City Planner Kebschull reviewed the staff report included in the packet, noting the
following requirements:
1. Plat note two requires a 25 foot setback.
2. Plat note five should specify City of Kenai construction standards.
3. Include property owner's names on the plat.
4. The requested street name is Tay Court.
5. Prior to recording the final plat, an as -built survey must be provided to
verify the subdivision does not create encroachments for the existing
structures.
6. An installation agreement must be formalized with the City of Kenai
addressing the minimum improvements listed above. However, the final
agreement may include additional requirements determined as the plan
is reviewed.

Thanked everyone for their testimony and noted hearing very valid
concerns.

the June 2, 2010 City Council meeting and noted an appropriation of $2 million in
Recovery Zone Facility Bonds from the Kenai Peninsula Borough to fund construction
of a commercial building in Kenai would take place during the June 16, 2010 City
Council meeting.

after the June 23, 2010 meeting regarding dog kennels and noted Administration
would be working with the owners of the retention basin near the Aspen Hotel on

ANALYSIS
General Information:
This is an application to modify the Condition #3 placed on the Conditional Use Permit
PZ09 -45 approved on September 9, 2009.
Provide ADEC approval for on -site water and sewer utilities.
KMC 14.20.150 (h) outlines the process for modifying an approved Conditional Use
Permit. Any modification is subject to an application and public hearing
Background:
In the summer of 2009, the City of Kenai received a complaint about a recreational
vehicle (RV) park on 1115 Angler Drive. The owner of record was contacted and advised
the use of recreational vehicles in the City was regulated and that a Conditional Use
Permit for a Recreational Vehicle park would be required. An application was approved
by the Planning and Zoning Commission on September 9, 2009. The approval was
granted with several requirements.

The applicants purchased the property in 1984 for a private family recreational area for
use from May to September. The property generates no income and is strictly used for
family and friends.
There are three (3) permanent recreational vehicles, two (2) storage containers and a large
gazebo located on the property. There are four (4) RV spaces available for visiting
relatives. The property is served by on -site water, sewer and electricity. The sanitary
facilities have not been approved by the Alaska Department of Environmental
Conservation (ADEC).
Modification:
The property owners are requesting a modification to the Conditional Use Permit to allow
them to use the self contained units on the vehicles located on the property while they
work with an engineering firm to design a sewer system for the property. While the
system is being designed and constructed the applicant proposes to place a port -a -potty at
the property, disconnect the units from the existing system, and use the self contained
holding tanks with weekly pumping. The pipes to the existing tank will be dismantled.
The applicant provides a thorough description of the proposed modification. (See
attached.)
Building Official:
A building permit has been issued for the gazebo.
RECOMMENDATIONS
In 2009 a Conditional Use Permit was granted for a private recreational vehicle park.
That permit was approved with several conditions including the requirement that the
owners provide the City with proof that the on -site water and sewer facilities met with
Alaska Department of Environmental Conservation (ADEC) requirements. Since the
permit was issued, the owners have attempted to meet this requirement but to date have
been unable to do so. With the upcoming summer season, their families would like to be
able to use the property as they have for numerous years. To this end, they are applying
to modify the Conditional Use Permit to allow for an interim solution while they continue
to work with an engineer to find a long -term solution that meets ADEC requirements.
The owners are proposing a short-term solution which would allow them to rent a port-a-
potty for the property, use the holding tanks on the recreational vehicles, and have those
tanks pumped weekly or as required. In addition, they will begin dismantling the existing
system and contract with an engineer to design a solution for the property.
The modification appears reasonable for a short-term solution. Recommend approval
with the following requirements:
1. The existing septic system must be dismantled and may not be used.
2. A pot -a -potty must be rented and placed on the property for use during the 2010

season. Facility must be pumped weekly, or as needed.
3. Provide documentation that an engineer has been contracted with to design an
approved ADEC system for on -site water and sewer facilities.
4. Building Official must conduct a final inspection on the gazebo to verify that the
structure meets the building code requirements. Final inspection and approval
must be completed no later than August 31, 2010.
5. ADEC approved system must be installed prior to May 31, 2011.
The remaining conditions imposed under the original permit continue as requirements of
the permit:
1. Limit the number of permanent trailers structures to the existing structures.
2. Limit use to operating during the period of May e October 15
3. Fees shall not be charged for RV occupancy.

use of the property while solution of the sewer system deficiency is determined
and corrective construction can be contracted and accomplished to meet ADEC
standards, While this effort is underway we want to use the self-containment
holding tanks on the three (3) owner trailer nits on site with weekly commercial
pumping service when such trailers are occupied and such service is needed.
Note: There will be weeks during the May September Season when one or
more of the trailers will not be occupied based on our past usage since 1984.
The drainage conduits from our 3 trailers to the existing gathering tank will be
disconnected We contemplate excavation at the gathering tank to ascertain
whether the leech field exit can be capped and the tank alarm awned to become
a holding tank meeting ADEC requirements in lieu of the more expensive soil
absortion system as our commercial neighbors with much greater occupancy
have needed and had installed as a business expense.

The City of Kenai received a complaint about a recreational vehicle (RV) park on Angler
Drive. A site visit confirmed multiple recreational vehicles set up for long -term use
(KMC 14.20.245) at 1115 Angler Drive. The owner of record was contacted and advised
the use of recreational vehicles in the City was regulated and that a Conditional Use
Permit for a Recreational Vehicle park would be required. This application for a
Conditional Use Permit to operate a private family RV park at 1115 Angler Drive is
result of that complaint.
The applicants purchased the property in 1984 for a private family recreational area for
use from May to September. The property generates no income and is strictly used for
family and friends.
There are three (3) permanent recreational vehicles, two (2) storage containers and a large
gazebo located on the property. There are four (4) RV spaces available for visiting
relatives. The property is served by on -site water, sewer and electricity. The sanitary

facilities have not been approved by the Alaska Department of Environmental
Conservation (ADEC). The property owner has hired an engineering firm to have these
facilities inspected and approved by ADEC. The applicant provides a thorough
description of the proposed activity and a site plan.
A site visit was conducted and in addition to the available RV spaces there is sufficient
parking for vehicle and boat parking. The Building Official inspected the electrical
outlets and the gazebo. A building permit is required for the gazebo. However, without a
principal structure on the property, a building permit cannot be issued for an accessory
structure. If the Conditional Use Permit is approved, a building permit can be issued.
KIV1C 14.20.150 details the intent and application process for conditional uses. The code
also specifies the review criteria that must be satisfied prior to issuing the permit. The
criteria are:
1. The use is consistent with the purpose of this chapter and the purposes and
intent of the zoning district.
This property is zoned Rural Residential. The intent of the zone is to
provide for low- density residential development. The specific intent is
to preserve the rural, open quality of the environment, prevent health
hazards in areas not served by public water and sewer, to prohibit
uses which violate the residential character of the environment and to
prohibit uses which generate heavy traffic in predominantly residential
areas. Recreational Vehicle Parks are allowed by conditional use in
the zone. This will be a private RV park No spaces will be rented and
use will be restricted to family and friends. There are eighteen (18)
properties on Angler Drive operating under Conditional Use Permits.
A majority of these parcels offer guiding and lodging. Because the
proposed use has been used in this manner since 1984, the proposed
use should generate no additional traffic. The applicant states the
property is used only during May to September. Because the proposed
use is in an area that has been developed with commercial recreation
uses, the use appears compatible with the adjoining properties. It
appears the proposed private family RV Park meets the intent of the
zone.
2. The value of the adjoining property and neighborhood will not be significantly
impaired.
This property has been used in this manner since purchased in 1984.
There is no evidence the value of the adjoining property or
neighborhood would be impaired by granting the Conditional Use
Permit.
3. The proposed use is in harmony with the Comprehensive Plan.
The Land Use Plan classifies this property as Rural Residential. This
district includes areas that, due to location or site conditions, are best
suited for large -lot single-family residential development. Homes in

this district typically rely on individual on -site water supply and
wastewater disposal systems. Compatible institutional uses such as
churches, schools, and daycare facilities may be intermixed if they
comply with zoning design guidelines. Small home -based businesses
may be accommodated within certain design guidelines. RV parks are
allowed by conditional use. The applicants only use the property
during the summer months. During the off season the property is
securely closed down. Mr. Bancroft and Mr. Ames have been using
this property as a private family RV Park since 1984. It appears the
use would be in harmony with the Comprehensive Plan.
4. Public services and facilities are adequate to serve the proposed use.
This property is served with on -site water and sewer. Police and fire
services are adequate to serve the property.
5. The proposed use will not be harmful to the public safety, health or welfare.
The proposed use will not be harmful to the public safety, health or
welfare of the neighborhood.
6. Any and all specific conditions deemed necessary by the commission to fulfill
the above mentioned conditions should be met by the applicant. These may
include, but are not limited to measures relative to access, screening, site
development, building design, operation of the use and other similar aspects
related to the proposed use.
Building Official:
Applicant must obtain a building permit for the gazebo.
RECOMMENDATIONS
The applicant has provided a detailed description of the proposed private family RV Park.
The applicants have operated this property as a private recreational park since they
purchased the property in 1984. The property generates no income and is strictly used for
family and friends only. The private family RV Park does not appear to adversely affect
the neighboring properties. Recommend approval with the following requirements:
1. Apply for a building permit for the gazebo and meet all Building Official
requirements.
2. Limit the number of permanent trailers structures to the existing structures.
3. Provide ADEC approval for on -site water and sewer facilities.

1. Our request is to provide short-term comfortable use of the property by
Owners families (and occasional guests) for personal recreation and
relaxation with convenient access to the Kenai River fishery.
2. No commercial use or revenue- producing business activities have been or
will be conducted or supported thereon.
3. Owner's families have not and do not desire long -term use; most visits
are two or three days, with occasional weeklong visits as individuals'
work schedules permit. Owner's families are Anchorage residents and
make frequent weekend round trips from May 15 through Sept 30.
4. Facilities provided and maintained by Owners since purchase in June
1984 include RV, vehicle and boat parking space; well water for fish
cleaning; trailer sleeping and cooking accommodations for those without
self-contained motor homes, and electrical service. A free standing, large
gazebo is on the lot for social gatherings and there is a removable boat
dock on Beaver Creek.
5. We have hired Mike Taurlainen PE Consulting Engineering to inspect the
onsite sewer and well and report finds to DEC.
6. There are only 3 permanent trailers located on the property and 2 storage
containers, the old storage trailer maybe removed next year.
7.. Along with the 3 permanent trailers, there are 4 additional spaces
available for our families with motor homes.
8. The Building Official inspected the property on 8/11/09 and told us what
had to be done if our conditional use permit were granted. We have no
problem making the necessary requirements for the property to be legal.

On May 19, 2009, Lynford Disque applied for a Conditional Use Permit to operate an
outside storage yard, for his business Circle D Restoration and Racing, from 2021 Wyatt
Way. On June 10, 2009, the permit was approved with several requirements that had to
be met before the permit could be issued. Several of those conditions had to be met prior
to May 31, 2010.
Mr. Disque was to provide quarterly reports on the progress made to the property to bring
the property into compliance. The following is a synopsis to the revocation request:

KMC 14.20.150 (g) outlines the process for revoke an approved Conditional Use Permit
for noncompliance /compliance notices.
Background:
Mr. Disque purchased the property 13 -years ago for retirement. The property is served
by on -site water and sewer. According to the applicant, there is a two car garage and a
foundation for a home on the property. The garage is intended to be used to work on
vehicles as well as the storage of equipment.
On May 26, 2009, the City met with Mr. Disque to discuss possible solutions for the
property. This property is located off Wyatt Way which is a platted right -of -way and not
maintained by the City. Fences over six -feet (6') require building permits. The City does
not issue building permits for development on properties not located on developed rights
of -way. The only alternative for the applicant to proceed with the application for the CUP
would be to apply for a variance from the requirement for the six -foot (6') high fence. It
was agreed the applicant would apply for Conditional Use Permit for outside storage as
defined in KMC 14.20.050(h) and a Variance for an 6 -foot high fence.
On June 10, 2009 the Planning and Zoning Commission approved Conditional Use
Permit PZ09 -30 Outside Storage Yard and Variance PZ09 -31 six -foot (6') sight
obscuring fence, with the following requirements:
1. Variance for a six -foot (6') high sight obscuring fence must be approved.
2. Variance to only screen the property along Wyatt Way must be approved.
3. Obtain a current State of Alaska business license.
4. Register for sales tax with the Kenai Peninsula Borough.
5. Remove the unsafe mobile home from property.
6. Remove all junk vehicles not pertaining to the "Dodge" restoration business.
These vehicles are identified from the inventory dated September 18, 2006.
7. Miscellaneous debris and junk must be removed from the site.
8. No additional vehicles may be moved to the storage yard.
9. Permit is valid for a period of five (5) years. Prior to expiration, an application
to renew the permit must be submitted.
10. Permit will not be issued until Conditions #1, 2, 3, 4, 5, and 6 have been met.
Conditions must be met within 60 days of the date of the public hearing.

KMC 14,20,260(b) states that, "If the administrative official finds that any of the
provisions of this chapter are being violated, he or she shall notify in writing the person

the requirements of PZ09 -30.
Administration has provided the permit holder sufficient notice and opportunity to
contact the City with the required documents. Due to non compliance, it is recommended
that the permit be revoked.

WHEREAS, the City of Kenai Planning and Zoning Administration finds this plan provides for orderly
and safe development within the City commensurate with protecting the health, safety, and welfare of its
citizens, and provides adequate and convenient open spaces, light and air in order to avoid congestion of
commercial and industrial areas; and,
WHEREAS, the plan appears to provide for landscaping and/or the retention of natural vegetation in
conjunction with commercial and industrial development within the City; and,
WHEREAS, the purpose of landscaping is to visually enhance the City's appearance and reduce erosion

Additional Requirements:
1. All required landscaping as presented in the approved landscaping plan must be
installed within one (1) year of the approved landscaping plan.
2. One hundred percent (100 of ground cover of the landscaping beds must be
planted and maintained so that there is no exposed soil within three years of the
approved plan.
3. Snow storage must be located on the lot and cannot be placed on required parking
spaces or the snow must be removed from the site. No snow may be stored in
such a manner that would block visibility for ingress and egress to the lot.
4. No dumpster location is identified on the site plan. If a dumpster is placed at the
site, the structure for the dumpster must be constructed of wood or concrete.
City administration may approve other materials prior to construction.
5. If construction of the project has not started within one year of the approval of the
landscaping /site plan, the approval may be revoked by the Administrative Official
after providing at least thirty (30) Day notice unless extended for good cause.

The City of Kenai has received a building permit application for a transmission shop.
As required in KMC 14.25, a landscape /site plan has been submitted for the
project.
KMC 14.25 specifies the regulations for landscape /site plans within the City of
Kenai. Section 14.25.030 of that chapter details Landscaping /Site Plan submittal
requirements.

o The plan identifies the ground cover as typical grass. Also
identified in the plan are 5 Native White Spruce trees and 3 Native
Birch trees.

Section 14.25.040 of the code outlines the landscaping plan performance criteria.
Perimeter /Buffer Landscaping involves the land areas adjacent to the
lot lines within the property boundary and serves to separate and minimize
the impact between adjacent uses.
o Natural vegetation will be retained on three sides of the
development.
Interior Landscaping involves areas exclusive of the perimeter and
parking lot areas.
o No interior landscaping is planned. Two moveable planters will be
situated near the front entrance.
Parking Lot Landscaping involves areas adjacent to or within parking
Tots and access drives.
o No parking lot landscaping is planned.
Street- right -of -way Landscaping intent to soften the impact of land

o As required, ten feet of landscaping will be placed along the Bridge
Access Road right -of -way. This area will be landscaped using
grass and Spruce and Birch trees.
The following are required in the site plan:
Parking
o This is an automotive service /repair shop. Parking requirements
are one per 400 square feet of gross floor area of sales room and
four for each auto stall. The architect has identified the sales area
as 280 square feet requiring one parking space. There are 6 auto
service stalls requiring 24 spaces. The plan provides 25 spaces
with two handicapped spaces.

o This development is located in a Heavy Industrial zone and exempt
from the paving requirement.

RECOMMENDATIONS
The plan as submitted meets the intent of KMC 14.25. Plan is approved as
submitted with the following requirements:

I have reviewed the information provided for the proposed Transmission Shop on Bridge Access
Road in Kenai, AK. The following zoning analysis is based on the City of Kenai Code of
Ordinances and on conversations with Marilyn Kebschull at the City of Kenai Planning
Department. This property is zoned Heavy Industrial (IH zone).
Setbacks
There is a twenty -five foot (25') setback from the front of the lot and a ten foot (10') setback from
the sides and rear of the lot.
Design Standards for Off Street Parking
All parking lots shall be provided with durable, well drained, and dust -free surface and shall
have appropriate bumper guards where needed.
Parking areas and front yards, which includes the required parking spaces, in commercial use
areas shall not be used for storage, repair work or any purpose other than parking, landscaping,

Every building or structure used for business, trade, or industry and normally requiring truck
loading or unloading with respect to the use, shall provide space for the loading and unloading
of vehicles off the street or public alley.
Marilyn at the City of Kenai confirmed that this project does not require a truck loading/
unloading parking space.
No open storage shall be located closer than twenty -five feet (25') to the adjoining right -of -way
of any collector street or main thoroughfare. Any open storage visible from a collector street or
main thoroughfare shall be enclosed with an eight -foot (8') high fence of good appearance
acceptable to the Commission
Curb cuts shall be located so as to avoid traffic hazards and shall be approved by the
administrative official.
Interior landscaping involves those areas of the property exclusive of the perimeter and parking
lot areas. Screening or visual enhancement landscaping is recommended to accent or
complement the building and to identify and highlight entrances to the site. Landscaping may
include landscaping beds, trees and shrubs, but an amount is not specified in the zoning code.
Parking lot landscaping involves the land areas adjacent to or within the parking lot and
associated access drive. Parking lot landscaping serves to provide visual relief between vehicle
parking areas and the remainder of the development. It also is desirable for the purpose of
improving vehicular and pedestrian circulation patterns.
Street right- of -wav Iandscapinq softens the impact of land uses along street rights -of -way, but
does not obscure land uses from sight. Landscaping beds must meet all of the following
minimum standards:
1) Landscaping Beds. Minimum of ten feet (10') in width along the entire length of the
property lines which adjoin street rights -of -way, exclusive of driveways and other ingress
and egress openings.
2) Ground Cover. One hundred percent (100 ground cover of the landscaping bed within
three (3) years of planting and continuous maintenance so there will be no exposed soil.
3) Trees and /or shrubs appropriate for the climate shall be included in the landscaping
beds.
Snow storage /removal and drainage as referenced on the site plan shall be compatible with the
surrounding area.
