That an application meeting the requirements of Section 14.20.150 has been submitted and received on: March 16, 2004 2. This request is on land zoned: RR1 -Rural Residential 1 3. That the applicant has demonstrated with plans and other documents that they can and will meet the following specific requirements and conditions in addition to existing requirements: a. See Page 2 4. That a duly advertised public hearing as required by KMC 14.20.280 was conducted by the Commission on: April 14, 2004 5. Applicant must comply with all Federal, State, and local regulations. NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI THAT 7HE APPLICANT HAS DEMONSTRATED THAT THE PROPOSED Townhouse (Condominium De~eiopmentl MEETS THE CONDITIONS REQUIRED FOR SAID OPERATION AND THEREFORE THE COMMISSION DOES AUTHORIZE THE ADMINISTRATIVE OFFICIAL TO ISSUE THE APPROPRIATE PERMIT. PASSED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI, ALASKA, April 14, 2004. CHAIRPERSON: ~ ATTEST: 0413 Res.doc Special Requirements: Page 2 1. Prior to the Conditional Use Permit being issued and the sale of any unit, proof that the development meets the Horizontal Property Regimes Act must be submitted to the City of Kenai Planning Department including: a. Filing and recording of a survey map and floor plans with verified statement as required under the Horizontal Property Regimes Act, Section AS 34.07.030 "There shall be filed and recorded simultaneously with the recording and declaration in the recording district in which the property is located {1} a survey map of the surface of the land submitted under the provisions of this chapter showing the location of the building on it; (2} a set of floor plans of the building showing the layout, apartment numbers and dimensions of the apartments in sufficient detail to identify and locate each apartment with certainty, stating the name of the building or that it has no name, and bearing the verified statement of a registered architect or registered professional engineer certifying that it is an accurate copy of portions of the plans of the building as filed with an approved by the governmental entity having jurisdiction over the approval or issuance of permits for the construction of the building, ar a statement that no approval permit is required. b. if not included in the Declaration Submitting Real Property to Horizontal Regime Act, an agreement far joint ownership and maintenance of the on-site water and waste systems should be recorded and be a part of the ADEC approval prior to final plat approval.
