Dear Mr. McAllister,
Enclosed are copies of a packet sent out August 1, 1983 to the Kenai Harbor
Commission to bring them up to date. I am sending you one also so that you
will be kept abreast.
There have been no meetings since April, 1983, however there have been
several informal meetings with TAMS engineers and city administration
regarding the upgrading of the boat launch facility now in progress.
There is to be a bid opening on Thursday, August 11, 1983 for that project.
1 will be sending you further information on that project as well as future
endeavors.

071- 0YD -2- 830221, Kenai River 113 authorizing reconstruction of the
existing boat ramp and expansion of the parking area. Also, enclosed is a
Notice of Authorization which should be posted in a prominent location
near the authorized work.
If changes in the location or plans of the work are necessary for any
reason, plans, should be submitted to this office promptly. If the changes
are unobjectionable, the approval required by law before construction is
begun will be issued without delay.

t. That this permit may not be transferred to a third party without prior written notice to the District Engineer, either by
the transferee's written agreement to comply with all terms and conditions of this permit or by the transferree subscribing to
this permit in the space provided below and thereby agreeing to comply with all terms and conditions of this permit. In addi-
tion, if the permittee transfers the interests authorized herein by conveyance of realty, the deed shall reference this permit and
the terms and conditions specified herein and this permit shall be recorded along with the deed with the Register of Deeds or
other appropriate official.
u. That if the permittee during prosecution of the work authorized herein, encounters a previously unidentified ar-
cheological or other cultural resource within the area subject to Department of the Army jurisdiction that might be eligible for
listing in the National Register of Historic Places, he shall immediately notify the district engineer.

Thank you for advising us that the proposed boat ramp addition in the
subject permit, will be 16' x 224' rather than 16' x 22' as described in
our 401 Certification of Reasonable Assurance. The dimensions stated in
our Certification were taken from the written description portion of the
Corps public notice and your signed permit application. We had noted the
differences in length mentioned in the public notice and in its attached
drawing, but thought that you planned to add 22' to the length of the
existing ramp rather than 16' to its width, as said drawing also showed
the existing ramp to be 41'4 not 25'4 in width.

COASTAL ZONE MANAGEMENT ACT CERTIFICATION: Section 307(c)(3) of the Coastal
Lone Management Act of 19/2, as amended by 16 U.S.C. 1456(c)(3), requires
the applicant to certify that the described activity affecting land or water
uses in the Coastal Zone complies with the Alaska Coastal Management
Program. A permit will not be issued until the Division of Policy
Development and Planning has concurred with the applicant's certification.
PUBLIC HEARING: Any person may request, in writing, within the comment
period specified in this notice, that a public hearing be held to consider
this application. Requests for public hearings shall state, with
particularity, the reasons for holding a public hearing.
CULTURAL RESOURCES: The property described is not a registered or eligible
property in the latest published version of the National Register of
Historic Places.
ENDANGERED SPECIES: Preliminarily, this described activity will not affect
endangered species, or their critical habitat designated as endangered or
threatened, under the Endangered Species Act of 1973 (87 Stat. 844). Formal
consultation under Section 7 of the Act is not required for the described
activity.
FLOOD PLAIN MANAGEMENT: Evaluation of the described activity will include
conformance with appropriate State or local flood plain standards;
consideration of alternative sites and methods of accomplishment; and
weighing of the positive, concentrated and dispersed, and short and
long -term impacts on the flood plain.
EVALUATION: The decision whether to issue a permit will he based on an
evaluation of the probable impact including cumulative impacts of the
proposed activity on the public interest. That decision will reflect the
national concern for both protection and utilization of important
resources. The benefit which reasonably may be expected to accrue from the
proposals must be balanced against its reasonably foreseeable detriments.
All factors which may be relevant to the proposal will be considered
including the cumulative effects thereof; among these are conservation,
economics, aesthetics, general environmental concerns, wetlands, cultural
values, fish and wildlife values, flood hazards, flood plain values, land
use, navigation, shoreline erosion and accretion, recreation, water supply
and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, and, in general, the needs and welfare of the
people.
Comments on the described work, with the reference number, should reach this
office no later than the expiration date of this Public Notice to become

Any applicant for a Federal license or permit to conduct any activity
which may result in any discharge into the navigable waters must first
apply for and obtain certification from the Alaska Department of
Environmental Conservation that any such discharge will comply with the

accordance with Public Laws 92 -583 and 94 -370 and Alaska
Statute 46.40.010, has completed review of the consistency
of the subject proposal with the Alaska Coastal Management
Program (ACMP).

The purpose of the ACMP consistency review is to balance
the potentially conflicting uses of the coastal zone through

CONSISTENCY DETERMINATION WITH THE. ALASKA COASTAL MANAGEMENT PROGRAM
A determination of consistency with the Alaska Coastal Management Program,
as required by 6 AAC 80, has been requested by the City of Kenai, P.O.
Box 580, Kenai, Alaska to reconstruct an existing boat ramp to include
an additional 16' wide by 22' long launch ramp. Approximately 2,500
cubic yards of fill material would be placed to expand an existing
parking area by 1/2 acre. The proposed activity is located at Ninth Avenue
and K Street, Kenai, Alaska section 9, T. 5 N., R. 11 W., S.M.
This proposed activity, identified as Kenai River. 113, State I.D. No.
AK830523 -55, COE No. 071- OYD-2- 830221, requires an authorization from
the U.S. Army Corps of Engineers and is therefore subject to review for
consistency with the Alaska Coastal Management Program, in accordance
with Section 307(c) 3A of the Federal Coastal Zone Management Act.
Having reviewed the application, the Division of Policy Development and
Planning determines that the proposed activity is consistent with the
Standards of the Alaska Coastal Management Program, 6 AAC 80, provided
that the applicant complies with the following stipulation(s):
1. All construction below the mean high water line shall occur only
during periods in which the area is not covered by water. (This
stipulation is intended to protect water quality by preventing excessive
introduction of sediments into water sources) 6 AAC 80.140. AIR,

2. Rock riprap or similar material of sufficient size to preclude
washout or erosion, shall be placed on the new fill side slopes up to
the higher high water line. (This stipulation is intended to protect

b. That all activities authorized herein shall, if they involve, during their construction or operation, any discharge of
pollutants into waters of the United States or ocean waters, be at all times consistent with applicable water quality standards,
effluent limitations and standards of performance, prohibitions, pretreatment standards and management practices establish
ed pursuant to the Clean Water Act (33 U.S.C. 1344), the Marine Protection, Research and Sanctuaries Act of 1972 (P, L. 92 532,
86 Stat. 1052), or pursuant to applicable State and local law.
c. That when the activity authorized herein involves a discharge during its construction or operation, or any pollutant
(including dredged or fill material), into waters of the United States, the authorized activity shall, if applicable water quality stan-
dards are revised or modified during the term of this permit, be modified, if necessary, to conform with such revised or modified
water quality standards within 6 months of the effective date of any revision or modification of water quality standards, or as
directed by an implementation plan contained in such revised or modified standards, or within such longer period of time as the
District Engineer, in consultation with the Regional Administrator of the Environmental Protection Agency, may determine to
be reasonable under the circumstances.
d. That the discharge will not destroy a threatened or endangered species as identified under the Endangered Species Act,
or endanger the critical habitat of such species.
e. That the permittee agrees to make every reasonable effort to prosecute the construction or operation of the work
authorized herein in a manner so as to minimize any adverse impact on fish, wildlife, and natural environmental values.
f. That the permittee agrees that he will prosecute the construction or work authorized herein in a manner so as to minimize
any degradation of water quality.
g. That the permittee shall allow the District Engineer or his authorized representative(s) or designee(s) to make periodic in-
spections at any time deemed necessary in order to assure that the activity being performed under authority of this permit is in
accordance with the terms and conditions prescribed herein.
h. That the permittee shall maintain the structure or work authorized herein in good condition and in reasonable ac-
cordance with the plans and drawings attached hereto.
i. That this permit does not convey any property rights, either in real estate or material, or any exclusive privileges; and
that it does not authorize any injury to property or invasion of rights or any infringement of Federal, State, or local laws or
regulations.
j. That this permit does not obviate the requirement to obtain state or local assent required by law for the activity authoriz-
ed herein.
k. That this permit may be either modified, suspended or revoked in whole or in part pursuant to the policies and pro-
cedures of 33 CFR 325.7.
1. That in issuing this permit, the Government has relied on the information and data which the permittee has provided in
connection with his permit application. If, subsequent to the issuance of this permit, such information and data prove to be
materially false, materially incomplete or inaccurate, this permit may be modified, suspended or revoked, in whole or in part,
and /or the Government may, in addition, institute appropriate legal proceedings.
m. That any modification, suspension, or revocation of this permit shall not be the basis for any claim for damages against
the United States.
n. That the permittee shall notify the District Engineer at what time the activity authorized herein will be commenced, as
far in advance of the time of commencement as the District Engineer may specify, and of any suspension of work, if for a period
of more than one week, resumption of work and its completion.
o. That if the activity authorized herein is not completed on or before day of 19 (three years
from the date of issuance of this permit unless otherwise specified) this permit, if not previously revoked or specifically extended,
shall automaticallyexpire.
p. That this permit does not authorize or approve the construction of particular structures, the authorization or approval of
which may require authorization by the Congress or other agencies of the Federal Government.
q. That if and when the permittee desires to abandon the activity authorized herein, unless such abandonment is part of a
transfer procedure by which the permittee is transferring his interests herein to a third party pursuant to General Condition t

Thank you for advising us that the proposed boat ramp addition in the
subject permit, will be 16' x 224' rather than 16' x 22' as described in
our 401 .Certification of Reasonable Assurance. The dimensions stated in
our Certification were taken from the written description portion of the
Corps public notice and your signed permit application. We had noted the
differences in length mentioned in the public notice and in its attached
drawing, but thought that you planned to add 22' to the length of the
existing ramp rather than- 16' to its width, as said drawing also showed
the existing ramp to be 41'4 not 25'4 in width.

A Certificate of Reasonable Assurance, as required by Section 401 of the
Clean Water Act, has been requested by the City of Kenai, P.O. Box 580,
Kenai, Alaska 99611, for the construction of an existing boat ramp
16' x 224' addition, and placement of 2,500 cubic yards of fill material
into an intertidal area for the expansion of an existing parking area.
The proposed activity is located in Section 9, T5N, R11W, Seward Meridian
at Mile 1.8 Kenai River, 9th Avenue and "K" Street, Kenai, Alaska.
Public notice of the application for this certification has been made in
accordance with 18 AAC 15.180.
Water Quality Certification is required for the proposed activity because
the activity will be authorized by a Corps of Engineers permit identified
as Kenai River 113, NPACO No. 071- 0YD -2- 830221, and a discharge may result
from the proposed activity.
Having reviewed the application and comments received in response to the
public notice, the Alaska Department of Environmental Conservation certi-
fies that there is reasonable assurance that the proposed activity, as
well as any discharge which may result, is in compliance with the require-
ments of Section 401 of the Clean Water Act which includes the Alaska
Water Quality Standards, 18 AAC 70, and the Standards of the Alaska
Coastal Management Program, 6 AAC 80, provided that:
1) All construction below the mean high waterline occurs during a
period in which the area is not covered by water. (6 AAC 80.140

2) Rock riprap or similar material of sufficient size to preclude
washout or erosion is placed on the new fill side slopes up to the
