Existing Zoning: Suburban Residential (RS) Current Land Use: Medium Density Residential (4-plex) Action Requested: Approval of Encroachment Permit nrcrttceTnu. Lots 50, 51, and 52 began as one large project with shared carports for the units. The structures on Lot 52 face S. Forest Drive with the second carport for that unit on the rear of the lot and is encroaching on Lot 51. Preliminary Plat PZ89-12 for Replat of Redoubt Terrace S/D realigned the lot line, however, the Encroachment Permit is still necessary as the structure sits within the allowed 3' of the lot line. Resolution PZ89-11 Amended Page 2 All three lots are currently in the hands of Housing & Urban Development and it is assumed that their intention is to clear up all encroachments in order to resell the lots individually. A letter from Mr. Michael M. Hamrick, owner of Lot 49, addressed concerns about encroachments onto his lot. As a result of contact with a representative of H.U.D., the lot was surveyed and the following are the results: 1) Building setback for structure over one story - 15'. According to the as-built survey, the building on lot 50 is 5' or less on both sides. 2) The carport, which is an accessory structure, has been surveyed to be between 3.1' and 2.9', from the property line. The surveyor was asked to check the overhanging eaves specifically, and he reports that those footages include the overhanging eaves. Locating the correct property lines may be an answer for Mr. Hamrick. It will be the task of the Commission to determine the eligibility of the structures on the lot for the Permit. ' 3) Utility corridors are outside the purview of the City. Unless property is subdivided with a utility easement, this is something that would have to be addressed by the individual utility companies. 4) The City of Kenai does not enforce covenants, however, I have included them with the letter for your information. 5} Mr. Hamrick would like the problems corrected. It would appear that the only problem the City could correct is number 2), however the survey has indicated that the carport is very near the required setback footage. Number 1) would entail removing the building or removing a portion of the building. There are actually five encroachments surrounding Lot 51: 1) West lot line - building sits 4.5' from the lot line and is a two story building. 2) West lot line - the carport lies across a lot line (KMC 14.20.200 (2), (3), and (4)). 3) East lot line - the carport from lot 52 extends over the lot line. The realignment puts the carport at 3 tenths of afoot from the new lot line. 4) East lot line - the building lies 3.4 feet from the new lot line. 5) East lot line - the carport lies across a lot line. NOTE: PZ89-12: Replat of Lots 51 & 52, Block 1, Redoubt Terrace S/D moves the lot line between the two lots, thus removing a portion of the encroachment on the west lot line (2). Resolution PZ89-11 Amended Page 3 Lot 52 shows that the gravel driveway extends into the adjacent property, and the building setback is less than 25' at the northern lot line. The permit should include this staff comment sheet which references all encroachments to be covered under this permit. The approval of the resolution and permit will allow the property and all structures on the property to be sold to private individuals or firms. jal ` Michael M. Hamrick P.O. Loper Planning Specialist City of Kenai Kenai, Alaska 99611 Ms. Loper, This letter is written in acknowledgement of, and in reference to an article of notification you sent me which served ~o inform me of official public hearing dates set to review and amended petition for an Encroachment Permit at 1502 Fathom Drive on Lots 51 & 52 Redoubt Terrace Subdivision. I am the owner of record for Lot 49 and consequently am directly affected by any utilization of Lots 51 & 52, as well as Lot 50, which at present isn't addres- sed by the petition you are concerned with. At the present time, I feel the City of Kenai should delay any decisions on an Encroachment Permit, until such time as a review of Lot 50 can be completed, as similar problems exist with all three of the premises. Until this notification I was unaware that the property owners of Lots 50, 51 & 52 had not obtained a variance prior to construction and my unhappiness at the encroachment on my own property has increased significantly with the know- ledge now that it was done so illegally. To be more specific about violations, I believe hat according to code a multi story structure must be 15 feet from lot lines These re set back ap- proximately 4} to 5 feet. This is the main 4-plex structure.~The carport on Lot 50 is even closer to my property line and the roof may even overhand my pro- perty.~ Between Lot 50 and my own Lot 49, is a utility corridor which contains natural gas, electric and telephone buried lines. The carport on Lot 50 is such that five to 6 feet of the telephone cable has now been exposed and is lying on top of the ground within the carport. Upon complaining to the manager of these 4-plexes some two years ago, I was told that it was "only telephone cable and didn't hurt anything". Since my receipt of your letter and our subsequent conversation I have ob- tained and reviewed a copy of the covenants for Redoubt Subdivision. These -`~ covenants in the Kenai Recording District Serial ~P67-1285 and Recorded in Book K 26 beginning on page 12 then continuing for the next several pages are duly re- corded and legal. Whether the City of Kenai decides to grant an encroachment permit or not, these properties are still in violation of the legal covenants of the subdivision. Janet A. Loper City of Kenai September 8, 1989 Page -2- In view of several problems exisiting at all three properties coming to light and seemingly in deliberate violation of our, zoning laws, merely for ..// speculation purposes, I personally feel the owners should correct the problem at their own expense and no variance or encroachment permit be issued AFTER THE FACT. At the very least, I would expect the City of Kenai to delay the finding on one property before the process is repeated again for the other two pro- perties and the same steps repeated at added expense to the city. GRE'AS;, through previ©us contacts with the public over the years concerning seTaeral matters regarding diverse uses of property, and 6'~~A~, t1!nrough these previous contacts, have identified a need fora zone which aridresses the unique topographical category of some lands within the City, and 'kTHEREAS,, the Planning & Zoning Commission feels that it is in the best interest ®f the City, both private and public property owners to have this new zoning designation, 'iB~REAB, the Planning & Zoning Commission has held a public hearing on the propcased amendment on October 25, 1989 and as a result of this public hearing, recommend the Kenai City Council make the appropriate amendments to the Kenai Municipal Zoning Code. NOS, '~'HEFORE BE IT RESOLVED, by the Planning & Zoning Commission of the City of Kenai, Alaska that it is hereby recommended to the Kenai City Council, that the appropriate ordinance be drafted which would amend the Kenai Municipal Code to include the new zoning designation, 14.20.145, "Recreation (R) Zone as described in Attachment A. Chairman AT~"ES'T' Planning Secretary Di2AF'T 14.20.145 Recreation Zone (R): (a) Intent: The Recreation Zone (R) is intended to contain both public and private lands to be utilized for recreation and residential purposes. Lands designated for this district should be evaluated for long term public benefits to accrue from the protection offered by this designation. (b) Permitted Principal Uses and Structures. (1) Ball fields; (2) Exercise trails and facilities; (3) Parks and playgrounds; (4) Picnic facilities; (5) Recreation facilities, shelters, bathhouses; (6) Recreation cabins; (7) Single-family and duplex residences; (8) Trails; (9) Visual corridors and viewpoints; (10) Watersheds. ' (c) Permitted Accessory Uses and Structures. (1) Boardwalks; (2) Parking - not to include large trucks or trailer vans; (3) Essential services (as defined in 14.20.320 (28); (4) Watchman or caretaker dwelling. (d) Conditional Uses and Structures. (1) Boat harbors, docks, wharfs, launching ramps; (2) Bunkhouses, bed & breakfasts, hunting & fishing lodges; (3) Fuel facilities for river boat traffic; (4) Convenience or grocery outlets; (5) Marinas, including boat rentals; (6) Aquaculture; (7) Charter or guiding services; (8) RV parks; (9) Multi-family units; (10) Hotels; (11) Restaurants. (e) Prohibited Uses and Structures. Any use or structure not of a character indicated under permitted principal use or conditional use shall be prohibited. (f) Minimum Lot Requirements. Shall follow the requirements for the Rural Residential (RR) Zone including the 100' setback from slopes, bluffs, or banks as described in the Comprehensive Plan, Coastal Zone Management Plan, and Kenai River Special Management Area Plan. (g) Required Off-Street Parking and Loading. Adequate off-street parking and loading shall be provided in connection with any permitted use in accordance with the provisions of KMC 14.20.250. Preliminary Plat PZ89-12: Replat Lots 51 & 52, Block 1, Redoubt Terrace S/D Planning Specialist Loper explained that the minutes of the last meeting revealed that no main motion had been made approving the plat. There were several amendments, however. Discussion followed regarding the staff comments on the plat since the plat and encroachment permit were no longer accompanying each other. Commissioner Walker felt that the last part of the statement presupposes that the permit will be approved. Planning Specialist Loper explained that the Borough will have no problem with the plat. That the encroachment is a City problem only in that we have zoning and the plat corrects, to an extent, a zoning problem. Even though the lot line is moved, there still is an encroachment. MOTION: Commissioner Bannock moved approval of PZ89-12 in the original form, seconded by Commissioner Glick Commissioner Walker indicated that he still felt uncomfortable with the wording of the staff comments. MOTION AMENDMENT: Commissioner Walker moved to amend by striking the phrase, "clears the title", seconded by Commissioner Glick. The Commission discussed the time frame for approval of the plat. It was pointed out that, as a plat it meets Borough standards and would probably be approved regardless of whether or not the Commission commented. Commissioner Bannock asked why the plat was needed, answer because the lot line ran through the building. However, even moving the lot line, the building still lies well within the setback. At one time the idea yeas to require surveying at the time of construction. Councilman Smalley stated that the initial fee for the permit was set at $500 which would have been the cost of surveying, however, due to strong opposition by contractors, the fee was dropped to the current $100. At one time a fine vas considered, all the way to $500, however, Council rejected the idea and the encroachment permit was created with the $100 fee which pays for th.e advertising costs. b. Preliminary Plat PZ89-15: MaQUire S/D Planning Specialist Loper explained that this plat comes at the request of Council. While the Commission had requested a plat, the only one submitted had been a computerized plat. The Council request was more :specific and the owner complied. The engineers comments were discussed. My wife and I have a small enterprise which we run out of our home. We make ceramic objects to sell to Gift Stores. We cast these pieces using molds in our basement, paint them on the. Kitchen table, and fire them in a kiln in our back room. We have 31 molds, 3 of which are palm sized, 5 about 6"x 6"x 6", 16 about 6"x 6"x 9" and one of them 4"x 12"x 16". These molds sit on top of the pouring table in the basement. The liquid clay which we use is mixed in a machine resembling a clothes washer, which sets under the pouring table. The clay is poured into the molds and allowed to build up on their inner surfaces, after which the remaining clay is poured out into the mixer. Thus there is no clay being washed down the drains, nor any extra water use, as a mixer full of clay takes about 10 gallons of water and generally lasts one to three months. The clay built up in the mold dries for several hours until firm enough to remove, and is then dried for several days. When dry it is painted, then fired, then repainted and refired. At this point it is finished. We wrap the finished pieces and put them into boxes for the different stores. We then either mail them from the Post Office or deliver them ourselves. Most of our materials to run the business arrive by mail or are purchased locally, however we do receive one or two freight shipment every year. These are in the form of 50 lb. bags of dry clay, 5 gallon pails and l gallon jugs of ceramic paint or "glaze". All of these take up only the space under my worktable in the basement. 2nd page Our current floor usage is diagramed on Plan "A". However we would like to move the ceramics into the "addition" in order to free the kitchen table and other areas of the house for their intended uses. In this case, see Plan "B", the space needed would amount to a little more than half of the room, about 11 to 12% of the floorspace of the house. Although we keep fairly busy in the summer and Christmas seasons, we do not store any ceramics and the materials and equipment are quite compact so the business occupies a fairly small percentage of our floorspace. Paula does most of the work although I help out during the busiest times after I get home from my job. We have no employees although the children helped out this summer. We are hoping that moving the ceramics ~o a more efficient arrangement in the new room will allow me the time to add new designs to our line. This would allow us to increase our volume enough to support the move to a suitable commercial location in Kenai, something which we currently cannot afford. Responding to comments regarding the article, the City sent a letter to Mr. Carlyle pointing out that businesses are not allowed in residential neighborhoods without either a conditional use permit or a home occupation permit depending upon the business (Attachment A). Home Occupation - "Carlyle Designs" Page 2 Several discussions between Mrs. Wright of the Finance Department, Mr. Carlyle and me followed regarding both zoning codes and water & sewer charges. Mr. Carlyle applied for and obtained a building permit and since the newspaper article discussed an addition for his business, a second letter was sent (Attachment B) with a little stronger language. Mr. Carlyle responded (Attachment C) and further discussions were held in which the end result is the attached application for a Home Occupation Permit. At this point it will be the decision of the Commission to determine if this is the appropriate vehicle for Mr. Carlyle to continue his business in his home and if not, what the appropriate steps would be. KMC 21.10.030 (5) states the intended use must comply with the zoning ordinance and comprehensive plan of the City. Both parties have submitted the appropriate goad faith deposit and filing fee. Both applicants are expected to be at the October 25 meeting should you have any questions. For your information I have done a synopsis of the events leading to this point: October, 1985 City sold property to the lessee July, 1988 City repossessed the property and building July, 1988 Original bid date for requests for proposals - this was postponed because of legal ramifications March, 1989 New bid date, Ischi's were the only bidder April 5, 1989 Council voted unanimously to award lease to Ischi's April 7, 1989 Ischi protested a clause in the lease April 24, 1989 At a Special Council Meeting, Ischi verbally represented he did not wish to proceed with the lease April 28, 1989 Ischi requested to lease if option was still open May 3, 1989 Council Meeting - Council voted whether Ischis' be granted a contract by the City pursuant to the agreement passed with amendment? Tie vote - failed. Minutes of these meetings are available if you wish to review them. No further action was taken by the Council. Therefore, the property was available for lease or sale. Val Ischi submitted a proposal to lease the property on behalf of herself and her husband Pete on October 5, 1989. She was told the City was accepting applications and that the proposal would be sent to the Legal Department for review. She was told that she might need to submit an application on a City form. The City accepted her good faith deposit of $2,000.00 and 520.00 filing fee. I have attached my letter to Mr. and Mrs. Ischi dated October 10 for your information. QBP, Inc. submitted an application on October 9, 1989. The Legal Department determined that provided Mr. & Ms. Ischi complete a City lease application form and comply with any additional requests by the Planning and Zoning Commission their application would be considered "first". The Ischi's submitted an application on October 19, 1989. KMC 21.10.060 states the Commission "shall normally consider applications for specific lands on a first-come, first-serve basis if the Commission finds that the application is complete and the use proposed in the application is the highest and best use and conforms to the Airport Master Plan and other goals set by the Commission or the City Council". KMC 21.10.060 (d) states "Where there are two or more applications for the same airport lands for different uses, then if the Advisory Planning & Zoning Commission makes a finding that a subsequent application would result in use of the lands for a higher and better purpose with a greater benefit to the City of Kenai and the citizens thereof, then the lease will be issued to such applicant ". I spoke with Ms. Ischi at that time and told her that the City was accepting lease applications for the property. I told her that I would give the proposal to the Legal Department for their review. Today I received a memorandum from the Acting City Attorney on this subject. I have restated his opinions as they relate to your proposal. • It the attorney's recommendation that you should submit an application on the form provided by the City with an attached development plan. Ms. Ischi picked up an application, Title 21 of the Kenai Municipal Code, a sample lease and an expired appraisal on October 3. You have met the requirement of providing a filing fee and good _~.~ ~ faith deposit. The lease application for airport lands and the development plan __ is sent to the Planning and Zoning Commission for approval or ., rejection. If the Planning and Zoning Commission approves the application, it is sent to the Council for its approval or rejection. If the Planning and Zoning Commission rejects the application, the applicant may appeal to the Council. (KMC 21.10.060). Pursuant to KMC 21.10.100 and Resolution No. 89-37, the minimum annual rental for leased airport lands shall be six percent (6~) of the appraised market value. Thus, the minimum rental of the property must be six percent (6~) of the new appraisal. Your proposal for redetermination of the lease rate after the first five years of the lease period is in accordance with RMC 21.15.040 and KMC 21.10.130. {'~ a .~ I Regarding the appraisal cost, RMC 21.10.35(c) determines whether the applicant or City shall be responsible for paying for the appraisal. It is the attorney's opinion that "to the extent the Ischi's proposal is inconsistent with that provision, it is unacceptable". I have a written proposal from Mr. Schaafsma, of Frykholm and Schaafsma Appraisals, indicating that a Letter of Opinion can be done for $950.00. The City Manager has acknowledged that a Letter of Opinion will be sufficient to determine the fair market value. Your proposal requests an option,. to purchase at any time during the ten-year lease period. RMC.22.030 allows the City to sell certain property by negotiated sale, provided the purchase price is not less than fair market value. KMC 22.050.045 provides that the City may finance the purchase of land from it. The purchaser must pay at least 15~ down and the note may not run for longer than 20 years, unless the Council approves a longer term for that specific piece of land. The rate of interest is set by the City by resolution and is currently 10~. RMC 21.15.050 states that Council may provide for subleasing without prior approval, provided that any such subleases shall be subject to all terms and conditions of the original lease. Thus, the decision whether or not to grant the lessees such a right is a policy decision to be made by the Council. The option to allow the lessees to terminate the lease upon b0 days written notice is not prohibited by the Code. Therefore, it is a policy decision to be made by Council. ALASKA 99510 703d October 9, 1989 Call for Comments Proposed State of Alaska Oil and Gas Lease Sales for 1994 The Alaska Department of Natural Resources, Division of Oil and Gas, is requesting coin~nents on the following sales which are proposed for addition to the state's Five-Year Oil and Gas Leasing Program. Three sales aze proposed to be held in 1994: Sale 78, Cook Inlet Sale 79, Yakataga Sale 80, Shaviovik. Adding these proposed sales to the Five-Year Oil and Gas Leasing Program does not mean that the sales will automatically be held. This call for comments is the first step in a lengthy planning and review process that may or may not result in conducting these proposed oil and gas lease sales. The preparation of the Five-Year Oil and Gas Leasing Program, in which sale azeas are ident~ed five yeazs before the proposed sale dates, allows local governments, state and federal agencies, the public, and the petroleum industry ample opportunity to study each proposed area and to plan for potential effects if the sale should occur. The azeas described and depicted here aze very general. In many cases, the actual areas that finally may be offered for leasing will be smaller than what is shown. The proposed sale area's land status will be analyzed approximately six to eight months prior to each lease sale, and only these lands belonging to the state will be offered for lease. in those areas involving coastal waters, state ownerships extends seawazd to the three mile limit. There may be environmentally sensitive lands within these proposed sale azeas. These lands will be identified later in the leasing process, and special protective measures may be required if oil and gas leasing takes place on these lands. Additional opportunities for comment will occur at several intervals during the leasing process. These opportunities include two calls for comments issued about 36 and 18 months prior to the sale. In addition, about five months before each sale, a request for comments on the director's preliminary finding is made. If the proposed sale is in the state's coastal zone, an analysis of the sale's consistency with the the Alaska Coastal Management Program is included in the preliminary finding. In commenting on these proposed sales, please be as specific as possible. The Department of Natural Resources is interested in learning about areas you believe should or should not be leased for oil and gas exploration and development and potential mitigation measures to protect the enviromnent. The proposed sale azea consists of approximately 600,000 acres located in the lower Susitna Valley, the Anchorage bowl, the Kenai Peninsula, western Cook Inlet uplands, and offshore lands. Other Cook Inlet lands available for lease may be offered in proposed Sale 78. Proposed Sale 79 Cape Yakataga,~~y 1994 Proposed Sale 79 will include approximately 350,000 acres of state-owned onshore and offshore lands between Cape Suckling and Icy Bay. The proposed sale azea is bordered on the south by a proposed federal outer continental shelf oil and gas lease sale (Gulf of Alaska Sale 114, proposed for 1991). At this point it looks as if the Public Works Department is going to recommend working with Chester Cone to locate this facility on his property. Attached you will find Exhibit A1, which is a Quitclaim D d ee to Cunningham Park, and Item 2 in that Deed is one of the conditions subject t o the gift. Janet Loper has gone one step further and checked with Parks and Outdoor Recreation and Fish and Game regarding access to the river from the Loftstedt property identified as Exhibit A3, and received a verbal and strong support for developing that ten acres in a fashion that has already been described in this memorandum. C From a visual observation of the ten acre site, it appears to be heavily wooded, 98~ outside of the wetlands description, and an ideal location for what it appears Council is looking for in order to provide additional municipal access to the Kenai River. I talked to Paul Krasnoski, Fish & Game, Anch. We looked for lands to utilize. We are serving the public, there is no public access on the river for 21 miles. Our City ramp is at the mouth of the river, it is for commercial fishing. The exception is during the dip net fishery. We have had problems with people trying to develop commercial enterprises in residential zones. Anglers Acres, Beaver Creek are controversial. We have been pushing tourism and the Bicentennial. We had no motor home parks, we have 3 now, one on Beaver Creek. We need river access. Cunningham Pk. is expensive and not good for boat launching, the neighborS,.object. The City owns 2,100 acres in the area. We may be able to trade. Public Works Director Kornelis. The alternatives are: Cunningham Pk. with the Doyle property for parking, the area below Cone's property (we think this is the best). The City owns land, Mr. Cone owns the right-of-way. We could buy or trade for City land. Mayor Williams. It would be a boat launch and parking area, boat berths, concessioner. There would be no overnight parking. Norval Netsch, AK F&G :. What is the current? Mr. Kornelis. Not bad, it is almost dead at low tide. It is a 2-way current. It is 7 miles from Cunningham Pk. to our dock. Mayor Williams. The greatest amount of fishing is from Eagle Rock to the bluffs. . Mr. Netsch. Dingall/Johnson Act is restricted to benefit to sports fishing. ~~ Mr. Kornelis. We are not ready for profit businesses, would that make a difference? Mr. Donek. We would want to know the private boat launches on the river. Where are they and how do they feel? Mayor Williams. The Corps. of Engineers will ask if the City has an alternative that is not wetlands. Mayor Williams. The City owns 2,100 acres, most is wetlands. Mr. Kornelis. We have looked at alternatives. There are access problems, some people are not willing to sell. Mr. Netsch. Maintenance is a concern. There should be a provision for City responsibility. Mayor Williams. _ We would have a cooperative agreement. We would expect to maintain. Mr. Donek. The Feds require a guarantee that funds will be used as stated. They will fund, the City will guarantee use for 20 years. You could renew, but you do not turn over ownership. If the City uses the land for a match, the City would have to dedicate use but would retain ownership. Improvements and the cost of building an access road could be used for match. We are better at getting grants from the State for match. Mr. Netsch. The match would be in our access budget. Mayor Williams. We would be better utilizing City lands for a match . Mr. Donek. The land would have to be appraised. Mr. Kornelis. Could Federal money be used for the access road? Mr. Donek. They would prefer not. Harbor Commission Chairman Eldridge. Could the project be phased? Mr. Netsch replied yes. Mr. Donek. But each year we would have to go to the Legislature. Mayor Williams. We could use income from the dock. Mr. Donek. The Feds do not like launch fees. Mr. Netsch. If there are fees they should go back into the .~ dock, maintenance or improvements. Mayor Williams. We will have to: a) get costs of the - program, b) exchange land, c) talk to the Feds. What ._•..~~ is the time frame for the 1991 budget? Mr. Netsch. -~' ~ Next Tuesday (8-15-89). We do not have to have.a final ' figure. Mayor Williams. If there is a problem, can we ' move forward? Mr. Donek replied yes. Mr. Netsch. It is getting tighter on plans. Mayor Williams. Engineer LaShot will get the preliminary figure by 8-15, for the ramp and the / parking lot. Mr. Donek. AbiL members will be at a Sept. 19~meeting at the Borough (regarding the Borough pulling out of AML). All who feel strongly are urged to attend. It will increase our dues by $5,000 if they pull out. We will urge continuing membership. e. I met with Sen. Stevens regarding Federal and State legislation on the oil spills. Some laws are not conducive to Cook Inlet. There is considerable difference between House and Senate legislation. It could affect Cook Inlet commerce. f. The Fire Training grounds proposal. 16 agencies have been notified regarding our intentions. It will probably occur next Spring. g. The helicopter recovery school funding will be in the Senate on Sept. 11. I am preparing additional information. We may have positive news by the end of the month. It would be about S5 Million. I have enlisted the services of others to ensure we ._..~„ receive it. h. The City proposal for the boat facility. Public Works Director Kornelis is arranging a meeting to discuss the location. It will develop tourism. We anticipate the location behind Beaver Loop Mortuary. we would remove the boat ramp from Cunningham Pk. Financing, Council should be aware of. We expect $200,000 Dingall-Johnson funds, but will be short $150,000. Council should be prepared to expend $150,000 to complete this. It can be spent over 5 years. The land owner would prefer it that way. . Councilwoman Dionfor. We need to have a discussion about this. Z did not know of it. Info 2 says ' work session. Mayor Williams. It was an Administrative work session, not Council work session. Councilwoman idonfor. We should know before. Mayor Williams. we have done nothing obliging the City at this point. Councilwoman Monfor. Zf we are going to do this, we should wait till after the election is over and discuss goals and objectives. At the same time include the municipal park. We are talking a lot of money. Mayor Williams. Whenever projects of this type start, there is preliminary work. I spoke of this at last meeting. When we get together with these people, we found out we had to have an amount ready immediately. This would have come at last meeting had Z been here. In order to have this for next year, we had to have figures ready. It will be necessary to have land to build this. If we decide to do it, we will enter into negotiations with the owner. The land owner is not attuned to a land swap, just cash. It would appear Council will be involved with 50/50 match with the Feds. It was necessary to get this in place right away in order to get in next year's budget. Zf we have a chance between meetings, we have to take advantage of it. If we want to continue developing we must explore all areas. i. I met with Korean representatives regarding Cook Inlet development. j.
