MOTION: Commissioner Bryson MOVED to approve PZ11 -32 and Commissioner Knackstedt SECONDED the motion. Carver reviewed the staff report included in the packet, noting the following criteria needed to be met: 1. An encroachment as defined in KMC 14.20.185(a) exists. 2. The encroachment does not encroach upon a Federal, State or City right -of- way or utility easement. 3. The issuance of the encroachment permit will not authorize a use which is not a principal permitted use in the zoning district in which the property is located. 4. The encroachment is not located across a platted lot line. Carver noted Administration was recommending denial of the perrnit, but if the permit was issued, the following recommendation was suggested: • An as -built of the property must be provided to verify the deck does not cross the property line. As -built must be provided prior to issuance of the encroachment permit. Twait read the rules of public hearing and opened the meeting to public comment. Robert Myles, 605 Ponderosa -- Applicant spoke in favor of the permit, noting a surveyor had surveyed the property; he was willing to shorten the deck by 20 inches, and he would provide an as -built if required. Twait noted after the 20 inches have been removed, there would still be an PLANNING AND ZONING COMMISSION MEETING AUGUST 24, 2011 PAGE 2 encroachment of one foot four inches.
