MOTION:
Commissioner Weller moved, seconded by Commissioner Houtz,
to approve the minutes as submitted.
Motion passed by unanimous consent.
Chairman Williams asked that copies of the minutes of 9 -15
meeting, as well as minutes of this meeting, be sent to
Commissioners Dragseth, M. Thompson, and Quesnel.
4. GUEST SPEAKERS
Jim White Barge Docking Facilities
Chairman Williams explained, he asked Mr. White to this
meeting because the Harbor Comm. will have a say in the
overall scheme. This would be on the primary site as the
most optimum site on the river, but since it was privately
owned, they had opted for City property. Mr. White said he
is speaking for Dan Frederick's proposal. He would like to
donate enough land to the City if the City will provide a
dock and access. It would be the property between Dragnet
Fisheries and Salamatof (the City dock). Chairman Williams
added, some of the ideas are, if Mr. Fredericks donates the
property, the city could dredge a slip for large barges and
build a dock facility. We would open ourselves up to large
barges for safe haven. There is a potential for a rail
barge, they could be rolled off onto spur trucks. The
trucks could connect to the airport. The rail cars could be
brought in at the airport to all over Alaska instead of into
Anchorage. The potential is there for a transportation
base. The rail barges could go out of the river to Collier
for urea, be sealed, shipped to Seattle and connected
anywhere in the country. It would not have to be

transferred. A rail could be built to Collier, but this
seems more feasible. Comm.Thompson noted it is feasible if
the weather cooperates. Comm. Houtz noted they could not use
a box car at Colliers, it is a vertical drop. Collier loads
by gravity drop and a slinger. Chairman Williams suggested
Collier could modify with a chute. Comm. Houtz replied he
doubted if Collier could do that, bagging and dropping to
box cars could be feasible. Mr. White said, currently they
load in bulk to Rivergate and re -load there, they would not
have to re -load. All the rail traffic comes up here and goes
back empty. If it is marked here for destination, it could
go direct. Comm. Weller asked if it was worth the
modification to the company. Chairman Williams noted it
will he large shipments. Mr. White noted, development is
coming, the Anchorage bowl is saturated, there are also
environmental problems there. Chairman Williams suggested
Finance Director Brown prepare an updated budget on what
monies are available, and that the Commission consider
asking TAMS to do a minor study and drawings to see if a
barge facility could be built there and costs.
The commission agreed to the suggestion.
Comm. Houtz asked Mr. White, how big is the area? Mr. White
replied, 275 ft. frontage. Comm. Houtz asked, what would
the City net? Mr. White replied, it would be a public
dock. Any business would have access to it. He noted it
costs as much to ship from Seattle to Anchorage as it does
from Anchorage to Kenai. Comm. Houtz asked, where are they
off loaded now? Comm. Weller replied, Northland loads in
Seattle and off -loads in Kenai on a regular basis. 2 more
come in to Homer because there is no facility in Kenai.
Chairman Williams noted there are some pretty good sized
tenders working the river. Mr. White said for every new
business you have, that is 6 more people going to work. It
also lends stability to the area. Comm. Weller said he
wanted to make sure there was room on the dock for all
businesses wanting to use it. Mr. White said the adjoining
acreage could be developed. He added, you would need a port
captain for scheduling. Chairman Williams asked Mr. White
to contact Mr. Fredericks and have him lay out in writing
what his intentions are, the property donated and what he
expects in return. Then Harbor Comm. could go to Council,
move on to plans, and contact barge operators. Mr. White
noted the trucking companies are owned by barge operators.

from Anchorage to Kenai shipping. Mr. White said the
adjoining land is leased by Mr. Dragseth, he imagined he
would be amenable. Comm. Houtz asked, what kind of fees are
there with rig tenders? Comm. Weller replied, dock fees,
tonnage fees, water fuel are available, longshoring costs
(these are where ever you go). Mr. White noted if all is
containerized and on rails, longshoring costs would go
down.
5. COMMUNICATIONS
a. Corps. of Engineers, Zubeck request for fill
Chairman Williams explained, Mr. Zubeck is requesting
dumping fill at the Swires Rd. area. Our concern as a public
agency is that it is on wetlands. He suggested a letter be
sent stating Harbor Comm. has no objection to issuance of
the permit, and Harbor Comm. has no jurisdiction over those
lands located that distance from the harbor.
Commission agreed to the reauest.
7 REPORTS
a. TAMs request for payment.
Chairman Williams said our question is whether the design
was proper after construction. He suggested the Commission
defray (sic, defer comment on payment to the City Manager
and Engineering Dept. If they feel the job was completed,
let them pay it. Engineer LaShot is aware of the
shortcomings. Comm. Thompson noted we do not know if it was
construction or drawing problem. Chairman Williams said the
City retains inspection responsibility. Comm. Weller said
if the contractor followed instructions on the steep grade,
it would not be his fault. Chairman Williams said if it is
faulty plans, our recourse is to the engineering firm. He
suggested we hold action till they meet with Engineer
LaShot. Comm, Thompson asked if they had-to- sign- -off.
Chairman Williams replied yes, but they said he worked
according to specs. The ramp end is below the mud. The 1st
tide has dumped 1 -1/2" to 4" of mud. Comm. Thompson said
the earlier ramp would get mud on the lower end in winter,
but no problem in the summer. Chairman Williams added, the
fill is washing out. He suggested a meeting with all
commissioners, City Manager Brighton and Engineer LaShot.
Comm. Weller suggested slides of the area for the meeting.

The Commission decided on meeting Nov. 8, 1983 in Council
chambers, request Engineer LaShot and City Manager Brighton
attend, and urge all Commission members to come. Comm. Houtz
will contact Mr. Horton of TAMs regarding the ramp and
submit a report to the Commission. Chairman Williams asked
that minutes of this meeting be sent to Mr. Brighton and Mr.
LaShot with hi -lites of this item.
b. TAMs Sedimentation Study
Chairman Williams explained, TAMs has one more project, the
feasibility study. He would like to ask TAMs for insight
into the next phase in time for the next meeting, and ask
them to send any detailed material concerning the next phase
of analysis. He also asked that City Manager Brighton and
Engineer LaShot review the minutes and let Chairman Williams
know if they have any grave concerns about the design; and
that Comm. Houtz is taking pictures and contacting TAMs
regarding the design.
Chairman Williams reported he received a magazine from TAMs
for review of the Commission. TAMs will be presenting a
packet to present to the Legislature if the Comm. determines
we want to go ahead with the harbor. The feasibility study
will be done before the Legislature convenes. He had not
been to Council work sessions regarding Capital Improvements
because he was waiting for the study. He had a long talk
with Gov. Sheffield regarding the harbor and other items
last week. The Governor's sentiments are that if it is
needed, it will be built, but it must be a proven need.

Please find enclosed the requested copies of the two preferred
harbor development schemes. As shown on the drawings, our
analysis now indicates that Alternative 2 is the most desirable
plan on which to base the harbor development program, as
Alternative 5 may add to congestion in the river, may create
some environmental problems, and offers no advantage in terms
of sediment control.
We are continuing to investigate means of controlling sedimen-
tation in the entrance channel. One option, as shown on the
drawings, is to reduce the channel width to 100 feet and to
raise the bottom elevation to +1 MLLW, which would enable
harbor maintenance crews to remove the accumulated sediments
in- the -dry during minus tides. Another option under considera-
tion is to close off the harbor during the off season, using a
floating gate or similar closure device.
We are looking forward to presenting the results of our analyses
at the November 15th City Council meeting. If you have any
questions or comments prior to the meeting, please do not
hesitate to call.

Please find attached our final account on the above contract.
Since all work included in our professional services agreement
of September 14, 1982 was completed with the award of the
construction contract, we would appreciate your confirmation
that we have completed our work under this agreement.
May we also thank you for your assistance during the design
phase of the contract. Although it was unfortunate that
funding was only obtained for a small portion of the project
as designed, the documents and drawings submitted will
hopefully be incorporated in the larger boat harbor project
now under detailed study. In the meantime should the
City require any further assistance on this project please
do not hesitate to call on us.

DATE: November 2, 1983
The lease application has been referred to you for review and
comment at the request of the Planning Zoning Commission. In
the future, all lease applications involving waterfront real
estate will be forwarded to the Harbor Commission for
consideration.
Robert Schmidt, Robert Ducker, and Lottie Edelman (d /b /a
Fisherman's Packing) have made application to lease Lot 1, Kenai
Spit S /D. A copy of the proposed development plan for an ice
house and cool room is attached.
The Planning Zoning Commission recommended approval of the
lease with a proposed completion date of January 1, 1986. The
Council considered this application at their meeting of October
19 and postponed action on the request. The major concern was
that prime waterfront real estate was proposed to be used for the
described facilities.
The petitioner has been directed to work out suitable
arrangements with the City Administration in this matter.

At the regular meeting of the Planning Zoning Commission,
Wednesday, October 12, 1983, the above lease application came

Along with the lease itself, Mr. Labahn asked the Commission to

Th Commission recommended a completion date for the proposed

Dear Mr. Labahn,
We are in receipt of your letter dated September 2, 1983. We understand
that the Kenai City Council recommended approval of our application for
a lease of the adjacent 10 acres of land which is adjacent to Spit S/D
Lot 2. Also that the City Council requested that Sea Catch Drive and the
northerly portion of Columbia Street be dedicated as a public right -of -way.
If we consented to the dedication that the Council is requesting we would
be leasing a parcel of land with a public right -a -way through it, which for
all purposes we would have to fence completely for security reasons. We
would like to discuss another proposal of ours with you.
At the time that we applied for the present lease that was approved with
certain provisions, by the Council, we would have preferred applying for
the property adjoining directly to the North, Lot -1, but at that time
there was an application pending by another party. I have since been
informed that this piece of property is now open. The property to the
North of us would much better suit our expansion plans. We would consider
the dedication of Sea Catch Drive and Columbia Street if this could be
arranged and drop the lease of the 10 acres to the West which would require
a field survey.

9. REPORTS
a. City Council Report
Councilman Wise reported that the Council appropriated money
to upgrade Thompson, Aliak, Princess, etc.
The lease from Fisherman's Packing was tabled. The
Commission and Councilman Wise discussed the lease and came
to the conclusion that the lease would go before the Harbor
Commission and then return to either the Council or the
Commission.
b. Borough Planning Report
Commissioner Bryson informed the Commission that the
rezoning of R.M. Thompson S/D was reviewed and approval was
recommended to the Borough Assembly.
c. City Administration Report
Jeff Labahn informed the Commission that there would be a
work session with the Council on Monday with the topics
being the engineering proposals for Section 36 and capital
improvement requests.
The corner lot of Spur S/D No. 1 where the lease for the
plumbing supply had been has been advertised for sale. Mr.
Ron Malston has indicated interest in the lot.
There has been a request to purchase both Tract D E of
Daubenspeck property. There is no indication of how the
potential buyer wishes to develop the property.
An agreement has been reached with the Kenai Native
Association regarding the ROW on Wildwood Drive and Cook
Inlet View Drive. The 120' portion from the entrance to the
Wildwood Reservation to the Spur Highway.

11. COMMISSION QUESTIONS COMMENTS
The question of quorum for December was discussed. It was
agreed that many Commissioners planned to be out of town
during that time.
