City Council Council Member Molloy reviewed the action agenda items of the March 3, 2010 City Council meeting included in the packet, noting the birding celebration presentation, the donation to the Russian Orthodox Church for renovations, and the rescission of the Schilling lease. 9 -b. Borough Planning Commissioner Bryson reviewed the agendas of the February 22 and March 8 Borough Planning Commission meetings included in the packet, noting the ordinance on permitting activities on sloped riverbanks of interest to the City of Kenai. 9 -c. Administration City Planner Kebschull reported she met with representatives of the MAPS neighborhood concerning how to proceed with their plan for a special zoning process, and reminded the Commissioners to RSVP to the City Clerk on the Appreciation Dinner before March 20, 2010. Wada 260 -2680 35182 Huntington Drive Soldotna, AK 99669 Conditional Use Permit Retail Business Lot 12, Block G, Beaver Creek Alaska Subdivision Amended 3521 Tustumena Street 047107112 RR Rural Residential Vacant Rural Residential General Information: Mr. Wada is proposing to develop a retail business which will feature outdoor equipment such as trapping supplies, bear baiting supplies, animal calling equipment and the purchasing and sales of furs. Mr. Wada is in the process of purchasing this property and has provided written permission from the current property owner to proceed with the application. The property is zoned Rural Residential. Zoning requires a Conditional Use Permit for retail businesses in the Rural Residential Zone. This property is located one parcel from the Kenai Spur Highway. Properties along the Kenai Spur Highway in this area are zoned General Commercial. Other properties adjacent to this parcel are zoned Rural Residential. Recent developments along the Kenai Spur Highway in this area include Matson Winery and Peninsula Power Sports. Development across Beaver Loop Road includes three undeveloped lots and residences including multi family duplexes. Tustumena Street parcels are undeveloped. The property is located on the corner of Beaver Loop Road and Tustumena Street. Tustumena Street is an undeveloped right -of -way. There is currently no developed access 7 PZIO -03 Comments Page 2 to the property. Mr. Wada hopes to obtain a right -of -way driveway permit from the State of Alaska, Department of Transportation to develop access onto Beaver Loop Road. If that permit is denied, Mr. Wada will work with the City of Kenai to develop access via Tustumena Street. The application includes a site plan with the preferred access off Beaver Loop Road. If that access is denied, Mr. Wada will revise the site plan with access off Tustumena Street. Long -term plans would be to develop the property so that in the future the applicant could also build his residence on the property. KMC 14.20.150 details the intent and application process for conditional uses. The code also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district: The Rural Residential zone is intended to provide for low density residential development in outlying and rural areas in a form which creates a stable and attractive residential environment. The specific intent in establishing this zone is to separate residential structures to an extent which will preserve the rural, open quality of the environment, to prevent health hazards in areas not served by public water and sewer and to prohibit uses which would violate the residential character of the environment or uses which will general heavy traffic in predominantly residential areas. Beaver Loop Road is classified by the State of Alaska as a Major Collector. A collector is defined as `A road classification applicable to roads serving a mixture of local access and through traffic, for which the volume, average speed, and trip length of vehicles using the road are usually lower than for principal or minor arterials, but higher than for local roads." Because access to the proposed business would be off a collector, and not through a residential neighborhood, the impact should not violate the residential character of the environment. The use will not create a health hazard. The proposed structure will be a single story, wood-sided building. The property is over an acre in size. It appears that the proposed use can be developed in a manner consistent with the intent of the zone and should not adversely affect neighboring properties. 2. The value of the adjoining property and neighborhood will not be significantly impaired: The value of the adjoining property should not be impaired. 3. The proposed use is in harmony with the Comprehensive Plan: The Rural Residential Land Classification is defined as, "The Rural Residential district includes areas that, due to location or site conditions, are best suited for large -lot single-family residential development. Homes in this district typically rely on individual on -site water supply and wastewater disposal systems. Compatible institutional uses such as churches, schools, and daycare facilities may be intermixed if they comply 8 PZ10 -03 Continents Page 3 with zoning design guidelines. Small home -based businesses may be accommodated within certain design guidelines." This property is identified in the Land Use Plan as Rural Residential; however, it abuts General Commercial property and is accessed via a major collector road (Beaver Loop Road). The development plan can meet all design guidelines identified in the Development Requirements Table. The planned structure will be a single story, wood sided building that will fit in with the residential structures in the area. It appears that the development can be designed in harmony with the Comprehensive Plan. 4. Public services and facilities are adequate to serve the proposed use: The development will be served with on -site water and sewer. If the conditional use is approved, the Fire Marshall will review the building plans and site plan to insure that the property meets all safety requirements. City of Kenai police and fire department resources are sufficient to serve the proposed use. 5. The proposed use will not be harmful to the public safety, health or welfare: The proposed use is not harmful to the public safety health or welfare. 6. Any and all specific conditions deemed necessary by the commission to fulfill the above mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Due to the commercial nature of the proposed development, the building permit will be processed as a commercial permit and will be required to meet all building and fire codes. In addition, a commercial landscape /site plan will be required to meet the requirements of KMC 14.25. No other conditions are recommended for the proposed development. Building Official: Proposed construction must comply with all adopted codes. RECOMMENDATIONS The applicant proposes to build a retail store to market outdoor equipment such as trapping supplies, bear baiting supplies, animal calling equipment and the purchasing and sales of furs. The structure is planned as a single- story, wood sided building. The site for the store is located off Beaver Loop Road near the Kenai Spur Highway intersection. The property adjoins property zoned General Commercial. The applicant is pursuing a driveway permit from the State of Alaska to develop access off Beaver Loop Road. If that permit is denied, the applicant will work with the City of Kenai to develop access off Tustumena Street which is an undeveloped right -of -way. Beaver Loop Road is identified by the State of Alaska as a major collector road. The surrounding area is a mix of undeveloped land and commercial and residential development. It appears that the proposed store can be developed without a negative impact on 9 PZ10 -03 Comments Page 4 adjoining residential lots and can meet the development guidelines for the zone. Recommend approval with the following requirements: 1. Apply for and obtain a commercial building permit. 2.
