Chair Twait called the meeting to order at approximately 7:02 p.m.

5 -a. PZ11 -32 - An application for an encroachment for a two foot (2') ten inch
(10 ") side yard setback for the property known as Lot 8, Block 3, Silver
Pines Subdivision Part One (605 Ponderosa Street). Application
submitted by Robert A. Myles, 605 Ponderosa Street, Kenai, Alaska.
Commissioner Navarre noted he had lived in the neighborhood and his brother had
sold the property in the past.
MOTION:
Commissioner Bryson MOVED to approve PZ11 -32 and Commissioner Knackstedt
SECONDED the motion.
Carver reviewed the staff report included in the packet, noting the following criteria
needed to be met:
1. An encroachment as defined in KMC 14.20.185(a) exists.
2. The encroachment does not encroach upon a Federal, State or City right -of-
way or utility easement.
3. The issuance of the encroachment permit will not authorize a use which is
not a principal permitted use in the zoning district in which the property is located.
4. The encroachment is not located across a platted lot line.
Carver noted Administration was recommending denial of the permit, but if the permit
was issued, the following recommendation was suggested:
• An as -built of the property must be provided to verify the deck does not
cross the property line. As -built must be provided prior to issuance of the
encroachment permit.
Twait read the rules of public hearing and opened the meeting to public comment.
Robert Myles, 605 Ponderosa -- Applicant spoke in favor of the permit, noting a
surveyor had surveyed the property; he was willing to shorten the deck by 20 inches,
and he would provide an as -built if required.
Twait noted after the 20 inches have been removed, there would still be an

encroachment of one foot four inches.
There being no one else wishing to speak, the public hearing was closed.

Reconsideration of PZ11 -30 - A resolution of the Kenai Planning and
Zoning Commission recommending Kenai City Council amend Kenai
Municipal Code 14.22.010, Land Use Table, to make comprehensive
changes to the uses allowed in the Rural Residential RR -1 Zoning District.
(Ordinance No. 2546 -2011 - An ordinance of the Council of the City of
Kenai, Alaska, amending KMC 14.22.010, Land Use Table, to make
comprehensive changes to the uses allowed in the Rural Residential 1
(RR -1) zoning district including changing many "Conditional Uses" to uses
"Not Permitted," and providing for certain "Conditional Uses" for
properties along the Kenai Spur Highway within the RR -1 zoning district.)
(Postponed on 8/10/11.)

Commissioner Navarre MOVED to amend PZ11 -30 by moving all changes to the RR -1
zone from the August 16 and August 24 work sessions into the land use table and
requested UNANIMOUS CONSENT, Commissioner Knackstedt SECONDED the
motion. There were no objections. SO ORDERED.
MOTION TO AMEND:
Commissioner Navarre MOVED to amend PZ11 -30 to strike footnote #29 and replace
it with the following: Use allowed only for those parcels that abut the Kenai Spur
Highway. The access to any such parcel must be either from (a) driveway access on
the Kenai Spur Highway, or (b) driveway access from a dedicated right -of -way and that
driveway access is not more than 275 feet from the constructed centerline of the Kenai
Spur Highway to the center of the driveway access as shown on an as -built drawing of
the parcel. Commissioner Navarre requested UNANIMOUS CONSENT. Commissioner
Koester SECONDED the motion. There were no objections. SO ORDERED.
MOTION TO AMEND:
Commissioner Navarre MOVED to amend PZ11 -30 to add the following footnote:

30. Use allowed for only those parcels that abut Beaver Loop Road, Bridge Access
Road, and Kalifornsky Beach Road. Access to the parcel must be from these streets
unless applicant can provide documentation that an application for a driveway permit
has been denied by the State of Alaska or City of Kenai. In that case, the Commission
may consider alternate ingress and egress. Driveways should be located a reasonable
distance from the Kenai Spur Highway, Beaver Loop Road, Bridge Access Road, and
Kalifornsky Beach Road to ensure the driveway does not create an unsafe traffic
pattern and to ensure that traffic impact into the neighborhood is minimized.
Industry established trip generation standards for the commercial use should be used
to determine the impact on the neighborhood.
Commissioner Navarre requested UNANIMOUS CONSENT. Commissioner Knackstedt
SECONDED the motion. There were no objections. SO ORDERED.

the work session with the resolution and requested UNANIMOUS CONSENT.

Planning & Zoning Commission recommending Kenai City Council adopt
updated zoning and land use maps for the Comprehensive Plan for the
City of Kenai.
Carver reviewed the staff report included in the packet and general discussion
occurred. The public hearing was set for the September 14, 2011 meeting.

input and provided valuable information, noting she supported good cause.

November meeting.

Council Action Agenda which was included in the packet, noting Ordinance No. 2546-
2011 had been postponed to the September 7 meeting, passage of the junk vehicle
ordinance, and a Council work session regarding City Clerk recruitment would take
place on August 29, 2011.
9 -b. Borough Planning -- Commissioner Bryson reviewed the Borough
Planning Commission agenda of August 22, 2011 which was included in the packet.

5 -a -1. PZ11 -30 Substitute -- A resolution of the Kenai Planning and Zoning
Commission postponed on August 10, 2011, recommending Kenai City
Council amend Kenai Municipal Code 14.22.010, Land Use Table, to
make comprehensive changes to the uses allowed in the Suburban
Residential (RS), Suburban Residential 1 (RS1), Suburban Residential 2
(RS2), Rural Residential (RR), Rural Residential RR -1, And The Urban
Residential (RU) Zoning Districts.

Gary Hinkle, Box 322, Soldotna -- noted when land cannot be economically
developed, it can be rezoned for that development and spoke against the resolution.
Charles Winegarden, 309 Princess -- spoke in favor of the substitute resolution.
Navarre noted the land use table for the RR -1 zone included footnotes C29 and C30.
MOTION:
Commissioner Navarre MOVED to forward Resolution No. PZ11 -30 to the City Council
and Commissioner Rogers SECONDED the motion.
MOTION TO AMEND:
Commissioner Navarre MOVED to amend Resolution No. PZ11 -30 by removing the last
paragraph and replacing it with the following:
NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING AND ZONING
COMMISSION REQUESTS ADMINISTRATION INTRODUCE A SUBSTITUTE TO
ORDINANCE NO. 2546 -2011 AT THE SEPTEMBER 7, 2011 COUNCIL MEETING
WHICH INCLUDES ALL PLANNING AND ZONING RECOMMENDATIONS AND
CHANGES TO THE RR -1 LAND USE TABLE. THIS WOULD AMEND KENAI MUNICIPAL
CODE 14.22.010 AS SHOWN ON ATTACHMENT A.

RESOLUTION NO. PZ11 -33
A RESOLUTION OF THE KENAI PLANNING AND ZONING COMMISSION
RECOMMENDING KENAI CITY COUNCIL ADOPT UPDATED ZONING AND LAND
USE MAPS FOR THE COMPREHENSIVE PLAN FOR THE CITY OF KENAI.

WHEREAS, The Kenai Peninsula Borough Ordinance 90 -31 delegated authority to the City of
Kenai to make Land Use Amendments to the Comprehensive Plan; and,
WHEREAS, Kenai Municipal Code requires the Commission to review the Comprehensive Plan
on an annual basis; and,
WHEREAS, The City of Kenai Comprehensive Plan was adopted in 2003; and,
WHEREAS, Amendments to the Official Zoning Map require updates to the Zoning and Land
Use Plan maps within the Comprehensive Plan; and,
WHEREAS, the last update to the Zoning and Land Use Plan maps in the Comprehensive Plan
occurred in August of 2010; and,
WHEREAS, Amendments to the Official Zoning Map have occurred since August 2010
requiring an update to the Zoning and Land Use Plan maps within the Comprehensive Plan; and,
NOW, THEREFORE, BE IT RESOLVED, that the Planning and Zoning Commission
recommends that the Kenai City Council update the City of Kenai Comprehensive Plan with
adoption of the updated City of Kenai Zoning, and Land Use Plan Maps as shown on Attachment
A (Map 6), Attachment B (Map 10), and Attachment C (Map 11).

Alaska is still building its basic transportation network. Before any road construction can
occur, it needs to go through the project development process. This session will provide an
overview of the project development process from idea to the start of the National
Environmental Policy Act (NEPA) process. In additional to building new roads, we are
constant state of improvement for our existing road network. This session provides a brief
history and overview of the State of Alaska's Statewide Transportation Improvement
Program (STIP) and information on how projects are nominated and evaluated for inclusion

David Montgomery is the authorof "King of Fish: The Thousand Year Run of Salmon" and a
McArthur Foundation Genius. He studies the evolution of topography and the influence of
geomorphologlcal processes on ecological systems and human societies. David received his B.S.
in geology at Stanford University (1984) and his Ph.D. in geomorphology from UC Berkeley
(1991). His published work includes studies of the evolution and near-extirpation of salmon,
fluvial and hillslope processes In mountain drainage basirs, the evolution of mountain ranges
(Cascades, Andes, and Himalaya), and the analysis of digital topography. Current research

The second meeting in November is on November 23rd, the evening before
Thanksgiving. In the past, we have requested the meeting be cancelled.
The second meeting in December is December 28th. Unless there are going to be a
number of Commissioners absent, it doesn't appear necessary to cancel this meeting.
If we request the Clerk to cancel these meetings now, we will have sufficient time to
inform people of the cancellation(s) and will not schedule public hearings for those
meetings.
