Title of Project: Stabilization of the Holy Assumption Orthodox Church, a National Historic Landmark in Kenai, This title must be the same as the "Descriptive Title of Applicant's Project" entered in field 15 of the SF424. National Significance The Holy Assumption Orthodox Church has been the principal and most enduring representative of Russian culture in southcentral Alaska from 1841 to the present. For the Kenaitze Indians, who are still a significant portion of the population, it was the major institution for the assimilation of western culture when the Russian fur traders first came to the area. In addition to serving as a religious center, the church began the first school on the Kenai Peninsula educating the local Kenaitze children and young adults to read, write, grow vegetables, and learn basic building methods. It served as a judicial center acting as arbiter between the officials of the Russian American Fur Trading Company and the natives. The church served as a social center, bringing the community together to share ideas and promote the welfare of all. The church also provided the region's first access to public health with the introduction of smallpox vaccine after the first epidemic decimated the local population. All three structures which contribute to the National Historic Landmark (NHL) site represent classic Russian -style architecture on the far western frontier. The church is a fine example of a Russian village church, designed in the classic Pskov, vessel or ship pattern. It is perhaps the most colorful of all Russian Orthodox churches in Alaska with its broad pallet of colors from pure white to blue, green, and gold on the exterior. The chapel is an excellent model of Russian techniques of log construction with its uncovered log walls that illustrate of the precise craftsmanship and engineering of the Russian trained builders of the Kenai Peninsula. The rectory is typical of the homes of the Russian village gentry and at the time of its construction was clearly a substantial landmark, being the only two -story structure in the community. The icon and artifact collections date from the early 1700's when the first group of Russian missionaries came to Alaska. With the exception of three icons, all were written in Russia and transported to Kenai. The oldest icon, "Our Lady of Kazan," is believed to have been written in the early 1700's and brought to Alaska by the first missionaries in Kodiak Island. It is one of the oldest pieces of non- native art in the state of Alaska. The three icons that are not of Russian origin are rare examples by the native Aleut iconographer Gregori Petukhov who studied under Bishop Veniaminov, Enlightener of the Aleuts and Bishop of Sitka, who later was consecrated St. Innocent. The church attic contains primary resource documents dating from the first resident priest, Igumen Nikolai, as well as from subsequent priests who served the community, including educational materials from the first school in Kenai. The priests' journals and notes represent invaluable historical data that document the Kenaitze way of life beginning in 1844 when Igumen Nikolai became the first resident priest. This property represents a complete historical resource because it has maintained its original, continued use by the community for over 150 years. Title of Project: Stabilization of the Holy Assumption Orthodox Church, a National Historic Landmark in Kenai, Severity of Threat to the Historic Property or Collection The Holy Assumption Orthodox Church contributes to the history of the Russian American occupation of Alaska. Unfortunately, the church is showing clear signs of structural deterioration that threaten its preservation. The north and south walls of the church nave have bowed outward considerably and suggest that the original log members have rotted. Many irreplaceable relics dating from the early Russian settlement are threatened not only by decaying wall logs within the church, but from the risk of fire or theft. There are four primary threats to the Holy Assumption Orthodox Church which are the focus of this project: 1) deteriorated structural wall logs lacking lateral stability, 2) lack of adequate foundation and seismic reinforcing, 3) lack of an accessible ramp at the entry and, 4) absence of fire and theft alarm system. Log Walls On March 27, 2008, a contractor removed exterior siding from the north wall of the church to reveal what lay beneath. Once exposed, it became clear that the original wall logs had deteriorated over time due to moisture infiltration from roof runoff and wind driven rain. Previous attempts to arrest the outward bow were uncovered as were dimensional lumber patches replacing deteriorated wood. Not only are the original wall logs deteriorating, they lack lateral stability. The interlocking nature of log construction corner timbering provides much needed lateral support to resist roof thrust and wind and shear forces. When the bell tower was added sometime before 1910, the original interior log wall, now defining the narthex, was removed; its members cut flush against the north and south walls. Two round columns were installed to carry the load of the missing wall. However, as the exterior walls deteriorated and their structural integrity diminished, the walls began to bow outward. if the wall logs are not stabilized, other components of the structure, including the roof, will be severely compromised. Foundation The existing foundation was constructed during a centennial project in the 1970s. An inspection of the foundation on March 27, 2008, revealed that the concrete block stem wall was settling, cracking and lacked any structural connection to the building. Differential settlement of the perimeter wall and intermittent piers is revealed through sloping floors and cracking sheetrock. Kenai, Alaska, is a Zone 4 seismic area and this church serves an assembly occupancy. The combination of failing wall logs and a discontinuous, unattached foundation pose a serious threat to the inhabitants and the preservation of the building. Accessible Ramp Disabled and elderly members of the Holy Assumption parish have specifically requested an accessible ramp to access the church which is currently entered by way of a covered porch with two steps. The steps do not meet the Americans with Disabilities Act of 1990 (ADA) and limit safe and appropriate access to the church by regular users and visitors alike. Fire and Theft Alarm The Holy Assumption Orthodox Church is the most in tact representative of the Russian Orthodox churches in the State of Alaska. The building and related historic icons dating to 1700 are irreplaceable and are at risk to fire and/ or theft. Currently, the church does not have a fire or theft detection or alarm system which poses a serious threat to this National Historic Landmark. Title of Project: Stabilization of the Holy Assumption Orthodox Church, a National Historic Landmark in Kenai, How Effectively the Project Mitigates the Threat Wall Logs Successfully mitigating the threat to the deteriorated wall logs at both the north and south walls will include epoxy consolidation, Dutchman repairs and in -kind full log replacement. Our objective is to preserve as much original fabric as possible while realizing that some log members have deteriorated beyond repair. The replacement logs will be shaped by hand to replicate the existing tool marks. Efforts to arrest the outward bow will include the use of steel plates, wooden keys and tension cables, none of which will be visible from the interior or exterior. Two windows penetrate both the north and south walls of the nave and the logs abutting the window jambs are not connected structurally other than by the dead load from the roof. As a result, it is necessary to "tie" the logs together so they act in unison to resist the roof thrust and wind and shear forces. Two, 4 "x 3/8" thick steel plates will be set into the logs and through bolted on either side of the log at four locations, two per wall on opposing sides, to effectively "sandwich" the logs together. At the top of the wall, a cable and turnbuckle passing through the attic space will help resist the outward force. The original exterior siding and drywall at the interior will cover the plates. Wood keys, acting as a butterfly, will be set into the wall logs at the window jambs to adequately connect the Iogs where no connection currently exists. Foundation Installing a new foundation will effectively mitigate the building's differential settlement and adequately protect the building during an earthquake. The work under this task will include the removal of the existing concrete masonry unit perimeter wall and hand excavating to the required depth to install a perimeter spread footing. It will be necessary to contract with an archeologist to monitor the digging and a structural engineer to determine the extent to which a perimeter concrete foundation wall or intermittent perimeter concrete piers are capable of carrying the load and shear forces. The sill logs, or in -kind replacements if the original has deteriorated, will be bolted to the foundation. In addition, the log joists will be secured to the concrete foundation with the appropriate seismic connection. The exterior appearance of the foundation will look similar to the existing condition as no change in elevation is anticipated. Accessible Ramp Designing and constructing a ramp that meets the ADA requirements and does not deter from the historic appearance of the church will successfully mitigate this concern. Fire and Theft Alarm The Holy Assumption church does not have an automatic fire protection or detection system nor does it have any security alarm system. The installation of a fire detection and theft alarm system will greatly reduce the potential for losing this irreplaceable National Historic Landmark church or historic icons and artifacts within. Mitigating this threat will include placing heat, smoke and intrusion sensors in appropriate locations including the attic and crawl spaces. This effort will require contracting with a fire suppression engineer to ensure the system is designed appropriately and the sensors are placed as inconspicuously as possible in interior spaces. This system will include an automatic dialer to the local authorities. Water and sewer serve the residence. Pinewood Lane is not developed and access to the property will be from Linwood Lane.. No installation agreement is required. On June 30, 2009, the City received a complaint that a guide business was operating from this location. The complainant advised there were six to seven (6 -7) boats operating daily from this location and that they believed they were renting lodging to clients. On July 1, 2009, a site visit was conducted. There is a residence located at this location as well as a "mother -in -law" cottage. In addition, two camp trailers were located at the site. There were four boats at the location and it appeared parking for at least two additional boats. Two sheds were also on the site. One of them was open and assorted fishing gear was visible. The owner, Reubin Payne, was contacted and advised zoning required a Conditional Use Permit to operate a business in a residential district. An application was left with Mr. Payne. On July 6, 2009, a follow -up meeting was held with Mr. Payne. The process for PZO9 -41 Comments Page 2 obtaining a Conditional Use Permit was explained. Mr. Payne was also informed that short-term rentals (less than 30 days) require zoning permits. The matter of the camp trailers was also discussed and code restrictions on the use were explained. Mr. Payne advised that he does not rent to his clients and that the camp trailers are not used for living quarters in violation of KMC 14.20.254. Mr. Payne has provided a detailed synopsis of his business activity. He did not explain in the information that he has employees (it is unclear how many) who stay at his residence. These employees take the boats to the river for charters and return after the day to clean the boats and prepare for the next day's fishing. It was explained that these employees are self-employed. It is unclear if these individuals pay for room and board. KMC 14.20.150 details the intent and application process for conditional uses. The code also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district. This property is zoned Rural Residential. The intent of the zone is to provide for low density residential development. The specific intent is to preserve the rural, open quality of the environment, prevent health hazards in areas not served by public water and sewer, to prohibit uses which violate the residential character of the environment and to prohibit uses which generate heavy traffic in predominantly residential areas. Guide service is allowed by conditional use in the zone. The number of boats and activity that could result from daily, summer rentals may not be consistent with the intent of the zoning district. 2. The value of the adjoining property and neighborhood will not be significantly impaired. This business has operated from this site for some time. There is no evidence the value of the adjoining property or neighborhood has been impaired. 3. The proposed use is in harmony with the Comprehensive Plan. The Land Use Plan classifies this property as located Rural Residential. This district includes areas that, due to location or site conditions, are best suited for large -lot single-family residential development. Homes in this district typically rely on individual on -site water supply and wastewater disposal systems. Compatible institutional uses such as churches, schools, and daycare facilities may be intermixed if they comply with zoning design guidelines. Small home -based businesses may be accommodated within certain design PZ09 -41 Comments Page 3 guidelines. Guide services are allowed by conditional use. This guide service is described by the applicant as a home based business. However, due to the number of boats and individuals operating from the location, the business does not meet the criteria for a home -based business as described in KMC 14.20.230. Building Official: Not available to comment. RECOMMENDATIONS This is an application for a Conditional Use Permit for a fishing guide service. The application is the result of a complaint from a neighboring property owner. The business has operated from this site for several years and this is the first complaint the City has received regarding the business. Based on the information included in the application, the site visit, and the application interview, this business is clearly not secondary to the residential use at this location; at least during the summer fishing season. Conditional Use Permits are provided for in KMC 14.20.150. Section (a) describes the intent: "It is recognized that there are some uses that may be compatible with designated principal uses in specific zoning districted provided certain conditions are met. The conditional use permit procedure is intended to allow flexibility in the consideration of the impact of the proposed use on surrounding property and the application of controls and safeguards to assure that the proposed use will be compatible with the surroundings." PZO9 -41 Comments Page 4 The proposed permit does not appear to meet the intent of the zone or to comply with the Comprehensive Plan. However, the business has operated from this location for several years without complaint. Now that a complaint has been received, the owner must obtain a Conditional Use Permit or relocate the business. One of the adjoining property owners, Gwen Thomas, of 2545 Watergate Way has provided a letter to the Commission supporting the permit. The other neighbor, Chris Every, who owns 2515 and 2525 Watergate Way, is the complainant in this case. It appears that with restrictions on the use, the business could be allowed to continue to operate from this location. The applicant must understand that violating any other sections of the Kenai Municipal Code including renting lodging or using the recreational vehicles for living or sleeping accommodations in violation of KMC 14.20.254 could result in revocation of the permit (if issued). It is recommended that the Commission approve the permit with the following restrictions: 1. Hours of operation are restricted to the hours of 4 a.m. to 8 p.m. daily. 2. Morning activity is restricted to removing the boats from the site. 3. All boat cleaning must be completed by 8 p.m. 4. No clients may be met at this site. 5. No fish cleaning or processing for the business may be conducted at this location. 6. The number of boats is restricted to the six (6) boats described in the application. The Commission may want to consider requiring screening between the boat parking and the adjacent property owned by Ms. Thomas. These lots are very narrow and the existing natural vegetation is limited. I own and operate a professional fishing guide service for three months of the year and work as a teacher for the Kenai Peninsula School District the other nine months of the year. My wife Mindy is a fishing guide three months each year and a stay at home mom to our two young sons under the age of two. We store our guide and personal use boats on our property at 2535 Watergate Way. Mindy owns two power boats that we use on the Kenai River. I also own two Kenai River power boats. In addition to the Kenai River boats, we own two drift boats that we use to guide the Kasilof River. I am a member of the Kenai River Sportfishing Association, Kenai Professional Guide Association, and Chamber of Commerce and a participant in charitable programs such as Take A Kid Fishing Day, Make A Wish Foundation, Wounded Warriors Foundation, and others. Three years ago I built a small 16 by 20 foot cabin on my property for friends and family to use when visiting. The house in which I live is very small but plenty of room for our young family. I do not rent our cabin. As Alaskans we all know how popular we can become with family and friends from the Lower 48 during the summer months. Like many of the folks in this area I do get visitors that tend to stay for 7 to 14 days and I often offer them the use of my "mother in law cabin (My mother in law spent 5 weeks with us this summer already!) I do offer lodging packages on my website. I began this package pricing two years ago due to the growing request for "package deals I have always and will continue to outsource all lodging. I currently and have historically used Kenai River Raven, Alaskan Sunset Cabins, Alaska Serenity Bed and Breakfast, A Wandering Moose, Caribou Crossing Cabins, Krog's Kamp, Red Fish Lodge and several other locations here in the Central Peninsula for lodging my clients. We wash and hook our boats to the truck each evening before 7 PM. We respect our neighbors and will always make accommodations to meet their needs and desires regarding this conditional use application. I pay property tax to the City of Kenai. I live on the Kenai River, so this tax is not inexpensive. I don't enjoy paying taxes any more than anyone else, however, I see it as a necessary responsibility of a citizen. When I pay property tax, it reminds me that I own property, which is a privilege. I also recognize the fact that my neighbors pay property tax, mortgages and upkeep expenses as well. I will always treat my neighbors the way I would like to be treated and I hope they feel comfortable enough to approach me if ever they have a request or complaint. I truly enjoy living and working in the City of Kenai. We are blessed to be able to make a living in such a beautiful place. If I were forced to purchase or lease a safe and secure location to store my boats away from my home, this would cause me a financial burden. In addition to the financial burden, it would mean that every time we wanted to tie leaders for the next day's fishing, check to make sure the boat was clean and presentable, or any of the other hundred tasks that present themselves regarding boat care and maintenance, instead of walking to our boats as we do currently, we would need to get into our truck and drive through our neighborhood to wherever our boat was stored. Having to drive to a separate location to do these basic tasks would take my wife and me away from our family and cause the additional traffic of us driving through the neighborhood each time we had to leave to "visit" our boats. When we perform these tasks on our property, our children are with us and are learning. I respect the zoning board's desire to keep the City of Kenai safe, reduce heavy traffic in residential areas, and help Kenai's citizens to continue to enjoy a friendly city to live and work.
