Kebschull reviewed the staff report included in the packet and recommended approval
with the following requirements:
1. The water and wastewater systems must be approved by the State of
Alaska Department of Environmental Conservation for the proposed
use(s). A copy of the approved systems must be provided to the City of
Kenai.
2. The guiding business is limited to two boats as described in the
application.
3. House rules for the cabin rentals must be developed which are
compatible with residential zoning including quiet hours.
4. All trash and fish remains must be properly disposed. Bear proof
containers which meet Alaska Fish and Game standards must be used
for any trash kept at the property.
5. The Fire Marshall must inspect the cabins prior to occupancy and every
two years thereafter to insure they are in compliance with fire safety
codes.
Twait opened the meeting to public hearing.

on the property and wanted to keep the neighborhood residential.
Sharalyn Wright, 1412 Barabara Drive, Kenai Spoke in opposition to the permit,
noting poor road conditions, young children in the neighborhood, and noise issues.
Terri Elliott, 1500 Barabara Drive, Kenai Spoke in opposition to the permit,
noting road conditions, water and septic issues and noise issues.
Greg Zorbas, 1308 Barabara Drive, Kenai Spoke in opposition to the permit,
noting traffic issues and road conditions.
Niki Schemanski, 1402 Barabara Drive, Kenai Spoke in opposition to the permit,
noting traffic, increased road use and safety issues.

This is an application for a 3 -foot, 3.6 -inch (3.3') front yard setback
encroachment. This property is located in the Suburban Residential zone.
Front yard setbacks in this zone are 25 -feet. This is a newly constructed
residence. When the as -built survey was completed for the sale of the
property, the encroachment was discovered.
KMC 14.20.185 details the definition, intent, and permit application process
for Encroachment Permits. Code also lists the review criteria that should be
considered by the Planning and Zoning Commission when determining if a
permit should be granted. The Commission is to establish that the following
conditions exist before issuing an Encroachment Permit:
1. An encroachment as defined in KMC 14.20.185 (a) exists. An

encroachment into the front setback exists.
2. The encroachment does not encroach upon a Federal, State or
City right -of -way or utility easement. The encroachment does
not encroach upon a Federal, State of City right -of -way.
3. The issuance of the encroachment permit will not authorize a
use which is a not a principal permitted use in the zoning
district in which the property is located. This is a single family
residence, a principally permitted use in the zone.
4. The encroachment is not located across a platted lot line. The
encroachment is not located across a platted lot line.
Building Official:
No building code issues.
RECOMMENDATIONS
An as -built survey conducted during the sale of this newly constructed
residence identified a 3 -foot, 3.6 -inch (3.3') front yard setback
encroachment. The property is located in the Suburban Residential zone and
requires a 25 -foot front setback. The as -built also identifies the other
distances from property lines including the distance of the garage from the
property line and the side setback. One corner of the garage is shown at 10-
feet from the front property line and the other corner at 10.2 -feet from the
front property line. Kenai Municipal Code (KMC 14.20.200) allows for a
minimum front yard setback for an unoccupied garage of ten feet (10'). The
development meets all other setback requirements for the zone.
The encroachment meets the conditions outlined in KMC 14.20.185. The
encroachment does not create an unsafe condition. Recommend approval.

General Information:
This application is submitted by F. Todd Wortham, DDS for a Conditional Use Permit to
build a dental office on property located across from Kenai Central High School. The
property is zoned Rural Residential 1. Professional offices require a Conditional Use
Permit in the Rural Residential 1 zone.
This property is approximately three acres (2.97 acres). The property has access via the
Kenai Spur Highway and Cinderella Street. The proposal is to build a dental office with a
4500 square foot footprint. The proposal is for a two -story building with an apartment on
the second story. The residential use is permitted in the zone.
A rendering of the proposed structure has been provided. The proposal is to place the
office in the southwest corner of the property. Because this is a commercial building, a
formal landscape /site plan will be recommended to insure the development meets
standards for commercial development including landscaping and parking. All other
development requirements for the zone will be met.

also specifies the review criteria that must be satisfied prior to issuing the permit. The
criteria are:
1. The use is consistent with the purpose of this chapter and the purposes and
intent of the zoning district This property is located in the Rural Residential
1 (RR1) zone. The RR Zone is intended to provide for low density residential
development in outlying and rural areas in a form which creates a stable and
attractive residential environment. The specific intent is to separate
residential structures to preserve the rural, open quality of the environment
and to prevent health hazards in areas not served by public water and sewer.
Uses which violate the residential character of the environment and generate
heavy traffic in predominantly residential areas should be prohibited
This property is located across from Kenai Central High School along the
Kenai Spur Highway. Prior to the current ownership, the lot was clear cut,
filled with gravel and is barren of any landscaping. The proposed dental
office will be designed with the dental office on the ground level and an
apartment on the second story. The building will be designed to blend with
the residential structures in the zone. The structure will be separated from
adjoining residential development by a large vacant portion of the lot and
Cinderella Street. The plan is to use the existing access from the Kenai Spur
Highway. Landscaping will provide additional screening.
City water and sewer are available to serve the properly. With access from
the Kenai Spur Highway, the dental office should not generate heavy traffic
into the residential area.
1. The value of the adjoining property and neighborhood will not be significantly
impaired Properties are assessed by the Kenai Peninsula Borough. The
proposed professional office would be assessed by the Borough after
construction. There is no indication that the proposed development would
adversely affect the adjoining property and neighborhood.
2. The proposed use is in harmony with the Comprehensive Plan This properly
is classified as Neighborhood Residential. The Neighborhood Residential
district consists of single-family and multi family residential areas that are
urban or suburban in character. Typically, public water and sewer services
are in place or planned for installation. This land use district may include
both single-family and multi family dwellings subject to reasonable density
transitions and /or design compatibility. Formal public outdoor spaces
(parks) are a critical feature in this district. Small home -based businesses
may be accommodated within certain design guidelines. Neighborhood

institutional uses such as churches, schools, and day care facilities may be
intermixed if they comply with neighborhood design guidelines.
This property is bordered on the south by the Kenai Spur Highway across
from Kenai Central High School. To the east, there are four properties which
are developed with 4 plexes. To the west, lies Cinderella Street, Across
Cinderella Street is a duplex. The planned development is designed to be
compatible in the residential zone. The lot is large and will accommodate the
development and provide sufficient separation from adjoining properties. As
proposed, the office should be compatible with the Comprehensive Plan.
3. Public services and facilities are adequate to serve the proposed use City
water and sewer are available to serve the development. The Kenai Spur
Highway is a state maintained highway. The City of Kenai police and fire
departments have sufficient resources to serve the development.
4. The proposed use will not be harmful to the public safety, health or welfare

5. Any and all specific conditions deemed necessary by the commission to fulfill
the above mentioned conditions should be met by the applicant. These may
include, but are not limited to measures relative to access, screening, site
development, building design, operation of the use and other similar aspects
related to the proposed use. The development should be required to meet the
landscaping /site plan requirements for commercial developments.
Building Official:
Note: A 2 -hour rating is required in the floor /ceiling between the dental office and the
apartment above. A design professional is required for the building plans.
RECOMMENDATIONS
This is an application for a Conditional Use Permit for a professional office. The
applicant, Dr. Wortham, is hoping to build an office to house his dental practice. He has
provided a letter to the Commission explaining his plans to build the office for himself
and a new partner who will be joining the practice. Dr. Wortham explains he would like
to build an apartment on the second story of the building. Residential use is permitted in
the Rural Residential 1 zone.
This property is approximately three (3) acres and sits on the corner of the Kenai Spur
Highway and Cinderella Street. The preliminary plan is to locate the building on the
corner of the property closest to Cinderella Street. The building is planned to appear
similar to a residence. There is developed access off the Kenai Spur Highway.

To issue the permit, the Commission must find that the application meets the
requirements of KMC 14.20.150. Based on the information provided in the application
and the development plan, it appears the professional office could be developed at this
site in harmony with the Comprehensive Plan while maintaining the integrity of the zone.
Recommend approval with the following requirement:
1. Landscape /site Plan must be submitted with the building permit that meets the
requirements for commercial development as required in KMC 14.25.
Landscaping, as required by code, will be limited to the area involved in the
development.

As many of you know, I've grown up in Kenai most of my life. I attended elementary, junior high
and high school here. My parents have owned and operated Alyeska Tire for over 30 years. Our
family has contributed to the City of Kenai tremendously over the years. It is with this deep devotion
that I submit to you an application for a Conditional Use Permit to build a dental office on my land
across from Kenai Central High.
I've submitted a rendering of the outer appearance of the building and the approximate placement of
the building on the lot. My plans are to build only one building approximately 4500 sq. ft. pad size. I
would like to build an apartment over the top of the office, further adding to the mixed use theme of the
area. The building would be large enough to house 2 dentists and expansion for further growth.
My practice has grown over the last 10 years and I've decided to take on a partner. He will be a
wonderful addition to our community. He is married with two young children and one on the way. I
will be introducing him to the community in the corning months and I'm sure he will be received very
well. He is also excited about the undertaking of the building and planning for a life with his family in
the area.

A public hearing is scheduled for your June 9 meeting to review the Comprehensive
Plan. The resolution will recommend Council adopt updated zoning and land use maps
to reflect zoning amendments that have occurred since the last update. As part of that
review, Council will be provided the Implementation Measures table showing the status
of the measures. Any comments you would like incorporated into that table should be
provided to me prior to June 2 to provide sufficient time to update the information prior
to the public hearing. If you have questions, don't hesitate to contact me. My direct

KMC 14.25 specifies the regulations for landscape /site plans within the City of
Kenai. The City has received a landscape/site plan for the City of Kenai Library
Expansion.
Section 14.25.030 of that chapter details Landscaping /Site Plan submittal
requirements.
Scientific or common name or type of planting materials to be used in
the project.
o The plan includes a planting schedule which lists trees, shrubs,
perennials, and grass that will be included in the landscaping.
(Paper Birch, Columnar Swedish Aspen, Colorado Green Spruce,
Red -twig Dogwood, Creeping Juniper, Diablo Ninebark, Miss Kim
Lilac, Rose Tree of China Dwarf Mugo Pine, Wild Geranium, Wild
Iris, Ostrich Fern, and Type A Seed Mix (grass).

Section 14.25.040 of the code outlines the landscaping plan performance criteria.
Perimeter /Buffer Landscaping involves the land areas adjacent to the
lot lines within the property boundary and serves to separate and minimize
the impact between adjacent uses.
This is an established site. Existing vegetation is being retained where
possible. Where existing vegetation cannot be retained, the plan
identifies areas to be seeded.
Interior Landscaping involves areas exclusive of the perimeter and
parking lot areas.
o Landscaping is shown along the front and side of the library
addition and in the area behind the existing city hall building.
Parking Lot Landscaping involves areas adjacent to or within parking
lots and access drives.
o See above.
Street right -of -way Landscaping intent to soften the impact of land
uses along rights -of -way but does not obscure land uses from sight.

The following are required in the site plan:
Parking The plan identifies 47 parking spaces with 4 handicapped
spaces. An additional 16 parking spaces are planned for the Fidalgo
Avenue side of the building. Libraries require one space for every 400

square feet of gross floor area. The library with a square footage of
22, 225 will require 56 spaces. The parking shown meets parking
requirements.
O Parking Lot.
o Parking lot must be paved. Paving must be completed within two
(2) years after the certificate of occupancy is issued. Plan shows
asphalt parking areas.
Snow storage.
o Snow storage areas are identified.
Dumpster.
o No dumpster is shown on the plan. Any dumpster on the site
must be screened with a sight obscuring structure made of wood
or concrete.
RECOMMENDATIONS
This is a landscape/site plan submitted for the City of Kenai's addition to the Kenai
Library. The plan as submitted meets the intent of KMC 14.25. The plan is
approved with the following requirements:
1. All required landscaping as presented in the approved landscaping plan
must be installed within one (1) year of the approved landscaping
plan.
2. One hundred percent (100 of ground cover of the landscaping beds
must be planted and maintained so that there is no exposed soil
within three years of the approved plan.
3. The parking lot must be paved within two (2) years of the Certificate
of Occupancy.
4. Snow storage must be located on the lot and cannot be placed on
required parking spaces or the snow must be removed from the site.
No snow may be stored in such a manner that would block visibility
for ingress and egress to the lot.
5. Any dumpster located on this site must be screened. The structure
for the dumpster must be constructed of wood or concrete. City
administration may approve other materials prior to construction.
