In enacting this ordinance the assembly finds numerous factors affec ' anadromous streams w' ' ~ . t the habitat of the ithin the Kena~ Peninsula Borough. Among others these include ba erosion, bank tramplin , ollution inad nk g A , equate tourism infrastructure, unsuccessful attempts to remedy bank erosion or protect and restore habitat, inconsistent re ' ' . gulations, logg~ng, grazing, mining, wetland fill and drainage, excavation and fill of ro e '' p p rty, dredg~ng, inappro- priately installed culverts, fuel storage, and maintenance of existin g structures. The assembly finds that the sensitivity of the river area requires eneral ro ''' '~• •• g p h~bition of activlties within an area immediately adjacent to the anadromous streams and onl ''' ~ damage the habitat sbould Y activities which do not be allowed. The assembly finds that certain activities have mi impact and that existing state, federal and local laws a nor nd regulations contain sufficient controls on these activities that further regulation is not curren tly needed, The assembly further finds that fuel storage and sigmificant removal of ve eta ' '' lain alon the a g tlon wittun the 100-year flood P g nadromous streams need regulation to protect the salmon hab' (Ord. Code also lists the review criteria that should be considered by the Planning and Zoning Commission when determining if a permit should be granted. The Commission is to establish that the following conditions exist before issuing an Encroachment Permit: 1. An encroachment as defined in KMC 14.20.185 (a) exists. 2. The encroachment does not encroach upon a Federal, State or City right-of-way or utility easement. 3. The issuance of the encroachment permit will not authorize a use which is a not a principal permitted use in the zoning district in which the property is located. 4. The encroachment is not located across a platted lot line. 0420 Comment.doc Page 2 A building permit to construct a residence was issued for this property on March 18, 2004. The foundation was dug and poured while there was still snow on the property. When the owner had an asbuilt done, it showed a 13.2 - setback, an encroachment of 1.8-feet or 1-foot 9- %2 inches along the side of the garage. A 15-foot side set back is required in the Rural Residential zone. When the owner realized the mistake, they contacted the Building Official to determine what steps they should take to eliminate the mistake. The Building Official may grant up to a one-foot administrative encroachment. Because this is larger than that, the applicant was advised to apply for an encroachment permit and is requesting an encroachment permit for this structure. City En~ ineer: Not available to comment. Buildinq Official: Granting this encroachment will violate no building code. I suggest granting a 2-foot encroachment due to the current measurements is taken from concrete foundation. When framing and trim boards are installed this encroachment could increase at least another 1/10 of a foot. RECOMMENDATIONS The encroachment was a mistake in calculations due to construction while there was still snow on the ground. Based on the application, it appears the encroachment meets the requirements of KMC 14.20.185. Recommend granting a 2-foot side setback encroachment per Building Official's recommendations. As you are aware, there has been considerable interest in leasing airport property, The majority of unsubdivided airport property is zoned conservation. The newly adopted Comprehensive Plan has recommended an airport overlayzone to eliminate the zoning restrictions on this property due to the conservation status. The original plan was to begin this process as soon as the Comprehensive Plan was adopted. However, the airport is in the process of conducting an airport supplemental plan that includes an inventory of airport properties and recommendations for future use. Due to this supplemental plan, it seems premature to rezone properties without the advantage of this study and the consultant's recommendations. For the short-term, it is administration's recommendation that the Land Use Table, Footnote 20, "The airport and related uses allowed under this entry are aircraft approach zones per KMC 14.20,070(a)," be amended to allow uses as permitted by the FAA, Due to the length of time required for a code amendment and the immediate need to allow airport-related uses along the airport proper, administration is seeking to fast track this amendment. The City Attorney is preparin a draft ordinance that should be , , t~ , available and will be presented to you on the 9. The draft will be placed on the Council's consent agenda for introduction on June 16th and public hearing on July ltn The ordinance, if passed, will become effective on August 7th. The Attorney has determined that after July 7th, pending the effective date of the ordinance, building permits could be issued. The Airport Commission will discuss the proposed amendment at their meeting on June 10t" and their comments should be available for you at your public hearing. -~~-~ .~.~. :...~~~~ 1~ ii , , jr ~"~ 210 FIDALGO AVE., SUITE 200 KENAI, ALASKA 99611•7794 ~ TELEPH4NE 947-283-7535 ., _ FAX 907-263-3014 ~ ~~~ I I . ~ ~94z Spencer De Vito P.O. Box 317 Soldotna, AK 99669 Dear Mr. De Vito and Mr. Segura: Jimmy Segura 320 Thompson Place #3 Kenai, AK 99611 I received your letter regarding the One Stop development located at 5455 Kenai Spur Highway. Your concerns are noted, and the information will be provided to the Planning and Zoning Commission. Since the property is zoned general commercial, the property owner was notified that they would have to stop work on their coffee stand until they completed a building permit and a landscape application. Once these are received, reviewed, and approved they c~an continue work on their coffee stand. To date, the City has not received the application for the building permit or landscape site plan. The City of Kenai landscaping requirements are minimal. The intent is to provide for orderly and safe development. The code lists perimeter landscaping to provide buffer to minimize impact. However, the buffer may not be requ~~ ed. The plan, when presented, will be reviewed to insure that it meets the code requirements. Speci~'ically, the plan must provide for planting details, snow storage areas, drainage patterns, locatic~ns of buildings, parking and access. Required landscaping is a maximum of five percent of project area limiting the amount of landscaping that the City may require. Your concern about noise pollution is noted, and the developer will be encouraged to maintain as much natural buffer as possible when developing the property. The City appreciates your input and will work diligently with the property owner to insure that the City's development requirements are met, The City Administration will review any proposed development to insure that it meets the City code and Comprehensive Plan. Because this property is in a commercial zone, a coffee stand would meet the development requirements for that zone. IS the proposed USE although commercial designated, in h~~rmony with the ariginal intent of the Kenai Comprehension Pian IS ~he proposed use HARMFIJL to pub~ic safety, health and we~fare when one cans~ders the egress and area road congestion ~ Safe~y a.) Serious, hazardous and menacing veh~cle road entry and exit exists. 55 mph normally means 65mph to most young and old drivers on this s~retch of lughway and they often approach this a~ea at high speeds where `~tapped' vehicles wait for long periods of time to turll off the highway. b, } Four road ~oprions to turn inta once a motorist's direcdanal light is turned on, often confuses oneaming and rear t~affic. Passing on the wrong side, the shauld~r, is very commun. Thus a cantinued access problem. ~.} ~Dangerous and numerous residen~ial pedestrians, especially kids, are constantly running, crossing the Kenai Spur Highway to beat the traff'ic to visit the One Stop for candy, ice cream or groceries for mom! d.} *Resp~nsib~e scrutiny concerning this dangerous traffic area must be addressed and carefully outlined ~Welfa-re a) A Buffer Strip must be required because of the e~treme road noise and present nois~ at the liq~or store and gas station, which now exists. To ~.dd add.itianal buildings wili require additional buffering such as 1~ No mo~e tree cutting to re#ain what little natural s~reening that is left. 2} Arti~icia~ screening must be required fvr the immediate inhabitants to help e~te some of t~e nois~ which is often a nu~sance, especially late at night where screeching tires and excessive noise can never seem to be eli~inated! Bushes won't do it! Cansider a fence! b) Alsa be awar~ t~at break-ins, robberi~s, etc. have occurred at the One Stop liquor s~are. That has indeed had an effect on our health, safety and we~fare in Thompson P1ace where we have also been vandalized ~n the past because of the more obvious exposure. (Out vf sight-out of mind no longer exists} Since excess tree ~utting has already happen, our residences have m~uch more exposure to the h~ghway and noise polurion! ~} For the two residents adjacent to the One Stop, noise pollution is more than just a phr~.se one hears on TV ~r rea.ds in the paper. In fact, wl~en ~ie leaves fa11 and wi~nter approaehes and the loss of our natural screening is gone; noise pollu~on from the hig~way is plenty. Ta add more builtl~ing and conges~ion at the One Stap requires strong scrutinny and responsible cansideration void o~ ~rsonal agendas. d} And yes, we realize this to be 'commerciat property' and yes, the owners should be able to "do their thing" and na, we are not trying to stop them but YES, we do want some sort of buffer so we can isolate from them as much as possible. ~equiring scrutiny by the city af Kenai and DOT to ex~~nine the traffic safety situatian in the said location is reasonable. A dang~rous traffic "can af worms" cont~.ues to e~ist where four roads advance and enter the Spur Highway within a distance of 140 yards, There, quite often, speeders cross the solid line on front of the One Stop at dangerausly high speeds. In fact, the original issuance of a liquor license was contested by all landowners in the residential area at the time. Perhaps Kenai Roads and Maintenance needs to also take a close look at the Condirional Use Permit Requested Proposal as it relates to entry and e~it. It is aur intent that this pasitive infornlation b~ helpfi~l to the Planning and Zoning Board in m~aking the eorrect decisionsi ~s! ~ AGENDA KENAI CITY COUNCIL - REGULAR MEETING JUHE 2, 2004 ?:00 P.M.
