In April of 2012, the Police Department is sending two KPD training officers to the annual International Law Enforcement Educators and Trainers Association (ILEETA) Conference in Chicago. The two officers will attend seminars presented by some of the nation's top law enforcement trainers. The seminars will include advanced training for firearms instructors and control tactics instructors. This opportunity will benefit all officers at KPD, as they receive in- house training from KPD trainers. WHEREAS, the City of Kenai previously received a grant from the State of Alaska for $1,000,000 for municipal improvements of which $250,000 was appropriated for the City's Library Expansion Project, $150,000 was appropriated for improvements at Daubenspeck Park and the remaining $600,000 was appropriated for street and sewer projects; and, WHEREAS, there remains $531,289 of street, water and sewer project funds currently unallocated to a specific project; and, WHEREAS, the installation of a new pedestrian bridge over No Name Creek is eligible project under the state grant; and, WHEREAS, the City received $150,000 in funding from the State of Alaska Department of Fish and Game and $25,000 from US Fish and Wildlife to construct and repair infrastructure associated with the annual State of Alaska personal use fishery; and, WHEREAS, to date $137,439 has been spent or encumbered to upgrade trails on the City's north beach and construct additional permanent bathrooms on the City's north beach; and, WHEREAS, installation of the new bridge over No Name Creek is expected to cost approximately $85,000 requiring an additional $46,000 to complete the project. The City has received funding for personal use fishery related infrastructure from the State of Alaska Department of Fish and. Game in the amount of 51.50,000 and from the United States Fish and Wildlife Service in the amount of $25,000. To date the following funds have been expended on personal use fishery related infrastructure improvements: North Shore Fencing Extension $ 20,708 Meeks Trail Improvements 22,730 North Shore Bathroom Construction 73,500 No Name Creek Bridge Replacement 15,569 Total $132,507 $42,493.36 remains available for the bridge project. These funds were seized pursuant to 2008 and 2010 drug investigations. The checks for $560.50 and $58.00 were provided to City Finance. Per the U.S. Department of Justice Equitable Sharing Guide, equitable sharing funds used by law enforcement shall be used for law enforcement purposes only. Permissible uses of the funds include, but are not limited to, law enforcement investigations, training, and equipment. We are permitted to purchase equipment which is used by law enforcement personnel that supports law enforcement activities. I am requesting an ordinance to appropriate these funds to the General Fund, Police — Small Tools Account, to help pay for law enforcement equipment, to include investigative equipment. 1952 7 the cry of KENA EASNA Suggested by: Council Member Marquis, Council Member Bookey, and Administration CITY OF KENAI ORDINANCE NO. 2603 -2011 AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING KENAI MUNICIPAL CODE CHAPTER 7.05, "TAXATION OF REAL AND PERSONAL PROPERTY" BY ADDING A NEW SECTION `PROPERTY TAX CREDIT - RESIDENTIAL SPRINKLER SYSTEMS," TO PROVIDE A TAX CREDIT TO OWNERS OF RESIDENTIAL STRUCTURES WHO INSTALL CERTAIN QUALIFYING SPRINKLER DEVICES. WHEREAS, the 2009 International Residential Building Code requires the installation of an NFPA (National Fire Protection Agency) 13D compliant sprinkler system in all newly constructed 1 and 2 family dwellings; and, WHEREAS, the City of Kenai has elected not to impose this requirement by amending the City's adopted local building codes; and, WHEREAS, the City understands the benefits of sprinlder systems and encourages that all new one and two family dwellings constructed in the City limits of Kenai to be sprinklered to a minimum standard that complies with the 2009 International Residential Building Code (or better); and, WHEREAS, in light of those benefits, it is in the best interest of the City to provide a property tax credit to the legal owner(s) of the qualified dwelling that is equal to the actual cost of installation or $2.00 per square foot of the dwelling (excluding attached garages), whichever is less, to be used to satisfy City of Kenai real property taxes for the subject property. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI, ALASKA, as follows: Section 1. Form. This is a Code ordinance, Section 2. Amendment of Chanter 7.05 of the Kenai Municipal Code: The Kenai Municipal Code is amended by adding a new section, Property tax credit - residential sprinklers, to be numbered 7.05.075 which shall read as follows: 7.05.075 Property tax credit - residential sprinklers. (a) Credit. The owner(s) of a newly constructed one or two family- dwelling who installs, and /or has certified, a compliant sprinkler system by a qualified installer may receive a credit against the City of Kenai property taxes. The credit allowed under this section for a residential sprinkler system is the lower of the eligible cost to the owner of the property for the installation of the system or $2.00 per square foot of the dwelling (excluding attached garages). "Eligible cost" means the cost of the sprinkler system including labor and materials required to comply with the minimum standard established by code. (c) Carry Over. The amount of credit in any tax year must not exceed the amount of the City of Kenai property tax imposed on the property benefitted by the credit in that tax year. Any amount of a credit not taken in the tax year in which an application is approved may be carried over in subsequent years until the full credit is granted, Any unapplied credit shall remain with the property and may be utilized by subsequent owners, in the event the property is sold, until the full credit has been applied against taxes of the property. (d) Application. (1) A property owner must submit an application for the tax credit to the Finance Department on or before the date that the Finance Department sets which date shall be no later than April 30 of each year. Applications filed after April 30, or applications that are incomplete as of the date set for filing by the Finance Department, will be retained and, once complete, evaluated for a tax credit for the next succeeding year. (2) An application must: (A) be on the form that the City requires; (B) demonstrate that the taxpayer is entitled to the credit; and, (C) include a certificate of occupancy from the City of Kenai's building official indicating that the system for which the credit is sought meets the requirements of the 2009 International Residential Building Code (of subsequent edition adopted by the City). (e) Appeal. If the tax credit is denied, or if less costs for the installation of the system are allowed than the applicant believes appropriate, the applicant may appeal that decision to the City Manager on a form provided by the City. Appeals shall be filed with the City Manager within fifteen (15) days of the date of any decision under this section. In reviewing an appeal, the City Manager shall consider whether the sprinkler system meets the requirements of this section; the costs were necessarily incurred to install the system in accordance with this section and applicable codes; and the application for the tax credit was timely filed. The 2009 International Residential Building Code (IRBC) requires installation of fire sprinkler systems in newly constructed one and two family dwellings. The requirement to install fire sprinkler systems in newly constructed one and two family dwellings has been met with strong opposition, primarily as a function of cost, from a variety of individuals and organizations. As a result of this opposition, the majority of municipalities nation -wide have chosen to eliminate the provision requiring fire sprinkler systems. 1997 The Administration, Fire Department, and Emergency Services recognize the value of fire sprinkler systems in newly constructed one and two family dwellings, Administration has prepared this ordinance establishing a property tax credit for homeowners that decide to install fire sprinkler systems. Attached is correspondence from the Finance Department estimating the future financial impact of the proposed ordinance, Fire sprinkler systems have been shown to provide protection for building occupants, the structure, and for emergency response personnel. This analysis will not project potential future use of the proposed credit but will look at the maximum impact the credit could have had if available during calendar years 2007 through 2010. Maximum potential exposure for the City is $2.00 per square foot of new construction excluding garages. The following table shows by year the number of homes constructed, the maximum credit that would have been available, the combined square footage which would have been available for credit had a qualified sprinkler system been installed, the current assessed value of those properties, and the estimated number of years it would take to exhaust the City's credit. (KPBA), I'd like to thank the City of Kenai for their time and effort in developing and proposing a property tax credit in regards to residential sprinkler systems in residential dwellings (ORDINANCE NO. 2559 - 2011). As an Association, we continue to be in strong support of any precautions a homeowner may take to better protect themselves from fire danger, which would include sprinkler systems, smoke alarms, and all other appropriate safety measures. The KPBA is a strong advocate of the homeowner's right to choose to install a sprinkler system, and will therefore continue to be in opposition of any proposed mandate. On November 22, 2011 at 2:OOpm we received nine bids for the above project. These bids have been reviewed and it was determined that Cornerstone Equipment Rentals, LLC was the lowest responsive bidder. The bid documents were complete and responsive and sufficient funds will be available to complete the project. Porter asked what the kitchen would be used for. Hancock replied the kitchen would used as training and open as a restaurant to allow for income for maintenance of the building. Koch supplied the language to resolve the restriction issues on the building height that will be added to the agreement. The Communications Center received 256 emergency 9 -1 -1 calls (170 from cell phones). Communications personnel handled 3,211 administrative phone calls. Officers made 44 arrests. Traffic enforcement resulted in 101 warnings, 41 speeding tickets, 11 seatbeft tickets, 10 citations for equipment violations, and 69 citations for "other" traffic violations. There were 3 DUI arrests (two of which were felonies). Police investigated 13 vehicle crashes. Two of the crashes involved moose. None of the crashes were DUI - related. On November 2, Sgt. Longhorn attended a one -day Internet Crimes Against Children Conference in Anchorage. On November 17, Sgt. George and Officer Cushman attended a two -day problem - oriented policing and tribal relations course in Anchorage. On Friday, November 25, 9 officers provided traffic control for the annual electric light parade and fireworks show. On Nov. 28, SRO Prins attended 4 days of School Resource Officer training in Las Vegas, NV. In the Schools, SRO Pdns handled the following: 5 investigations, 12 DARE presentations, 3 alcohol presentations, 2 internet safety presentations, 4 "other' presentations. 48 arc of KENAI, ALASKA FIRE DEPARTMENT MID - MONTH REPORT November 2011 This last week we were visited by the FAA and were part of the Part 139 inspection for the Kenai Airport. Response capability, training records and performance inspections were all done. As a whole the department performed well with no glaring short comings. We continue to participate with the Paramedic ride along program through KPC and hopefully adding to their learning experience. We had two members of the department attend a Methods of Instruction Level II class this month in Nikisici. It was taught and sanctioned through the State Fire Marshal's office so congratulations to Pete Coots and Tony Prior. Mince the last meeting we have sponsored two Safe Kids car seat checks here at the station. Increases in the call volume for the Fire Department are presently above the typical average for 2011. Presently we are 20% higher than last year at this time. With the winter weather we are starting to see more medevacs from the hospital to the airport. Additionally the present road conditions have created a challenging driving environment and have led to multiple vehicle accidents. Having just gotten done with Fire prevention in the schools, we hope to get through the Holiday season with no fires. You will be hearing PSAs soon speaking about Holiday safety and prevention measures during this Holiday season. Finally', the new ambulance has been put into service. The radios have been installed and we are actively training all personnel on the characteristics of this new vehicle. It is a great addition to the fleet and we anticipate years of service from it. 49 i0/innicipai Airport December 2011 Airport Manager's Report Airport improvement Program: Apron Rehabilitation: The Airport and Finance Department are finalizing the close out documents. Master Plan — Existing facility inventories and inspections are being conducted in addition to collecting and updating aviation related activities existing and forecasted for the airport. Phase One tasks are about 60% complete. Obstruction Clearing EA - Comments were received and the draft document has been edited. The draft Environmental Assessment has been prepared and is available for review. Comments should be returned no later than January 16, 2012. Float Plane Basin EA & Design: The project will be bid ready when grant funds become available. Winter Operations: The crew has been very busy battling the many winter storms and has done a commendable job. Airport Inspection: The airport had a certification inspection on December 5, 6, & 711. The inspection is conducted to determine compliance with Federal Aviation Regulation (FAR) part 139, the Airport Certification Manual, and the Airport Operating certificate. The airport received a Letter of Correction for three items; two items were immediately corrected and the third corrective item is a communications (radio) issue between ARFF personnel and M &O personnel. The inspector complimented the airport for its lighting and snow removal maintenance and the conduct of the Kenai Fire Department personnel. Information for budget preparation will be distributed to City Departments by December 23rd. The Council will receive its first draft of the FY2013 budget with its April 4"' packet. There is much work to be done by all City departments over the next couple of months. The department is preparing for a year -end review of the Airport Land Sale and General Land Sale Permanent funds performance. Representatives from Alaska Permanent Capital are scheduled to present a portfolio review at the second meeting in January. Council will also be asked to set the portfolio's asset allocation for 2012 at that meeting. Construction on the City's data center is underway at the Public Safety Building. Construction should be complete in January at which time network equipment will begin to be moved. In November we had 907 volunteer hours. KENAI SENIOR CENTER DECEMBER REPORT in November, 15 people that had flu shots sponsored by Public Health. The yearly October flu shots were sponsored by Safeway this year with 125 people getting shots, At the beginning of fall, public health did not believe they would be getting serum for the shots, fortunately they did. We held a Veterans Luncheon with 80 seniors present. Many veterans shared a story about their service and how many years they served their country. Senior Connection, Inc. and Frontier Community Services, inc.'s Mystery Dinner Theater was this month. [t was very successful with staff asking if we can do it again next year. FCS staff volunteered their time in preparation and the days of the event. This month kicked off the holiday season at the Center. The Marathon Dinner was held and was a huge success. Again this year Marathon Employees helped prepare, set up and served the congregate meal as well as their volunteers going with meal drivers from Kenai, Soldotna, Nikiski Senior Centers and delivering meals. There were 109 home meals that went out besides serving 199 meals at the congregate site. Everyone enjoyed themselves and it was wonderful to have such great volunteers. A senior center staff person and family volunteered at the Thanksgiving Day Potluck. They prepared the turkey and potatoes with others providing side dishes and desserts. 35 people attended. 54 the of KEN I, ALASKA PARKS & RECREATION MID -MONTH REPORT December 2011 A total of 115.75 hours were reserved at the ice rink during the month of November. This compares to 112 hours in November 2010. A new micro - processor was installed last month and is operating without any difficulty. A set of bearings need replaced in one of the glycol pumps and this work is scheduled for January. Approximately 30 hours were dedicated to maintaining sidewalks during the month of November. A total of 27.75 hours have been spent maintaining sidewalks to date for the month of December. These hours were spent performing snow removal and other related activities located at City Hall, Kenai Cultural & Visitors Center, and Kenai Library. Director Frates and the Parks /Grounds Operator conducted interviews for a FT Operator position. Several hours throughout the month of November were dedicated to addressing training matters for Chris Konig. Test measurements were taken over the course of a couple weeks in November and into the month of December. As of December 16th, measurements ranged from 14" to 18 ". The pond was cleared of snow on December 16th and available for skating. Rec. Center painting bids were developed and will soon be available to contractors, in addition to, solicitation of bids to upgrade the Leif Hansen Memorial Park flower beds. Maintenance on the ski trails has been minimal to date due to weather and available time. Street pole decorations were put up toward end of November and early December along with a couple new static displays for Leif Hansen Memorial Park. Ten more poinsettias recently arrived and will be installed along the Spur Hwy with remaining decorations. New winter banners were recently installed on the light poles in the parking lot at the Kenai Cultural and Visitors Center. A new fence along the south east corner of Bernie Huss trail was installed. Fence will serve as a deterrent and prevent snow from being piled up onto property. Flowers were ordered for next summer's circle planters along the Spur Hwy, City Hall, street corner boxes, and gazebo.
