AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING KMC 1. 15.130 TO ALLOW COUNCIL MEMBERS TO TELEPHONICALLY ATTEND UP TO SIX (6) ADDITIONAL COUNCIL MEETINGS DURING A TWELVE (12) MONTH PERIOD IF THE MEMBER IS PHYSICALLY UNABLE TO ATTEND DUE TO THE NEED FOR EXTENDED MEDICAL CARE AND TREATMENT OF THE MEMBER OR THE MEMBER'S IMMEDIATE FAMILY. WHEREAS, Section 2-7 of the Kenai City Charter states a Council Member shall cease to hold office if the member misses more than one-half of the regular and special meetings within a three-month period; and, WHEREAS, KMC 1.15.130 allows a Council Member to attend up to two (2) meetings telephonically during a twelve (12) month period beginning on November 1 if the member is physically unable to attend; and, WHEREAS, even after allowing for two (2) meetings being attended telephonically under KMC 1.15.130, an extended illness of a Council Member or the member's immediate family member can require the member to be physically absent from more than one-half of the regular and special council meetings within a three-month period; and, WHEREAS, providing for an additional six (6) meetings to be attended telephonically during a twelve (12) month period would permit the member to retain a council seat while dealing with an extended illness a: , allow the member to be more effective for the public than if additional telephone participation were not allowed; and, WHEREAS, while a Council Member could possibly attend up to eight (8) meetings telephonically during a twelve (12) month period under this ordinance, prohibiting the member from attending two (2) consecutive meetings telephonically would limit potential abuse of KMC 1. 15.130 and avoid a member's prolonged absence from the community he/she represents; and, WHEREAS, telephonic attendance at various meetings, both in the public and private sectors, in increasingly allowed; and, WHEREAS, it is good public policy to allow and encourage Council Members to help provide care and support for immediate family members when they are suffering from an extended illness. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, that KMC 1.15.010 is amended as shown on Attachment A. (a) A member of the Council may participate via telephone in a Council meeting, if the member declares that circumstances prevent physical attendance at the meeting. If the Mayor chooses to participate via telephone, the vice -mayor or president pro tempore shall preside. (b) No more than the first two (2) members to contact the Clerk regarding telephonic participation in a particular meeting may participate via telephone at any one (1) meeting. (c) The member shall notify the Clerk and the presiding officer, if reasonably practicable, at least twenty-four (24) hours in advance of a meeting that the member proposes to attend by telephone and shall provide the physical address of the location, the telephone number, and any available facsimile, email, or other document transmission service. (d) At the meeting, the Clerk shall establish the telephone connection when the call to order is imminent. (e) A member participating by telephone shall be counted as present for purposes of discussion and voting. (f) The member participating by telephone shall make every effort to participate in the entire meeting. From time to time during the meeting, the presiding officer shall confirm the connection. (g) The member participating by telephone may ask to be recognized by the presiding officer to the same extent as any other member. (h) To the extent reasonably practicable, the Clerk shall provide backup materials to members participating by telephone. (i) If the telephone connection cannot be made or is made and then lost, the meeting shall commence or continue as scheduled and the Clerk shall attempt to establish or restore the connection. 0) Meeting times shall be expressed in Alaska time regardless of the time at the location of any member participating by telephone. (k) Participation by telephone shall be allowed for regular, special and work session meetings of the Council. (1) Remarks by members participating by telephone shall be transmitted so as to be audible by all members and the public in attendance at the meeting, provided Ordinance 2168-2006 Attachment A Page t of 2 that in executive session the remarks shall be audible only to those included in the executive session. (m) As used in these rules, "telephone" means any system for synchronous two- way voice communication. "Mayor" includes the vice -mayor or any other member serving as president pro tempore. (n) Each Council member may attend a maximum of two (2) meetings by teleconference during the twelve (12) month period starting November I of each year. (o) A Council member may attend an additional six (6) meetings by teleconference during a twelve (12) month period starting November 1 of each vear if the member declares that he/she is phvsicaily unable to attend the meeting due to the need for extended medical care and treatment of the member or member's immediate familv. A Council member may not attend two (2) consecutive meetings by teleconference under this section. (n) In this section. "immediate family" means the shouse of the person. another person cohabitating with the nerson in a conivaal relationship that is not a legal marriage, a child (including a stepchild or foster child) of the nerson. a parent. sibling. grandparent, aunt or uncle of the nerson. or a parent or sibling of the person's snouse. Cqj Council members are responsible for any telephone long distance charges incurred due to their participation in a meeting via telephone unless they are absent from the community on City business. Graves, City Attorney DATE: May 11. 2006 RE: Proposed Amendment to Extended Illness Ordinance Mayor Porter asked me to draft an amendment to Ordinance 2168-2006. Mayor Porter's amendment would substitute a new paragraph (o) in the ordinance. The new paragraph would read: (o) A Council member may attend an additional six (6) meetings by teleconference during a consecutive thirty-six month period if the member declares that he/she is unable to attend the meeting due to the need for extended medical care and treatment of the member or member's immediate family. The consecutive thirty-six month period starts the first day in which the Council member attends telephonically under this subsection. A council member may not attend two (2) consecutive meetings by teleconference under this section. This would change the proposed ordinance as follows. Instead of getting six meetings per year (based on a Nov to Nov period) to attend telephonically due to an extended illness, a member would get six meetings over a three year period. If the member used up his/her six meetings in the first six months, the member would not get any more until after the three year period expires. The member could also space out his/her meetings and use two a year during the period. The three year period would start the first day a member appears telephonically. The member would still get to attend two meetings per year telephonically for any reason under the existing rule in KMC 1.15.130(n). The amendment would also still prohibit a member from attending two meetings in a row telephonically whether it was due to an extended illness or under subsection (n). CRG/sp Suggested b7: CITY OF KENAI ORDINANCE NO. 2171-2006 Administration AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, INCREASING ESTIMATED REVENUES AND APPROPRIATIONS BY $11,680,065 IN THE RUNWAY SAFETY AREA IMPROVEMENTS CAPITAL PROJECT FUND. WHEREAS, the Airport Master Plan calls for certain improvements to the main runway including new runway lighting, overlay of runway pavement, pavement of runway shoulders, and a 200 foot extension of the runway to provide required safety area on the south end of the runway; and, WHEREAS, the FAA has offered a grant of $11,380,576 to fund 95% of the project cost; and, WHEREAS, the State of Alaska is expected to offer a grant for 2.5% of the project cost; and, WHEREAS, $300,000 was previously appropriated from the Airport Fund for the remaining 2.5%. WHEREAS, a written request has been received from Walt Larson to purchase a lot in Evergreen Subdivision, Kim Addition for $9,500.00 (terms); and, WHEREAS, Ordinance No. 1548-93 determined the property is not required for a public purpose and can be sold; and, WHEREAS, this lot was included in a competitive bid sale in April of 1994, with the minimum bid being the fair market value of $11,000 (cash); and, WHEREAS, no valid bids were received; and, WHEREAS, there have been no other offers to purchase this parcel at the fair market value; and, WHEREAS, KMC 22.05.040(e) states the following: If no offers are submitted meeting the minimum acceptable offer (or appraised valuation), the City Manager may negotiate for sale of said tract or tracts of land with a modification of proposed terms or for less than the appraised valuation provided that no such negotiated sale for less than appraised value shall be binding upon the City unless the terms and price therein are approved by resolution of the City Council. The terms were cash at the appraised value of $11,000. There were no bidders. There have been "For Sale" signs on the lots. KMC 22.05.040(e) states the following: If no offers are submitted meeting the minimum acceptable offer (or appraised valuation), the City Manager may negotiate for sale of said tract or tracts of land with a modification of proposed terms or for less than the appraised valuation provided that no such negotiated sale for less than appraised value shall be binding upon the City unless the terms and price therein are approved by resolution of the City Council. Attached is an offer to purchase Lot 7, Block 2, Evergreen Subdivision, Kim Addition submitted by Walt Larson. Mr. Larson has offered $9,500 terms. (The interest rate would be 11%.) The Borough assessed value is currently $12,900. Council has approved discounted sales in the subdivision, as follows: • April 2006 — $9,500 (cash) • December 2005 - $25,000 for three lots (No electric & gas) • September 2005 - $9,500 each for two lots • May 2005 - $9,500 (terms) • June 2002 - $9,500 • September 2000 - $9,500 • June 1997 - $9,500 each for four lots In March, the City sold the largest lot in the subdivision (Lot 1, Block 3) for $12,000. There have been no offers to purchase this remaining lot that the City has for sale in the subdivision. Attached is a resolution approving the sale for Council consideration. At this time the FY 2007 budget does not contain funding for this project. There are several sources of potential funding. If the LID is ultimately approved by the council in the estimated amount of $ 89,500, there is contained in the State of Alaska FY 2007 budget two grants that could be used dependent upon specific giant language. There is a grant from the Department of Commerce, Community & Economic Development (DCCED) .n the amount of S 322,000 for road, ;eater, & sewer improvements, and a federal earmark through the Department of Transportation & Public Facilities (DOT/PF) in the amount of $ 850,000 for road improvements. The DCCED grants are historically administered in a manner very conducive to using those funds for an LID, allowing the grant recipient to manage the projects in accordance with grant requirements. The federal earmark administered through ADOT/PF will have its challenges. Central Region ADOT/PF has historically resisted efforts to "pass through" the funding to the recipients, and instead has demanded to manage the projects themselves, burdening the projects with administrative/engineering costs averaging 40% of the available funding. We will be meeting with ADOT/PF later in July to discuss the manner in which the $ 850,000 earmark will be administered. The City's position is through a memorandum of agreement (MOA) we be allowed to manage the design and construction of projects funded by this earmark, in accordance with the conditions of the MOA, without a significant administrative load being placed on the project(s) by ADOT/PF. Based on these challenges I would not recommend use of the federal earmark for this LID. Page 2 Memo to Council June 30. 2006 In regards to this specific LID, I see the options as follows: 1. Council does not pass the resolution setting a date for a public hearing, as there is not at present, an identified funding source to support the $ $9,500 project. This effectively dismisses this LII) petition. 2. Council sets a public hearing date for August 16, 2006, and at the regularly scheduled council meeting of July 19, 2006 discusses use of the $ 322,000 grant from DCCED, and it's use to support this project. If the council decides to not fund the project it will still be necessary to hold the scheduled public hearing as code required advertising would have already begun. Administration recommends the council set a public hearing for the LID. Advertising costs are estimated at S 400, and it allows the process to move forward concurrent with council's discussion of DCCED grant supported capital improvement priorities. These trails are generally road -based trails with sites along the road for individuals to use as a guide; benefits of a wildlife viewing trail are both economic and promote awareness of habitat and habitat use by animals being viewed; he expects the trail to bolster tourism during shoulder months; there have been 64 sites nominated on the Kenai Peninsula for the trail; there are four sites nominated in Kenai including Cannery Road, the boat launch, the Bridge Access pttllotit and the Erik Hansen Scout Park overlook; the guide is to be released in March 2007; and, the State is asking landowners to write letters stating they are willing to promote these sites. Council Member Molloy noted the following: • If a Council member misses more than one-half of the meetings in a calendar year that that person would cease to hold office. • An allowance was added to attend up to two Council meetings telephonically. • He was proposing an exception to specifically address the situation where a council member or the member's immediate family member has an extended illness requiring the member to be physically absent from the area for an extended period of time. • The exception would provide for an additional six meetings to be attended telephonically for that member meeting the minimum attendance requirements and allow them to be effective in doing it in that they would be required under the ordinance to attend half the meetings which would be 12 out of 24 and then with the two business telephonic, plus the six additional ones, they would be able to attend 20 meetings out of 24 in a year and be more effective in representing constituents. Council Member Ross noted: • The telephonic meeting is a meeting for purposes of attendance under the Charter requirements. • The ordinance states a member is prohibited from attending two consecutive meetings telephonically. • For purposes of the Charter, a member must only attend one meeting a month. • In the proposed ordinance, a member would not have to physically attend a single council meeting for an eight-month period if they attend every other meeting telephonically. KENAI CITY COUNCIL MEETING MINUTES JUNE 21, 2006 PAGE 4 Council Member Boyle explained, the last sentence in "o" of the ordinance addressed that issue, noting "A council member may not attend two (2) consecutive meetings by teleconference under this section." Molloy added: • The intent of the ordinance was to help a council member that was in that special circumstance to be effective by allowing them to attend more meetings and making up to 20 out of 24. • The intent is not to allow a council member to not be present at all for eight months which was why the last sentence in "o" was added - that a member may not attend two consecutive meetings by teleconference under this section. • The intent is that they would be able to attend one telephonically then they would have to attend the next one in person before they could ever use a telephonic under this section again. He suggested, if additional drafting is needed to clarify that for Council members consideration, that is appropriate. Ross stated he felt additional drafting was needed; the fourth "whereas" is very specific that it provides six additional meetings in order to permit a council member to retain a Council seat; the legislative intent as expressed in that "whereas" does go to those six meetings counting toward the minimum under the Charter, which combined with the way the language is presently written on the consecutive meetings is a legislative intent that would allow eight months of non-attendance except once a month telephonic. i He would not support the ordinance in the present form. Molloy recommended adding to "o" on the Ordinance "...after attending by telephone under this section, the Council member must attend a meeting in person before being entitled to attend telephonically under this section again." Ross recommended the ordinance go back for a rewrite, noting the problem would be cured having an ordinance that would provide for the six meetings on this basis, but those six meetings could not be counted toward the minimum as required by the Charter; if the purpose is to allow participation by the councilperson, yet not have them totally away from the community for eight months, that would be understandable and would allow additional meeting attendance by teleconference for an individual that was otherwise meeting the requirements of the Charter. MOTION: Council Member Ross MOVED to postpone until Councilman Molloy and City Attorney Graves have had an opportunity to rewrite the language. It was a very positive meeting. • She attended an RDC meeting in Anchorage at which 500 individuals attended to hear an update on the Pebble Mine Project. • She has requested the City Attorney to investigate a way to take care of old abandoned trailers. • The town clock dedication, scheduled for July 20th at 3 p.m., will be attended by the CityLink Russian delegation. City Manages — City Manager Koch reported the following: • A proposal is being considered for a web page enhancement. • A proposal is being considered for an arsenic groundwater study to assist in the placement of a new well. • Administration is working with Salamatof Native Association on their purchase of a Six -acre parcel VerSeS the 16 -acre panel ,-eviOUSly discussed on which to build a professional building. This parcel fronts Marathon Road. • Administration is preparing to meet with the KEDS group and the Airport Commission to discuss the airport reserve and the location of that boundary. After that meeting, information will be taken to FAA with a request for potential deed release of some of that property. • Wahnart is in the final stages of traffic analysis and representatives would be performing a soil analysis on the site during the next week. • Lowes and the City are passing back and forth the lease documents. • In addition to Mayor Porter's comments on the meeting with Central Heights citizens, the City will provide dumpsters in that area beginning July 14 through the 24th for the removal of debris from yards. Enforcement action would then take place after July 24. • The airport consultants have recommended airport funds be consolidated into one enterprise fund as of July 1, 2006. • The soccer fields will be available for use for the 2008 season. • The automatic sprinkler system had not yet been put out to bid. We understand that this study will be used to develop future groundwater wells for the City's drinking water supply. The following presents our scope of work: In 1999, the National Academy of Sciences concluded that the standard Maximum Contaminant Level (MCL) for arsenic of 50 parts per billion (ppb or micrograms per Liter:ug/L) does not adequately protect public health. The EPA revised the MCL to10 ppb and the standard went into effect in January 2006. Previous studies in the Cook inlet Basin including the Kenai Peninsula indicated that some domestic and public -supply wells have water containing concentrations of arsenic that exceed the 10 ppb and even the previous standard of 50 ppb. Arsenic commonly is adsorbed to or coprecipitates with iron oxide minerals; adsorbed to clay -mineral surfaces; and is associated with sulfide minerals, organic carbon, and volcanic rocks. The majority of arsenic in wells in the Kenai Peninsula is naturally -occurring. Conditions that affect the release of arsenic to water include the presence of iron oxide and sulfide minerals, alkalinity of groundwater, and presence of phosphate and organic carbon. We understand that the objective of this project will be to delineate the occurrence of waters containing arsenic that exceed the 10 ppb MCL and develop a map that may indicate potential areas that would have waters with arsenic concentrations below the MCL of 10 ppb. The study area will be within the city limits as directed by the City administration. We have divided our work into the three phases: 1) literature review; 2) additional well sampling; 3) data analysis and reporting. 1. literature Review We will gather existing literature on the geology, hydrology, and water well information that is available. The literature will consist of reports from the USGS, the Alaska DGGS, and other sources. Existing chemical data from existing wells will also be reviewed. We will also try to determine the hydrological regime in the region and the number, depth, and physical and material characteristics of the aquifers in the area. The geology of the area will also be Hw i, PE researched in order to better understand the distribution of rocks, soil units and their DIOay, rercPc correlation to arsenic concentrations. Well Sampling For this project we have allowed for 30 additional well sampling sites. We will select wells within areas that have not had previous sampling or where there are gaps in the data. Water -well data from ADEC and USGS Groundwater Site Inventory will be gathered to select suitable wells. Landowners will be contacted to obtain permission. The wells should have construction information (depth, perforated interval, casing length, geological materials encountered), be open in unconsolidated deposits, submersible pump, and sampling point before any water treatment systems and measure the depth to the water surface in the well. After the wells are identified we will sample the groundwater at each well and submit the samples to Analytica/Northern Testing Laboratories for analysis. The wells will be sampled according to ADEC procedures and a chain -of -custody procedure will be followed. All 30 samples will be analyzed for arsenic and 10 samples will be analyzed for the major rations and anions including iron, calcium, phosphate, and for pH. 3. Data Analysis & Reporting Once the chemical data is returned we will analyze the data in terms of distribution among wells, concentration levels, and the overall hydrology. The correlation of arsenic concentration to the hydrological and geological regime will try to be determined. This understanding will assist in delineating areas for future water supply development. The final report will include a description of the project, a summary of the reviewed literature, an explanation of the hydrological and geological regime and the data collected. The deliverable will include a map that indicates areas with arsenic concentrations of greater than 50 ppb, greater than 10 ppb, and no detection. This map will then be used in conjuction with our understanding of the hydrology and geology to delineate areas for future water supply development. ASSUMPTIONS We have assumed the following in preparing our proposal: 1. A base map in AutoCAD with existing well locations will be made available. 2. Based on the previous reports, arsenic concentrations for a number of existing wells are available. 3. Thirty select landowners will consent to sampling of their wells. 4. Well sampling will be done prior to any treatment if possible. 5. We will not sample the Kenai River which should be conducted on a routine method for a year if surface water is to be considered. SCHEDULE We can begin work as soon as the notice to proceed is received. It will take approximately three to four weeks to obtain and review the existing literature. Conducting the well sampling will take about a week after permission from the landowners is obtained. Laboratory analyses of the samples generally take about two to three weeks. Several pilot studies have been completed by two different water treatment plant suppliers in order to determine an effective and affordable treatment process to remove arsenic to conform to EPA the EPA maximum contaminant level. So far, none of the pilot studies have proven to be both effective and affordable. In order to determine if a suitable source of water might be available at a previously unstudied location, I understand that the City would like to have an exploratory well drilled in Section 36, along the Kenai Spur in West Kenai. The site would be on City owned property adjacent to the soccer fields. I propose to provide an exploratory well at the Section 36 site. The well will be cased with 6" steel pipe and will have a 20' surface grout and stainless steel screen. For purposes of planning the project budget, I am proposing to drill the well to 200' and to provide 30' of well screen. I propose to subcontract the well drilling and testing to Kraxberger Drilling. I will provide project monitoring, collect and expedite well sampling and laboratory testing and will provide a summary report of the well drilling. Kraxberger will log the well as it is drilled and will collect samples and size the well screen. Kraxberger will conduct the 6 hour step drawdown test and the 24 hour pumping test. I am proposing unit pricing for the well casing, grout, screen, test pumping and laboratory testing as listed on the attached spread sheet, i propose to provide the exploratory well up to the listed quantities for a not to exceed price of $28,052. The road s in question were constructed and initially inte nd e d to be private road s serving s ix re sidential lot s . Logistical issues that arose as the developme nt of the s ubdivis ion progressed required that the streets be made public. I met with c it y officials to di sc uss the roads, a nd was told that if I had an engineer a ssess , and s ign off on th e road it would be approved ·'as is". After Mr. Koch was hire d , I m et with him , a nd was told that I had to place DI course on top of m y finished roadway. I req uested that a n exception be made s in ce my road had bee n deemed acceptable by my engineer and city personnel. After Mr. Koch denied my request, and in preparation to bring thi s before the council , I brought in two additional enginee rs to exam and test the roads for s afety and s tability (see attached reports). T heir assessment s are in agreement w ith m y engineer, Mr. Fors i. I a lso co nsulted with tlu·ee experienced road builders to confirm that my roads would serv e their functionality without the 01 leveling course (see lett er s). In summatio n. I fee l tha t m y roadways are built as well as an y other in the municipality if not better than most. It has been the unanimou s opinion of everyo n e that I have cons ulted that the ex istin g roads will serve the s ix lots and th e b enefit of add in g Dl is minimal if not unnecessary. I I Attached please find an "As-Built" survey of the subdivision street prepared by . Terry Easth~ project surveyor. Also attached are soils log that I completed last fall n the existing streets to verify the base and sub-base materials. STREET SOILS DATA We excavated nine test holes within the street cross-section. The approximate Ic!>cations of these test holes are shown on the street as-built drawing. All of the test holes ~bowed 12 to 14 inches of well-compacted gravel over seven to eight feet ofwell-gradtsands. In test hole Number 4 we encountered some root materials at approximately 18 ches. I had the owner excavate this area for approximately 25 feet on each side of this hole for a width of 12 feet to insure that this root material was removed and replaced jwith clean sand backfill and 12 inches of gravel for topping. In my professional engineering opinion, based on these soils test holes, this ~t meets City of Kenai specifications for road construction. : One item we discussed last month was the width of the constructed street. The q.ewly constructed street is 24 feet wide as shown on the as-built drawing. DRAINAGE I Shallow ditches and a larger drainage ditch along the North side of Rachel A veque accommodate all surface drainage. During site visits this spring there were no chjainage problems along the street. Additionally, we are also enclosing a copy of the original soils work completed by Ame Tikka PE. This soils information has been previously submitted to the Kenai Pe.)insuJa Borough and the City of Kenai and is re-submitted to show the existence of the well- graded sands in the subdivision area Please let us know if you have any questions or desire further information reg~ng this submittal. For soil s, in accordance with ASTM de s ignation g uidelines, applicable tests included Particle Size Analys is, Percent Passing No. 200 Sieve, Sand Cone Method, Field Soil Moisture Measurements, and Field Soil-Permeability Meas urements (Guelph Permeameter). For geo membranes, applicable ASTM testing guidelines included the Air Lance Test, Dual Seam Air Press ure Test, Vacuum Box Testing, and Peel and Bonded Seam Strength Destructive Testing. Due to concerns with using a soil derivative as an impermeable layer at a fuel storage facility , large sample s izes were used to make sure that data recorded could be classified as statistically s ignifi cant, in accordance with construction practices. In addition to duties assigned as a quality assurance manager, was also re sponsible for communicating daily progress with BFS, Inc. staff, and coordinating activities with construction sup ervisors in directing a crew of approximately 25 employees working on the secondary containment construction. Since a majority of the secondary containment design hinged on proper drainage des ign , add iti onal activities included surveying, via total station and laser level in struments, to guide the construction laborers and to determine final grade elevations were in accordance with constructi on plans. Alaska: Under the oversight ofGW Scientific and Restoration Science and Engin eering, performed an infiltration test using a double-ring infiltrometer with a sealed inner ring (ASTM D 3385-88). The test was performed on a des ign soil to be used as a sufficiently impermeable liner for secondary containment compliance con struction activities . Since the des ign soi l was a relatively new and unproven technology to be used in the containment of a fuel spill, at the request of the ADEC, an infiltration test was performed on the design soi l using a mix of Diesel and Jet A-50 fuel. Ultim ately, the design soil met ADEC infiltration require ments of 10 1\-6 emfs, and the Environmental Protection Agency (EPA) requirement of 10 /\-7 emfs. In addition to completing the infiltration test, was responsible for monitoring environmental data collection network, maintaining facility dewatering schedule, and performing differential level surveys to meet future drainage design goals. 3/98-1/99 Fort Wainwright, A laska: In conjunction with the University of Alaska-Fairbanks and ENSR, was responsible for the construction, installation, and maintenance of a ground-water monitoring network. ln order to assist contractors and researchers studying the effects ofbioremediation in arctic territories, a network of ground-water monitoring wells was established to better understand the hydrology a ssociated with a discontinuous pe rmafrost study area. In add ition to exh ibiting th e ability to work independently, knowledge of proper usage and programming of data recorders wa s obtained. POBox 1 966 Soldotna, AK. 99669 July 5, 2006 To Whom It May Concern: This is a letter regarding some roads recently built in the city of Kenai across from Redoubt Ave. The roads I am referring to are : llliamna Ave. Hannah St. and Bryson Ave. The streets are already constructed with the process that will follow the establishment of these locations. The legal description of the property is Denaina Point Estates. The roads were started , in fact, without the proper organization with the city, however, the owner of the roads, Brian Lowe, called myself, and, at times, an engineer in to meet with the city so we could understand what they would want us to do. These meeting were very important as we were trying to figure out the best roads for a "high dollar" subdivision. At first, the owner wanted to go with a private road into the subd ivision , but wanted to build it to be able to later give it to the city for maintenance and access purposes. The road was stripped of any overburden , and the overburden was disposed of on the surrounding private properties. Then the road was constructed with the onsite sand. There was then 1 foot of gravel placed on the road at a 24' width on the top of the road. The 24' width was on the surface of the road. There are established ditches and properly placed culverts in the road as we ll. The gravel used is the same gravel used on the Kenai Spur Hwy project to upgrade the roads in 1993, '94. The gradation of the gravel meets the states specifications for a road . I was present when the city officials presented to us that if an engineer would sign off on the road, the city wou ld accept it. The problems the owner is experiencing would drastically red uce the number of developers in the city, and I would urge the city to accept this road based on an engineer's approval of the construction of the road.
