RESOLUTION NO. PZ03-01
SUBDIVISION PLAT
A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE
CITY OF KENAI RECOMMENDING THAT THE ATTACHED SUBDIVISION
PLAT BE APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
WHEREAS, the attached plat Tide View Heights -Padget Replat was referred to
the City of Kenai Planning and Zoning Commission on December 6, 2002 and
received from In#egrity Surveys.
WHEREAS, the City of Kenai Planning and Zoning Commission finds:
'!. Plat area is zoned RR -Rural Residential and therefiore subject to said zone
conditions.
2. Water and sewer: Not available
3. Plat does not subdivide property within a public improvement district subject
to special assessments. There is not a delinquency amount owed to the City
of Kenai for the referenced property.
4. Installs#ion agreement or construction of improvements is not required.
5. Status of surrounding land is shown.
6. Utility easements, if required, shall be shown.
7. Plat shall verify that no encroachments exist.
8. Street names designated on the plat are correct.

NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING
COMMISSION OF THE CITY OF KENAI THAT THE KENAI PENINSULA
BOROUGH PLANNING COMMISSION APPROVE TIDE VIEW HEIGHTS -
PADGET REPEAT SUBJECT TO ANY NEGATIVE FINDINGS AS STATED
ABOVE.

1. Note 3 on the plat should be corrected. The City of Kenai requires a 25-
foot setback from right-of-ways.
2. Plat must verify there are no encroachments. Kenai Peninsula Borough
assessing data lists a structure on this parcel.
3. There appears a potential for more than 10 lots to be served from Ames
Road and a right-of-way that meets Kenai Peninsula Borough standards
should be dedicated.
4. A note should be placed on the plat noting that development is limited in the
area that does not meet the lot width for the zone, i.e. 90 feet. (No
structure should be placed in the area of the lot that is less than the 90-foot
wide.}
5. There is a question whether or not the section line was vacated. This
should be clarified and if not, vacation issue should be resolved.
