MINUTES
ITEM 1: CALL TO ORDER
ChairTwait called the meeting to order at approximately 7:02 p.m.
1 -a. Pledge of Allegiance
Chair Twait led those assembled in the Pledge of Allegiance.
1 -b. Roll Call
Commissioners present: Chair J. Twait, P. Bryson, H. Knackstedt, K. Koester,
K. Rogers, T. Navarre
Commissioners absent: S. Romain
Staff /Council Liaison present: City Planning Assistant N. Carver, Council Member
T. Bookey, Deputy City Clerk C. Hall
A quorum was present.
1 -c. Agenda Approval
MOTION:
Commissioner Bryson MOVED to approve the agenda as presented and Commissioner
Rogers SECONDED the motion. There were no objections. SO ORDERED.
1 -d. Consent Agenda
MOTION:
Commissioner Knackstedt MOVED to approve the consent agenda and Commissioner
Bryson SECONDED the motion. There were no objections. SO ORDERED.
1 -e. *Excused Absences
Approved by consent agenda.
*All items listed with an asterisk ( *) are considered to be routine and non-
controversial by the Commission and will be approved by one motion. There will be
no separate discussion of these items unless a Commission Member so requests, in
which case the item will be removed from the Consent Agenda and considered in
its normal sequence on the agenda as part of the General Orders.
ITEM 2: *APPROVAL OF MINUTES -- August 10, 2011
Approved by consent agenda.
ITEM 3: SCHEDULED PUBLIC COMMENT -- None.
ITEM 4: CONSIDERATION OF PLATS -- None.
ITEM 5: PUBLIC HEARINGS
5 -a. PZ11 -32 - An application for an encroachment for a two foot (2') ten inch
(10 ") side yard setback for the property known as Lot 8, Block 3, Silver
Pines Subdivision Part One (605 Ponderosa Street). Application
submitted by Robert A. Myles, 605 Ponderosa Street, Kenai, Alaska.
Commissioner Navarre noted he had lived in the neighborhood and his brother had
sold the property in the past.
MOTION:
Commissioner Bryson MOVED to approve PZ11 -32 and Commissioner Knackstedt
SECONDED the motion.
Carver reviewed the staff report included in the packet, noting the following criteria
needed to be met:
1. An encroachment as defined in KMC 14.20.185(a) exists.
2. The encroachment does not encroach upon a Federal, State or City right -of-
way or utility easement.
3. The issuance of the encroachment permit will not authorize a use which is
not a principal permitted use in the zoning district in which the property is located.
4. The encroachment is not located across a platted lot line.
Carver noted Administration was recommending denial of the perrnit, but if the permit
was issued, the following recommendation was suggested:
• An as -built of the property must be provided to verify the deck does not
cross the property line. As -built must be provided prior to issuance of the
encroachment permit.
Twait read the rules of public hearing and opened the meeting to public comment.
Robert Myles, 605 Ponderosa -- Applicant spoke in favor of the permit, noting a
surveyor had surveyed the property; he was willing to shorten the deck by 20 inches,
and he would provide an as -built if required.
Twait noted after the 20 inches have been removed, there would still be an

encroachment of one foot four inches.
There being no one else wishing to speak, the public hearing was closed.

ITEM 6:
UNFINISHED BUSINESS
6 -a. Reconsideration of PZ11 -30 - A resolution of the Kenai Planning and
Zoning Commission recommending Kenai City Council amend Kenai
Municipal Code 14.22.010, Land Use Table, to make comprehensive
changes to the uses allowed in the Rural Residential RR -1 Zoning District.
(Ordinance No. 2546 -2011 - An ordinance of the Council of the City of
Kenai, Alaska, amending KMC 14.22.010, Land Use Table, to make
comprehensive changes to the uses allowed in the Rural Residential 1
(RR -1) zoning district including changing many "Conditional Uses" to uses
"Not Permitted," and providing for certain "Conditional Uses" for
properties along the Kenai Spur Highway within the RR -1 zoning district.)
(Postponed on 8 /10 /11.)

Commissioner Knackstedt MOVED to reconsider PZ11 -30 and Commissioner Navarre
SECONDED the motion and requested UNANIMOUS CONSENT. Commissioner Bryson
requested a roll call vote.

MOTION TO AMEND:
Commissioner Navarre MOVED to amend PZ11 -30 by moving all changes to the RR -1
zone from the August 16 and August 24 work sessions into the land use table and
requested UNANIMOUS CONSENT. Commissioner Knackstedt SECONDED the
motion. There were no objections. SO ORDERED.
MOTION TO AMEND:
Commissioner Navarre MOVED to amend PZ11 -30 to strike footnote #29 and replace
it with the following: Use allowed only for those parcels that abut the Kenai Spur
Highway. The access to any such parcel must be either from (a) driveway access on
the Kenai Spur Highway, or (b) driveway access from a dedicated right -of -way and that
driveway access is not more than 275 feet from the constructed centerline of the Kenai
Spur Highway to the center of the driveway access as shown on an as -built drawing of
the parcel. Commissioner Navarre requested UNANIMOUS CONSENT. Commissioner
Koester SECONDED the motion. There were no objections. SO ORDERED.
MOTION TO AMEND:
Commissioner Navarre MOVED to amend PZ11 -30 to add the following footnote:

30. Use allowed for only those parcels that abut Beaver Loop Road, Bridge Access
Road, and Kalifornsky Beach Road. Access to the parcel must be from these streets
unless applicant can provide documentation that an application for a driveway permit
has been denied by the State of Alaska or City of Kenai. In that case, the Commission
may consider alternate ingress and egress. Driveways should be located a reasonable
distance from the Kenai Spur Highway, Beaver Loop Road, Bridge Access Road, and
Kalifornsky Beach Road to ensure the driveway does not create an unsafe traffic
pattern and to ensure that traffic impact into the neighborhood is minimized.
Industry established trip generation standards for the commercial use should be used
to determine the impact on the neighborhood.
Commissioner Navarre requested UNANIMOUS CONSENT. Commissioner Knackstedt
SECONDED the motion. There were no objections. SO ORDERED.
MOTION:
Commissioner Navarre MOVED to supply Council with the entire Land Use Table from
the work session with the resolution and requested UNANIMOUS CONSENT.
Commissioner Koester SECONDED the motion. There were no objections. SO
ORDERED.
MOTION TO POSTPONE:
Commissioner Navarre MOVED to postpone PZ11 -30 to the August 30, 2011 Planning
and Zoning Commission special meeting for a public hearing and Commissioner
Knackstedt SECONDED the motion.

ITEM 7:
NEW BUSINESS
7 -a. Discussion /Set Public Hearing -- PZ11 -33 - A resolution of the Kenai
Planning & Zoning Commission recommending Kenai City Council adopt
updated zoning and land use maps for the Comprehensive Plan for the
City of Kenai.
Carver reviewed the staff report included in the packet and general discussion
occurred. The public hearing was set for the September 14, 2011 meeting.

7 -b. Discussion /Recommendation -- Request for legal counsel at Planning
& Zoning meetings. Request submitted by Commissioner Knackstedt.
Commissioner Knackstedt reviewed his memo included in the packet.

Commissioner Knackstedt MOVED to request Council provide legal counsel at all
Planning and Zoning Commission meetings and Commissioner Navarre SECONDED
the motion.

7 -c. Discussion /Recommendation -- Excused Absences.
Carver reviewed the memo included in the packet.
Koester reported Romain had tried in the past to make meetings; he provided good
input and provided valuable information, noting she supported good cause.
Navarre supported good cause for past absences and requested an update at the
November meeting.

Commissioner Navarre MOVED to find Commissioner Romain's absences were for
good cause and Commissioner Koester SECONDED the motion.

ITEM 9: REPORTS
9 -a. City Council -- Council Member Bookey reviewed the August 17, 2011
Council Action Agenda which was included in the packet, noting Ordinance No. 2546-
2011 had been postponed to the September 7 meeting, passage of the junk vehicle
ordinance, and a Council work session regarding City Clerk recruitment would take
place on August 29, 2011.
9 -b. Borough Planning -- Commissioner Bryson reviewed the Borough
Planning Commission agenda of August 22, 2011 which was included in the packet.
9 -c. Administration -- No report.
ITEM 10: PERSONS PRESENT NOT SCHEDULED -- None.
ITEM 11: INFORMATION ITEMS
11 -a. City of Kenai Draft Trails Plan
ITEM 12: NEXT MEETING ATTENDANCE NOTIFICATION

Commissioner Bryson noted he would not he able to attend the August 30, 2011
meeting.
ITEM 13: COMMISSION COMMENTS & QUESTIONS
Navarre suggested the Council Liaison report on ordinances in a more timely manner.
Koester thanked the public for their attendance and participation.
