ITEM A: CALL TO ORDER
Mayor Porter called the meeting to order at approximately 7:00 p.m.
A -1. Pledge of Allegiance
Mayor Porter led those assembled in the Pledge of Allegiance.
A -2. Roll Call
There were present:
Mayor Pat Porter, Vice Mayor Ryan Marquis, Council Member
Terry Bookey, Robert Molloy, and Mike Boyle comprising a
quorum of the Council.
Also present was Student Representative Austin Daly, City Manager Rick Koch,
City Attorney Krista Stearns, City Clerk Sandra Modigh, and Deputy City Clerk
Corene Hall.
A -3. Agenda Approval
Mayor Porter read the following addition to the agenda:

Council Member Bookey MOVED to approve the agenda as amended and
Council Member Marquis SECONDED the motion.

ITEM C: UNSCHEDULED PUBLIC COMMENTS
Mayor Porter welcomed new City Clerk Sandra Modigh.

D -1. Ordinance No, 2600 -2011 -- Increasing Estimated Revenues and
Appropriations by $2,285 in the General Fund for Training Funds
Provided by the Alaska Police Standards Council.

Council Member Marquis MOVED to approve Ordinance No. 2600 -2011 and
Council Member Bookey SECONDED the motion.
There were no public comments or council comments.
VOTE: MOTION PASSED UNANIMOUSLY.
D -2. Ordinance No. 2601 -2011 -- Increasing Estimated Revenues and
Appropriations by $46,000 in the Personal Use Fishery Capital Project
Fund.
Council Member Molloy MOVED to enact Ordinance No. 2601 -2011 and
Council Member Marquis SECONDED the motion.
Mayor Porter opened the meeting for public testimony.
Bob Peters, Old Town - spoke in favor of the project and requested input from
the Harbor Commission.

D -3. Ordinance No. 2602 -2011 -- Increasing Estimated Revenues and
Appropriations by $618.50 in the General Fund for the Police
Department to Purchase Equipment from Asset Forfeiture Funds
Provided to the City Of Kenai.
MOTION:
Council Member Bookey MOVED to approve Ordinance No. 2602 -2011 and
Council Member Marquis SECONDED the motion.
There were no public comments.
VOTE: MOTION PASSED UNANIMOUSLY.
D -4. Ordinance No. 2603 -2011 -- Amending Kenai Municipal Code Chapter
7.05, "Taxation of Real and Personal Property" by Adding a New Section
"Property Tax Credit - Residential Sprinkler Systems," to Provide a Tax
Credit to Owners of Residential Structures Who Install Certain Qualifying
Sprinkler Devices,
MOTION:
Council Member Bookey MOVED to approve Ordinance No. 2603 -2011 and
Council Member Marquis SECONDED the motion.
There were no public comments.
MOTION TO POSTPONE:
Council Member Bookey MOVED to postpone Ordinance No. 2603 -201 lto the
January 18, 2012 council meeting and Council Member Marquis SECONDED
the motion.
City Manager Koch advised council of necessary revisions including clarification
of the proposed chapter providing a "tax credit" versus "tax exemption ".
VOTE ON POSTPONEMENT: MOTION PASSED UNANIMOUSLY.
D -5. Resolution No. 2011 -76 -- Awarding a Contract to Cornerstone
Equipment Rentals, LLC for the Project Entitled, "Kenai North Shore
Improvements Pedestrian Bridge," for the Total Amount of $68,500.00.

Council Member Bookey SECONDED the motion.
Mayor Porter opened the meeting for public testimony.
Bob Peters, Old Town - spoke in favor of the project and thanked
administration and council for bringing the resolution forward.
ITEM E: MINUTES
E -1. *Regular Meeting of December 7, 2011.
APPROVED BY CONSENT AGENDA.
ITEM F: UNFINISHED BUSINESS -- None.
ITEM G: NEW BUSINESS
G -1. Bills to be Ratified.
MOTION:
Council Member Molloy MOVED to ratify the bills and requested UNANIMOUS
CONSENT. Council Member Marquis SECONDED the motion.
VOTE: MOTION PASSED UNANIMOUSLY.
G -2. Approval of Purchase Orders Exceeding $15,000
MOTION:
Council Member Bookey MOVED to approve purchase orders exceeding
$15,000 and requested UNANIMOUS CONSENT. Council Member Marquis
SECONDED the motion.
VOTE: MOTION PASSED UNANIMOUSLY.
ITEM H: COMMISSION /COMMITTEE REPORTS
H -1. Council on Aging -- no report.
H -2. Airport Commission -- no report.
H -3. Harbor Commission -- Council Member Molloy reported the meeting was
rescheduled for January 5, 2012.

ITEM I: REPORT OF THE MAYOR
Mayor Porter reported on the following:
• Thanked the Eagles Club for the Christmas dinner provided for the
senior citizens of the community.
• Attended the Buccaneer presentation.
• Attended the Alliance presentation with Council Member Marquis.
• Swore in new City Clerk Sandra Modigh.
• Visited The Way Cafe which provides meals for children up to age 18
for low- income families.
J -l. City Manager -- City Manager Koch reported on the following:
• Included Representative Olsen in previous remarks made to the
legislative delegation thanking them for advocating on the city's
behalf for funds allocated to city for capital improvements.
• Employee Appreciation event January 13, 2012, black 8v white theme.
• Will not be attending the Winter Alaska Municipal League (AML)
Conference February 7 -8, 2012.
• Met with Buccaneer and subcontractors related to activities proposed
to take place on the city's right -of -way.
• Wished all Merry Christmas and happy holidays.
J -2. City Attorney -- City Attorney Stearns reported on the following:
• Thanked staff and administration for work during her absence.
• Oral argument of Disque appeal - January 4, 2012, 2:30 p.m.
• Happy Holidays.
J -3. City Clerk - City Clerk Modigh reported on the following:
• Expressed her delight to be part of the Kenai community and city
administration.
• AML Conference hotel rooms secured.
• Happy Holidays.

Bob Peters, Old Town - expressed concerned after attending the Buccaneer
presentation related to "thumping" on personal property and possible bluff
damage. Mr. Peters further expressed concern about slick street conditions and
wished all happy holidays.
K -2. Council Comments
Council Member Bookey thanked all the city employees for their hard work
and dedication; wished all happy holidays.
Student Representative Daly wished all an outstanding holiday and welcomed
the new city clerk.
Council Member Marquis recognized the Winter Solstice and wished all happy
holidays.
Council Member Molloy welcomed the new city clerk and thanked all
presenters and community members for participating at council meetings
throughout the year; thanked local businesses and organizations for
contributing time and funds to city projects; thanked council and
administration for their hard work and wished all happy holidays.
Council Member Boyle welcomed the new city clerk and wished all a happy
holiday.
Mayor Porter thanked the citizens for participating in the community and
making it the wonderful place it is to live; wished all happy holidays.
ITEM L: EXECUTIVE SESSION -- None Scheduled.
ITEM M: PENDING LEGISLATION (This item lists legislation which will be
addressed at a later date as noted.)
L -1. Ordinance No. 2597 -2011 --Amending Kenai Municipal Code
14.22.010, Land Use Table, to Make Comprehensive Changes to the Uses
Allowed in the Suburban Residential (RS), Suburban Residential 1 (RS I),
Suburban Residential 2 (RS2), Rural Residential (RR), Rural Residential RR -1,
and the Urban Residential (RU) Zoning Districts.
(Clerk's Note: At its November 16, 2011 meeting, the Council postponed
Ordinance No. 2597 -2011 to the August 1, 2012 meeting and the ordinance was
referred back to the Planning and Zoning Commission so the Commission could
continue to consider the changes proposed in this work product during the
Comprehensive Plan process.)
