MOTION:
Commissioner Bryson MOVED to approve PZ11 -22 including staff recommendations
and Commissioner Navarre SECONDED the motion.
City Planner Kebschull reviewed the staff report included in the packet, noting the
following criteria needed to be met:
1. The use was consistent with the purpose of this chapter and the purposes
and intent of the zoning district.
2. The value of the adjoining property and neighborhood would not be
significantly impaired.
3. The proposed use was in harmony with the Comprehensive Plan.
4. Public services and facilities were adequate to serve the proposed use.

5. The proposed use would not be harmful to the public safety, health or
welfare.
6. Any and all specific conditions deemed necessary by the Commission to
fulfill the above - mentioned conditions should be met by the applicant and could
include, but were not limited to measures relative to access, screening, site
development, building design, operation of the use and other similar aspects related to
the proposed use.
Twait read the rules of public hearing and opened the floor to public comment.
Scott Davis, 225 Birch Place, Soldotna -- Spoke in support of the permit, noting
racing was a family activity that brought additional commerce to the area.
Jeannie Carter, Kenai -- Thanked the City for the opportunity for her grandchildren to
participate in a safe environment.
Cathy Campbell, Kenai -- Identified herself as a business owner in the area and spoke
in opposition to the permit, noting noise issues.
Dennis Barnard, 335 Dolchok, Kenai -- Spoke in opposition to the permit.
Mark Powell, 46655 Kenai Spur Highway, Kenai -- Spoke in support of the permit.
Jerry Brookman, 715 Muir, Kenai -- Spoke in opposition to the permit, noting if
approved, Commission should put strict time constraints on the operation.
Molly Poland, 44715 Sterling Highway, Soldotna -- Spoke in support of the permit.
Josh Powell, 46655 Kenai Spur Highway, Kenai -- Spoke in support of the permit.
Barney Philips, Nikiski -- Identified himself as President of the Kenai Peninsula
Racing Lions Motocross Division and spoke in support of the permit, noting a noise
mitigation plan had been implemented, times for races had been limited, and a decibel
meter had been purchased.
Chris Garcia, Kasilof -- Spoke in support of the permit.
John Mellish, 14096 Kenai Spur Highway, Kenai -- Spoke in support of the permit.
Matthew Glidewell, Kasilof -- Identified himself as Vice President of the Kenai
Peninsula Racing Lions; spoke in support of the permit, noting the track provided a
controlled environment for racing; and, 40 to 50 riders were registered to race.
Jeff Tuttle, 47155 Black Bear Court, Nikiski -- Spoke in support of the permit.

Karen McGahan, Nikiski -- Spoke in support of the permit, commending the Kenai
Peninsula Racing Lions for their work on noise mitigation, and noting a camp host was
at the track.
Jeff Kipp, Kenai -- Identified himself as the Track Maintenance Director and spoke in
support of the permit; noted a gate had been added and then extended; fencing,
signage, and cameras had been added; the camera would time -stamp photographs;
dirt piles had been added as a sound barrier, and tires would also be considered for
that purpose; and, no specific timeframe had been set for their mitigation plan.
Ricky Gease, 4289 Beaver Loop, Kenai -- Spoke in opposition to the permit,
requesting restrictions to the permit, and suggesting a five -year plan on investigating a
new property for the track.
Aaron Poland, 44117 Sterling Highway, Soldotna -- Spoke in support of the permit,
noting the logistics of moving the track would be very hard.
Franz Plagge, 4384 Beaver Loop, Kenai -- Spoke in support of racing, but suggested
the track be moved away from the city center and noted concern with water pollution.
Steven Phelps, 45813 Boundbrook Drive, Kenai -- Spoke in opposition to the permit,
noting concern with noise.
Robert Flanders, 4769 Beaver Loop, Kenai -- Spoke in opposition to the permit,
noting additional traffic by motorcycles in the area.
Jackie McGahan, 2819 Bryson, Kenai -- Identified himself as the President of Kenai
Peninsula Racing Lions, both divisions and spoke in support of the permit, noting they
were currently investigating the previous Sunday's trespass; the addition of the dirt
wall was valued at over $200,000; and, trailering to the track could be added to the
rulebook
There being no one else wishing to speak, the public hearing was closed.
Commissioner comments included:
• Suggestion noise mitigation work should be continued.
• Thanked the public for their comments.
• Considered having a review in a year.
• Suggested looking at options of other sites.
• Suggested a five year review rather than one year.

Commissioner Romain MOVED to amend the permit by adding Recommendation 6.
The Conditional Use Permit would be reviewed before the end of 2013. Commissioner
Koester SECONDED the motion.

Navarre requested a discussion of timeline. Council Member Molloy reviewed the
memo given as a lay down item.

during the summer to allow for public comment.
Colleen Ward, 708 Magic, Kenai -- Requested clarification of the review of the
Comprehensive Plan.
Janine Espy, 403 McCollum, Kenai -- Requested clarification of the process, and
suggested allowing for public comment in work sessions, then following with a public
hearing.
Ricky Gease, 4289 Beaver Loop, Kenai -- Requested a public hearing on the change
in the corridor along Beaver Loop Road.

Kebschull reported the lay down was a map showing new streams to be added to the
Anadromous Stream Habitat Protection Area.
Twait opened the floor to public hearing.
Ricky Gease, Executive Director, Kenai River Sport Fishing Association -- Noted
concerns were heard from recreational miners in the area and the ordinance was
postponed to the next Assembly meeting.

the packet; a work session on City Clerk recruitment would be held June 9, 2011 at

9 -c. Administration -- Kebschull reported the Comprehensive Plan
Collaborative meeting with business owners was well.attended and an extension was
applied for on a conditional use permit on Angler Drive for a private RV park.

Pat Falkenberg, 399 McCollum, Kenai -- Spoke in support of Ordinance No. 2546-
2011 and requested a timely resolution to the issue.

ANALYSIS
This plat combines two lots into one Larger lot containing approximately 2.020 acres. The
property is located in the Rural Residential zone. The minimum lot size in the zone is
20,000 square feet. The new Lot exceeds the minimum lot size for the zone. The
properties are located on VIP Drive. VIP Drive is a City maintained street. There is a
house on Lot 2. The parcel is served by onsite water and sewer. An installation
agreement is not required. Because the subdivision increases the lot size, an
encroachment is not created by the subdivision.
RECOMMENDATIONS
This is a simple plat that combines two properties into one large parcel. The resulting
parcel meets all requirements for the Rural Residential zone. The property is served with
onsite utilities. VIP Drive is a City maintained street. An installation agreement is not
required. Recommend approval.

KENAI RECOMMENDING THAT THE ATTACHED SUBDIVISION PLAT BE APPROVED

ANALYSIS:
This plat subdivides 2 large parcels into 4 smaller parcels. Tracts A & B are approximately
9.777 acres each, Tract C consists of approximately 19.892 acres, and Tract D is
approximately 19.386 acres. Tracts A & C are adjacent to a gulley that goes through both
parcels. These parcels have been purchased by the City of Kenai General Fund. The City will
be reviewing zoning since it is unlikely that these lots are developable. Tracts B & D have
been purchased by the City of Kenai with Airport funds. Zoning will be reviewed and it is
likely a recommendation will be made to zone them appropriate for airport use.
All tracts are accessible from Float Plane Basin Road or Fifth Avenue. The parcels meet the
minimum lot size requirementsfor the zone. Water and sewer are available.
RECOMMENDATIONS:
This plat creates 4 parcels from 2 large parcels. All of the parcels meet the minimum lot size
requirements for the zone. The lots are accessible via developed rights -of -ways. Water and
sewer are available. An installation agreement is not required. Recommend approval with no
contingencies.

ANALYSIS:
This plat reconfigures two parcels. The property is located in the Townsite Historic Zone.
The minimum lot size in the zone is 7200 square feet. The resulting Lot 2C will be
approximately 7,605 square feet and the new Lot 2B will be approximately 9,469 square
feet. The new lots exceed the minimum lot size for the zone.
Lot 2C is accessible off Overland Avenue and Lot 2B is accessible off Overland Avenue
and Alaska Avenue. Water and sewer are available to serve the lots from Overland
Avenue. The structure located on Lot 2B is served by water and sewer through an
existing 15 -foot easement as shown on the attached easement. An installation agreement
is not required.
The newly created Lot 2B does not meet the minimum lot width of 60 feet and requires
an exception to KMC 14.10.070(e)(3). The plats were configured so that the new Lot 2C
meets the minimum width. The flag portion of the new Lot 2B contains the water and
sewer service for the structure located on the lot and serves as a driveway to the structure.
The flag is large enough to allow adequate access.

The lots are being subdivided to allow the sale of the newly created Lot 2C to the owner
of the adjoining property (Beluga Lookout RV Park), Jerry Dunn. Mr. Dunn has been
informed that using the property in a commercial manner may require a Conditional Use
Permit.
RECOMMENDATIONS:
This plat reconfigures two lots. The resulting lots meet the minimum lot size for the
Townsite Historic zone. Water and sewer serve an existing structure on the new Lot 2B.
This service was provided by recording an easement to cross a property line. This plat
will eliminate the need for the easement. The properties are served via developed rights -
of -ways. An installation agreement is not required.
The newly created lot 2B does not meet the minimum lot width of 60 feet for the zone.
The flag portion of the lot is 30 feet and meets the City's requirements for access for
emergency personnel and equipment. An exception must be granted to KMC
14.10.070(e)(3), Administration is recommending the exception be granted.
Recommend approval as submitted with the following exception being granted:
1. An exception to KMC 14.10.070(e)(3) is granted noting the minimum lot
width for the Townsite Historic Zone is 60 feet. Lot 2B has a minimum lot
width of 30 feet along Overland Avenue which is sufficient for emergency
personnel and equipment to access the property.

At your meeting on May 25th, you approved a Conditional Use Permit for Buccaneer
Alaska Operations, LLC. As plans proceed for the drilling operation, the City is
preparing to address the site location. As part of that process, the unnamed street will
need to be named. Based on the regulations in Title 14.15, administration is
recommending East Redoubt Avenue. A resolution has been prepared for your review
and a public hearing has been scheduled for your meeting on July 13th. The
Commission's recommendation will be forwarded to City Council who has the final
authority under KMC 14.15.140. A copy of the resolution is attached.

4. Ordinance No. 2563 -2011 -- Amending Chapter 4.25, Uniform
Plumbing Code, to Adopt the 2009 Edition of the Uniform Plumbing
Code, Which Code Also Incorporates the Uniform Swimming Pool, Spa
and Hot Tub Code and the Uniform Solar Energy Code and to Make Local
Amendments to the Codes.
5. Ordinance No. 2564 -2011 -- Amending Kenai Municipal Code Section
10.30, "Record Retention," to Add a New Section 10.30.060 "Disclosure
of Information Collection" to Require the City to Notify Residents and
Property Owners that the City Has Collected Information About the

Ordinance No. 2546 -2011 -- Amending KMC 14.22.010, Land Use Table, to Make
Comprehensive Changes to the Uses Allowed in the Rural Residential RR -1 Zoning
District, Including Changing Many "Conditional Uses" to Uses "Not Permitted," and
Providing for Certain "Conditional Uses" for Properties Along the Kenai Spur Highway
Within the RR -1 Zone.
(CIerk's Note: At its May 18, 2011 meeting, the City Council postponed Ordinance No.
2546 until the August 17, 2011 Council meeting for an additional public hearing at that
meeting and referred the ordinance to the Planning & Zoning Commission with directions
to schedule and to hold one or more work sessions, schedule a public hearing, and
return the ordinance to Council, with its recommendations, for the August 17 meeting.
Administration was also directed to send notice cards to all property owners of the City
to inform them of the work session(s) and public hearing. The motion to adopt is active.)

SUBJECT: Planning & Zoning Commission Request
At last night's Planning & Zoning Commission meeting, the Commission requested a
legal opinion as to the Commission's obligations and rights related to the Council's
direction on Ordinance No. 2546 -2011. On May 18, 2011, City Council postponed
action on the Ordinance until August 17, 2011. The motion included the following
direction, "refer the ordinance to the Planning & Zoning Commission with directions to
schedule and hold a work session or work sessions, schedule a public hearing, and
return the ordinance to Council with its recommendations in the packet for the
August 17 Council meeting."
The Commission voiced concern and frustration in trying to meet the Council's deadline
and fulfill the process they believe they are required to perform to make
recommendations on amendments. Because of the time constraints, the Commission
has limited public participation in the process and the public feels they are not being
given an opportunity to participate.
The Commission discussed several concerns:
• Who sets the Commission's agenda?
• Can the Council determine the process the Commission uses to review and
make recommendations?
• Can the Council require them to set aside other work and make their directive
take precedence?
• Are they required to make a recommendation when not prepared to do so?
• Are they required to set a public hearing when not prepared to do so?
Commissioner Navarre requested that a copy of the minutes from the discussion be
included with the request. That information is not available at this time. How do you
want to proceed with this request?
