A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE
KENAI GRANTING A REQUEST FOR A VARIANCE UNDER KMC 14.20.180;

WHEREAS, the Commission finds:
1) That an application meeting the requirements of Sa~tiot~ 14.20.180 has been submitted and

2) This reque~is on land zoned RR
3} That t~Se applicant seeks a variance from the spec'rfied requirement of the Zoning Code:
4) a. Spec I conditions or ci ums ~c s are present which are peculiar to the land or structures
involy which not a plica le to oiher lands or structures in the same land use or zoning
district.
b. The special nditions or cin~uchstances have not been caused by actions of the applicant and such
condition, a d circumstances do not merely constitute pecuniary hardship or inconvenience.
c. The granting of the variance does not authorize a use that is not a permitted principal use in the
zoning distriit in which the property is located.
d. The granting d~ the variance is the minimum variance that will provide for the reasonable use of the
land and/or stri~ciure.
e. The granting of 1 e variance is not based upon other non-conforming land uses ar structures within
the sale land use c zoning district.
5} That a duly advertised public hearing as required by I(MC 14.20.280 was conducted by the

NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING COMMISSION
OF THE CITY OF KENAI THAT THE CONDITIONS SPECIFIED IN 14.20.280 HAVE BEEN
SHOWN TO EXIST AND THEREFORE GRANTS THE VARIANCE.
