ITEM 2: *APPROVAL OF MINUTES -- June 22, 2011 Approved by consent agenda. ITEM 3: SCHEDULED PUBLIC COMMENT -- None ITEM 4: CONSIDERATION OF PLATS 4 -a. PZ11 -28 - Preliminary Plat - Fidalgo Commercial Center, Elks Replat (A resubdivision of Fidalgo Commercial Center, Lots 1 & 2, Block 3, KN- 1587). Plat submitted by McLane Consulting, Inc., P.O. Box 468, Soldotna, Alaska. MOTION: Commissioner Knackstedt MOVED to approve Resolution No. PZ1 1-28 and Commissioner Rogers SECONDED the motion. City Planner Kebschull reviewed the staff report included in the packet, noted this was a resubdivision within the Central Mixed Use Zone and recommended approval. Twait read the rules of public hearing and opened the floor to public comment. There being no one wishing to speak, the public hearing was closed. There were no Commissioner comments. VOTE: MOTION PASSED UNANIMOUSLY. ITEM 5: PUBLIC HEARINGS 5 -a. PZ11 -24 - A resolution of the Kenai Planning & Zoning Commission recommending the Council of the City of Kenai name an unnamed street. (Unnamed right -of -way located east of Kenai Airport proper.) PLANNING AND ZONING COMMISSION MEETING JULY 13, 2011 PAGE 2 MOTION: Commissioner Navarre MOVED to approve Resolution No. PZ 11 -24 and Commissioner Rogers SECONDED the motion. Kebschull reviewed the staff report included in the packet, recommending the approval of the name East Redoubt Avenue. Twait opened the meeting to public hearing. There being no one wishing to speak, the public hearing was closed. Commissioner comments included: • • • Suggested postponing for more options to be considered. Spoke in favor of naming the street after Fred Pearson. Suggested adding WHEREAS paragraphs as follows: WHEREAS, Redoubt Avenue would never connect to this portion of the section line; WHEREAS, Fred Pearson became a resident of the State of Alaska in 1952 or 1953, built the road in the late 1950's, and received a patent for homesteading in the area in 1965; MOTION: Commissioner Navarre MOVED to postpone Resolution No. PZ11 -24, requested Administration return with a new resolution and requested UNANIMOUS CONSENT. Commissioner Bryson SECONDED the motion. There were no objections. SO ORDERED. ITEM 6: UNFINISHED BUSINESS -- None ITEM 7: NEW BUSINESS 7 -a. Discussion /Recommendation -- Ordinance No. 2560 -2011 - An ordinance of the Council of the City of Kenai, Alaska, amending Kenai Municipal Code Section 12.25.030, "Leaving of Junked or Illegally Parked Vehicles," to amend the definition of what is a "Junk Vehicle." Kebschull reviewed the lay down of the Substitute Ordinance No. 2560 -2011 -- Amending Kenai Municipal Code Section 12.25.010, Definitions to Add Definitions for Operative Vehicle and Inoperative and Amending Kenai Municipal Code Section 12.25.030, "Leaving of Junked or Illegally Parked Vehicles," to Amend the Definition of What is a "Junk Vehicle." Commissioner comments included: • Noted in Section 2(e) and (f) vehicle should be defined as the PLANNING AND ZONING COMMISSION MEETING JULY 13, 2011 PAGE 3 manufacturer intended. • Inquired as to how the code was enforced. Kebschull noted it varied from case to case, including the owner paid to remove the vehicle, the City could help pay to remove the vehicle, or an abandoned vehicle could be removed at City expense. • Requested public comment. Twait opened the meeting to public comment. Alan Poynor, 4560 Wolfe Street, Kenai -- Noted that people who restore vintage cars could store inoperative cars for a long period of time and the code should not apply to them. Administrative Assistant Carver noted the owners could purchase vintage plates. There being no one else wishing to speak, the public hearing was closed. MOTION: Commissioner Navarre MOVED to amend Ordinance No. 2560 (Substitute) to delete the first vehicle in Section 2(e), recommended Section 2(e) and (f) be forwarded to Council, requested Administration prepare for Council a consideration for Section 2(b), and requested UNANIMOUS CONSENT. City Council -- Council Member Bookey reviewed the July 6, 2011 City Council Action Agenda included in the packet. 9 -b. Borough Planning -- Commissioner Bryson reported the next meeting would be July 18, 2011. 9 -c. Administration -- Kebschull reviewed the Quarterly Reports included in the packet; noted the Comprehensive Plan was on track with a meeting with local Native Associations on July 14, 2011; an information item regarding the public participation plan would be forthcoming; and, a meeting with the Senior class at Kenai Central High School was planned for after school restarted in the fall. To provide the recommendation, the Commission must hold a public hearing at your August 10th meeting. During work sessions, you began by reviewing land use in the City. Using the knowledge gained, you began reviewing the changes proposed in the ordinance to the Land Use Table for the RR1 zone. At the conclusion of the work session on July 13th, a preliminary review of the Land Use Table for the RR1 zone had been completed. Further work sessions are planned before and after your meeting on July 27th to continue reviewing the Land Use Table to include other residential zones. Until the work sessions are complete on the 27th, we won't know if you are prepared to include recommendations for all residential zones. To plan for the public hearing, I have prepared three resolutions for the Commission's consideration. The first option provides background as to the process used to make the recommendation for proposed changes to the Land Use Table for the RR1 zone. (Administration prefers this resolution.) The second option reflects the language used in Ordinance No. 2546 -2011. The third option was prepared to reflect proposed changes to all residential zones in anticipation that the Commission would complete the review during the work sessions. The Land Use Table in Attachment A will be updated to incorporate proposed amendments decided during the work sessions on July 27th Please review the proposed language in these resolutions. The Commission will need to determine which resolution to use for the public hearing on August 10th. Any proposed changes to the wording will be incorporated into the resolution for the public hearing. \Me aify a / KENAI, ALASKA Option 1: Resolution provides the history of the Commission's process to the recommendation. CITY OF KENAI PLANNING AND ZONING COMMISSION RESOLUTION NO. PZ11- A RESOLUTION OF THE KENAI PLANNING AND ZONING COMMISSION RECOMMENDING KENAI CITY COUNCIL AMEND KENAI MUNICIPAL CODE 14.22.010, LAND USE TABLE, TO MAKE COMPREHENSIVE CHANGES TO THE USES ALLOWED IN THE RURAL RESIDENTIAL RR -1 ZONING DISTRICT. WHEREAS, on April 6, 2011, Kenai City Council introduced Ordinance No. 2546 -2011 to amend KMC 14.22.010, Land Use Table, to make comprehensive changes to the uses allowed in the Rural Residential 1 (RR -1) Zoning District; and, WHEREAS, on April 6, 2011, Kenai City Council postponed action on Ordinance No. 2546 -2011 until May 18, 2011, to provide an opportunity to send the Ordinance to the Planning & Zoning Commission to hold work sessions and a public hearing and to send their recommendations to City Council for a public hearing on May 18, 2011; and, WHEREAS, the Planning & Zoning Commission held a work session on April 27, 2011 and during their regular meeting on April 27, 2011, voted against holding a public hearing on the proposed Ordinance citing the need for additional time to conduct a comprehensive review of the entire Land Use Table for all residential zones in the City and that with the beginning of an update to the City's Comprehensive Plan, the time may not be appropriate for an amendment; and, WHEREAS, on May 18, 2011, Kenai City Council held a public hearing and postponed action Ordinance No 2546 -2011 and requested the Planning & Zoning Commission hold additional work sessions and a public hearing and to send a recommendation to Council for Council's August 17, 2011 meeting; and, WHEREAS, the Planning & Zoning Commission held work sessions on June 8, June 22, July 13, and July 27, 2011; and, WHEREAS, during the work sessions, the Commission reviewed land use in the City of Kenai considering lot size, density, city infrastructure including water and sewer and street construction, and location of subdivisions so that this information could be used to make informed recommendations when reviewing the proposed ordinance; and, WHEREAS, based on the review of land use and development in the City, the Commission finds that the existing zoning for the two (2) areas in the City of Kenai that are zoned as RR -1, which are the Three W's Subdivision and the area generally known as the "MAPS Area may not accurately describe these two areas;" and, New Text Underlined; [DELETED TEXT BRACKETED] Resolution PZ11- - Page 1 WHEREAS, the Commission recommends that during the Comprehensive Plan update that zoning in the City of Kenai be reviewed for possible changes and rezones based on development; and, WHEREAS, residents of these areas in the RR -1 Zoning District have expressed significant concerns about the presently allowable types of land uses which are permitted or are conditional uses in their neighborhoods under the Land Use Table for the RR -1 Zoning District; and, WHEREAS, residents of these areas in the RR -1 Zoning District have made presentations to the Kenai City Council, Planning and Zoning Commission and Administration regarding their concerns and their proposed solutions; and, WHEREAS, residents of these areas in the RR -1 Zoning District desired to collaboratively work with the City through the public process to amend the land use table in order to promote the residential character of their neighborhoods, as follows: Protect against incompatible land uses; Preserve low density residential development; Prevent land uses that generate heavy traffic; and Support a stable and predictable setting for future investment; and, WHEREAS, after listening to the concerns of the RR1 neighborhoods, the Commission agreed neighborhoods should be protected from some commercial uses and that other neighborhood zones in the City should also be protected; and, WHEREAS, the ordinance proposes to amend the Land Use Table in KMC 14.22.010 to make comprehensive changes to the uses allowed in the RR -1 Zoning District, including changing many "conditional uses" to "not permitted," and providing for certain conditional uses for properties along the Kenai Spur Highway within the RR -1 Zoning District; and, WHEREAS, the Commission believes that the proposed ordinance is too restrictive and that the existing process required for conditional uses in the City provides the protection necessary while allowing uses that can be operated without adversely affecting neighborhoods; and, WHEREAS, the Planning and Zoning Commission recommends several changes from the changes proposed in Ordinance No. 2546 -2011 to KMC 14.22.010, Land Use Table; and, NOW, THEREFORE, BE IT RESOLVED THAT THE THAT THE PLANNING AND ZONING COMMISSION RECOMMENDS THAT THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMEND KENAI MUNICIPAL CODE 14.22.010, LAND USE TABLE AS SHOWN ON ATTACHMENT A: Dated at Kenai, Alaska this day of , 2011. The plan is intended to be a living document that will be updated periodically to take advantage of unexpected opportunities. As well as a planning document, it will also document public outreach efforts that have already been accomplished. 2.0 Boards and Commissions Involvement of City boards and commissions in the plan revision process provides an important link to the public. Boards and commissions involve community residents in City affairs on an ongoing basis. Department heads, board and commission members and the consultants met on the evening of April 20, 2011. Using a group process, the meeting participants prioritized actions the boards and commissions can take to fulfill the City's mission. The consultants prepared a meeting summary that identified all of the ideas generated during this meeting. 3.0 Planning Commission Meetings Preparation of the Comprehensive Plan is one of the most important functions of the Planning and Zoning Commission. • April 13, 2011 — Briefing on the plan update. • June 8, 2011 — Workshop on land use classification • June 22, 2011 — Workshop on land use classification • July 13, 2011 — Workshop on land use classification • July 27, 2011 — Review of Public Outreach and Participation Plan 4.0 Public Meetings The City sponsored a public meeting at the Senior Center on April 23, 2011. After a short presentation about comprehensive planning, a visioning exercise resulted in a list of what the participants want the community to look like in 2021. The ideas were grouped under three topics: Land use, infrastructure and quality of life. During the April 23 public meeting, participants broke into 9 different groups of approximately 6 people in each group. The groups brainstormed ideas and prioritized the top three actions related to two key questions. The first question asked "What policies, initiatives and actions should be pursued over the next decade to improve and ensure a high quality of life for residents of the City of Kenai ?" and the second question asked "What revisions to the land use Your City — Your Plan 1 map are needed to ensure there is adequate land available for all uses; including, but not limited to commercial, residential, industrial and open space?" A meeting summary lists the top priorities, and the attachment to the summary lists all of the ideas generated during the meeting. A second public meeting will be held to discuss goals and objectives to be included in the revised Comprehensive plan. 5.0 Agency Outreach The consultants and planning staff will inform appropriate state and federal agencies throughout the planning process. Meetings will be set up with the Kenai River Center, the Kenai Peninsula Borough Planning Department, the Mental Health Trust, U.S. Department of Housing and Urban Development, and other agencies as identified. 6.0 Business Leaders Meeting A meeting with community business leaders, held on June 8, 2011, involved a similar group process that was used for the other meetings. The business leaders developed a prioritized list of actions in response to the key question: "What policies, initiatives and actions should the City of Kenai pursue over the next decade to sustain existing businesses and to create new business opportunities ?" The meeting summary is posted on the City of Kenai webpage. A second meeting with business leaders will be scheduled to discuss goals and objectives that will be included in the plan revision. 7.0 Native Community The Planning Director and consultant met with representatives of local Native organizations to brief them about the Comprehensive Plan revision and to discuss the possibility of a meeting will all members of the tribes and the local corporations. • July 12, 201 — Meeting with Penny Carty of the Salamatof Native Association • July 12, 2011 — Meeting with Sasha Lindgren, Kenaitze Indian Tribe • July 14, 2011 — Meeting with the Board of Salamatof Native Association • September 15, 2011 — Meeting with Kenaitze Indian Tribe Board (scheduled) 8.0 Other Public Participation Techniques In addition to public meetings, a number of other public participation techniques will be used throughout the plan revision process. 8.1 Surveys Two types of surveys will be used for the plan revision. First, a web -based survey will be developed with hard copies distributed at the City Library and City Offices. Respondents may complete this survey online or fill out a hard copy of the survey which will be available at the City library. Second, a telephone opinion poll will be conducted by a polling firm.
