Department Assistant Carver explained this was a renewal of an existing lease and Commissioner Barrett reported the issue was reviewed by the Harbor Commission on March 7 who recommended approval. Commissioner Amen asked what calculation determined the length and cost of the lease. It was explained the State has established guidelines the City of Kenai follows. MOTION: Commissioner Bryson MOVED to recommend approval of the lease renewal for Shore Fishery Plat No. 71 and Commissioner Twait SECONDED the motion. Carver reported City Planner Kebschull was checking to see if travel funds could be available for any P&Z Commissioner wishing to attend the conference. The Commission approved the permit at their October 25, 2000 meeting. In June of 2001, Kenai City Council passed Ordinance No. 1916-2001. This ordinance required that all holders of Conditional Use Permits submit yearly reports between October 1 and December 31 st of the year. The report was to verify that the permit holder is current on all obligations with the City of Kenai and the Kenai Peninsula Borough. On December 6, 2004, City administration notified permit holders that their yearly reports were due by the end of the December 2004. A check with the Borough showed the applicants as being out of compliance with sales tax requirements and their account had been closed. A second notice was sent to Mr. & Mrs. Wilson on January 4, 2005, stating the City had not received their report and they were out of compliance with the Borough. Staff attempted to contact Mr. & Mrs. Wilson by phone using the number from their file and was unsuccessful. 0512 (00-34) Comment.doc Page 2 On January 21, 2005, a letter was sent to Mr. & Mrs. Wilson advising that their Conditional Use Permit was being revoked and they were asked to contact us. To date, no response has been received from Mr. & Mrs. Wilson. RECOMMENDATIONS KMC 14.20.150 (g) states that, "If the Commission determines, based on the yearly review of any other investigation undertaken by the official, that the conduct of the operation(s) is not incompliance with: 1) the terms and conditions of the permit; 2) the provisions of the Kenai Zoning Code; 3) or that the permit holder is not current on any obligations (e.g. sales tax, property tax, utility payments, lease payments) to the city unless the applicant has entered into an approved payment with the city on any obligations owed and the applicant is in compliance with the payment plan, the Commission may revoke the permit. The Commission shall not revoke the permit until the permit holder has been notified and given reasonable opportunity to correct the deficiency(s) or to provide information relating to or rebutting the alleged deficiency(s). Administration has provided the permit holder with sufficient notice and opportunity to meet sales tax requirements with the Kenai Peninsula Borough. Property owner was sent notices on 12/6/04 and 1/4/05 for failure to submit yearly report and to show compliance with Kenai Peninsula Borough Sales Tax. On 1/26/05 a third notice was sent to the property owner at the only known address we have informing them their Conditional Use Permit was being revoked. On 2/8/05 staff attempted to contact property owner at the only known phone number and was unsuccessful. That a duly advertised public hearing as required by KMC 14.20.280 was conducted by the Commission on March 9, 2005. This rezone is being requested in planning for future development of the area known as Millennium Square. Millennium Square includes three parcels, the FAA Field, FAA Tract and this parcel. The FAA Field and FAA Tract are zoned general commercial. This parcel is approximately 15.16 acres fronting Bridge Access Road and Frontage Road. Water is available from Bridge Access Road, Frontage Road, or Spur View Drive. Sewer is available from Spur View Drive or by extending the main along Bridge Access Road. The Comprehensive Plan Land Use Plan shows this land as Mixed Use and identifies it as part of the proposed City Center overlay zone. The Comprehensive Plan defines Mixed Use as "fosters a compatible mix of retail, service, office, public institutional recreational and multi-family residential uses." The proposed rezone will allow several of the proposed uses identified in the Comprehensive Plan and the Kenai Economic Development Strategy (KEDS) for the Millennium Square development. With the rezone to general commercial, residential 0516 Comment.doc Page 2 use would be limited to a secondary use. It should be recognized that the rezone to general commercial will not allow all of the mixed uses (residential) as proposed in the Comprehensive Plan and the KEDS Plan and to achieve those goals will require either developing a mixed use zoning definition and rezoning parcels or creating an overlay zone that allows for the variety of uses proposed for the development. City Engineer: Not available to comment. Building Official: No building code issues. RECOMMENDATIONS This rezone is being requested by the City of Kenai's Planning and Zoning Commission to plan for future development of Millennium Square. The Comprehensive Plan identifies this area as mixed use and a part of the proposed city center overlay zone. This request is being made to eliminate a duplicate street name that may cause confusion with the 91 1 system. There are ten parcels adjoining Bluebell Lane in Kenai all of which are vacant. Bluebell Lane is platted; however, is not constructed. There is what appears to be a rough pathway located through the right-of-way. Kenai Municipal Code 1 4.1 5.1 40 states, "The Council by resolution may change, rename, or name an existing street or newly established street within the limits of said City at any time after the adoption of this chapter upon recommendation of the Planning and Zoning Commission, and after consultation with the Kenai Peninsula Borough, and any other municipality directly affected thereby." Administration does not foresee any problems with the Borough's request to rename Bluebell Lane. To accommodate their request, I asked them to provide suggested names to insure that we would use a name that was unique and fit the scheme of the other streets in Black Gold Estates. The Borough has provided three names for the City to consider. They are: Harebell Lane, Rugosa Lane, and Yarrow Lane. All are flowers grown in Alaska. One Bluebell Lane is within the City of Kenai, and the other Bluebell Lane is in the Kasilof area. Bluebell Lane in the Kasilof area has 13 adjoining parcels. Twelve parcels have a residential use, and one parcel is vacant. Bluebell Lane is constructed, and six owners use Bluebell Lane for their mailing address. Maps of this area are enclosed. All 10 parcels adjoining Bluebell Lane within the City of Kenai are vacant so no property owners use Bluebell Lane for a mailing address. Satellite imagery indicates this Bluebell Lane is constructed. Maps of this area are enclosed. Although the Emergency Service Numbers (ESNs) for both streets are different, I am very concerned about the confusion that could arise because of these duplicate street names. I realize the 911 calls for the City of Kenai are handled by the Kenai Police Department; however, if multiple calls are received simultaneously, the dispatchers at the Alaska State Troopers take the overflow calls. Also, 'the Troopers provide backup assistance to the Kenai Police Department as needed. Borough staff strives to have the least impact possible on property owners while working to eliminate duplicate and sound-alike street names in conjunction with the 911 Street Naming and Addressing Project. Because of the number of residential parcels and the property owners who use Bluebell Lane for their mailing address in the Kasilof area, I respectfully request that the City of Kenai change the name of its Bluebell Lane. The dock will be installed by anchoring the upstream corner of the dock to a guy post, which will be set above the mean high tide line of Beaver Creek.. The dock floats will consist of closed cell styrofoam. A ramp will 6onnect the dock from above the mean high tide line to below the mean low tide line. The existing dock system consisted of a two-piece segmented 6X10 floating ramp and a 6X10 floating dock. It was made of wooden sides and plywood top and bottom decking and held together by marine glue, galvanized screws and bolts. Almost all of the screws and some of the bolts have corroded way; the top and bottom plywood decking has become rotten; and the glue has lost its adhesive ability a long time ago. In short, the system is worn out and needs replacing. We ask that the existing permits be amended to reflect the new aluminum ramp and floating dock we are having fabricated by Nick's Iron Works on Ames Road, Kenai.
