The location of the property is shown on the attached map. In 1967, the City originally entered into the referenced Lease with Dia -Log Company for a term of 55 years with. The purpose for which the lease was issued was "in accordance with the Use Plan of Small Aircraft Apron." In 2006, the purpose was amended to "Flying Instruction Business." Since 1967, the rights under the Lease have been assigned or transferred to various Lessors, and the current Lessor is Arctic Barnabas Ministries, inc., who has leased this lot since 2009 for a "hangar and office facility." Pursuant to KMC 21.10.080 and 21.10.040, Arctic Barnabas Ministries submitted a new lease application for the extension and the required non refundable filing fee. Since there are only 13 years remaining for the term of Arctic Barnabas Ministries, Inc.'s Lease, based on the proposed investment of $425,000, a 30 year lease extension would be appropriate under the table provided in KMC 21.10.090 (d)(1). The lease rate was re- negotiated in 2006, prior to the Kenai City Council's adoption of an 8% rate of return for the lease of Airport Land (KMC 21.10.100). The lease rate is not due to be renegotiated again until July 1, 2011. reviewed the application as outlined in KMC 21.10.070 (a)(1). Arctic Barnabas Ministries, Inc. is in compliance with the City and with the Kenai Peninsula Borough. Pursuant to KMC 21.10.080(d), the City Manager has determined that the City will not incur any engineering, surveying or consulting costs in association with the request for 1992 an extension and has waived the cost recovery deposits required under KMC 21.10.050(a)(2)(i) and (ii). My recommendation is approval of the lease extension provided the following terms are included in the Amendment to Lease: o The lease rate is adjusted to reflect the 8% rate of return adopted by Council in 2007. o The rate adjustment cycle is changed to reflect a five (5) year adjustment with years ending in zero (0) or five (5), making the next renegotiation due in 2015. The hangar is scheduled to be dried -in with the heat on by the end of December 2009 with a goal of occupancy by February 2010. ABM possesses all the necessary funds for project completion. (ABM) is a 501(c)(3) non profit corporation that controls and operates such business activities as are promulgated by its Board of Directors. ABM is financed entirely by individuals, business donors and churches who support ABMs stated purposes and strategies. Its governance is vested in the ABM Board, and the property, activities and business of the Corporation is managed under the board's direction. ABM was incorporated in 2000 in the State of Alaska, and exists to provide leadership training, practical support and encouragement to ministry workers, primarily in remote Alaska. Because the focus of ABM is providing services to those who are off -road in the Arctic, owning and operating aircraft is critical to the functioning of the business. Mission Statement The mission of Arctic Barnabas Ministries is to nurture vitality in pastors and missionary families serving throughout remote Alaska. Location As stated in the Articles of Incorporation, the principle office of the Corporation shall be located in the City of Kenai, Kenai Peninsula Borough, Alaska. This property is located at 135 North Willow Street and is located in the Airport Reserve. The applicant proposes to construct an 80' X 80' steel aircraft hangar and attach it to the existing building on the property. Airport Land Use Plan The ALP was approved in July, 2009. On sheet 13 of the plan, the property is shown as Commercial /Light Industrial. Sheet 14 of the approved ALP, identifies the parcel as General Aviation and Light Commercial. The Supplemental Plan defines General Aviation /Light Commercial as, "Areas used by general aviation and light commercial aviation activities requiring taxiway access to the paved runway. Uses shall be restricted to aircraft meeting taxiway pavement strength limitations and taxilane and taxilane object free area width standards defined in FAA Advisory Circular 150/5300 -13." Comprehensive Plan The City of Kenai Comprehensive Land Use Plan identifies this area as Airport Industrial. The Airport Industrial area is defined as, "The Airport Industrial district identifies airport lands reserved for the Kenai Municipal Airport and its future expansion, and tracts needed for present and future aviation related uses and activities. The proposed activity conforms to the Comprehensive Plan. Zoning —The property is zoned IL Light Industrial. Airports and related uses are permitted within the zone. Based on the information provided in the lease application, it appears that the proposed lease conforms to the Airport Layout Plan, the Comprehensive Plan, and Zoning. EXECUTIVE SESSION None Scheduled ITEM M: ADJOURNMENT Airport Projects: Airport Manager's Report For November 2009 Taxiway F, G, H Lightinq, Grading, Drainage Improvement: Proceeding with closeout. Apron Rehabilitation: The ARRA portion of the Apron Rehab Project is 94% complete and the FAA section is 26% complete. Construction contractors have shut down for the winter. Float Plane Basin Facility Improvement Project: An agency scoping meeting was held at 2:OOpm on November 12 followed by the first scheduled public information meeting at the 7:OOpm Airport Commission meeting. Aries Consultants is requesting comments and views on the project by November 23, 2009. Annual Snow Ice Control Meeting: All airports subject to icing conditions or annual snowfall of 6 inches or more are required by Part 139 to have a Snow and Ice Control Committee and a written Snow and Ice Control Plan that focuses on topics improving operational safety. A requirement of the plan is an annual preseason planning meeting to address needs of airport users and improve runway safety and communications between various offices involved or impacted by a storm event. This meeting was held on Wednesday, October 21 and was very well attended by tenants, air carriers, and employees. Representatives from the Air Traffic Control and Flight Service Station were on hand to address airfield communications and answer questions. Annual Airport Emergency Control Plan Review: On October 23, 2009 the airport held its annual review meeting of the Airport Emergency Control Plan (AECP). Representatives from the Airport, Kenai and Nikiski Fire Departments, and Kenai Police Department were in attendance. Several changes are being made to the current AECP which in turn will be submitted to the FAA for approval. After FAA approval, the AECP will be printed and submitted to all agencies having responsibilities with the plan. The FAA has also approved the Airport's Water Rescue Plan which will be included in the new AECP. LUKE Vehicle Parking Pay Station: The new parking meter system continues to receive compliments from airport users. Patrons are very happy to be able to use credit cards and get a receipt. 10 Annual Kenai Peninsula Air Fair: Date is set for Saturday, June 5, 2010. Municipal Airport Airport Manager's Report For December 2009 Airport Projects: Taxiway F, G, H Lighting, Grading, Drainage Improvement: Winter shutdown. Apron Rehabilitation: Winter shutdown. Float Plane Basin Facility Improvement Project: The consultant is receiving and responding to Agency questions. The next step is to summarize agency and public comments, complete draft Supplemental Environmental Assessment and circulate for review and comment. Christmas Play: The Academy of Higher Learning will present The Plane Truth About Christmas in the airport terminal on December 19 at 3pm. This is the second time students have held their play in the terminal to the enjoyment of patrons and tenants. Winter Operations The airport crew was very busy with the recent winter storm and worked very diligently to ensure safe operations. All flights arrived in Kenai as scheduled. Several tenants expressed their appreciation for the crew's hard work. The performance line up was outstanding: Kim Pearson, SF -260; Wayne Parrish, Davis Acro Pro; Jeff Davis, Pitts; Bill Johnson, SNJ; Bobby Hester, P -51 acro; Skip Homburg, JARRS Heilo STOL demo; MA Abram Tank Demo; an eight person female skydiving team; narration by Hugh Linda Oldham. The two day airshow lived up to expectations, but a major incident, before the start of Saturday's show, created a potential for catastrophe. What follows is a chronology of the major events at that show. Times are estimated. 10 Airshow Professional Saturday, October 21, 1989, StanlyCountyAirport, Albemarle, North Carolina 0730: Temporary Air Traffic Control Tower starts operation. 0800: Volunteers, vendors, staff, and performers are hard at work preparing for the Fourth Annual County airshow planned to start at 1400. Minor SNAFU's but no major problems. 0830: Fire Department and EMS units move to staging areas. 0900: The crew of a ANG C -130, scheduled for static display, phones to report engine problems. They state they are working on problem, and will try to make show. 0930: Local vendor begins to set -up a "Moon Walk," an inflated children attraction, in the vendor /sponsor display area. 0945: The Memorial Hospital "Life Flight" helicopter lands in a special controlled- access area for static display. The controlled ac- 2010 Edition cess area was necessary due to the state -wide "on call" status of air- craft and crew. 1100: Gates open, spectators begin to filter into airport, PA system up, narrators begin normal pre -show chatter. 1230: Performer briefing begins in airport terminal building. Nor- mal FAA stuff. Emergency plans discussed "Protect People before Property The airshow incident media person is introduced, the incident media plan is briefed. 1315: C -130 arrives over airport. Airshow director requests fly -by. Crew requests landing and static display. Staff discusses possible staging of C -130 into alternate static display site outside of spectator area. The control tower and narrators are advised to prepare to stage the C -130 to an alternate site. 1320: C -130 lands, taxies toward static display site with aid of many wingwalkers and security personnel. Narration crew briefs spectators. 1322: C -130 turns tail to spectator/vendor /sponsor area. Prop blast blows over vendor tents, sponsor displays, and then lifts the entire `Moon Walk" attraction completely into the air. The Air Traf- fic Control Tower and others call for engine shut down, the radio net becomes clogged and useless. The inflated castle -like "Moon Walk" structure executes a 180 degree end over -end roll while the lower portion of structure is 10 to 15 feet above the ground. It flies 75 to 100 feet laterally into an asphalt parking lot. An unknown number of children fall to ground and asphalt while the structure is in flight. Adults and children on the ground are injured as the struc- ture falls back to earth. 13224330: Emergency Plan is self activated. EMS, National Guard, Army Band, security and spectator personnel begin moving to aid victims. Narration team goes into emergency routine to calm, inform, and control spectators. "Life Flight" nurses aid victims while flight crew prepare aircraft for possible transport. 1330: An altercation erupts between an airshow volunteer and a local newspaper photographer over photographing victims. Air- port Manager strongly urges the photographer to remain outside of emergency area. I.340: All victims have been triaged, most have minor scrapes and bruises, several suffer major lacerations, and there is one possible serious head injury. 1350: Meeting in Airport Manager's office. Present: Airport Manager, Airport Commission Chairman, County Commissioner, primary airshow narrator. Decision is made to continue with show. Airport Manager and Commissioners are briefed by narrator on media questions and techniques. Airport Commission Chairman is appointed spokesperson. Tentative press release prepared. 1410: All victims requiring transport are off the airport. Approxi- mately 12 are transported by ambulance to the local hospital, treated and released. The possible head injury is air lifted to Charlotte Me- morial Hospital and held for over night observation, released next morning. Many others with minor injuries elect to remain on site and see show. Incident scene is cleared of debris, tents re- erected, displays repaired. 1415: Airshow Starts. 1430: Major network TV station calls airport for info on "airshow plane crashing into the crowd" Airport Commission members and Manager begin calling ALL media outlets within a 100 mile radius to relate true facts of incident. 1650: Airshow completed without further incident. 2300: All area TV stations run item on 11:00 News about "freak accident" at the County airshow. Report is factual and non sensa- tional. Sunday: Aftermath 0800: Sunday Morning Newspaper has story of the incident on page 1 of Local News'section. Story is factual, non sensational, and reports that the airshow will run through that afternoon. 1100: Second day of the airshow opens with the previous days in- cident victims as Guests of Honor. 1400: Airshow starts and completed without incident. What We Learned Handheld FM and VHF communications radios were useless dur- ing incidence due to frequency congestion. Everybody was talking at once. The controlled- access area for the "Life Flight" helicopter worked. The aircraft served two roles: first as a static display and marketing tool for the hospital, second as a valuable asset during the incident. All emergency and media plans must be discussed with all air- show participants. In an emergency, people will naturally look to the airshow personnel for leadership. Make sure the performers as well as all airshow staff personnel know how to lead, follow, or get out of the way. During this incident, the victims aided each other. This resource should not be discounted, minimized, or hindered in your emer- gency plan. Someone must handle the media people during the incident, at the scene, and at the narrators station. The media people will want information. If you do not provide it, they will find a way to gather whatever information they feel they need. They will interfere with the narrators, EMS and other personnel's duties. This causes prob- lems both when they get in the way, and later when they fill in the gaps with vivid imaginations. Get factual information distributed to the media outlets as quickly as possible. Media personnel constantly monitor radio scanners tuned to emergency dispatch frequencies. They will hear something has happened at the show site, and the lack of factual information can cause a public relations nightmare. The Good... This incident, at a small airshow at a rural airport, demonstrates the necessity for disaster planning. The successful treatment of the injured is evidence that the emergency plans worked. The profes- sionalism of the emergency medical personnel was outstanding. The available resources were used to the maximum benefit of the vic- tims. Everyone did their job without panic or heroics. The airshow and airport management team remained in control, kept the priori- ties in order, and successfully managed a potentially catastrophic situation. ...And Not So Good The major area overlooked in the emergency plan was media rela- tions, This incident, if it had received national exposure, would have resulted in a negative blow to the airshow industry's public rela- tions efforts. Quick thinking and reaction of the management team averted both the negative national publicity and blunted the impact on the local level. Mark Begich, Federal Aviation Administration (FAA) Administrator Randy Babbitt gave assurances that Alaska's Flight Service Stations (FSS) and their jobs would remain under the administration of the FAA. Alaska is the only state where FSS services are not contracted out, raising concerns in the state of a potential outsourcing. In today's hearing of the Commerce Committee's Aviation Operations, Safety, and Security Subcommittee, Begich discussed the good work Alaskans are performing at FSS and the need to keep it a government function under FAA control. He also expressed concern that reported vacancies at facilities are not being filled and rates of turnover at these facilities need to be addressed by the FAA. Alaska's 17 Flight Service Stations provide pilots with critical safety information including up- to -date weather information, en route communication, and search and rescue functions when needed. "Alaskans working at our FSS facilities are routinely helping to keep Alaska's skies safe before, during, and after flights," Begich said. "The work they perform comes with invaluable experience gained from the unique conditions of Alaska's airspace, planes, and pilots. 1 welcome the Administrator's stance to keep these jobs under the operation of the FAA and look forward to a report on Alaska's staffing levels." Concerns over a possible change for Alaska's FSS began in 2005 following a decision by the FAA to contract the operation of 58 FSS stations in the Lower 48, Puerto Rico, and Hawaii to Lockheed Martin. Administrator Babbitt absolved those concerns today: We will get back with you to make sure we have the staffing levels that are required up there (Alaska) and I have no intent of making any change in that environment, so I think I can assuage that fear for you, Babbitt said. Sen. Begich previously discussed the special conditions relating to Alaska's FSS facilities in a private meeting with the Administrator during his confirmation process. Additionally, the FAA's Flight Services Director, Dennis Roberts, visited Alaska and several FSS facilities in the state earlier this year. Following the hearing, Begich will send a letter to Administrator Babbitt asking the Administration to review staffing efforts and turnover levels at the FSS facilities. The letter will note the ability for the FAA to use Alaska's top notch training facilities, such as the University of Alaska's Aviation Technology Division, to produce quality operators.
