Marquis ITEM 2: AGENDA APPROVAL MOTION: Commissioner Bielefeld MOVED to approve the agenda as presented and Commissioner Zirul SECONDED the motion. There were no objections. SO ORDERED. ITEM 3: APPROVAL OF MEETING SUMMARY -- April 14, 2011 MOTION: Commissioner Bielefeld MOVED to approve the meeting summary of April 14, 2011 and Commissioner Zirul SECONDED the motion. There were no objections. SO ORDERED. ITEM 4: PERSONS SCHEDULED TO BE HEARD 4 -a. Rick Koch, City Manager -- Industrial Park City Manager Koch reported on an area of airport land off Marathon Road that he believed would be appropriate for an industrial, heavy commercial park. He added, he believed this type of park would take advantage of the airport. Koch noted there could be funding in the capital budget for development. ITEM 5: OLD BUSINESS 5 -a. Discussion -- Update of 2010/2011 Goals & Objectives Airport Manager Bondurant reviewed the goals and objectives and updates were noted. Bondurant reported she would update the 2011/2012 Goals and Objectives to bring back to the Commission for consideration at its July meeting. Commissioners Zirul and Knackstedt expressed thanks for the sidewalk changes, beautification efforts, banners, welcome sign and new fuel pumps. ITEM 6: NEW BUSINESS 6 -a. Discussion /Recommendation -- Schilling Rentals, LLC Amended Lease Application Bondurant reviewed the memorandum included in the packet. General d followed. scuss Knackstedt noted the Planning and Zoning Commission approved the proposed change at its June 8, 2011 meeting. MOTION: on Commissioner Zirul MOVED to recommend approval of the amended lease application for Schilling Rentals, LLC and Commissioner Porter SECONDED the motion. There were no objections. SO ORDERED. 6 -b. Discussion -- Design Study Report Float Plane Basin Development, Phase 1. Casey Madden, Wince Corthell Bryson -- Updated the Commission on the Phase I Design Study. All Commissioners reported they were in favor of the development. 6 -c. Discussion -- Airport Directory (First Draft) General discussion occurred regarding the draft of the Airport Directory. Commission suggested the final Airport Directory be added to the website. ITEM 7: 7 -a. Air Fair. REPORT Commission Chair -- Knackstedt reported he attended and enjoyed the 7 -b. Airport Manager -- Bondurant reported Administration was cleaning up after the Air Fair; the event was very well attended; there were 55 participants in the Poker Run; and, she thanked the volunteers. 7 -c. City Council Liaison -- Council Member Marquis reported on the last four Council meetings and work sessions. Discussions with committee members suggest that a set date such as the 1st or 2nd Saturday of a certain month will allow the committee, vendors, military, pilots, public and the weather (maybe) ample time to plan and prepare for our event. It has been suggested the event be calendared for the 2nd Saturday in June, since the Relay for Life event is always the Saturday following Memorial Day which is usually the 1st Saturday in June. Because this is a sizeable document, I plan to submit only a few chapters at a time for your review at each Commission meeting. Attached for your review and comment is the first 5 chapters with any comments and suggestions. Please be prepared to discuss these at the meeting. After a review of the regulations in entirety, Commission recommendations will be incorporated into a draft document that will be submitted to City Administration for review. Attachment www.KenaiAirport.com Chapter 1.05 AUTHORITY Section: 1.05.010 Authority 1.05.010 Authority. (a) Under the authority granted in Alaska Statutes, and pursuant to the provisions of Ordinance 48, Section 4, and KMC 21.05.030 of the Code of Ordinances of the City of Kenai, the following regulations are hereby promulgated governing the conduct of all persons visiting or using the facilities of the Kenai Municipal Airport and all vehicles, structures, property and aircraft on the Airport Reservepren3ises. The penalty for violation of any Airport Regulations shall be as prescribed in the Kenai Code of Ordinances, unless otherwise provided herein. (b) These regulations also govern the conduct of all persons flying within a five mile radius of the Kenai- Airport unless exceptions are specifically provided in the Federal Aviation Agency Regulations, or unless the Airport Manager authorizes exceptions not in conflict with the Federal Regulations, area4her+zed -by the Airport Manag Y. (Res. 91 -20) Chapter 2.05 DEFINITIONS Section: 2.05.010 Definitions. 2.05.010 Definitions. Whenever used in the regulations of the Kenai Municipal Airport, the following terms shall have the meanings given below, unless the context requires otherwise: -(A qualifier like this is needed because a defined term may occasionally be used in a generic sense. For example, "airport" in the NOTAM definition is a generic reference. It doesn't mean Kenai Municipal Airport) 2 (a) "Air Carrier" means a person engaged in the transportation of passengers or cargo in air commerce for com.ensation (ab) "Aircraft" signifies any contrivance now known, or hereafter designed, invented, or used for navigation or flight in the air, except parachutes and other contrivances used primarily as safety equipment. (c) "Airport" refers to the Kenai Municipal Airport, including all the runways taxiways . aprons, water lanes, water taxiways and all City -owned real estate located within the boundaries of the Airport Reserve. - (Using the unmodified word "Airport" throughout the regulations simplifies phrasing and eliminates the multiplicity of terms used in the existing regulations when referring to the airport, such as Kenai Municipal Airport, Kenai Airport, Kenai Field, Airport, etc.).) (db) "Airport Manager" refers to the official to whom the City Manager of the City of Kenai -has delegated the authority and responsibility of managing and directing the activities of the Municipal Airport-a d-whe perfermanee-of-leis-dutios. "Airport Manager" includes that person's authorized representative. (The accountability phrase adds nothing to the definition. The relative level of accountability between a given airport manager to a given City Manager doesn't help the public identify who is in charge of the airport. And, common sense provides that a person to whom authority is delegated owes accountability to the person who gave the de legation, unless the delegation document says otherwise. If there was any doubt about that, 3.05.010(a) eliminates it by making it clear that Airport Manager decisions are subject to appeal to the City Manager) (A) "Airport Reserve" refers to the Kenai Municipal Airport Reserve as defined in KMC 12.05.010,KMC 12.05.020, KMC 12.05.03000400. (fc) "Aviation Operator" refers to any person or organization engaged in business of an aviation nature having authority to conduct such business at the Municipal-Airport by virtue of a contract or lease with the City -of- Kenai. (Note: this definition would exclude a transient commercial air carrier because they would not have a "contract or lease with the City ". In the single regulation where this term is used (4.05.010(b)), I'm not sure you'd want to exclude a transient air carrier from lending aid (notwithstanding my adverse comments in my note to 4.05010(b).) 1 (gd) "City" shall mean the City of Kenai, Alaska. (he) "City Manager" refers to the official to whom the Kenai City Council has delegated the responsibility of managing and directing all activities of the City of Kenai. 3 (i) "CMGTW" means the certificated maximum +ross takeo established by the Federal Aviation Administration. wei +ht of an aircraft as (if) "Airport Employee" refers to any person employed by the City-of -Kenai and acting under the supervision and direction of the Airport Manager. (Whenever "employee" is used in the existing regulations with the meaning expressed in this definition, it is always preceded by 'Airport". The only time "employee" is used alone it does not refer to a City employee working at the airport. So, it seems much less confusing to make this special definition apply only to "Airport Employee ") (kg) "Field Area" is that area within the Airport Reserveboanc Municipal-Airport that the Airport Manager designatesd for. or restricts to, use by aircraft only, =ea- land- whietiis- pected or fenced, all being within -the official- boundaries of the- MunicipakAir-portand-designated by the Airport Manager as the Field Ar. a. Qh) "Fire Department" refers to any-employee-of-the City of Kenai Fire Department-or their - representatives as authorized by the Department -Chief or the Airport Manager. (Nowhere in the regulations is "fire department" used to mean an employee or representative. It is only used in its agency sense.) (m i) "Fuel Tender" refers to any motor vehicle, trailer, or other mobile contrivance used for the transporting, handling or dispensing of gasoline, kerosene, oil or other fuel or lubricant. (n{) "Heavy Aircraft" refers to any aircraft weighing 12,500 pounds or more. (ok) "Light Aircraft" refers to any aircraft weighing less than 12,500 pounds. (l) MobI - equipment -or device which no' of propelled and excludes any aircraft. (The term, "mobile equipment ", does not appear in the existing regulations) (pm) " "Motor Vehicle"" refers to any self - propelled contrivancevehiele other than annet including aircraft, upon or by which a person or property may be transported or drawnwhich sperxatien. ( "Contrivance" more specifically refers to something mechanical than does "device ") (gn) " "Movement Area"" refers to the runways, taxiways and other areas of the Airportan airport which are designated by the Airport Managerutilized for the taxiing, takeoff and landing of aircraft, exclusive of loading ramps and parking areas. 4 (o) " enai Municipal Airport" is the-name-91 Jan to the airfield and all related facTll° ••f the- Cityef -K e >c -_ (This definition seems unnecessary, given the definition of "Airport" above and the fact that the City operates only one airport.) (rp) it"NOTAM"" signifies an abbreviation for 'Ill:Notice to Airmen,, -"" published and distributed to pilots and others concerned with aeronautical operations calling attention to special airport or flying restrictions or conditions. to pilots and others concer ling attention to special airport or flying restristio (sq) " "Person"" refers to any individual, firm, partnership, corporation, company, association, joint stock association or body politic and includes any trustee, receiver or assigned representative thereof who will be responsible to adhere to any restrictions, limitations or rights covered within these regulations. (tr) " "Police Officer refers to an any employee or authorized agent of the City of Kenai Police Department having law enforcement authority -r- gray- aatherized -agent •r lice Department regulating -police enforcement powers. ( "Police is used in only two places in the existing regulations. In both places, the context of the regulation does not appear to extend beyond the Kenai Police Department or City Police officers.') (us) " "Public Area"° refers to that space on the Municipal Airport in which access by members of the general public is not prohibited, includingdeveted -te roadways, walkways, designated parking or service areas of airport structures, including both municipal and lessee buildings, and that-areas occupied and used by airport concessions for serving the public. (Ord. 316) (The need for this definition isn't immediately apparent to me because the defined phrase isn't used anywhere in the regulations. if there is some other legal need to include a "Public Area" definition here, I recommend the wording be clarified as indicated. Otherwise, the entire definition should be deleted.) (v) "Restricted area" means the field area, all other areas of the Airport enclosed by the Airport's perimeter fence and any other portion of the Airport the Airport Manager closes to regular access by the general .ublic for safet or securit reasons. Float Plane Basin Facility Improvement Project: The Float Plane Basin Development Phase One 2011 -2012 Design Study was completed on May 23, 2011 and is being circulated for review and comment. Review and comments should be completed by June 15`". Master Plan — City Administration is working on a scope for this project. Air Fair: Despite the rain, the 11th Annual KPAF was a huge success. The poker run had 55 participants and the barbeque served around 300 lunches. The EAA served over 200 breakfasts at the Soldotna Airport. The military units all expressed their appreciation of the event and said the people of the Kenai Peninsula are the best! A very special thank you to all the City & Council staff who contributed time and efforts; this truly would not have been a success without you!!! Airport Maintenance: Airport staff continues with beautification projects and welcomes any suggestions to improve the airport appearance.
