Kebschull reviewed the staff report included in the packet, noting the lease met the Airport Land Use Plan, the Comprehensive Plan, Zoning and Future Airport Developments. MOTION: Commissioner Brookman MOVED to recommend approval of the lease and Commissioner Rogers SECONDED the motion. Commissioner Bryson recused himself as the lease would come before the Borough Planning Commission. Administration -- Kebschull reviewed a draft ordinance on numbering buildings that would make the city consistent with the Emergency 911 system; reviewed a draft cell tower ordinance and scheduled a work session for May 27, 2009; noted Administration was considering an ordinance an regulation wind turbine placement; and, presented the subscription of "The Commissioner" for their review. The resulting Lot 9A is approximately 24,298 square feet and meets the minimum lot size for the Rural Residential zone. There is a structure located on the current Lot 10 of Sungate Park Subdivision ~- Randall Addition. Plat does not provide as-built information for the structure. However, if an encroachment exists, the plat does not create nor increase the encroachment. The subdivision is served by onsite water and sewer. No installation agreement is required. PZ09-27 `E{reclyvf' KENA~ SILA A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI, ALASKA, RECOMMENDING TO THE COUNCIL THAT THE LAND USE TABLE IN KMC 14.22.010 FOR THE LIMITED COMMERCIAL ZONE {LC) BE AMENDED BY LISTING WHICH PERSONAL SERVICES REQUIRE CONDITIONAL USE PERMITS (C) AND WHICH ARE PRINCIPAL PERMITTED USES (P). WHEREAS, the City of Kenai Zoning Code has a Land Use Table in KMC 14.22.010; and, WHEREAS, the Land Use Table contains a category for "Personal Services"; and, WHEREAS, the term "Personal Services" includes a variety of activity such as barbers, fitness centers, massage therapists, tanning salons; and, WHEREAS, in the LC Zone some personal services should be allowed as a principal permitted use (P) while others should be allowed as a conditional use (C}; and, WHEREAS, it is in the best interest of the citizens of the City of Kenai to amend the Land Use Table in KMC 14.22.010 to define better define personal services and provide which of them are allowed as a conditional use (C) and which are allowed as a principal permitted use (P). This is an application fora coffee cart. The improvement does not meet the value for requiring a landscapelsite plan; however, due to the change of use {KMC 14.20.250{a} a site plan is required. This is an established site used for parking for the Merit Plaza. Fven though the lot is used for additional parking for the Merit Plaza; there is sufficient off-street parking on the property where the Merit Plaza is located. Placement of the Coffee Cart will not remove required parking for the Plaza. The lot is paved, There is no landscaping on the property with the exception of a limited grass strip along Attla Way and North Willow Street. The applicant has agreed to a site meeting to determine the exact placement of the co#fee cart so that ingress and egress can be reviewed to insure the structure doesn't create a traffic hazard. The applicant will be placing flower boxes around the cart. Physical features of the property including location of all buildings, ingress and egress, any unusual features of the property, which may restrict development or drainage. Section 14.25,040 of the code outlines the landscaping plan performance criteria. • PerimeterlBuffer Landscaping -involves the land areas adjacent to the lot lines within the property boundary and serves to separate and minimize the impact between adjacent uses. o No additional perimeterlbuffer landscaping is planned nor required. There is some natural vegeta#ion along the rear of the property and along the eastern and western borders. Interior Landscaping -involves areas exclusive of the perimeter and parking lot areas. o There will be some interior landscaping along the front of the new addition. The plan shows geotextile over NFS fill, washed rock, landscape boulders and Mungo Pine. • Parking Lot Landscaping -involves areas adjacent to or within parking lots and access drives. o There is no parking lot landscaping planned or will it be required. The existing site is paved and used for parking. • Street-right-of-way Landscaping -intent to soften the impact of land uses along rights-of-way but does not obscure land uses from sight. o KMC 14,25.040(e) (1) requires a minimum of ten feet {10') wide landscaping beds along the entire length of property lines which adjoin street rights-of-way. As noted, this is an established si#e. The as-built survey identifies existing pavement and trees along the perimeter of the lat: The area is paved to South Forest Drive. It is not reasonable to request the pavement to be removed. The following are required in the site plan: + Parking - o The as-built identifies the asphalt parking lot. The plan shows 36 parking spaces, 33 spaces are required. The plan meets the parking requirements.
