A RESOLUTION OF THE COUNCILS OF THE CITY OF KENAI AND CITY OF
SOLDOTNA AND ASSEMBLY OF THE KENAI PENINSULA BOROUGH, RESPONDING
TO THE CLEAN WATER ACT SECTION 303(d) IMPAIRED STATUS DESIGNATION OF
THE KENAI RIVER.
WHEREAS, the Kenai River is a world-class sport, commercial and personal-use
resource supporting sustainable economic development and a spectacular natural
wonder; and,
WHEREAS, the Kenai River has been documented to exceed State of Alaska water
quality standards as defined by 18 AAC 70 for Total Aromatic Hydrocarbons (TAH
collectively known as Benzene, Toluene, Ethylbenzene and Xylene-BTEXj for a number
of years; and,
WHEREAS, multiple Kenai River specific studies have confirmed these exceedences
result from gasoline discharged through the use of outboard motors and to exceed
these stands, several hundred gallons of gasoline must enter the river during the
course of a single day; and,
WHEREAS, this would be the first waterbody on the Kenai Peninsula to be listed as
impaired under the Clean Water Act; and,
WHEREAS, the issue of fuel contamination in the Kenai River has been known by
State agencies as early as 1991, and no action has been taken; and,
WHEREAS, the Alaska Department of Environmental Conservation has suggested the
normal schedule for addressing the impairment would result in developing a plan for
the Kenai River in 201 l; and,
WHEREAS, the local governments recognize the importance of the Kenai River for the
local economy, tax revenue, and quality of life; and,
WHEREAS, multiple entities exist that could develop solutions for aclean-up plan and
limited solutions are within the jurisdiction of the local governments if they work
together, however because the local governments are connected by the River, the local
solutions require coordination and cooperation; and,
WHEREAS, it is in the best interest of the local governments to work together to fmd
solutions for improving water quality in the Kenai River in as expedient a manner as
possible.
NOW THEREFORE, BE IT RESOLVED, the City of Kenai, City of Soldotna, and the
Kenai Peninsula Borough will work together as recognized local governments to craft
solutions to remove and keep the Kenai River off the impaired water body list; and,

FURTHER, actions to craft solutions include, but are not limited to the following:
1. Provide written support and specific recommendations to State
regulatory bodies to take action.
2. Work together on regulatory actions within our jurisdictions.
3. Develop a joint resolution supporting a Board of Fish Proposal to address
the means and methods of powerboat fishing designed to curtail hydrocarbon
pollution due April 10, 2007.

A RESOLUTION OF THE COUNCILS OF THE CITY OF KENAI AND CITY OF
SOLDOTNA AND ASSEMBLY OF THE KENAI PENINSULA BOROUGH, SUPPORTING
BOARD OF FISH ACTIONS TO ADDRESS FUEL CONTAMINATION IN THE KENAI
RIVER.
WHEREAS, the City of Kenai, City of Soldotna, and Kenai Peninsula Borough Joint
Resolution No. 2007-01, responding to the Kenai River -Clean Water Section 303(d)
list (Impaired Status) identifies a mutual concern for all local governments along the
Kenai River; and,
WHEREAS, the local governments agreed to develop a Joint Resolution to the Board of
Fish requesting action be taken to curtail hydrocarbon pollution by regulating the
means and methods of powerboat fishing; and,
NOW THEREFORE BE IT RESOLVED, the City of Kenai, City of Soldotna and the
Kenai Peninsula Borough support the attached Board of Fish proposal with the
following significant actions to be taken as a whole:
Section l:
Effective January 1, 20_ gasoline operated powerboat fishing for Chinook Salmon will be
lirnited to either afour-stroke engine or atwo-stroke direct fuel injection engine type; and,
Section 2:
Effective January 1, 20_, gasoline operated powerboat personal use fishing will be limited
to either afour-stroke engine or a two-stroke direct fuel injection engine type UNLESS a
solution is found that allows other motor types to fish on anchor; and,
Section 3:
Completed Board of Fish proposal as attached.

LOCAL GOVERNMENT ACTIONS TO ADDRESS FUEL CONTAMINATION IN THE
KENAI RIVER.
WHEREAS, the City of Kenai, City of Soldotna and Kenai Peninsula Borough Joint
Resolution No. 2007-01 responding to the Kenai River -Clean Water Section 303(d)
list (Impaired Status) identifies a mutual concern for all local governments along the
Kenai River; and,
WHEREAS, the local governments supported a Joint Resolution to the Board of Fish
requesting action be taken to curtail hydrocarbon pollution by regulating the means
and methods of powerboat fishing; and,
WHEREAS, resolutions forwarded to the Board of Fish are not in the control of the
local government and it is in our best interest to take actions to address hydrocarbon
contamination that are within our local jurisdictions; and,
WHEREAS, the Kenai River flows through each of our jurisdictions and piecemeal
actions by one government may, in fact, make the issue of hydrocarbon pollution
worse for a neighboring jurisdiction, it is critical for all local governments to use
complimentary actions to most effectively reduce hydrocarbon pollution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF KENAI COUNCIL, CITY OF
SOLDOTNA COUNCIL, AND THE KENAI PENINSULA BOROUGH ASSEMBLY, the
following action items will be introduced as ordinances by the respective government
entities with jurisdiction as noted.
Section 1: Within the city limits of Kenai and Soldotna, the launching and operating
of powerboats during the month of July will be restricted to four-stroke or two-stroke
fuel direct-injected modeled motors; and,
Section 2: Within the 50 foot habitat protection area as described by Kenai
Peninsula Borough 21.18.040, or while on the river, transfer of fuel from one container
to another (except at the City of Kenai Commercial Zone) may not occur.

As a resident and proporty ownor in the City of Kenai, and having been one for almost twelve years,l've
got to ask if you have lost your baeter senses? Unless you have some kind of personal agenda, then why do
you wish to waste the councils time, alienate local supporters, and turn away city revonue, when all your
actions will do nothing to help the water quality in t}te Kenai River?
if atl the state resource agencies are working nn a wid® variary of causes, then why aze you continuing to
target ate small group of river users? Why do you feel you must take the lead in something you know very
little about, when there aze paid professionals, working daily on the whole problem.
As an elected official, who is supposed to represent all the citizens of Kenai, you are baring a deaf ear to
our wishes. Have you not seen the poll conducted by the Clarion, road she letters oppeatng the ban, and
1}stoned to the testimony at the council meetings, stating it alone would not help?
A lot ofyour tax paying citizens, like me, have small boats with 2-stroke motors. If we used them everyday,
instead of a few times a year, it would be a different matter If we had several extra thousand dollars lying
around we would ail buy new 4-svokes, but most of us don't. A lot of us are older retired people who
worked bard for what we have, and t don't think it is too much to ask, for you guys to not make it harder on
us than it already Is.
Now that 1 think about it ----- that really is not your boat launch anyway ------ it belongs to us citizens who
paid for it with our taxes, and it is maintahted by us users wish our launch fees.
So 1 respeotfully request that you stop yow personal attack on one smati group, look et the whole picture,
and start treating all the causes and everyone the same, regardless of what type of motor we have.

In keeping with the progress made last evening by your organizations I am forwarding you a copy of a
suggestion I have sent tc CNR. It may riot be the perfect solution and others should certainly be sought, but it
does demonstrate that there are ways to solve this problem without totally disenfranchising folks from the river
or sacrificing valued economic benefits garnered from these fishing activities. Please share with fellow council
members and officials that would benefit from this information.

Hello Chris,
I have been discussing possible solutions to this dilemma with Robert Ruffner of KWF. We both agree that
any solution should reduce hydrocarbons in July, provide 2-stroke owners with a reasonable length of time to
adjust to this situation and completely eliminate 2-strokes (except DFI) by 2010. Please see below suggestions
and share this information with anyone in your organization that would benefit from this information;
Four $troke.& DFI 2-Stoke Motors: These motors would remain at 35hp with one EPA approved detuning
methods. To allow an increase to 50hp during a time when a recovery plan from category 5 waters is in
progress would be counter productive and negligent on the part of DNR because this type of horsepower
increase will be accompanied by an unmeasured increase in hydrocarbons.
All Other 2-Stroke Motors: Allow use of these motors during the month of July on a limited basis for all
flowing waters from Skilak Lake to the mouth of the Kenai River. This will require a BOF action so that it is
applicable to both the Chinook fishery and the PU motorized dipnet fishery. I would suggest the following
proposal for integration into the regulation book, page 7 for all boats: "During July no one with a 2-stroke motor
(except DFI) may fish for Chinook salmon or participate in the personal use motorized dipnet fishery except;
Those boats with a current AK boat registration number who's last number is an odd number may fish only on
odd numbered days and those with last numbers that are even may only fish on even numbered days." This

would cut in half the number of remaining 2-stroke motors being used in these fisheries on any given day. At
the same time DNR would adopt this same regulation for2008 and 2009 to sunset with total elimination of2-
stroke motors in KRSMA waters commencing on Jan. 1, 2010. Thus the ADF&G regulation would still be in
effect below the Warren Ames bridge as a hydrocarbon reduction measure.
This type of thought process and forward thinking allows for progress in exploring solutions to this problem

RE: JOINT WORK SESSION
At its work session last evening, the Kenai City Council discussed its coning powers related to
the Kenai River as well as formulating a plan to limit types of outboard motors used on the
River.
Along with the City of Kenai, the City of Soldotna and Kenai Peninsula Borough are major
associates, users, and contributors to the health of the River. To that end, the Kenai City
Council would like to schedule a joint work session with the City of Soldotna Council and City
Manager, as well as Assembly Members Margaret Gilman and Gary Knopp and representatives
from the Kenai Watershed Forum, Kenai River Special Management Area Board, Department of
Natural Resources, Kenai Area Fishermen's Coalition, Depaztment of Environmental
Conservation and Kenai River Fishermen's Association.
The work session would be to discuss and develop a joint resolution endorsing the limitation of
types of outboard motors used on the Kenai River during certain periods of the year. A copy of
the resolution would then be forwarded to Governor Palin, Commissioners of the Department of
Natural Resources, Department of Environmental Conservation, and the Department of T'ish &
Game and its Board of Fisheries.
Because of the importance of the issue and work/travel schedules, we believe it imperative to
hold a first work session prior to March 1, 2007 at which time, general discussion of the
group's goal and review of a draft joint resolution would take place. At a second work session,
during the week of March 12, 2007, final review of the resolution and consideration of passage
would occur. Because the deadline for comments relating to regulation proposals is April 10,
2007, those participating in the discussions at last evening's work session strongly felt the
prompt attention to the issue is dictated.
Because of requfred public notice, a very prompt response is required. Please contact me as
soon as possible of what day next week will work for your group and tme. A location for the
meeting will be provided as soon as possible.

this Agreement with
(Renter) on this day of , 200_ for Renter's use of
the CLCA facility as specified below and subject to the following terms
and conditions:
1. Limited License
The CLCA grants to Renter the use of the Ted and Catherine Stevens
Center for Science and Technology Education solely on the Event
Date(s) and during the Event klours and to use the Center in
accordance with the Terms and Conditions attached to this
Agreement.
2. Fees and Deposits
Renter shall pay to the CLCA upon execution of this Agreement for
the use of the Facilitq, in accordance with the Application Form
attached to this Agreement, a Deposit of dollars and a
CLEANING DEPGSIT of $100A0. The CLCA shalt not reserve an
Event Date and Event time until Renter has rendered the full d®posit
which is $100.®0 or'/z of total ®vent costs, wrhich®ver is grisater ~
a $100.00 cleaning deposit: Reservation will not Ise considered
"Confirmed" and may be voided on said date.
3. Cancellations
Upan cancellation of a reserved Event Date and/or Event Time,
Renter wile be entitled to a refund of the deposit amount if Renter
provides notice of cancellation to the CLCA at least thirty (30) days
prior to the Event Date. CLCA shall refund tendered Deposit Fees to
the Renter within twenty-one (21) days of cancellation notice

of Alaska shall be named as an additional insured on said policy. Coverage
shall be in the amount of $50,000 for bodily injury, death or property damage
resulting from one occurrence.
7. Right of Entr19
CLCA, snd those persons authorized by It, shall have the right to enter the
Faclllty at all times for any purpose, as well as at any time in the event of
emergency involving possible injury to property or persons in or around the
Facility.
13. Revocation
This Agreement is freely revocable by CLCA and, upon written notice from
CLCA to Renter, may be terminated at any time in the CLCA's sole discretion.
9. Miscellaneous
a. Entire Agreement; Governing Law: This Agreement, together
with any attachmehts hereto, eontains the complete agr®ement of
the parties concerning the subject matter, and supersedes any prior
oral or written understandings, representations, or agreements
pertaining thereto which have not been incorporated herein. This
Agreement shall be construed and governed by the laws of the
State of Alaska, without regard to its conflicts of laws provisions.
b. No Amendment: No amendment or modiff~cation to this License
shall be binding upon CLCA unless same is in writing:
c. License Only: This Agreement shall be deemed to create only the
relationship of licensor-licensee between the parties and shall, in no
event, be deemed to create any other relationship, including without
limitation landlord-tenant, principal-agent, mast®r=servant,
employer-employee orpartner-joint-venturer.
d. No Assignment: This Agreement is for the sole benefit of the
Renter and the CLCA, and Renter may not assign or transfer its
obligations or rights under this Agreement. Any assignment or
transfer contrary to the provisions of this paragraph shall be null
and VOId.

9. Use of Facility
• Hours of operation are Monday -Friday, BAM-5PM.
Use of the facility outside of regular hours must be
scheduled in advance and approved.
• Renters shall not have access to areas not covered under
the contract agreement.
• Rental time includes your set-up and clean up, Rental of
the facility does not include pricy day access. Sear in
mind, additions/ costs may apply if mor® tfine is needed
before and after an event.
• tdo Smoking allowed in the building. Designated
smoking areas are outside the North and South exits and
are clearly marked. Cigarette receptacles are provided for
your use. Disposal of cigarette butts or trash on the grounds
of this facility is required before leaving.
• All decorations and the method used for application must be
approved. Nails or other hardware are prohibited for use on
the facility walls, tables or chairs. Candles are discouraged.
E'ecessive cleaning after event could put your cleaning
deposit in jeopardy.
• Damage to the facility will be the responsibility of the renter.
• Renter will comply with all Federal, State and Local laws.
• All passageways and fire exits will remain clear at ail times.
• A detailed facility cleaning list will be provided to the renter if
they have not entered intc a cleaning contract with the
Challenger Learning Center. Cleaning will be your
responsibility unless gther arrangements and payments
have been made in advance of your event. Cleaning
materials are provided. PBease not® that your cleaning
deposit will be refunded upon inspection approximately 21
days after your event.
• Alt rates are subject to change without notice.
2. Use of Kitchen
• Included in the kitchen r®ntal is use of the refrigerator,
freezer, ice maker, 4 burner stove with oven. The broiler
and deep fryer may be used with approval. When using
the stove and ovens the exhaust fan must be turned on_
• Sanitizer is also available. Directions for use are posted.
• Guidelines for kitchen usage are posted within the kitchen.
At the conclusion of event please refer to th® kitch®n
clean-up checklist requirements.

Kitchen Rental:
1. Remove anything that belongs to you from the
refrigerator and freezer.
2. Wipe out the inside of refrigerator and microwave if
you had any food spillage.
3. Wipe down ALL surfaces including the fronts of all
appliances with a hot soapy mixture. Make sure to
add a small amount of bleach to the water before
wiping any surface.
4. Wash and Sanitize dishes if applicable and wash out
the sinks.
5. Sweep the floats (Broom behind kitchen door)
6. Pull all garbage and throw into the dumpster outside.
R®om Rentals:
1. Clean ofF all tables and wipe them down with spray
from the kitchen. It will be marked "tables".
2. Sweep the floor.
3. Pull all garbage and #hrow into the dumpster outside.
