Current language: 9.30.010 Garbage to be deposited in containers.
A11 garbage created, accumulated, or produced shall be deposited in water-tight
containers equipped with tight-fitting lids. Such container shall be one manufactured for
the purpose of storing or deposiring garbage coliection. A11 premises shall be maintained
by the owner or agent free of garbage, rubbish, refuse, debris and fiith accumulation. If
after ten (10) days notice from the City, the owner or agent of a premises fails to correct
any of the above conditions, the City may cause it to be done and have cost thereof
assessed as a lien against the property. (KC 9-2; Ord. 19?9-2001)
My recommended language: 9.10.010 Garbage to be deposited in containers. All
garbage created, accumulated, or produced shall be deposited in water-tight, ADF&G
approved bear-resistant containers. Such container shall be.......
Which seems to makes this more easily enforceable: 9.10.090 Nuisance.
The keeping of garbage in containers other Chan containers prescribed by this
chapter or the keeping upon premises of garbage or rubbish whieh is aliowed to become
affensive and noisome, shall constitute a violation, aud may also be abated in the manner
provided by Iaw for the abatement of niusances. (KC 9-9; Ord. 1929-2001)

CHAPTER 21.46. LOCAL OPTION ZONING DISTRICTS
21.46.010. Paarpose.
The purpose of this chapter is to establish a place in the Kenai Peninsufa Borough Code for
Iocal option zoning districts formed pursuant to KPB 21.44 and provides an organized and efficient way
to reference local option zoning districts.

29.46.020. Requirements.
All locai option zoning districts shall compiy with KPB 21.44.

21.46.030. t2ural Residential (RR} Districts.
A. The following Rural Residential (R-R) districts and officiai maps are hereby adopted:
1. Russian Gap Subdivision according to Plat 2001-4, Seward Recording District,
Cooper Landing, Third Judicial District, State of Alaska, containing 118.507 acres.
a. The local option zoning applies to any further replats of Russian Gap
Subdivision.
2. Birch and Grouse Ridge Subdivision according to Plat 2004-14, Seward Recording
District, Cooper Landing, Third Judiciai District, State of Alaska, containing 317.962
acres.
a. The local option zoning applies to any further replats of Birch and Grouse
y Ridge Subdivision.

No. 97-90 KRD) exciuding Hollingsworth Subdivision. Located within Section 18, T5N,
R9W, S.M., Kenai Recording District, Kenai Peninsula Borough Alaska. Containing
311.893 acres.

AN ORDINANCE ESTABLISHING KPI3 21.46 LOCAL OPTION ZONING llISTI2ICTS AND
APPROVING A SINGLE FAMILY RESIDENTIAL DISTRICT
WHER~AS, KPB 21.44 °Local Option 7_.oning" was adopted to implement goa15.5, Objecrive 1,
Action B of the Borough Comprehensive Plan; and
WHEREAS, due to the formation af new local option zoning districts, a chapter in the Borough Code of
Ordinances is necessary to catalog future zoning districts without creating a new chapter for every new
disLrict; and
WHEREAS, this chapter wili provide an organized and effieient way to locate the new local option
zoiling districts aald make them accessible to the pubiic and staff; and
WHEREAS, KPB 21.44.030(C) provides a mechanism far fornling a local option zoning dislrict at the
time of preliminary or final plat approval upon conctiirrence of the pro~erty owi2ers and reeommendation
of the planning commission; and
WHEREAS, the Ten Mar Ranch R-1 District has been proposed through this initiation procedure; and
V6~HEREAS, the assembly ~finds that the proposed local option zoning district is consistent with the
borough comprehensive ptan and would benefit the affected property owners and local community by
providing some restrictions on development in a proposed residential area;
NOW, THEREFORE, BE IT ORI9AINED BY THE ASSEMBLY OF THE KENAI P~NINSULA
BOROUGH:

The Kenai City Council will meet in a work session on October 3, 2007
for the purpose of discussing City of Kenai Bear Populations and
Related Topics. The work session will be held in the Kenai City
Council Chambers located at 210 Fidalgo Avenue, Kenai, beginning at
