be connecting the shed to water, sewer or any
utilities. Portside Drive is a paved City maintained street.
• The proposed use will not be harmful to the public safety, health or
welfare.
o Staff finds the proposed development meets this standard.

Any and all specific conditions deemed necessary by the commission to
fulfill the above -mentioned conditions should be met by the applicant.

other similar aspects related to the proposed use.

The permit you have applied for may require Public Hearing and Notification under KMC
14.20.280. The Planning and Zoning Commission meets the 2"d and 41h Wednesday of each
month. To meet notice requirements, the Planning Department must receive your completed
application 21 days prior to the meeting when the Public Hearing is scheduled.
• Applications requiring Public Hearings must be filed no later than noon on the date of the
deadline.
• Home Occupations and Landscape/Site Plans do not require a Public Hearing.
• Allow up to 4 weeks for the permitting process.
• If required:
o The Fire Inspection Report must be received prior to processing the application.
o The Affidavit of Posting must be received 2 weeks prior to the hearing date in
order to schedule a public hearing.
o Resolutions cannot be issued until expiration of the 15-day appeal period.
