Commissioner Knackstedt questioned if 2077 was the correct length of the lease?
Kebschull replied that some of the older leases can be 90 year leases.
Commissioner Peterson asked if L&M would be relieved of lease payment obligations,
and what the lease amount was?
Kebschull replied that if approved, Jersey Subs would be the new lease and
responsible for payments. Ms. Kebschull did not know the lease payment amount.
Chair Twait informed staff the subject property map included in the packet was not
the correct, and a revised map be included in packet to Council.

5. Commission Discussion: Ordinance No. 2597 -2011 —Amending Kenai Municipal Code
14.22.010, Land Use Table, to Make Comprehensive Changes to the Uses Allowed in
the Suburban Residential (RS), Suburban Residential 1 (RS1), Suburban Residential 2
(RS2), Rural Residential (RR), Rural Residential 1 (RR -1) and the Urban Residential
(RU) Zoning Districts.
Planner Kebschull reviewed the history of Ordinance No. 2597 -2011. Commission
agreed to review proposed changes in Ordinance for RR and RRl zones first. No
changes recommended.
Ms. Ward commented she was opposed to changes to eliminate "N" in uses. Not
opposed to adding Footnote 30 and not opposed to removing off - street parking, charitable
institutions, and printing from the Land Use Table.

Ms. Espy commented she was against any changes that had been codified with Ordinance
No. 2546 -2011.
Ms. Kelso commented she was against businesses in neighborhoods
Planner Kebschull continued the review of remaining residential zones. Commission
questioned their decision for Dormitories /Boarding Houses for the RU zone.
Commissioner Knackstedt had read the definition of the zone and it appeared the use
should be permitted. Commission agreed to leave as a Permitted (P) use in the zone.
After the review, Planner Kebschull recommended the Commission consider
recommending Council postpone action until after the completion of the Comprehensive
Plan. There was a general discussion as to the Commission's ongoing recommendation
during the work on Ordinance No. 2546 -2011. Kebschull also advised that the work they
had accomplished clearly showed the need to review the number of zones in the City,
perhaps to consolidate zones, and then recommend changes to the Land Use Table.
It was agreed that Kebschull would discuss how to proceed with that recommendation
and bring something back to the Commission at their next work session on June 271H
Planner Kebschull recommended the Commission consider sponsoring a resolution to
amend Title 14 to update the definitions to include the definitions for all uses listed in the
Land Use Table and to make the following changes to the Land Use Table:
• Separate Theaters and Commercial Recreation
• Delete Charitable Institutions
• Delete Printing
• Delete Off - Street Parking
The Commission agreed to proceed with a recommendation to Council. Kebschull will
prepare draft resolutions for the Commission's consideration.

This plat reconfigures Baron Park Subdivision Fire Addition from three lots into five lots,
vacates a portion of Magic Avenue and associated utility easements, dedicates an
extension of Magic Avenue, and dedicates utility easements to accommodate existing
water and sewer mains. The resulting lots range in size from approximately 6.2 acres to
9.8 acres. Tract 1B of Baron Park 2008 Replat is included in this subdivision because of
the partial vacation of Magic Avenue. The parcels in this subdivision are zoned
Education and (IL) Light Industrial. The minimum lot size in the Education zone is
20,000 square feet. There is no minimum lot size for lots in the Light Industrial zone.
The City is in the process of requesting a rezone for existing Baron Park Subdivision Fire
Addition from the Education zone to Light Industrial.

Tracts 4, 5 and 6 will be accessed off Marathon Road. Tracts 2 and 3 will be accessed off
Magic Avenue. The plat includes dedication of an extension of Magic Avenue to provide
access to Tract 2. Tract 113 is accessed off the Kenai Spur Highway. Marathon Road is
maintained by the City to the intersection of Willow Street. The Kenai Spur Highway is
maintained by the State of Alaska. The City will construct Magic Avenue. Magic
Avenue will be maintained by the City of Kenai.
This is a City of Kenai development. Water and sewer will serve all lots. Water is
available and sewer will be extended to Tract 2. The extension of Magic Avenue will be
built to City standards.
An installation agreement will not be required. The purpose of an installation agreement
is to ensure that infrastructure in new subdivisions is completed so the City does not have
to assume responsibility for construction of the utilities and roads. Because the City is
the property owner, an installation agreement would serve no purpose.
RECOMMENDATIONS
This plat reconfigures Baron Park Subdivision Fire Addition from three lots into five lots,
vacates a portion of Magic Avenue and associated utility easements, dedicates an
extension of Magic Avenue, and dedicates utility easements to accommodate existing
water and sewer mains. The resulting parcels meet all zoning requirements. The parcels
are located off Marathon Road, Magic Avenue, and Kenai Spur Highway. The parcels
will be served by City water and sewer. An installation agreement is not required.
Recommend approval as submitted.

This property includes three parcels owned by the City of Kenai. The City is proposing a
rezone of the property to match the existing use and future proposed development. A
portion (Lot A -1 -A) of the property was previously leased by the University of Alaska
and used to provide training for the University's Mining and Petroleum program. The
university no longer leases the property. The Fire Training Facility is located on Lot A -1-
B. The Fire Training Facility houses the Beacon Occupational Health & Safety Services.
Beacon provides a variety of support services to business and industry. The City of Kenai
also leases office space to other businesses in the Fire Training Facility. The City is in
the process of subdividing these properties. Parcels will be subdivided for the City's new
shop building and the Daubenspeck Family Park. All existing and future proposed uses
are permitted in the Light Industrial zone. During the subdivision process, right -of -ways

will be dedicated and existing water and sewer lines will be located.
Kenai Municipal Code 14.20.270 describes amendment procedures. Section 2 states,
"Amendments to the Official Zoning Map shall be considered only if the area to be
rezoned contains a minimum of one (1) acre (excluding street or alley rights -of -way)
unless the amendment enlarges an adjacent district boundary." This property is bordered
by areas zoned Light Industrial and includes over 40 acres of land. The requested rezone
meets the criteria for an amendment.
The Comprehensive Plan classifies the area as Central Commercial. Central Commercial
is defined as, "The Central Commercial district supports retail, service, and office
business that serve all of Kenai and the larger region. It is the Kenai subregion's main
commercial district. Retail, service, office, and public uses predominate. Non-
commercial uses, such as public offices, institutional uses, and dwellings may be
appropriate among commercial uses within mixed use areas." 1 The Plan also provides
policy guidelines to consider when zoning land for industrial uses. These are listed on
Page 38 of the Plan and include:
• The use has adequate access to a collector or arterial level street. The property
is served by Marathon Road and Magic Avenue. Access is adequate.
• The use had adequate public services. The property is served with City water
and sewer and accessed by developed right -of -ways.
• Potential conflicts with adjacent non - industrial uses have been minimized
through the site design. The closest residential area is separated from the
subdivision by an adjacent tract of land zoned conservation. The natural
drainage running through the tract of land zoned conservation provides a
natural buffer between these parcels and the residential parcels to the east.
• Potential hazards from the proposed industrial use have been minimized. Any
future development in the area will be constructed to meet industry safety
guidelines.
Building Official:
No building code issues.
RECOMMENDATIONS
The proposed rezone meets the requirement for an amendment as defined in KMC
14.20.270 and conforms to the Comprehensive Plan.
Recommend approval.

Amendments to the Kenai Zoning Code and Official Map may be initiated by:
Kenai City Council; Kenai Planning and Zoning Commission; Submission of a
petition by a majority of the property owners in the area to be rezoned; or, a
petition bearing the signatures of fifty (50) registered voters within the City of
Kenai to amend the ordinance text; or, submission of a petition as provided by the
Home Rule Charter of the City of Kenai.
Amendments to the Official Zoning Map shall be considered only if the area to be
rezoned contains a minimum of one (1) acre (excluding street or alley right -of-
way) unless the amendment enlarges an adjacent district boundary.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF KENAI, ALASKA, AMENDING
THE OFFICIAL KENAI ZONING MAP BY REZONING, BARON PARK SUBDIVISION FIRE
ADDITION LOTS A -1 -A, A -1 -B, AND THAT PORTION OF LOT A -1 -B BEING UTILIZED
FOR A FIRE INDUSTRIAL/ STRUCTURAL TRAINING SCHOOL (PARCEL #'s 04501019,
045010020, and 04501021)FROM EDUCATION (ED) TO LIGHT INDUSTRIAL (IL).
WHEREAS, the City of Kenai as owner of this property initiated a request to rezone the
property; and,
WHEREAS, the property is currently zoned Education (ED); and,
WHEREAS, the Zoning Code states that the intent of the Educational Zone (ED) is to
provide for an area primarily of education and related uses such as schools,
dormitories for educational purposes, parks and recreation, libraries and museums;
and,
WHEREAS, the City Administration has requested to rezone the lots from Education
Zone (ED) to Light Industrial (IL); and,
WHEREAS, the Zoning Code states that the intent of the Light Industrial Zone (IL) is to
provide for the development of industrial and commercial uses which are usually
compatible and which are of a type which has no nuisance effects upon surrounding
property, or which may be controlled to prevent any nuisance effects upon
surrounding property; and,
WHEREAS, the Zoning Codes states that new residential uses and other non-
industrial uses, except as otherwise provided in the Zoning Code, are not permitted in
the Light Industrial zone as principal uses because land classified in this zone should
be reserved for industrial and commercial purposes, and because the Light Industrial
zone is not suited to the excluded uses; and,
WHEREAS, Lot A -1 -A is over 30 acres, is the largest parcel in the application to
rezone, and was previously leased by the City of Kenai to the University of Alaska for
use as the training site for the University's Mining and Petroleum Program; and,
WHEREAS, the University of Alaska no longer leases Lot A -1 -A; and,
WHEREAS, the City initiated a subdivision to subdivide Lot A -1 -A to create lots for the
new City shop and for the Daubenspeck Family Park, and;
WHEREAS, Lot A -1 -B is owned by the City and on it is constructed the Alaska Fire
Training Center, also commonly known as "the Beacon Building;" and,

WHEREAS, the City has a facility management agreement for the Alaska Fire Training
Center (Center) with Beacon Occupational Health & Safety Services (Beacon) and
Beacon manages and operates the Alaska Fire Training Center and provides education
and training and other occupational health and safety services to business and
industry at the Alaska Fire Training Center; and,
WHEREAS, Beacon maintains offices within the Center and similarly provides office
space for Homer Electric Association and Hilcorp Energy in the Center; and,
WHEREAS, the existing and proposed uses on Lots A -1 -A and A -1 -B are consistent
with the purposes and intent of the Light Industrial Zone; and,
WHEREAS, the 2003 Comprehensive Plan defines Industrial Land Use as, "the
Industrial district identifies areas reserved for manufacturing, warehousing, trucking,
marine- related industry, storage, and similar industrial activities; states that City
utilities and safe, convenient vehicular access is critical to this district; and further
states that buffers between industrial uses and adjacent non - industrial uses are
desirable;" and,
WHEREAS, the 2003 Comprehensive Plan discusses the opportunities and challenges
for existing and future industrial land use in the City and identifies the need to
preserve existing best - located industrial -zoned tracts for future industrial uses; and,
WHEREAS, the 2003 Comprehensive Plan provides policy guidelines to consider when
zoning land for industrial uses including: whether there is adequate access to collector
or arterial level streets, adequate public services, whether the zoning will to minimize
potential conflicts with adjacent non - industrial uses, and whether the zoning will
minimize potential hazards from proposed industrial uses; and,
WHEREAS, Lots A -1 -A and A -1 -13 are located off Marathon Road, which provides
adequate access to the Lots; are served by City water and sewer; and are separated
from the closest residential area by an adjacent tract of land zoned Conservation; and,
WHEREAS, the proposed rezone would designate additional property in an area of
concentrated industrial development and will enlarge an adjacent district boundary;
and,
WHEREAS, the rezone meets the requirements of KMC 14.20.270; and,
WHEREAS, rezoning the property to Light Industrial (IL) is consistent with the 2003
Comprehensive Plan; and,
WHEREAS, it is in the best interest of the City of Kenai to rezone the area shown on
Attachment A to the Light Industrial zone (IL); and,

WHEREAS, on June 27, 2012, the Kenai Planning and Zoning Commission voted
unanimously to rezone the lots to Light Industrial (IL).
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF KENAI,
ALASKA, that the official Kenai Zoning Map is amended by rezoning the parcel shown
on Attachment A from Education (ED) to Light Industrial (IL).

14.22.010, Land Use Table, to Make Comprehensive Changes to the USeE
Allowed in the Suburban Residential (RS), Suburban Residential 1 (RS1),
Suburban Residential 2 (RS2), Rural Residential (RR), Rural Residential
RR -1, and the Urban Residential (RU) Zoning Districts.
[Clerk's Note: At its November 16, 2011 meeting, Council postponed
Ordinance No. 2597 -2011 to the August 1, 2012 meeting and the
ordinance was referred back to the Planning and Zoning Commission
so the Commission could continue to consider the changes proposed in
this work product during the Comprehensive Plan process.]

The Alaska Chapter of the American Planning Association is sponsoring a conference in
Anchorage this fall. The conference is scheduled for November 11 — 13, 2012, at the
Hotel Captain Cook. The Association has reserved a block of rooms at a discounted
rate. Because the conference is being held in conjunction with the Alaska Municipal
League conference, there is a concern that hotel rooms at the conference hotel may be
limited and that is why we are planning ahead.
A preliminary information flyer has been prepared and is attached. Travel for the
Commission is provided by the Council and must be requested and approved by City

Perhaps we should talk and I could better explain the process. The Comprehensive Plan is a guide to assist with future
decisions. As you state, conditional uses provide an avenue to consider providing for uses not allowed by right in zones.
The land use designation is one of the tools used when reviewing requests for conditional uses permits. There is no plan
to initiate rezone to areas that are identified as mixed use on the proposed future land use map. Please give me a call if

I am saying that I want Beaver Loop to remain Rural Residential. A change to Mixed Use would indeed be a rezoning,
wouldn't it?
And if I understand the description of what is allowed under Mixed Use, it would completely open the door to all kinds of
businesses and structures that would totally change the nature of the neighborhood.
As I said in my first message, I don't see a problem with employing Conditional Use Permits when and if people want to
put a business or other enterprise on the road. It has worked so far. It seems unfair to change zoning in a neighborhood
where people have made their homes for many, many years. The businesses along the road are such that they blend well
with the neighborhood, so far. But we have had to fight against some Conditional Use requests- a batch plant, for
example- that do not fit in. I am asking that we retain that right by keeping the zoning as it is.

Thanks Laura for your input. The Commission will be provided a copy of your email. The Commission is not considering
rezoning the Beaver Loop Road area. What they have done is worked on the proposed future land use map for the
Comprehensive Plan. During that planning, the Commission identified highway corridors (Kenai Spur Highway, Bridge
Access Road, Kalifornsky Beach Road, and Beaver Loop Road) as areas that should be considered for mixed use. The
map would be a guide to use if future rezoning is considered or if Conditional Use Permits are considered in these areas.
Work continues on the plan. It is likely, that the final public hearing before the Commission on the plan will be held after
September 1't. The public hearing will be noticed and public participation will be encouraged.

Subject: Beaver Loop Road
Since I won't be able to attend P and Z meetings this summer, I want to urge you via this message to please not re -zone
Beaver Loop. Rural Residential is the correct zoning for the road. There have been some special use permits granted over
the years and that process seems to have worked well. Please do not try to 'improve' or 'fix' something that is not broken.
We all live on Beaver Loop because of its rural nature.
I have attended a few big community gatherings over the last couple of years designed to get community feedback for
the purpose of designing the Comprehensive Plan. It's true that'economic development' was always mentioned as a goal.
But it is also true that at every meeting, citizens urged the city to contain the commercial areas of the city to the center of
town, to try to build a more vibrant downtown, and to fill vacant buildings. Please do not rezone entire rural residential
neighborhoods just to help someone who has a special interest in locating a business there.
A bike trail on Beaver Loop would be a welcome addition. Especially in the spring and summer, there is almost always
someone walking, running, or biking on the road, and speeders make it dangerous. The City would do well to promote
the relative tranquility of a neighborhood so close to town by promoting biking and walking there, and hooking that path
onto the bigger Unity Trail.
Thanks for your hard work on this commission- I am sure it isn't easy.

Project Description:
This project started as a school assignment. Caring for the Kenai is an annual competition
for high school students to get them involved in the community. I participated and placed P
in the competition. Most people stop there, but my idea was so unique and meaningful that I
had no choice but to put it in to action,
This project is designed to place reflective mile markers along the banks of the Kenai
River to assist emergency services. However, even though the intended purpose is to assist
emergency services, the possibilities and advantages of this project are endless. Identification
is a major challenge and annoyance for anyone using the river, and I would like to put an end
to that problem.
My plan is to place mile markers along the southern (left looking downstream) banks of
the river wherever possible. There are certain places where it must be placed on the northern
side for various reasons and these cannot be revoked for the time being. Within this packet,
you will find all the information and consent of the state parks, private owners, and cities of
Kenai and Soldoma to have these mile markers placed upon their land.
The mile markers themselves are basically wooden posts. Each will consist of a 4 inch x
4 inch x 6 feet piece of treated wood, two aluminum reflective signs, and a Groundmasterg

CONSUMER INFORMATION SHEET
This wood has been preserved with CCA (chromated copper arsenate) wood preservative, an
EPA r@Gioro wmigal GGnwonq ingr9oc amnic to protect it from termite attack and decay.
Wood treated with inorganic arsenic should be used only where such protection is important.
CCA preservative penetrates deeply into and remains in the pressure - treated wood for a long
time. Exposure to CCA preservative may present certain hazards. Therefore, the following
precautions should be taken both when handling the treated wood and in determining where to
use the treated wood.
USE SITE PRECAUTIONS
• Wood pressure - treated with waterborne arsenical preservatives may be used inside residences as long
as all sawdust and construction debris are cleaned up and disposed of after construction.
• Dc not use treated wood under circumstances where the'preservative may become a component of food
or animal feed. Examples of such sites would be structures or containers for storing silage or food or
beehives.
• Do not use treated wood for cutting boards or countertops.
• Only treated wood that is visibly clean and free from surface residue should be used for patios, decks,
and walkways.
• Treated wocd should rot be used where it may come into direct or indirect contact with public drinking
water, except for uses involving incidental contact such as docks and bridges.
HANDLING PRECAUTIONS
• Dispose of treated wood by ordinary trash collection or burial. Treated wood should not be burned
in open fires or in stoves or fireplaces because toxic chemicals may be produced as part of the smoke
and ashes. Large quantities of treated wood from commercial or industrial use (e.g., construction sites)
may be burned in commercial or industrial incinerators in accordance with State and Federal regulations.
• Avoid frequent or prolonged inhalation of sawdust from treated wood. When sawing and machining
treated wood, wear a dust mask. Whenever possible, these operations should be performed outdoors
to avoid indoor accumulations of airborne sawdust from treated wood.
• When power- sawing and machining, wear goggles to protect eyes from flying particles,
• After working with the wood and before eating, drinking and use of tobacco products, wash exposed
areas thoroughly.
• If preservative or sawdust accumulates on clothes, launder before reuse. Wash work clothes separately
from other household clothing.
IMPORTANT
• Do not burn treated wood.

birth defects or other reproductive harm.
All CCA Treated wood made at Suporior Wood Treating goes through a second process immediately after
pressure treating. This second step is a highly agitated hot -water bath that cleans the surface of the wood and
heats the wood to about 150 degrees Fahrenheit — enough to ensure FIXATION, the chemical reaction that
locks the CCA components to the wood fiber,
