SUBJECT: Ordinance No. 2546 -2011 — Land Use Table
At the work session on July 13, 2011, you continued reviewing the Land Use Table for
the RR -1 zone. The Commission agreed that Footnote 29 would be changed to:
"Use allowed only for those parcels that abut the Kenai Spur Highway, Beaver
Loop Road, Bridge Access Road, and Kalifornsky Beach Road'. Access to the
parcel must be from these streets unless applicant can provide documentation
that an application for a driveway permit has been denied by the State of Alaska
or City of Kenai. In that case, the Commission may consider alternate ingress
and egress. Driveways should be located a reasonable distance from the Kenai
Spur Highway, Beaver Loop Road, Bridge Access Road, and Kalifornsky Beach
Road to ensure the driveway does not create an unsafe traffic pattern and to
ensure that traffic impact to the neighborhood is minimized. Industry established
trip generation standards for the commercial use should be used to determine
the impact to the neighborhood."
The Commission agreed to the following changes to the Land Use Table as provided in
Attachment A to the ordinance:

The Commission extensively discussed Off - Street Parking. The Ordinance proposes to
change the designation from a P to a C29. KMC 14.20.250 (Off- street parking and
loading requirements) regulates the requirements for off - street parking. Every
development, whether commercial or non - commercial, is required to provide off - street
parking according to the requirements outlined in KMC 14.20.250(8). This category of
the Land Use Table has always been interpreted as parking that is developed as part of
a principal use. It is my recommendation to remove Off - Street Parking from the Land
Use Table. Any commercial parking lot or parking not as part of a principal permitted
use would be considered under Public Parking Lots or as a Conditional Use under KMC
14.20.040 (b)(2) (Rules for interpretation.) "In cases of reasonable doubt as to whether
a use is permitted in a specific zone, the guidelines established in the conditional uses
section shall apply."
Draft resolutions have been prepared for the Commission in preparation for the
August 10th public hearing. The resolutions are included in your meeting packet under
New Business, 7b.

highways. Commercial or industrial which falls under the landscaping /site plans requirements of KMC 14.25 shall include

anticipated population;
h. The development shall not produce a volume of traffic in excess of the capacity for which the access streets are
designed;
i. The property adjacent to the proposed dwelling group will not be adversely affected.

minimum Federal Housing Authority requirements.
