The Kenaitze Indian Tribe opposes the granting of a conditionat use permit for
Lot 21 Block 5 for the fol.[owing reasons.
1. Historic Use - The use of this property as a narrow two-story
restaurant with attached rentat units is not in keeping with the'
historicat nature of Otd Town Kenai. The City must recognize and
enforce an atmosphere in OJd Town which is consistent with historic
Kenai. A two-story fast food restaurant btocking visibility is not an
appropriate use of this property. This [ong narrow tat[ structure and
its proposed use wi[t not protect or enhance the historic nature of
this zone. The City must carefutJy regutate at[ construction in order
to preserve the character of the area.
2. Lot Width - The pJat shows that Lot 21 is onty 50 feet wide. The
development requirements table attached to section 14.24.02 shows
that the minimum lot width for devetopment is 60 feet. /he

development of this lot with this narrow structure violates this
provision of the City zoning code. .6 variance or conditional, use
permit must be granted for devetopment, but the City has faired to
property notify adjoining owners that this 50' tot ~s ~ntended to be
devetoped and a variance of w~dth requirements is sought.
3. Parkin~ - The plans provided by the owner do not provide for
sufficient parking. Seven parking spaces are drawn within the ten
foot setback on the west side of the building. It is doubtfut that
there is sufficient room within that setback for parking. £ven if
there is room, onty three addKionat parking spaces are attowed on
the southern end of the buitding along Uptand Street.
The owner claims the restaurant wilt seat 40 people. This means
there must be 8 parking spaces for the restaurant. In addition, there
must be 1 parking space for employees (~/2 per emptoyee) and 2
parking spaces for the residence which wiLL be upstairs. This is a
total of eleven parking spaces. Only 10 are shown on the drawing.
In addition, the owner has indicated that there is some sort of [ivin8
quarters on the ground floor of the north end of the buitding. In that
20'X 30' space the owner has indicated that there are "steeping" and
"bath" quarters. Parking must atso be provided for those areas. /he
owner has not exptained if they are residences or rentats. Assuming
onty ~ parking space is required for each of these areas, a totat of ~ 3
off street parking spaces must be provided. Insufficient parking has
been provided. In addition, the adjoining property owners and the
affected pubUc have not received notice that variance from the CKy's
off street parking requirements may be necessary.
Furthermore, the proposed parking space wiLL not be able to
accommodate vehicles over 10 ft. in I. ength (R¥$) which frequent that
area. Nor is there any space for vehictes to access parking in the ~0'
tength provided once other veh~¢tes have parked.
4. Right of Way Issues - The right of way (Overland Way) separating
the subject property from adjoining landowners is not a devetoped
road. A¢¢ord~ng~ to the drawing provided by the owner, parking
spaces and access to the back of the buitding woutd have to occur

from Overtand Way which is just a trait. This is an inappropriate and
poor design feature. Untess the £ity devetops Overtand Way this use
of what is essentiatty just a dirt trait shoutd not be permitted.
6. Wheelchair and Handicapped Access - The entrance to the
restaurant must have wheetchair access and handicapped parking as
weft. None of that space is drawn in the ptans.
7. ..Notice - Not onty.is it incumbent upon the City to adhere to the
zoning code, but before proceeding, the City must require that the
owner property identify at[ uses of the bui['ding including residential
or townhouse rentals. Currently there is insufficient detail on the
issue of the "rental units" for the City to proceed with the permit.
Apparent[y, no one knows exactly what these units are to be used
for.
To the extent that in this historic area, adjoining property owners
and the pubtic are affected by the addition of rental units, a fast
food restaurant and a dwelling at[ contained in a narrow two-story
structure with insufficient off-street parking, adequate notice of att
the features of this property must be given so that the concerns of
those affected can be heard.
In conclusion, we request that the City Planning and Zoning Commission deny
this appUcation for conditional, use permit or a[ternativel, y provide additiona[
not~¢e and the opportunity to be heard by those affected by this proposed
devetopment.

My name is Alexandra "Sasha" Lindgren, I am a Kenaitze Tribal member and the
Director of the Tribe's Cultttral and Educational Department. I have worked for the
Tribe for 13 years, during this time it has been my pleasure to work with the City of
Kenai on projects directly impacting the City's Historical District, these included drafting
verbage for the signage at Shk'ituk't, and a preliminary draft for enscription on the
monument at the Eric Hanson Memorial Park. In 1995, Michael Huhndorf was employed
by the Tribe and researched and drafted the signage and preliminary brochure for the
Historic District walking tour. In addition, Michael represented the Tribe on the Historic
Board. These projects required a major commitment of tribal staff time and resources.
The results enhance the historic character of Old Towne and give visitors an oppommity
to experience and appreciate our collective history. The proposed restaurant structure
will not. I hope the City of Kenai will stand by the commitment it made years ago to
preserve the flavor and history of Old Tome.

· This was an application for a 6 foot encroachment permit for an
existing structure.
· The structure was on the land when the Roneys purchased the property.
· The structure was built without a building permit.
· The staff recommended approval.
Chairman Hammelman opened the public hearing.

following:
· She is one of the owners of the property in question.
· The owners would like to improve the structure but have not been able to
because it is illegal.

Discussion followed and comments included:
· This proposal pertains to anywhere it is zoned Conservation.
· Food vendors need an itinerant merchant license (Clerk's correction,
should be Mobile Food Vendor's License) and a DEC permit.
· The purpose of the change is for public need.
· The city could bid for only one vendor.
· Vendors need to be managed well.
· Vendor would need permission from the City to sell on Conservation
lands owned by the City.
· The resolution refers to seasonal vendors.

Discussion and Recommendation -- Land Trade for Boating Facility
Exit Road.
Kebschull and Kornelis noted the following:
· The City has been seeking land for a boating facility exit road.
· The Conservation Fund is interested in trading land.
· An updated appraisal has been done on the properties.
· The Conservation Fund is proposing they trade their land plus $10,000
for the City's parcel 7.
· The Conservation Fund would like to purchase parcels 1,2,4,5 and 6 for
cash.
· The Conservation Fund is a legitimate organization not a development
corporation in disguise.
· The Harbor Commission supports the trade and the sale.
Discussion followed and comments included: · The city should make the trade.
· The panhandle of Parcel 2 is developable.
· It is in the city's best interest to retain the panhandle.
· The parcels other than Parcel 7 could be used for bargaining.
· City staff was surprised to receive the purchase offer.
· There may not be an offer to buy wetlands in the future.
· Favor retaining panhandle of Parcel 2.

Commissioner Amen MOVED the Planning & Zoning Commission recommend to the
Kenai City Council the City swap Parcel 7 for The Conservation Fund lands
plus $10,000. Commissioner Eldridge SECONDED the motion.

· Letters serve as a "heads up" to whole neighborhoods.
· Actual citations go to court.
· The Code Enforcement Officer is also a Seasonal Officer.

WHEREAS, the attached plat Enders Subdivision was referred to the City of Kenai
Planning and Zoning Commission on July 8, 2005 and received from Integrity Surveys.
WHEREAS, the City of Kenai Planning and Zoning Commission finds:
1. Plat area is zoned RR- Rural Residential and therefore subject to said zone
conditions.
2. Water and sewer: are available
3. Plat does not subdivide property within a public improvement district subject to
special assessments. There is not a delinquency amount owed to the City of Kenai for

A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI, ALASKA RECOMMENDING TO THE COUNCIL THAT THE LAND USE TABLE
IN KMC 14.22.010 BE AMENDED TO ADD A FOOTNOTE TO THE CONSERVATION
ZONE LAND USE TABLE TO ALLOW SEASONAL AND TEMPORARY FOOD SERVICE
AS AN ALLOWED USE.
WHEREAS, a portion of the land in the Conservation Zone is used for out-door recreation; and
WHEREAS, currently food sales are not an allowed use in the Conservation Zone; and
WHEREAS, allowing food sale on a seasonal or temporary basis in the Conservation Zone
would allow an important service to be provided to citizens utilizing the Conservation Zone for
out-door recreation while not detracting from the purposes of the Conservation Zone.
NOW, THEREFORE, THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI, ALASKA recommends that the Land Use Table in KMC 14.22.010 be amended as
shown in Attachment A.

KENAI, ALASKA, RECOMMENDING TO THE COUNCIL AN AMENDMENT TO THE
~NAI ZONING CODE LAND USE TABLE IN KMC 14.22.010 TO ALLOW RETAIL
BUSINESSES SUCH AS GIFT SHOPS AND COFFEE SHOPS IN THE EDUCATION ZONE
AS A SECONDARY USE.
WHEREAS, land uses allowed in the Education Zone such a schools, museums, parks and
recreation, and governmental buildings often have retail operations in them such as gift shops
and food services; and
WHEREAS, such secondary uses are traditionally associated with such buildings and would not
detract from the purposes of the Education Zone; and
WHEREAS, it is in the best interest of the City of Kenai to amend the land use table in KMC
14.22.010 to allOw retail business in the Education Zone as a secondary use subject to the
limitations in Footnote 24 which allows such businesses as coffee shops and gift shops within
other allowed uses.
NOW, THEREFORE, THE PLANNING AND ZONING COMMISSION OF THE CITY OF
KENAI, ALASKA recommends that the Land Use Table in KMC 14.22.010 be amended as
shown in Attachment A.

General Information:
KMC 14.20.150 details the intent and application process for conditional uses.
The code also specifies the review criteria that must be satisfied prior to issuing the
permit. The criteria are:
1. The use is consistent with the purpose of this chapter and the purposes and
intent of the zoning district;
2. The value of the adjoining property and neighborhood will not be significantly
impaired;
3. The proposed use is in harmony with the Comprehensive Plan;
4. Public services and facilities are adequate to serve the proposed use;
5. The proposed use will not be harmful to the public safety, health or welfare;
6. Any and all specific conditions deemed necessary by the commission to fulfill
the above-mentioned conditions should be met by the applicant. These may
include, but are not limited to measures relative to access, screening, site
development, building design, operation of the use and other similar aspects
related to the proposed use.

Applicant is proposing to construct a two-story building at this location to house a
restaurant on the ground level. In additiOn, the rear of the building would have two guest
rooms with separate bathroom facilities. The top story would be an apartment.
Restaurants require a Conditional Use Permit in the Townsite Historic District. Lodges
and Single Family Dwellings are permitted uses in the zone.
Applicant has provided a tentative layout for the development. The building is proposed
to be 30 feet wide and 71 feet long. The plan provided shows the building will meet all
required setbacks. Ten tentative parking spaces are shown. Based on the 40 seats, 8
parking spaces would be required for the restaurant (1 for every 5 seats). In addition,
one-half space per employee would be required for an additional space. The residence
apartment would require two additional spaces. A total of 11 spaces would be required
for the restaurant and apartment. If the lodging were rented, additional spaces would be
required. If approved, prior to the building permit being issued, a landscape/Site plan
would be required to insure the development meets the requirements for off-street
parking.
The restaurant portion of the bottom floor is proposed to be 50 feet by 30 feet with
seating for approximately 40. Applicant explained that they believe the business would
be more of an ice cream or snack type restaurant and plan to market to tourists visiting the
Old Town area.
To approve the conditional use, the Commission must determine the following'
The use is consistent with the purpose of this chapter and the purposes
and intent of the zoning district.
The intent of the zone is, "The TSH Zoning District is intended to provide
for a mixed, controlled use in a designated area, which will protect and
enhance the historic character of the zone. The goal of the TSH zone is to
manage all new development, reconstruction and alterations within the
zone." The proposed restaurant/apartment is a mixed use. If the permit is
approved, the Commission, acting as the Historic District Board, must
approve the proposed construction plans. At that time, the development
would be required to meet the historic character of the zone.
The value of the adjoining property and neighborhood will not be
significantly impaired
The proposed development should not impair the value of the adjoining
property.
The proposed use is in harmony with the Comprehensive Plan.
The Comprehensive Plan identifies the Townsite Historic Zone in the
Land Use Plan as Mixed Use. Mixed Use is defined as, "The Mixed Use
district fosters a compatible mix of retail, service, office, public,
institutional recreational and multi-family residential uses. The district
does not prescribe specific proportions for these uses, only that all these

uses are desirable within the district. Mixed uses are particularly desirable
in the Townsite Historic District and City Center overlay zone."
Public services and facilities are adequate to serve the proposed use.
Water and sewer are available to the parcel. The City has sufficient fire,
police, and street maintenance departments to provide services to the
proposed development.
The proposed use will not be harmful to the public safety, health or
welfare.

RECOMMENDATIONS
The application for the proposed restaurant appears to meet the criteria for a Conditional
Use Permit. The parcel is located in the Townsite Historic Zone, an area that fosters a
mix of commercial and residential uses. If the permit is approved, the development will
be reviewed under the criteria listed in KMC 14.20.105.

The proposed rezone meets the requirements of KMC 14.20.270. The
parcel is 1.03 acres and enlarges an adjacent boundary.
The prOperty is currently zoned rural residential. The intent of the rural
residential zone is, "The RR Zone is intended to provide for Iow density
residential development in outlying and rural areas in a form which creates a
stable and attractive residential environment."
The proposed zoning is general commercial. The intent of the general
commercial zone is, "The CG Zone is established to provide for areas where
a broad range of retail, wholesale, and service establishments is desirable.
Uses are regulated to concentrate commercial development to the greatest
extent possible and to prevent any uses which would have an adverse effect
upon nearby properties. New single and two-family residential uses and other
noncommercial uses, except as otherwise provided in this chapter, are not
permitted in this zone as principal uses because it is intended that land
classified in this zone be reserved for commercial purposes, and because a
commercial zone is not suited to the uses excluded above."
This parcel is designated in the Comprehensive Plan as Rural Residential.
The Comprehensive Plan defines the Rural Residential Land Use as, "The
Rural Residential district includes areas that, due to location or site
conditions, are best suited for large-lot single-family residential development.
Homes in this district typically rely on individual on-site water supply and
wastewater disposal systems. Compatible institutional uses such as
churches, schools, and daycare facilities may be intermixed if they comply
with zoning design guidelines. Small home-based businesses may be
accommodated within certain design guidelines."
The applicant is requesting this rezone to allow for a car lot and auto shop
repair business.-. The proposed uses are permitted in the General Commercial
zone. The rezone would create a non-conforming use with the residence
located on this parcel. The City Attorney has determined that a rezone is
allowable and that the non-conforming use could continue but could not be
enlarged or expanded.
The Comprehensive Plan notes that there is, "an issue of neighborhood
concern as result of commercial development near residential areas as
conditional uses or through rezones, particularly along the Kenai Spur
Highway. One of the goals of zoning is to achieve stable, livable residential
neighborhoods by separating them from incompatible uses." The Plan also
recommends, "Promote adaptive reuse of vacant commercial buildings in the
city center and along the Kenai Spur Highway." The requested rezone would
enlarge a neighboring commercial use. A rezone will result in commercial

zone abutting a residential zone but that situation now exists with the
existing zoning pattern. Commercially zoned property requires landscaping
and site plans. Updating landscaping/buffering requirements as
recommended in the Comprehensive Plan would help insure adequate
separation of uses.

No building code issues. However, issuance of building permits for the
residential structure will be limited to remodeling the interior only.
RECOMMENDATIONS
The proposed rezone meets the requirements of the Kenai Municipal Code.
The rezone will enlarge an adjacent boundary. The parcel fronts Kenai Spur
Highway and is accessed from the highway. The rezone will create a non-
conforming residential use. The residential use will be allowed to continue
but may not be expanded.
