Kenai Planning and Zoning Commission recommending Kenai City
Council amend Kenai Municipal Code Chapter 3.10, Control and

the City of Kenai including the citation procedures and penalties for
violation of ordinances, and making technical changes and corrections.
City Planner Kebschull reviewed the staff report included in the packet, noting the
resolution would add honeybees to the existing livestock ordinance in the City Code
and the lay down was the draft ordinance that would be presented to City Council.
MOTION:
Commissioner Bryson MOVED to recommend advancing the changes from the lay
down for public hearing and Commissioner Rogers SECONDED the motion.

Goddard Board of Adjustment Hearing on December 13, 2010.
Wind Turbine Study work session on December 15, 2010. Molloy
reported three sites were investigated and it was concluded a wind
turbine was not economically feasible for the City at this time,
City Council meeting of December 15, 2010.
Work Session with Legislators on December 21, 2010.
City Council meeting of January 5, 2011.
Molloy noted a work session would be held on new building codes scheduled for March
3, 2011.

The Kenai Racing Lions may need a conditional use permit if its usage
had changed.

and reported two would be making presentations to the review team on February 3,
2011
Buccaneer Alaska would be applying for a conditional use permit for a
gas manufacture and storage facility at the January 26, 2011 meeting.

General Information:
The City of Kenai has received an application for a Conditional Use Permit from
Buccaneer Alaska Operations, LLC to construct a natural gas storage facility on city
owned property located at 700 Marathon Road. The property is zoned Light Industrial.
This type of development is allowed by conditional use provided that all applicable safety
and fire regulations are met.
Included with the application is the Plan of Operations for the Kenai Loop Prospect
Exploration Program. This document describes an overview of the project. The project
will include three phases.
The initial project involves drilling the exploratory well which will involve the site
development including an access road and drilling pad. A drilling rig, the Kuukpik Rig

#5 or equivalent, will be onsite. The drilling pad will include the drilling rig, office
building, warm and cold storage areas, and maintenance buildings. During this phase, an
onsite office will contain housing for several personnel including the drilling supervisor
and tool pusher. Other personnel will be housed offsite. Once drilling is complete, the
drilling rig will be moved off-site.
The drilling portion of the project does not require a Conditional Use Permit. The City
will issue a drilling permit as required in Kenai Municipal Code Chapter 5. A copy of the
application for the drilling permit is attached. That application describes the well with a
true vertical depth of 10,500 feet. In addition, the City will issue a Special Use Permit
which will provide the use of the City property. If the well is successful, a lease
application for the ongoing use of the land will be submitted and processed and a pipeline
construction project would be developed.
Production equipment will be enclosed in a one -to -two story structure. (Photos of similar
sites are included with the application.) Typical equipment required for the production
will include multiple wellhead structures, separators, dehydrators, produced water storage
tanks, compressors and emergency generators.
KMC 14.20.150 details the intent and application process for conditional uses. The code
also specifies the review criteria that must be satisfied prior to issuing the permit. The
criteria are:
1. The use is consistent with the purpose of this chapter and the purposes and
intent of the zoning district.
The property is zoned Light Industrial. This zone is designed to provide for
the development of industrial and commercial uses which are usually
compatible and which are of a type which has no nuisance effects upon
surrounding property, or which may be controlled to prevent any nuisance
effects upon surrounding property. New residential uses and other non-
industrial uses, except as otherwise provided in this chapter, are not permitted
in this zone as principal uses because it is intended that land classified in this
zone be reserved for industrial and commercial purposes, and because the IL
zone is not suited to the excluded uses. Gas manufacturing /storage is provided
for as a conditional use in this zone provided that all applicable safety and
fire regulations are met.
The proposed facility appears consistent with the Light Industrial zone.
2. The value of the adjoining property and neighborhood will not be significantly
impaired.
The proposed development is consistent with industrial uses in the zone. The
facility is planned approximately 500 feet off Marathon Road. The closest

residential development is located approximately 1400 feet to the east.
Natural vegetation will be maintained around the site. A natural drainage
way and wetlands to the north and east of the site will restrict future
development in the area and provide a natural buffer.
There is no evidence that this development will impair the value of adjoining
property.
3. The proposed 'use is in harmony with the Comprehensive Plan.
This property is classified as Airport Industrial. The Airport Industrial district
identifies airport lands reserved for the Kenai Municipal Airport and its
future expansion, and tracts needed for present and future aviation related
uses and activities.
This property is located outside of the Airport Reserve and not needed for
future airport operations. Funding from the lease of airport properties
supports airport operations.
The proposed facility is in harmony with the Comprehensive Plan.
4. Public services and facilities are adequate to serve the proposed use.
The property is accessed off Marathon Road. The applicant will build an
access road to the site. Water and sewer service are available off Marathon
Road,
Public services and facilities are adequate to serve the proposed development.
5. The proposed use will not be harmful to the public safety, health or welfare.
State and Federal agencies regulate this type of development. Through the
permitting process, mitigation requirements and restrictions on the
development will be required to obtain permits from the various agencies.
The facility will be built to industry standards and will meet all building and
fire codes. The facility will be operated under industry guidelines. All
personnel will be trained in general and site specific environmental, spill
response, safety, and operating rules and regulations associated with this type
of development.
The proposed use will not be harmful to the public safety, health or welfare.
6. Any and all specific conditions deemed necessary by the commission to fulfill
the above mentioned conditions should be met by the applicant. These may
include, but are not limited to measures relative to access, screening, site

development, building design, operation of the use and other similar aspects
related to the proposed use.
Through the leasing and building permit process, the City will ensure that the
required State and Federal permits are in order and that sufficient buffers are
in place around the development. The site will be secured with security
fencing. No additional conditions are recommended for the proposed facility.
RECOMMENDATIONS
Buccaneer Alaska Operations, LLC has obtained oil and gas leases from the Alaska
Mental Health Trust Office in the City of Kenai. They are proposing to drill for gas on
City property located off Marathon Road and adjacent to the Beacon Occupational Health
Safety facility. The drilling operation requires a Special Use Permit from the City of
Kenai to locate on airport lands. A drilling permit is also required under Kenai Municipal
Code Title 5. The drilling portion of the project does not require a Conditional Use
Permit. In planning for a successful project, Buccaneer is applying for a Conditional Use
Permit to locate the natural gas production facility on this site.
This type of development requires multiple permits from the City, State, and Federal
governments. The City does not have the expertise to regulate the oil and gas industry
and relies on the State and Federal regulatory agencies to review and address permitting
for the development and operation of the facility. Attached is the "Plan of Operations"
for the Kenai Loop Prospect Exploration Program. In this document, the applicant
outlines the permits that are required for this type of development. The City will issue
and review the building permits to ensure the facility is built to meet required fire and
building codes. The Conditional Use Permit will ensure that the development is
consistent with the zone and in harmony with the Comprehensive Plan and that the
development is not a danger to the public.
The conditions required to issue the permit under KMC 14.20.150 have been reviewed. It
is administration's opinion that the development meets those criteria and recommends
approval with the following requirement:
1. All permits required from City, State, and Federal agencies must be approved
prior to construction of the facility.

to construct and operate natural gas production activities associated with our Kenai Loop Prospect
Development should our upcoming drilling activities prove successful. The exploration drilling activities
are discussed in the attached Plan of Operations.

CONDITIONAL USE STANDARD (KMC 14.20.150)
The Planning and Zoning Commission may only approve the conditional use if the commission finds
that all the following six (6) standards are satisfied. Each standard must have a response in as much
detail as it takes to explain how your project satisfies the standard. The burden of proof rests with
you. Feel free to use additional paper if needed.
1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning
district,
Area is currently zoned airport industrial
Airport activities may include high noise levels from aircraft activities. These same type of
noises may be present during periods actual drilling operations are underway.
2. The value of the adjoining property and neighborhood will not be significantly impaired;
The current City of Kenai plan includes light industrial activities for the general area.
Areas to the surrounding the site are currently undeveloped and owned by the City of Kenai.
Areas to the north and east are currently undeveloped. The Marathon Road and additional
undeveloped lands lie to the west.
The area to the south is used for educational purposes by Beacon Occupational Health Safety
Services who provides services mainly to oilfield service oil companies. The proposed operations
could possibly provide a hands on model for training in the immediate area.
3. The proposed use is in harmony with the Comprehensive Plan;
The proposed operations will initially include exploration drilling operations and then possibly
development operations.
The site was examined by an Archaeologist and there was no evidence found of historical or
cultural resources on the site.
There were no wetlands found on the site to be developed. A separation of at least 50 feet will be
maintained from wetland areas to the immediate east of the site.
Once these activities are completed, activities will be limited to a light industrial operation which
is the general zoning for the immediate area. There will be minimal manpower requirements for
the production operations.
4. Public services and facilities are adequate to serve the proposed use;
Water main and hydrant is located across Marathon Road from the site.
City sewer extends up to the property to the south.
Electric power lines run along the east side of Marathon Road which is immediately west of the
site.
Water, sewer and electric would probably all be needed for development operations.
S. The proposed use will not be harmful to the public safety, health or welfare;
An EPA approved Class I Non- Hazardous Waste Disposal Well may be used for deep injection of
liquid wastes.
All other wastes would be hauled offsite for disposal at approved sites.
Air emissions would be permitted under ADEC regulations. Air emissions are expected to be
minimal from the limited surface equipment.
The operations will be surrounded by a fence and locked gate.
Fire and gas sensors will be installed onsite and monitored continuously.
Sound barriers will be installed as appropriate.

There is a north -south band of wetlands to the east that separates the proposed site from other land
further to the east.

Subsurface owned by the Mental Health Trust Land Office and Buccaneer holds the oil gas lease.
The Marathon Road lies west of the site.
6. Any and all specific conditions deemed necessary, by the conxniission to fulfill the above
mentioned condlfttions should be met by the applicant. These may include, but are not limited to
m easures relative to access, screening, site development, building design, operation of the use
and other similar aspects related to the proposed use
The proposed operations will be limited and similar to those used by Marathon at their Ninilehik
Unit operations. The pad size should be about the same size as the drilling pad with most of the
area required by a drilling rig that will be moved offsite once all wells are drilled. A workover rig
or drilling rig may need to be used intermittently for well workovers, for drilling additional wells,
or for site abandonment.
Production equipment will be enclosed in one to two story structures similar to those shown on
the photos of other existing natural gas production facilities on the Kenai Peninsula. Equipment
would typically include multiple wellhead structures, separators, dehydrators, produced water
storage tanks, compressors and emergency generators.
A natural gas pipeline will need to be installed from the production pad to a point of sales yet to
be determined.

1. Permit Requirements
The Plan of Operations describes drilling operations proposed by Buccaneer Alaska
Operations, LLC "Buccaneer at their Kenai Loop Prospect and adjacent leases located
northeast of Kenai on the Kenai Peninsula in Southcentral Alaska. These operations
require developing plans and obtaining permits and approvals from the following

2. Overview and Timetable
Buccaneer proposes to drill two or more wells into Mental Health Trust Land Office
(TLO) oil and gas leases located within the City of Kenai on the Kenai Peninsula. The
general timetable for various activities are outlined as follow:
October to December 2010 Conduct drilling site evaluation
December 2010 to January 2011- Prepare and submit permits for project
January 2011- Obtain permission from land owners to construct a 500 foot long
access road to the Kenai Loop Well #1 location.
January to March 2011 Obtain permits and mobilize equipment and materials for
drilling the Kenai Loop #1 Well
February 2011- Construct a gravel access road and pad next to the Marathon Road
to drill the Kenai Loop Well #1.
March to April 2011 -Drill the Kenai Loop Well #1.
Additional wells and full scale development of the Kenai Loop Field will occur if the
field is determined to be commercial.
3. Well Site Access
The site is located approximately 0.5 mile up the Marathon Road and on undeveloped
land on the east side of the road. The Kenai Loop Well #1 will require a 500 ft long
gravel access road to get to the well site which will be on a gravel pad.
4. Drilling Operations
4.1 General
The wells will be drilled using the Kuukpik Rig #5 or equivalent drilling rig. The
planned well design will be similar to that employed in previous Cook Inlet exploration
wells and in accordance with a Permit to Drill from the Alaska Oil and Gas Conservation
Commission (AOGCC). Due to the exploratory nature of the well, nearly all information
regarding the down hole aspects of the well is confidential.
The gravel pad for the wells will be approximately 400 ft by 500 ft. The access road will
be constructed of gravel and will be about 30 feet wide.
Subsurface ownership for all areas to be drilled is held by State of Alaska Mental Health
Trust Land Office. Surface ownership for the Kenai Loop Well #1 is held by the City of
Kenai.

Buccaneer will acquire the required State Oil and Gas Bonds for the proposed drilling
operations.
4.2 Support Facilities
The drilling pad will include the drilling rig, office building, warm and cold storage
areas, and maintenance buildings.
The onsite office will contain housing for several personnel including the Drilling
Supervisor and the Toolpusher. All other drilling personnel will be housed offsite in
existing facilities available locally.
Up to 10,000 gallons of diesel fuel may be stored at the drilling site in lined, bermed fuel
storage areas. Fuel will be re- supplied to the site from existing local suppliers.
Communications systems will be installed in the camp buildings.
4,3 Testing and Surveys
Production tests may be performed as needed after production casing is set. Testing may
include extended flow periods to determine the productivity of the well. Testing will be
accomplished in accordance with approved techniques.
Vertical seismic profiles (VSPs) may be acquired using off road capable vibroseis trucks.
These operations will generally occur within a 2 -mile radius of the surface location of the
well.
5. Water Requirements and Sources
Fresh water is needed primarily for drilling operations. Normal water requirements are
expected to be less than 1,000 gpd except when mixing new drilling mud in which case
10,000 gpd may be required.
Water will be provided from the City of Kenai who has a water hydrant located across
Marathon Road near the drilling location. New sources of water are not required.

6. Wastes and Emissions
6.1 Drilling Wastes
An estimated 2,000 bbl of water based drilling mud and cuttings may be generated from
the operations. Waste drilling mud and cuttings may either be injected into existing wells
in the area or be hauled to existing offsite facilities for disposal.
Prior to hauling, the cuttings and liquids will be temporarily stored in onsite containers
either on the well site or at the staging areas, but in either case storage will be in
compliance with ADEC temporary storage permits. All wastes will be disposed of prior
to completion of the operations.
6.2 Non Drilling Wastes
Solid, non burnable waste will be deposited in dumpsters located at the site. These
containers will be hauled to local landfills for disposal. The food waste that could attract
wildlife either will be stored in enclosed containers awaiting periodic hauling, or such
wastes will be hauled each day to an approved disposal center.
To reduce the amount of trash that must be hauled from the drilling location, all solid,
burnable waste may be incinerated at the location in accordance with 18 AAC 50. The
ash will be hauled to the existing landfills.
Limited wastewater generated onsite will either be treated and disposed of onsite in
accordance with federal /state permits or be hauled to an approved disposal facility
locally. The drilling operations should generate less than 1,000 gpd of domestic
wastewater.
6.3 Produced Fluids
All fluids from production testing will be held in tanks until the testing is completed.
After testing, the fluids will either be injected back into the formation from which it was
produced or hauled to Nikiski oil and gas production facilities for processing and/or
product recovery.
6.4 Air Emissions
Sources of air emissions from the operation are rig engines, camp generator engines,
steam generators, waste oil burners, hot -air heaters, light plants, incinerators and well test
flaring equipment. Buccaneer will obtain the ADEC General Permit MGP1 for Oil
Gas Drilling Rigs and will comply with the stipulated parameters established under this
authorization.

7. Well Abandonment and Site Closure
Upon completion of drilling and evaluation operations, all debris will be hauled to an
approved disposal site. Spills or soil contamination occurring on the pads will be
removed and disposed of at an approved manner or disposal facility.
Depending on the results of the drilling activities and/or testing, the well may either be
plugged and abandoned in accordance with applicable AOGCC regulations, left in a
condition to re -enter and resume drilling operations in a succeeding year, or left in a
condition to permit the well to be produced. If the drilling is not successful, the access
road and pad will be left in place in accordance with desires of the City of Kenai who is
the land owner.
8. Environmental Issues and Contingency Plans
8.1 Wildlife issues
The usual wildlife that could be in the area during the winter include owls, ravens, foxes,
moose, and brown and black bears. Encounters with wildlife are expected to be minimal
as the drilling location is adjacent to existing activities within the City of Kenai.
Project personnel will be instructed not to feed wildlife of any type or in any other way
attempt to attract them either at the drill site or on the roads. Food will be kept inside
buildings or containers that minimize odors. Hazardous materials will be kept in drums
or other secure containers.
Building and drill pad layouts will be designed to maximize visibility and minimize
potential areas that a bear could crawl into or otherwise be hidden from view. Any
sightings will be immediately reported and the personnel in the area warned of the
location of the bear.
Buccaneer will have an approved Oil Discharge Prevention and Contingency Plan (C-
Plan) for drilling operation into the oil bearing formations (Hemlock Formation).
Information related to immediate response actions, receiving environments, spill cleanup
mobilization response times and well control can be found in that plan. Buccaneer plans
to use Alaska Chadux Corporation (ACC) as a Primary Response Action Contractor.

8.2 Oil Spill Contingency Plans

The drilling contractor holds an EPA Spill Prevention Control and Countermeasure Plan
(SPCC Plan) for their fuel storage facilities associated with drilling operations.
Additional SPCC requirements will be handled in the C-Plan as appropriate.
Cultural resources studies for site clearance were conducted to assess any known sites,
and to locate unknown sites. These included a surface inspection of the site in October
and December of 2010 and examination of test pits conducted to determine soils
conditions in December 2010. There were no sites identified in the studies to indicate
that historical, archaeological or cultural resources would be impacted by the project.

Buccaneer will hold meetings locally as appropriate to present additional information

A RESOLUTION OF THE KENAI PLANNING AND ZONING COMMISSION
RECOMMENDING KENAI CITY COUNCIL AMEND KENAI MUNICIPAL CODE
CHAPTER 3.10, CONTROL AND TREATMENT OF ANIMALS, TO PROVIDE FOR NEW
REGULATION OF BEEKEEPING WITHIN THE CITY OF KENAI INCLUDING THE
CITATION PROCEDURES AND PENALTIES FOR VIOLATION OF ORDINANCES, AND
MAKING TECHNICAL CHANGES AND CORRECTIONS.
WHEREAS, honey bees (species Apis mellifer'a) are of benefit to humankind by
providing for agriculture and fruit and garden pollination services, and by furnishing
honey, wax, and other useful products; and,
WHEREAS, domestic strains of honey bees have been selectively bred for desirable
traits, including gentleness, honey production, tendency not to swarm, and non
aggressive behavior; and,
WHEREAS, gentle strains of honey bees can be maintained within populated areas in
reasonable densities without causing a nuisance if the bees are properly located and
carefully managed and maintained; and,
WHEREAS, there are hundreds of beekeepers throughout the State of Alaska and
there are many beekeepers that reside in the City of Kenai; and,
WHEREAS, the City recognizes that adverse neighborhood impacts, including but
not limited to swarming, stinging and the spread of disease, may result from the
keeping of bees if appropriate and responsible beekeeping practices are not followed;
and,
WHEREAS, regulation by the City is intended to create standards and requirements
that help to ensure that bees kept by residents do not adversely impact the use and
enjoyment of neighborhood properties surrounding the property on which the bees are
kept; and,
WHEREAS, it is in the best interests of the City to adopt standards for the keeping of
bees within the City limits.

ALASKA, AMEND KENAI MUNICIPAL CODE CHAPTER 3.10, CONTROL AND
TREATMENT OF ANIMALS as follows:
Section 1. Form: This is a Code ordinance.
Section 2. Amendment of Section 3.05.070 of the Kenai Municipal Code: The Kenai
Municipal Code, Section 3.05.070, Citation procedure, is hereby amended as follows:
3.05.070 Citation procedure.
(a) An officer may serve a summons and complaint in the form of a citation upon a
person for violating a provision of this chapter, or a term, condition, or limitation of a
license issued hereunder, or a City regulation promulgated under this title.
(b) A summons and complaint issued under this section shall contain a notice
directing the person to whom it is issued to appear to answer to the charge in the
District Court for the Third Judicial District of the State of Alaska at Kenai.
(c) An officer who issues a summons and complaint under this section shall deposit
the original and a copy of the citation with his immediate superior who shall forward
the citation to the District Court for the Third Judicial District of the State of Alaska at
Kenai. Thereafter, the summons and complaint may be disposed of only by official
action.
(d) A summons and complaint in the form of a citation that fulfills the requirements
for a complaint under the District Court Rules of Criminal Procedure promulgated by
the Supreme Court of the State of Alaska shall be deemed a lawful complaint for the
purpose of prosecuting a violation of this title.
(e) Mandatory Court Appearance shall be required:
(1) For a violation of KMC 3.10.020(c).
(2) For a violation of KMC 3.10.0700).
([2]) For all cruelty charges under this code.
(4[3]) Upon second citation of all other provisions of Chapter 3.10 in a twelve (12)
month period.
Section 3. Amendment of Section 3.10.070 of the Kenai Municipal Code: The Kenai
Municipal Code, Section 3.10.070, Livestock within the city limits, is hereby amended
as follows:
3.10.070 Livestock within the city limits.
(a) Except as otherwise provided in this section, no person shall keep or maintain
livestock within the City of Kenai.
(b) Livestock, other than bees, may be kept on lots of forty thousand (40,000) square

feet or greater. No livestock shall be allowed in the RU, RS1, RS2 or TSH zones.
Animals raised for a fur bearing purpose are not allowed in any zone. Beekeeping will
be restricted as described in 3.10.070(g).
(c) In this section "livestock" is defined as the following animals:
(1) Cow
(2) Horse
(3) American bison
(4) Llama
(5) Alpaca
(6) Sheep
(7) Swine
(8) Goat
(9) Mule
(10) Donkey
(11) Ratite
(12) Duck
(13) Goose
(14) Chicken
(15) Turkey
(16) Rabbit
(17) Honey Bees (Apis mellifera)
(d) (1) Except for the RS1, RS2, RU, TSH zone(s), the Chief Animal Control Officer may
issue temporary permits of not more than fourteen (14) days for the keeping of
livestock not otherwise allowed for public exhibitions or entertainment events. The
Chief Animal Control Officer may impose conditions on the permits as reasonably
necessary for sanitation, safety, or hygiene. The permit may be revoked for a violation
of the conditions of the permit or pertinent section of the Kenai Municipal Code. The
City may charge a permit fee, which fee shall be as set forth in the City's schedule of
fees adopted by the City Council. [THE CITY MANAGER MAY SET A PERMIT FEE AS
SET OUT IN KMC 7.15.100.]
(2) Except in the RU zone, the Chief Animal Control Officer may, after notifying
adjoining property owners in writing and allowing reasonable time for comment, issue
a permit for the keeping of livestock for educational or youth activities, such as 4 -H,
Future Farmers of America, or Boy /Girl Scouts on lots not otherwise eligible under
this section. The permit shall state the duration of the permit, which shall not exceed
two (2) years, and the type and number of livestock to be kept. The Chief Animal
Control Officer may impose conditions on the permits as reasonably necessary for
sanitation, safety, or hygiene. The permit may be revoked for a violation of the
conditions of the permit or Title 3 of the Kenai Municipal Code. Appeal of issuance or
revocation of a permit may be made in writing to the board of adjustment. A permit
may be renewed following written notice and reasonable time for comment to the
adjoining property owners. The City may charge a permit fee, which fee shall be as set
forth in the City's schedule of fees adopted by the City Council. [The City Manager

may set a permit fee as set out in KMC 7.15.100.1
(e) Lots on which livestock are kept on the effective date of the ordinance codified in
this section which are not eligible for the keeping of livestock under this section shall
be considered a non conforming use of land under KMC 14.20.050. No new or
replacement livestock may be kept or introduced on such lots after the effective date of
the ordinance codified in this section. Offspring of livestock allowed as a non-
conforming use under this section may be kept on such lots only until they are old
enough to be relocated to a site conforming to this section or outside of the city limits.
(1) Except as set forth in subsection (g), below, c[C]orrals, pens, hutches, coops or
other animal containment structures must have a minimum setback of twenty -five feet
(25') from the property's side yards, fifty feet (50') from the front yard, and ten feet (10')
from the back yard,[;] All animal containment structures [AND] must be secure and in
good repair.
(g) No person may keep honey bees, Apis mellifera, in a manner that is inconsistent
with the following requirements or that is inconsistent with any other section of this
Code.
(1) Colonies shall be managed in such a manner that the flight path of bees to and
from the hive will not bring the bees into contact with people on adjacent property. To
that end, colonies shall be situated at least twenty -five feet (25') feet from any lot line
not in common ownership; or oriented with entrances facing away from adjacent
property; or placed at least eight feet (8') above ground level; or placed behind a fence
at least six feet (6') in height and extending at least ten feet (10') beyond each hive in
both directions.
(2) No person shall keep more than four (4) hives on a lot of 10,000 square feet or
smaller, nor shall any person keep more than one (1) additional hive for each
additional 2,400 square feet over 10,000 on lots larger than 10,000 square feet.
(3) It shall be a violation for any beekeeper to keep a colony or colonies in such a
manner or in such a disposition as to cause any unhealthy condition or to interfere
with the normal use or enjoyment of any property in the vicinity of the colony by
humans or animals.
(4) Each beekeeper shall ensure that a convenient source of water is available to the
bees at all times during the year that the bees are active so that the bees do not
congregate at pools, pet water dishes, bird baths or other water sources that are not
part of the natural landscape where the bees may come into contact with humans,,
pets, or birds.
(5) Beekeepers shall take appropriate care according to best management practices
when transporting hives of bees. Bees being transported shall have entrance screens
or be secured under netting.

(6) Beekeepers shall acquire hives and hive equipment from sources that are free from
American Foulbrood and other bee related diseases and pests.
(7) The term "hive" as used in this section means the structure intended for the
housing of a bee colony. The term "colony" as used in this section means a hive and
its equipment and appurtenances, including bees, comb, honey, pollen, and brood.
(12[G]) A person seeking relief from the provisions of this section may apply for a
conditional use permit under KMC 14.20.150.
[(h) THE ORDINANCE CODIFIED IN THIS SECTION WILL COME BACK TO THE CITY
COUNCIL FOR REVIEW TWENTY -FOUR (24) MONTHS AFTER THE EFFECTIVE
DATE.)
Section 4. Severability: If any part or provision of this ordinance or application
thereof to any person or circumstances is adjudged invalid by any court of competent
jurisdiction, such judgment shall be confined in its operation to the part, provision, or
application directly involved in all controversy in which this judgment shall have been
rendered, and shall not affect or impair the validity of the remainder of this title or
application thereof to other persons or circumstances. The City Council hereby
declares that it would have enacted the remainder of this ordinance even without such
part, provision, or application.
Section 5. Effective Date: Pursuant to KMC 1.15.070(f), this ordinance shall take
effect one month after adoption.

Day care facilities shall be inspected by the Fire marshal for compliance with the fire code (KMC 8.05)
prior to approval of the permit. Thereafter, they shall be inspected every other year by the Fire marshal.
Failure to comply with the fire code (KMC 8.05) shall be grounds for the suspension or revocation of the
facilities' home occupation permit.
Residences which are the subject of a home occupation permit application (other than day care facilities)
may be required to be inspected by the Fire Marshal for compliance with the fire code (KMC 8.05) prior
to approval of the permit, if the Fire Marshal determines it is necessary for public safety.

In September 2010, Carolyn Unger spoke to the City Council and Planning Commission
relating concerns that the City did not regulate outdoor wood burning boilers (OWB).
Administration advised Council that when time permitted, the Commission would be
asked to discuss OWB's to make a recommendation as to whether the City should
regulate this type of boiler.
This issue came as result of Ms. Unger believing a property owner in Woodland
Subdivision was installing an OWB and discovering that no building or zoning permits
were required by the City. Further investigation by the City found that the property
owner was not installing an OWB but instead an outdoor sauna.
Since the initial discussion, to my knowledge, there have been no further complaints in
the City regarding OWB's.
Does the Commission want to schedule a work session to discuss possible
regulations for Outdoor Wood Burning Boilers in the City of Kenai?
