~IHEREAS, AS 29.40.010 grants the Kenai Peninsula Borough planning, platting and
land use regulation power on an area-wide basis; and
VVHEREAS, in 1996, the Kenai Peninsula Borough adopted an Anadromous Steams
Habitat Protection Ordinance, codified as KPB 21.18.010-140; and
WHEREAS, KPB 21.18.1 ~0 allows cities urithin the covered area to administer and
enforce the ordinance by enacting an ordinance incorporating it by reference into the
city code; and
WHEREAS, consistent with its home rule powers the City of Kenai finds it is in the
best interest of the city to administer and enforce the Anadromous Streams Habitat
Protection Ordinance by incorporating it into its city code as KMC 14,20.165; and
WHEREAS, the City of Kenai finds that zoning decisions affecting property within the
City of Kenai should be made locally.
NO~V, THEREFORE, THE PLANNING AND ZONING COMMISSION RECOMMENDS TO
THE COUNCIL OF THE CITY OF KENAI, ALASKA that KMC 14.20.1b5 be enacted as
follows:

There is hereby incorporated by reference into this Code, KPB 21.18,
to the extent that such provisions are in effect on or following the
effective date of this ordinance.

21.16.010, Purpose.
The purpose of this chapter is to ensure measures for the rotection with'

21.18.040. Habitat protection area established.
There is established an anadromous stream habitat protection area. Except as otherwise
provided in this section, this area includes all lands within 50 horizontal feet of the streams set
forth in KPB 21.18.025. This shall be measured from the ordinary high water mark or mean
high water line in tidal areas. Where the banks within this ~0-foot area consist of a fi0 de ee

or mare eut bank the habitat protection area shall consist of the greater of 50 feet from the
river or to a point 25 feet back from the top of the cut bank.

21.18.050. Flood plain-R,estrictions within for habitat protection--Permit required--
Fuel storage tanks and logging--Conditions,
A. No person shall install or replace a fuel storage tank or conduct logging activities as
defined in this section within any lflood hazard area bordering the Kenai River or an of its

ground.
Cables may be used for anchoring that are of su~icient strength to prevent the tank from
tearing loose if it were to float while empty. The tank must also be installed witbin an
impervious containment basin of a size sufficient to contain 110~/ of storage capacit lus 12

E. A decision of the planning director under this section may be appealed to the plannin

commission. The appeal must be filed with the planning director within seven days of the date

21.18,070. Activities not requiring a permit.

significant erosion, destruction of wetlands or riparian habitat, or result in or increase

or water pollution it shall deny a conditional use permit for the requested activit .

21.18.090. Prior existing activities and structures.
A, Intent. There are activities which were conducted, and structures which wer
e under
construction, or exist and were in use before the enactment of this ordinance which woul
d be
prohibited or restricted under the terms of this ordinance or future amendments. '
It is the
intent of this section to permit these prior existing activities or structures to contin
ue. Any
such activities or structures must still comply with other applicable laws, The '''
activities
referenced in this section shall be allowed if they do not result in significant erosion or
damage
to the riparian habitat.
B, Structures. Structures which were under construction or in use before the effectiv
e date
of any provision of this chapter, but that would be prohibited or restricted under the term
s of
this chapter shall be allowed to continue, provided that a structure under construction
must
be substantially completed within two years of enactment of this ordinance. Such a struc
ture
may be maintained or repaired without a permit. Such a structure may also be re lace
p d or
reconstructed within two years after accidental damage to accidental destruction b fire

explosion, or other casualty or act of God, Reconstruction or replacement not com leted wi '

two years of tbe date of the damage is prohibited except in compliance with curren

requirernents. Such replacement or reconstruction may only be undertaken in the same s ac

C. Acti~~ities. This chapter shall nat prohibit or restrict activities u~hich were conducted
before the effective date of any pravision of this chapter, provided that, after the e~'ective date,
such activities are conducted in the same location and are not enlarged to include a greater
number of participants or to occupy a greater area of land.
D. Permits. Any enlargement or expansion of such an activity or structure within the
habitat protection area shall require a conditianal use permit. A conditional use permit shall
be granted to an applicant if the enlargement or expansion will be conducted in a manner that
does not result in significant erosion, destruction of wetlands or riparian habitat or increase in
ground or water pollution. The permitting authority may attach conditions to the permit it
feels are reasonably necessary to achieve the above objectives.
E. Other provisions.
1. Any prior existing activity or structure which is abandoned for two years or more shall
thereafter not be conducted, used or occupied except in conformity with the provisions
of this chapter,
2. Nothing in this chapter shall prevent any change of tenancy, ownership or manage-
ment of any prior existing structure.

21.18.100. Administration by cities--Delegation-Legal proceedings,
A. The administration and enforcement of this ordinance may be undertaken b a cit ,

B. A city may adapt the standards established in this chapter or prescribe standards more
stringent than those established in this chapter for the areas of the city within the habitat
protection area or other areas regulated by this chapter. A conditional use permit issued by a
city planning commission may serve to satisfy the requirements of 21,18.072 and 21.18.080.
C. A city wishing to adrninister and enfarce this chapter shall enact an ordinance adopting
tbe provisions of this chapter by reference, providing the city will undertake the administra-
tion in conjunction with the adrninistration of land use regulations and building and health
codes enacted by the city. Within 30 days of passage of the ordinance the mayor shall transfer
the administration and enforcement to the city, The city may relinquish and transfer the
administration and enforcement back to the borough by ordinance, however the transfer shall
not take efi'ect until 90 days after the city approves the transfer or the commencement of a r~ew
fiscal year for the borough, whichever is greater.
D. If a city assumes administration of this chapter, conditional use permit determinations
shall be made by the city planning cornmission, or by the city cauncil, as provided by city
ordinance. Appeals or legal proceedings taken fram actions of the city in adininistering shall
be the sole responsibility of the city.

G, "Kenai River" shall mean the main stem of the river from and including Kenai Lake to
the mauth including Skilak Lake, The main stem shall include all slou hs, channels

shall be described as the western most section line common to Section 5 and Section 8

H. "Logging" shall mean removal or cutting down more than 50 trees per acre that have
a breast diameter height of 6" or more.
I. "Mean high water line" or "ordinary high water l~ne" shall have the definition given in
11 AAC 53.900(15) as it currently exists or as it may be renumbered or revised.
J. "Ordinary high water mark" shall have the definition given in 11 AAC 53.900~23) as it
currently exists or as it may be renumbered or revised,
K. "Riparian habitat" shall mean the areas within and adjacent to the river containin

spawning and rearing habitat for salmon or that provide immediate cover ar stability
for salmon and eggs at all stages of development,
L. "Soil erosion" shall mean the increased movement of soils that occurs as a result of
human activities or development.

premises and which is located above, on, or below the ground, including buildings,
roads, signs, billboards, satellite antennas and other communication structures

the habitat protection area.

owner's beneficial use for the purpose and in the manner intended for the structure.

CouncillVlember Joe 1Vloore -- Explained he is the liaison of the Airport Commission
and reported, the Commission met immediately prior to the Planning 8~ Zoning
Commission and reviewed the lease application. Moore stated, the Commission found
the proposed use of the property to meet the requirements of the Airport Master Plan
and zoning codes.
MOTION:
Commissioner Eldridge MOVED to recommend council approve the lease application
for Lots 5 8~ 6, Block 1, FBO Subdivision, submitted by Bellair, Inc. Commissioner
Hammelman SECONDED the motion.
Vice Chair Bryson asked if the intent of the motion was to determine the proposed use
of the property is in conformance with the Airport Master Plan and zoning
requirements for that area. Eldridge stated it was and asked that information be
included with the motion.
A brief discussion took place relating to who eventually verifies the value of the
development correlates with the length of the lease. It was noted, the process included
the application for a building permit, development completion and Borough
assessment. Council Member Bookey reported he was unaware of any length of lease
needing to be amended upon completion of a development on airport lands.

to proceed with a replatting and rezoning of Lawton Acres.
Bookey also ga~e a brief report of his and Mayor ~1Uilliams' trip to Washington, DC; i.e.
to attend the Police Memorial activities in memory of Officer John Watson and to meet
with congressional delegation regarding the bluff erosion and coastal trail project. He
noted, Senator Murkowski has continued to be very supportive in the effort and
suggested the proj ect be a Corps of Engineers proj ect with the city handling 30% of
the cost, which may include previous expenditures, the value of lost private bluff
property, and bonding for the remainder. Bookey also suggested the project could be
three to five years out, depending on funding and election results.

Bryson reviewed actions taken at the May 24, 2004 Borough Planning Commission

ANALYSIS
General Information:
KMC 14.20.185 details the definition, intent, and permit application process
for Encroachment Permits. Code also lists the review criteria that should be
considered by the Planning and Zoning Commission when determining if a
permit should be granted. The Commission is to establish that the following
conditions exist before issuing an Encroachment Permit:
1. An encroachment as defined in KMC 14.20.185 (a) exists.
2. The encroachment does not encroach upon a Federal, State or
City right-of-way or utility easement.
3. The issuance of the encroachment permit will not authorize a
use which is a not a principal permitted use in the zoning district
in which the property is located.
4. The encroachment is not located across a platted lot line.

A building permit to construct a residence was issued for this property on
March 18, 2004. The foundation was dug and poured while there was still
snow on the property. When the owner had an asbuilt done, it showed a
13.2 - setback, an encroachment of 1.8-feet or 1-foot 9- %2 inches along the
side of the garage. A 15-foot side set back is required in the Rural
Residential zone. When the owner realized the mistake, they contacted the
Building Official to determine what steps they should take to eliminate the
mistake. The Building Official may grant up to a one-foot administrative
encroachment. Because this is larger than that, the applicant was advised to
apply for an encroachment permit and is requesting an encroachment permit
for this structure.

Buildinq Official:
Granting this encroachment will violate no building code. I suggest granting
a 2-foot encroachment due to the current measurements is taken from
concrete foundation. When framing and trim boards are installed this
encroachment could increase at least another 1/10 of a foot.
RECOMMENDATIONS
The encroachment was a mistake in calculations due to construction while
there was still snow on the ground. Based on the application, it appears the
encroachment meets the requirements of KMC 14.20.185. Recommend
granting a 2-foot side setback encroachment per Building Official's
recommendations.

At your meeting on June 23rd, a public hearing will be held to consider amending the
Land Use Table, Footnote 20. As you are aware, there has been considerable interest
in leasing airport property, The majority of unsubdivided airport property is zoned
conservation. The newly adopted Comprehensive Plan has recommended an airport
overlayzone to eliminate the zoning restrictions on this property due to the conservation
status. The original plan was to begin this process as soon as the Comprehensive Plan
was adopted. However, the airport is in the process of conducting an airport
supplemental plan that includes an inventory of airport properties and recommendations
for future use.
Due to this supplemental plan, it seems premature to rezone properties without the
advantage of this study and the consultant's recommendations. For the short-term, it is
administration's recommendation that the Land Use Table, Footnote 20, "The airport
and related uses allowed under this entry are aircraft approach zones per KMC
14.20,070(a)," be amended to allow uses as permitted by the FAA,
Due to the length of time required for a code amendment and the immediate need to
allow airport-related uses along the airport proper, administration is seeking to fast track
this amendment. The City Attorney is preparin a draft ordinance that should be

available and will be presented to you on the 9. The draft will be placed on the
Council's consent agenda for introduction on June 16th and public hearing on July ltn
The ordinance, if passed, will become effective on August 7th. The Attorney has
determined that after July 7th, pending the effective date of the ordinance, building
permits could be issued.
The Airport Commission will discuss the proposed amendment at their meeting on June
10t" and their comments should be available for you at your public hearing.

I received your letter regarding the One Stop development located at 5455 Kenai Spur Highway.
Your concerns are noted, and the information will be provided to the Planning and Zoning
Commission. Since the property is zoned general commercial, the property owner was notified that
they would have to stop work on their coffee stand until they completed a building permit and a
landscape application. Once these are received, reviewed, and approved they c~an continue work on
their coffee stand. To date, the City has not received the application for the building permit or
landscape site plan.
The City of Kenai landscaping requirements are minimal. The intent is to provide for orderly and safe
development. The code lists perimeter landscaping to provide buffer to minimize impact. However,
the buffer may not be requ~~ ed. The plan, when presented, will be reviewed to insure that it meets the
code requirements. Speci~'ically, the plan must provide for planting details, snow storage areas,
drainage patterns, locatic~ns of buildings, parking and access. Required landscaping is a maximum of
five percent of project area limiting the amount of landscaping that the City may require.
Your concern about noise pollution is noted, and the developer will be encouraged to maintain as
much natural buffer as possible when developing the property.
The City appreciates your input and will work diligently with the property owner to insure that the
City's development requirements are met, The City Administration will review any proposed
development to insure that it meets the City code and Comprehensive Plan. Because this property is
in a commercial zone, a coffee stand would meet the development requirements for that zone.

residences have m~uch more exposure to the h~ghway and noise polurion!

the paper. In fact, wl~en ~ie leaves fa11 and wi~nter approaehes and the loss of our natural screening is gone; noise
pollu~on from the hig~way is plenty. Ta add more builtl~ing and conges~ion at the One Stap requires strong scrutinny
and responsible cansideration void o~ ~rsonal agendas.
d} And yes, we realize this to be 'commerciat property' and yes, the owners should be able to "do their thing" and na, we
are not trying to stop them but YES, we do want some sort of buffer so we can isolate from them as much as possible.

Use Permit Requested Proposal as it relates to entry and e~it.
