Administrative Assistant Shinn distributed color copies of the 5 -shirt design, poster,

6 -a. Discussion /Recommendation -- Kathy Chircop, d /b /a Alaska Realty
Group, Inc. Request to Lease Additional Airport Terminal Space
The Commission reviewed the information included in the packet related to the
request for additional leased space in the airport terminal building. It was noted it
would be a month -to -month lease and if an aviation - related business requested lease
space, the Chircop lease for this space would be terminated. A suggestion was made
to move the pipeline display to another location to provide additional lease space.
MOTION:
Commissioner Bielefeld MOVED to recommend to Council the terminal space be
leased to Alaska realty Group, Inc. and Commissioner Zirul. SECONDED the motion.

Subject: Schilling Rentals, LLC — Amended Lease Application
On February 4, 2011, a lease lot inspection was conducted on Lot 3, Block 2, General
Aviation Apron, leased to Schilling Rentals, LLC.
Airport and City staff noted that the current use of the property conflicted with the
purpose and use (aircraft maintenance & operations) stated in the original lease. City
Administration notified the Lessee that they were out of compliance with the terms of the
lease, to request a change of use, and utilize the facility for aviation related purposes.
Attached for your review and recommendation is a lease application to amend the use
to "air freight shipping and receiving and /or aircraft parking".

On April 19th, I reviewed the original lease application and noted concerns with the
application, as submitted, and whether it conformed to the Airport Layout Plan and the
Comprehensive Plan. The amended lease application identifies the proposed use of
the property as air freight shipping and receiving or aircraft parking. The following
information addresses the amended application and stated use(s).

This property is located at 155 Granite Point Court and is located in the Airport Reserve.
➢ Airport Land Use Plan — The ALP was approved in July, 2009. On sheet 13 of
the plan, the property is identified as Aviation Related Activities. Sheet 14 of the
approved ALP, identifies the parcel as General Aviation and Light Commercial.
The Supplemental Plan defines General Aviation /Light Commercial as, "Areas
used by general aviation and light commercial aviation activities requiring taxiway
access to the paved runway. Uses shall be restricted to aircraft meeting taxiway
pavement strength limitations and taxilane and taxilane object free area width
standards defined in FAA Advisory Circular 150/5300 -13."
The proposed uses conform to the ALP.
➢ Comprehensive Plan,— The City of Kenai Comprehensive Land Use Plan
identifies this area as Airport Industrial. The Airport Industrial area is defined as,
"The Airport Industrial district identifies airport lands reserved for the Kenai
Municipal Airport and its future expansion, and tracts needed for present and
future aviation - related uses and activities.
The proposed uses conform to the Comprehensive Plan.
Zoning —The property is zoned IL — Light Industrial. Warehouses and Airports
and related uses are permitted within the zone.
Based on the information provided in the amended lease application, the proposed
lease conforms to the ALP, Comprehensive Plan, and Zoning.

21.10.070 and the findings are below:

SCOPE OF PROJECT
The Float Plane Basin Phase One Project is the first phase, of several, to develop combined
water and land General Aviation Facility on the Kenai Municipal Airport, This project will
establish and side improvements adjacent to the Float Plane Basin Facility, between the Float
Plane Basin and Runway IL -19R, with Taxi Lanes providing access for Tee Hangars and Shelters
as well as conventional hangers. The Taxiway -Taxi Lane system will also provide access to west
side airfield facilities as well as amphibian access to the Float Plane Basin.
The project will entail a significant amount of excavation and drainage work followed by
embankment construction utilizing sand stockpiled material on the Airport from previous
projects. The Taxiways will be paved, and receive Taxiway lighting and signage as well as
pavement markings. Electric and Gas Utilities will be extended into the facility and the City is
considering extending a water fire line in as well. No sewer service is planned at this time.
The Runway Safety Area and the terrain adjacent to the Localizer Critical Area will receive
grading improvements to correct some deficiencies pointed out by FAA during prior
Certification Inspections.
PROJECT HISTORY
Several development scenarios were presented to the Airport Commission beginning in 2008.
T he selected plan, shown below, underwent an Environmental Assessment with a "Finding of
No Significant Impact" issued in August 2010.
Design work commenced with Field Work and Design Development in October. Based on input
from interested leasers and the Airport Commission several more development plans were
prepared for consideration with the figure shown below selected to advance to final design.
The Plans, attached to this report, reflect a few changes in the alignment of Taxiway "S ", the
Lease Lot area reduced to 100 feet , and of course does not include the future Taxi Lane shown
on the East side at this time.
GEOTECHNICAL INVESTIGATION
On October 8, 15 test pits were excavated across the project foot print. Two shallower test pits
were hand dug in December. Test pits along the west side of Taxiway "S" and out to Float Plane
Road identified overburden depths to native non frost susceptible sand and the absence of
ground water to the depth of at least 10 feet. A majority of the test pits were taken across the
area to be developed as this area has been disturbed several times over the past 45 years most
recently in 1992 when the airfield underwent a large Runway Safety Area and Drainage earth
work project.
Taxiway "5 ", for the most part, will align over what once was a natural drainage that over the
past 40 years has been constructed to control the Basin water elevation and provide for it's
over flow. In 2007 the ditch was cleaned out, reshaped and reseeded. The development area
has been filled, over several projects, resulting in several feet of Silty material, over native Kenai

sands, varying in depth from 5 to 10 feet. No organics or wood debris were encountered and
the material was found fairly well drained, and moderately dense, with silt content of between
26% and 71 %, averaging 49 %. The material will provide good sub grade qualities with good
drainage and a suitable non frost susceptible section provided Test Hole Logs and Laboratory
test results are attached as Appendix B
DESIGN CONSIDERATIONS
Aircraft Design Group (ADG): Over the long term the design aircraft is ADG I with occasional
ADG II operations. Taxiway "5" dimensions provide for ADG II aircraft while the Taxi Lanes
provide safety area width for ADG II and object free area width for ADG I to accommodate
normal operations and vehicular parking alongside hangars as well as the infrequent use by
ADG 11 aircraft.
Typical Sections: Frost susceptible soils will be removed to native sand or to a maximum depth
of 48 inches below finish grade. Geotextile Separation Fabric will be provided, where required,
under paved sections and sand embankment provided from airport sand stockpiles. An 8 inch
gravel sub base will be provided and due to the light traffic loading 2 inches of D -1 crushed base
and 2 inches of asphalt will complete the section.
Drainage: Centered on the lease lot area, between the Taxi Lanes, a longitudinal grade of 0.5%
with a transverse grade of 1,0% will provide uniform sheet drainage at about 1.2% to ditches
along the East and West side of the development. The 42" basin overflow drainage system Is
connected and the ditch backfilled for Taxiway "5".
Lighting and Signage: Taxi way "5" will be lit off the existing high intensity Taxiway T -1 circuit
with LED fixtures in a watertight HDPE conduit and can system. The Taxiway will be lit from the
run way, including Elevated Runway Guard Lights (wig wags) to and into the Taxi Lane
intersections. Hangar exterior lighting will provide lighting along the Taxi Lanes as they
develop.
Appropriate signage is provided at the Runway /Taxiway intersection. Taxi Lanes are not
proposed to be signed as they are not intended for transient use. Additional "Yield to Aircraft"
and "Authorized Vehicles Only" signage will be provided inside the secure area to control
vehicular traffic as is the practice in the East Side General Aviation area.
Security Fencing and Gates: Security fencing is reconfigured to maintain the current level of
airport security. All gates remain physically locked or electronically controlled restricting access
into secure areas while 5`h avenue gate is electronically and manually operated to
accommodate transient access. Under Phase One the security fencing will cross the end of
Taxiway "5" and connect to the perimeter fence and gate at 5th Avenue. When Phase Two
advances the Taxiway and Access Road system around the West side, the fence will be
relocated to separate the Taxiway and Access Road with a gate system to control aircraft and
vehicle crossings at the 5th Avenue Access Road intersection. The Gate Control Systems are
specified so as to match the several gates installed in 2004. In addition, an improved Load
Center design is provided to provide for expansion and better protection of the circuits.
ATCT Control Areas: It is anticipated that the tower will assume control of ground traffic at the
T/W "5" and Taxi Lane One intersection. A holding bay along Taxiway "5" near the runway,
while desirable, will not be necessary until operations approach 30 per hour. That demand is
not expected over the life of this first pavement construction and can be added with a
pavement rehabilitation project in the future.
Pavement Markings: Enhanced Centerline, Runway Hold Lines and Surface Designation
Markings are provided with double yellow edge markings along Taxiway "5" and the East and
West sides of Taxi Lanes One and Two. Dashed double yellow edge markings are provided
fronting hangar areas.
With concurrence of FAA a Non- Movement Area marking will be placed across Taxiway "5" at
the Taxi Lane One intersection
PROJECT SPECIFICATIONS
The State of Alaska, Department of Transportation, Standard Specifications for Airport
Construction, General Provisions and Technical Specifications were utilized and edited for
Project specifics. The City typically prepares the "front end documents" i.e. Bidders
Information, and Completed Forms, and the Contractors Contract Forms. Public Works should
have the Apron Project Documents for a template and if not WCB can provide them.
On May 19, 2011 the State of Alaska issued a new General Permit for Discharges from Large
and Small Construction Activities. This document will need to be reviewed to make sure the
current Erosion and Pollution Control (SWPPP) Specifications are in compliance with the new
Permit requirements.
UTILITIES
Homer Electric Association (HEA), Alaska Communication Systems (ACS) and Enstar Natural Gas
(ENSTAR) currently provide utility service to the Kenai Airport.
The Primary Electric lines that currently feed the Airfield power grid for NAV /Aids, ASOS, and
the Floatplane Basin fueling facility and security gate are direct bury lines and in conflict with
the new Access Road and Taxi Lane Two. The Primary Phone line, also in conflict, only serves
the public phone at the Basin fuel facility and may not warrant relocation with existing Cell
Phone service available and the possibility that Wireless Internet Service, if not available now,
could be provided from the Terminal in the future. The existing lines were installed in 1993,
are over half way to the end of a dependable useful life, and, in the case of the electric, feed
important navigation equipment and their relocation will benefit those important NAV /Aid
systems. Enstar currently feeds gas to the Water Tank Pump House providing a convenient
point for extending service into the development area.
Strategic location of the relocated utilities will benefit the Airport in providing a convenient
opportunity to co- locate primary pull boxes with secondary transformers. Leasers will be

required to install their own services as the area develops. The following table shows the
scaled length of existing and relocated power and phone as well as amenities added for Airport
service connections. The existing and proposed relocated and extended utilities are shown on
the plan sheet 23

Relocation of conflicting utilities are grant eligible expenses, however, utility upgrades,
extensions, and amenities are not and would be paid for by the City. The utility companies
have not completed their relocation plans and estimates yet but discussions with them provide
the following budget figures:

HEA recommends that under the current utility policy the most economical installation is to

facility would be installed under an Owner - Developer agreement that is shared by HEA and the
City 40 % -60% respectively. Under that plan, estimated costs would be:

City of Kenai, Water and Sewer utilities are not proposed to be extended into this area at this
time however underground casings will be provided for future use. It should be noted that
Hangar Insurance may be a consideration and the extension of a Fire Line into the south end of
the development may have positive influence on Insurance rates and potential lease's. An 8

inch, AC water line, that used to connect old City wells to the system, exists about half way in
on the 41h Avenue access road adjacent to the Water Tank. About 700 feet of 6 inch line would
be necessary to install a fire hydrant at the south end of the lease lot area. At an estimated cost
of $55,000.00.
CONSTRUCTION SAFETY
A Construction Safety Plan is provided showing the project footprint, allowable haul routes,
waste areas, sand stockpiles, NAV /AID critical areas, and the Runway Object Free Area that will
require special provisions controlling access and construction operations. A detail is provided
for displacing the Runway IL Threshold while working in the Runway Safety Area. A marked and
lit displacement will be necessary for about 5 days to complete excavation, backfill and restore
the Safety Area. Periodic day displacements will occur for electrical installations, final grading,
and paving.
General provisions, section 80.04, "limitations of operations" further defines construction
safety and construction requirements within and near controlled movement areas.
CONSTRUCTION COSTS
The 2011 and 2012 bid climate is very good for owners this year on the Kenai Peninsula. There
have been no large earthwork projects bid for this season and ADOT has none scheduled for
next year on the Kenai Peninsula at this time.
Due to uncertain funding schedules, several bidding scenarios are provided to allow the City to
be prepared to take advantage of one grant or two grant cycles.
Scenario One is funded under one grant. Two Basic Bid Schedules are provided reflecting City
supplied waste areas or not. Scenario T.vo is funded under two grants and is constructed over
one, or two seasons. Schedule One includes the heavy earthwork, drainage, fencing and
related items . Again two schedules are provided reflecting where the waste areas are.
Schedule Two Includes electrical, borrow import, grading, paving and related items to complete
the project. Scenario Two would work well for a 2011 late summer start and an early summer
2012 completion however mobilization/ demobilization would increase somewhat. Following is

PROJECT SCHEDULING AND FUNDING
The July 2010 - Kenai AIP Program, maintained by Airport Management, in consultation with
Wince - Corthell- Bryson, estimated the total project costs for Construction and Administration
at $2,537,097, about 3% lower than the above Engineers Estimates. City Utility expenses were
estimated at that time at $65,000 about 12% under the above Estimate. Considering this
projects Engineer and Utility estimates are probably a bit high, the Project funding
requirements and programming by the FAA is probably in pretty good shape at this point.
As the project is a Development Project and will not score well for Discretionary Funding,
Entitlement Funding will fund the project. Discussions with Airport Management and FAA have
provided the following Funding information. It is important to know that the Re Authorization
Acts from Congress has been irregular in timing but in the past the funding has come available
in early winter, late spring, and mid- summer.

As is shown above, the total available in 2011 is $704,083 short for bidding Scenario Two —
Schedule One. Schedule Two estimated at $1,116,345 will bring the total Entitlement need
to $1,820,428 and appears it will take the entire FY 2012 Entitlement Funding that has been
about $1,100,000 over past years.
That being the case, it would appear that the earliest the City should consider bidding the
project is May 201 2for construction over the late 2012 and early 2013 construction seasons.

GENERAL AIRPORT INFORMATION
The Kenai Airport has a precision instrument approach on Runway 19R and a non - precision instrument approach on Runway 01L. There is a
float plane basin with a separate taxi lane and tie down area. Fuel is available 24 hours a day. Transit parking is available for wheeled, float and
ski planes. Envelopes and deposit slot for payment are provided in the registration building.

FLOAT PLANE FACILITIES
The Kenai float plane facility offers 25 long -term tie -down slips, 10 itinerant slips, accommodating aircraft with up to a 48 -foot wing
span in private slips and a 65 -foot wing span in commercial slips.
The landing and takeoff water runway is 4,653 feet long and 250 feet wide. There is vehicle access to the facility via Float Plane
Road off First Street.
Pay telephones and restrooms can be found at the registration building at the south end of the parking lot and taxi waterway along
with a transition ramp and paved apron for those who wish to seasonally convert their aircraft from floats to ski's or wheels. Upon
arrival, visiting pilots must register their aircraft in the registration building.
Fuel and minor aircraft repair and maintenance services are also available at the airport.

Effective September 24, 1999
The following procedures are in effect to promote a good neighbor policy between the users of the Kenai Municipal Airport and the residents of
Kenai. This program is published as voluntary in nature, however, it is expected that companies and individual pilots operating at this facility
will make every effort to follow these procedures.
These procedures are directed at large, heavy and jet aircraft performing training maneuvers and do not override procedures for aircraft on an
IFR flight plan.
Unless otherwise instructed by Air Traffic Control, the following voluntary noise abatement procedures are in effect at Kenai.
1. Training flights for large, heavy and jet aircraft will be prohibited from 2200 Local until 0700 Local.
2. At the discretion of ATC (Air Traffic Control) and when traffic, wind, and other conditions allow, aircraft will land runway 19R and depart
On.
3. These procedures are written assuming a right traffic pattern on 011. If conditions do not allow for this or other noise abatement
procedures to be followed. ATC will restrict aircraft to one operation and request they depart the airspace until such time as there is a
reasonable expectation that noise abatement procedures can be adhered to.
4. Large, heavy and jet aircraft will strictly comply with the 1600 MSL visual pattern altitude.
• Visual patterns using Runway 19R: Aircraft on departure will not turn crosswind until at least 1000 MSL and % mile past the
shoreline. A wide pattern will be flown west of the prison.
• Visual pattern on Runway 011: Fly a wider than normal pattern, remain west of prison. Initiate turn to base Yz mile past the
shoreline over the water.
S. Large, heavy and jet aircraft circling from a published approach under VFR will do so at 1000 AGL or higher. Aircraft will circle west and
initiate circle so as to avoid housing areas west and southwest of the airport.
• Circle to Runway 19R: Initiate circle over water at least % mile from the shoreline. Fly a wider than normal pattern and remain
west of the prison.
• Circle to Runway 011: Fly a wider than normal pattern, remain just west of the prison. Initiate turn to base at least 1/, mile past
the shoreline over the water.
6. No tactical (extreme low level) type approaches are permitted on 01L.
7. All companies desiring to conduct training activities involving large, heavy or jet aircraft at the Kenai Municipal Airport will provide the
Airport Manager with a contact phone number for noise complaints.
It is expected that all pilots operating at this facility will demonstrate regard for the neighboring community and conduct their operations
accordingly.

DISADVANTAGED BUSINESS ENTERPRISE
PROGRAM
The City of Kenai has established a Disadvantaged Business Enterprise (DBE) program in accordance with regulations of the U.S. Department of
Transportation (DOT), 49 CFR Part 26. The City of Kenai has received federal assistance from the DOT, and as a condition of receiving this
assistance, the City of Kenai has signed an assurance that it will comply with 49 CFR Part 26.
It is the policy of the City of Kenai to ensure that DBE's, as defined in Part 26, have an equal opportunity to receive and participate in DOT
assisted contracts. It is also our policy to:
• Ensure nondiscrimination in the award and administration of DOT assisted contracts.
• Create a level playing field on which DBE's can compete fairly for DOT assisted contracts;
• Ensure that the DBE program is narrowly tailored in accordance with applicable law;
• Ensure that only firms that fully meet 49 CFR Part 26 eligibility standards are permitted to participate as DBE's;
• Help remove barriers to the participation of DBE's in DOT assisted contracts; and
® F. the development of firms that can compete successfully in - .narket place outside the DBE program.
The Airport Manager has been delegated as the DBE Liaison Officer. In that capacity, the Airport Manager is responsible for implementing all
aspects of the DBE program. Implementation of the DBE program is accorded the same priority as compliance with all other legal obligations
incurred by the City of Kenai in its financial assistance agreements with the DOT.

Airport Improvement Program:
Apron Rehabilitation: Winter shutdown. Start up meeting scheduled later this month.
Float Plane Basin Facility Improvement Project: Wince - Corthell- Bryson is working on the
design.
Master Plan — City Administration is working on a scope for this project.
FAA Grant Funds: The City has received the grant offers for 2 new pieces of snow removal
equipment and the Wildlife Hazard Assessment.
On- Airport Car Rental Concession: Advertising for the rental car concession starts on
Thursday, April 14m. There will be a prebid meeting on Friday, April 22 with bids due Friday,
May 13m. The new concession agreements will be for 5 years starting June 1, 2011.
Airport Emergency Plan (AEP) — The new AEP was officially approved by the FAA on March
15, 2011. This is the 1st approved plan in the State! Thank you to Fire Chief Mike Tilly and
Erica Shinn, Airport Administrative Assistant, for their contribution to this effort.
Float Plane Basin Fuel Pump — The new fuel pump was installed the weekend of April 9`"
The Finance Department is currently working on the credit card operating system, which will be
followed by staff training on the new software.

airport reserve and findings were reported to City Administration. The Assistant to the City
Manager is reviewing the leases along with the inspection reports and notifying lessee's of any

2011 Kenai Peninsula Air Fair: The poster and t -shirt design have been completed and both
should be available for Airport staff to take to the Fed Ex /Alaska Airmen's Trade Show the end
of this month. Erica has collected some very nice poker run prizes. The Committee is having
their first meeting on Thursday, April 14 at 4p.m. Everyone is welcome to participate. Again the
event is Saturday, June 4, 2011, if you can volunteer please contact Mary or Erica.

participation this year. The Air Force Band "Northern Lights Brass" will be performing at 1:00

Airport Maintenance: Airport staff has been busy with crack - sealing, sand pick -up and

SPECIAL USE PERMIT
THE CITY OF KENAI (CITY) for the considerations and pursuant to the conditions and
requirements set forth below, hereby grants to ASHLEY BULOT HANSEN D/B /A AK
KIDS (PERMITTEE), whose address is 130 South Willow, Unit 9, Kenai, AK 99611, the
non - exclusive right to use that area described below:
A portion of Lot 12, Block 1, Etolin Subdivision No. 3 and:
Commencing from the South East Corner of Lot 12 and the true point of
beginning thence N 19 °49'55 "E – 50 ft. to a point, thence N 61 °13'53 "W – 60 ft,
to a point thence S 19 °49'55 "W -- 50 ft. thence S 61 °13'53 "E – 60 ft. back to the
true point of beginning and containing 2,963.58 square feet more or less,
hereafter referred to as "the Premises." The Premises is further described in Exhibit A. In
the event of conflict between this description and Exhibit A, the description above shall
prevail.
1. TERM. This special use permit shall commence on the day of June, 2011,
and shall extend to and through day of June, 2012.
2. PERMIT FEES. The Pe nittee shall pay $792.00 per year, plus applicable sales
tax. This fee is computed based upon the following calculation: 3,000 s.f. x $3.30 x 8% of
the fair market value of the Premises.
Permittee shall pay the City the fee on or before the first day of this permit beginning
, 2011.
Checks, bank drafts, or postal money orders shall be made payable to the City of Kenai
and delivered to the City Administration Building, Kenai, Alaska, 210 Fidalgo Avenue,
Kenai, Alaska 99611 on or before the due date.
In addition to the permit fee specified above, Permittee agrees to pay to the appropriate
parties all levies, assessments, and charges as hereinafter provided:
a) Sales tax now enforced, or levied in the future, computed upon the permit fee
payable in monthly installments whether said fee is paid on a monthly or yearly
basis;

b) All necessary licenses and permits, pay all lawful taxes and assessments which,
during the term hereof may become a lien upon or which may be levied by the
State, Borough, City, or by any other tax levying body, upon any taxable
possessory right which Lessee may have in or to the Premises by reason of its use
or occupancy or by reason of the terms of this Permit, provided however, that
nothing herein contained shall prevent Permittee from contesting any increase in
such tax or assessment through procedures provided for by law.
c) Interest at the rate of eight percent (8 %) per annum and penalties of ten percent
(10 %) of any amount of money owed under this Special Use Permit, which money
or fee not paid on or before the date it becomes due.
d) Costs and expenses incident to this Special Use Permit including, but not limited
to, recording costs.
3. USE. The use of the Premises by Permittee is limited to its use as an outdoor play
area for children. Use of the Premises is subject to the following conditions:
Permittee shall maintain the outdoor play area in good repair, clean of garbage or
junk.
b) Permittee shall use the Premises for an outdoor play area only. Permittee shall not
make any permanent improvements to the Premises other than the following:
clearing, planting grass and installing a fence.
c) This use is further subject to the reasonable administrative actions of the City of
Kenai for the protection and maintenance of the Premises and of adjacent and
contiguous lands or facilities.
4. LICENCES AND PERMITS; LAWS. Permittee shall obtain and maintain all
required federal, state, and local licenses, permits, certificates, and other documents
required for its operations under the Permit. Permittee shall provide proof of compliance
to the City upon request by the City.
Permittee shall adhere to all federal, state, and local laws, ordinance and regulations
while conducting its activities on the Premises
5. NO EXCLUSIVITY. This Permit is not intended to grant any exclusive use to the
described Premises except as otherwise expressly provided herein.

6. INSURANCE. Permittee shall, throughout the term of this Permit, and at its own
expense, secure and keep in force adequate insurance, as stated below, to protect the City
and Pennittee. Where specific limits are stated, the limits are the minimum acceptable
limits. If Permittee's insurance policy contains higher limits, the City is entitled to coverage
to the extent of the higher limits.
a) Comprehensive general liability insurance protecting Permittee and covering all of
its activities in the City of Kenai related to or arising out of its use of the Premises,
with such insurance to be evidenced by a certificate of insurance showing the
insurance in force. Said comprehensive general liability insurance shall be in the
form of policy commonly known as a level limit policy combining bodily injury
and property and in an amount not less than $2,000,000.
b) Worker's compensation insurance with coverage for all employees engaged in work
under this Permit or at the Premises as required by AS 23.30.045, and, further,
Permittee is responsible to provide worker's compensation insurance for any
subcontractor who directly or indirectly provides services to Permittee under this
Perin1t.
All insurance required must meet the following additional requirements:
a) Name the City as an additional insured and in all cases where possible shall
contain a waiver of subrogation against the City.
h) Provide the City with notification at least 30 days before any termination,
cancellation, or material change in insurance coverage of any policy required
hereunder.
All policies will be by a company /corporation currently rated "A -"or better by
A.M. Best.
Evidence of Insurance Coverage:
a) Permittee shall submit to the City proof of continuous insurance coverage in the
form of insurance policies, certificates, endorsements, or a combination thereof,
and signed by a person authorized by the insurer to bind coverage on its behalf.
b) Evidence of insurance coverage must be submitted to the City by June , 2011.

The effective date of the insurance shall be no later than June , 2011.
The indemnification, hold harmless, and insurance coverage requirements stated herein
do not relieve the Permittee of any other obligation under this Permit.
The City may increase the amount or revise the type of required insurance on written
demand without requiring amendments to this Permit. The City will base any increase or
revision on reasonable and justifiable grounds. Within two weeks of the written demand,
the Permittee will submit to the City evidence of insurance coverage that meets the
requirements of the City.
7. INDEMNITY, DEFEND, AND HOLD HARMLESS AGREEMENT.
Permittee agrees to fully indemnify, defend, and save harmless, the City of Kenai, its
officers, agents, employees, and volunteers from and against all actions, damages, costs,
liability, claims, losses, judgments, penalties, and expenses of every type and description,
including any fees and /or costs reasonably incurred by the City's staff attorneys and
outside attorneys and any fees and expenses incurred in enforcing this provision
(hereafter collectively referred to as "Liabilities "), to which any or all of them may be
subjected, to the extent such Liabilities are caused by or result from any negligent act or
omission or willful misconduct of the Permittee in connection with its use of the
Premises. This shall be a continuing release and shall remain in effect after tell iination of
this Special Use Permit.
8. PERSONALITY. Permittee shall remove any and all personal property from the
Premises at the termination of this Permit (or any renewal thereof). Personal property
placed or used upon the Premises will be removed and /or impounded by the City, if not
removed upon termination of this Permit and when so removed and /or impounded, such
property may be redeemed by the owner thereof only upon the payment to the City of the
costs of removal plus storage charges of $25.00 per day. The City of Kenai is not
responsible for any damage to or theft of any personalty of Permittee or of its customers.
9. NO WAIVER. Failure to insist upon a strict compliance with the terms, conditions,
and/or any requirement herein contained, or referred to, shall not constitute or be construed
as a waiver or relinquishment of the right to exercise such terms, conditions or
requirements.
10. MUTUAL CANCELLATION. This Peuuit may be cancelled in whole or in part
with ninety (90) days written notice by Permittee or the City.

11. NO ALCOHOL. No possession or consumption of alcoholic beverages is permitted
on the Premises.
12. NO DISCRIMINATION. Permittee will not discriminate on the grounds of race,
color, religion, national origin, ancestry, age, or sex against any patron, employee,
applicant for employment, or other person or group of persons in any manner prohibited
by federal or State law. Permittee recognizes the right of the City to take any action
necessary to enforce this requirement.
13. ASSUMPTION OF RISK. Permittee shall provide all proper safeguards and
shall assume all risks incurred in its use of the Premises.
14. NO JOINT VENTURE. The City shall not be construed or held to be a partner
or joint venturer of Permittee in the conduct of its business or activities on the Premises.

Thank you for participating in the City of Kenai Comprehensive Strategic Planning Session on
April 23, 2011. It was exciting to see community members come together to plan for the future of the
City. Approximately 80 people participated in the session and there were lots of issues and ideas
discussed. The facilitators reviewed ideas from each group and prepared a list of key issues. These key
issues will provide guidance in drafting goals for the plan. Objectives to meet the goals will address
specific ideas. There will be several processes involved in the development of the Plan including public
meetings, a scientific survey, and a web -based survey to list a few.
