PZ05-12 (PZ40-34) ttieG~°~ REVOCATION OF CONDITIONAL USE PERMIT KENA~ SKA A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI REVOKING CONDITIONAL USE PERMIT PZ00-34 DUE TO FAILURE TO MEET REQUIREMENTS OF KMC 14.20.150 {g}. WHEREAS, the Commission finds: 1. That Conditional Use Permit PZ00-34 was issued on October 25, 2000 for a Bed & Breakfast, Hotel (Short-term Rentals) and Fishing Guide Service. 2. The permit was for the property located at Lot 17, Block 10, Valhalla Heights No, 1 - 5296 Kenai Spur Highway. 3. The Kenai Peninsula Parcel Number is 04925013. 4. The land is zoned Rural Residential. 5. In June of 2001, Ordinance No. 1916-2001 was passed that requires yearly reporting by holders of Conditional Use Permits to insure permit holders are current with all obligations with the City of Kenai and the Kenai Peninsula Borough. 6. Property owner was sent notices on 12/6/04 and 1/4105 for failure to submit yearly report and to show compliance with Kenai Peninsula Borough Sales Tax. 7. On 1126105 a third notice was sent to the property owner at the only known address we have informing them their Conditional Use Permit was being revoked. 8. On 218105 staff attempted to contact property owner at the only known phone number and was unsuccessful. 9. That a duly advertised public hearing as required by KMC 14.20.280 was conducted by the Commission on April 13, 2005. NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI THAT CONDITIONAL USE PERMIT PZ00-34 HELD BY PAUL B. & DEBRA M. WILSON FOR A BED & BREAKFAST, HOTEL (SHORT-TERM RENTALS} AND FISHING GUIDE SERVICE IS REVOKED. PASSED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI, ALASKA, A ril 13 2~OS.
