Administration -- Kebschull noted the draft implementation plan of the Comprehensive Plan had been sent to commissions and committees for their comment, the landscape site plan for the Denaina Health Clinic had been approved and the foundation permit would be issued, and City administration met with FEMA regarding the national flood insurance program. 10. Notes taken by: Planning Assistant Carver STAFF REPORT To: Planning & Zoning Commission Date: July 26, 2012 Res: PZ12 -24 GENERAL INFORMATION Applicant: Integrity Surveys 262 -5573 43335 K -Beach Road, Suite 10 Soldotna, AK 99669 Requested Action: Legal Description: Street Address: KPB Parcel No.: Existing Zoning: Current Land Use: Land Use Plan: Preliminary Subdivision Plat — Fresh Start Subdivision A subdivision of Government Lot 111 202 North Forest Drive 04312005 RS — Suburban Residential Gift Shop/Nursery Neighborhood Residential ANALYSIS This plat subdivides Government Lot 111 into three parcels and dedicates a 50 -foot right - of -way for North Forest Drive and a 33 -foot right -of -way for Second Avenue. The subdivision is located in the Suburban Residential zone. The minimum lot size in the Suburban Residential zone is 7,200 square feet. The three parcels range in size from 19,136 square feet to 36,155 square feet, exceeding the minimum lot size for the zone. Lots 1 and 3 will be accessed off North Forest Drive and Lot 2 will be accessed off Second Avenue. North Forest Drive is a paved street and Second Avenue is a gravel street. Both streets are maintained by the City. City water and sewer serve what will be the new Lot 1 and are available to serve the new Lot 2 and Lot 3. An installation agreement is not required. There are several structures located on the newly created Lot 1 including a gift shop located at the corner of North Forest Drive and Second Avenue, a cottage located off Second Avenue, a large greenhouse and unidentified building in the middle of the lot. The surveyor has provided dimensions to show distances from the lot lines for the gift shop and cottage. A 25 -foot front setback is required for these two buildings. The gift shop meets the setback requirements. The cottage is located in the required front setback. In 1991, a variance was approved for the cottage (PZ91 -12). PZ12-24 — Comment Page 2 Page 2 Building Official: No building code issues. RECOMMENDATIONS Fresh Start Subdivision subdivides Government Lot 111 into three lots and dedicates two right -of -ways. The subdivision meets all development standards for the Suburban Residential zone. City water and sewer serve the subdivision. Both streets are developed and maintained. Tract C of Northgate Subdivision No. 1 lies to the south of Tract 37. Tract C is a long, narrow strip of land 30 -feet wide containing approximately .4 acres. The plat for Tract C requires the tract be conveyed with Tract 37. This results in almost 2.5 acres for the development of the assisted living facility. The property is located in the Suburban Residential zone. Assisted living facilities are listed in the Land Use Table and require a Conditional Use Permit in all zones. The Suburban Residential zone is intended to provide for medium density residential development in areas which will be provided with common utility systems. The applicant proposes to build and operate an assisted living facility. The access to the property will be directly off North Forest Drive. The proposed development must meet commercial building and fire codes. A landscaping /site plan must be submitted and approved Site plans are required to provide for orderly and safe development. Landscaping will provide attractive and functional separation and screening between uses. The proposed development site is large enough to provide sufficient separation from adjoining developments, especially the residential subdivision. This property is located off North Forest Drive, a collector street which provides access to multiple neighborhoods. To the south of the development are Northgate Subdivision and the Church of the Latter Day Saints. The property to the north is undeveloped. Woodland Subdivision is located across North Forest Drive. Other institutional uses along Forest Drive include the Salvation Army, Star of the North Lutheran Church, Fireweed Herb Garden, and Courtyard Gardens (apartments and short -term rentals). The Suburban Residential zone provides for multi family dwellings up to a 6- plex as a permitted use. Multiple 6 plexes could be built on this property. The proposed development will not impair the value of the adjoining neighborhood • The proposed use is in harmony with the Comprehensive Plan. o Staff finds the proposed development meets this standard. The 2003 Comprehensive Plan defines the Neighborhood Residential district as consisting of single-family and multi family residential areas that are urban or suburban in character. Typically, public water and sewer services are in place or planned for installation. This land use district may include both single-family and multi family dwellings subject to reasonable density transitions and /or design compatibility. Formal public outdoor spaces (parks) are a critical feature in this district. Small home -based businesses may be accommodated within certain design guidelines. Neighborhood institutional uses such as churches, schools, and day care facilities may be intermixed if they comply with neighborhood design guidelines. • Public services and facilities are adequate to serve the proposed use. o Staff finds the proposed development meets this standard. City water and sewer are available to serve the development. North Forest Drive is a paved City street. • The proposed use will not be harmful to the public safety, health or welfare. o Staff finds the proposed development meets this standard. • Any and all specific conditions deemed necessary by the commission to fulfill the above - mentioned conditions should be met by the applicant. I apologize that I am out of town for my daughter's wedding and unable to attend the hearing. I would like to comment that I would rather see no development on the property. I moved here because of the rural feel of the area. That being said, I realize there is a need for assisted living facilities in the area. I would ask Mr. Hall to leave as much of the natural landscaping as possible around the facility rather than clearing the land and replanting with non - native fauna. Due to the size of this project, the preliminary submittal is being reviewed. A foundation permit has been issued. As required in KMC 14.25, a landscape /site plan has been submitted for the project. The Kenaitze Indian Tribe is building a 52,000 mixed -use facility which will include medical, dental, wellness activities, and behavioral health and substance abuse services. The facility will also provide a location for the Kenaitze to gather for social and cultural events including classrooms and a meditation /traditional healing area. The property is located in the Townsite Historic zone which restricts buildings with a footprint over 5,000 square feet and certain types of uses. In October 2012, a Variance Permit for the building size and a Conditional Use Permit for a medical clinic were approved for the development. Since the conception of the development, meetings have been held with the Tribe and their architect, Mr. Klauder, to ensure that the development met the City's building and zoning requirements. The collaboration is continuing with the Building Official and Fire Marshal as they review the building plans. PZ12 -21 Comments Page 2 A complete set of drawings for the landscape /site plan have been submitted and reviewed. KMC 14.25 specifies the regulations for landscape /site plans within the City of Kenai. Section 14.25.030 of that chapter details Landscaping /Site Plan submittal requirements. • Scientific or common name or type of planting materials to be used in the project. o Sheet L103 of Progress Set 1 provides a detailed list of planting materials that will be included in the landscaping for the development. The list includes trees, shrubs, perennial flowers, ferns, vegetative mat and grass seed. Also included is other landscaping materials including rocks, bounders, and driftwood. • Typical planting details. o Planting details are provided on Sheet L501 of Progress Set 1. • Location of all planting areas and relationship to buildings, parking areas and driveways. o Due to the size of the development, several pages include these details including Sheets L103, L104, L105, L106 and L107 (Progress Set 1 — Revised on 7/13/12.) An overall marking and sign plan is provided on Sheet C300 of Progress Set 2. • Identification and location of existing vegetation to be retained. o Due to the extensive site development, natural vegetation will not be retained. • Identification of on -site snow storage areas. o Snow storage is identified on the drawings. In addition, a snow storage easement has been provided for storage on the adjacent lot which is also owned by the Tribe. • Drainage patterns. o Drainage is shown on several drawings. The Tribe is investing in developing the site in hopes of receiving Leadership in Energy and Environmental Design (LEEDS Certification). As part of that goal, the intent is to recycle drainage water for use in the facility. The Public Works Director will verify that drainage provided with the development is contained on the site and does not affect other properties or the City's drainage in the rights -of way in the area. • Physical features of the property including location of all buildings, ingress and egress, any unusual features of the property, which may restrict development or drainage. o The site plan provides all required information. Section 14.25.040 of the code outlines the landscaping plan performance criteria. • Perimeter /Buffer Landscaping — involves the land areas adjacent to the lot lines within the property boundary and serves to separate and minimize the impact between adjacent uses. o The landscaping plan provides for extensive landscaping and meets code requirements with two exceptions. An exception has been requested along Overland Avenue wherein the plan provides a 9 -foot landscaping bed with a 5 -foot sidewalk. The exception is for the 9-foot landscaping bed. The alternative would be to limit the sidewalk to 4 feet wide. The exception appears reasonable and minimal and has PZ12 -21 Comments Page 3 been granted. Along the property line between the elder center and this development, landscaping has not been included. There is a sidewalk which abuts parking spaces. A snow storage area is located directly adjacent to this sidewalk. It does not appear necessary to provide landscaping in this area when this parcel is being included in the development. (Even though it is a separate parcel.) • Interior Landscaping — involves areas exclusive of the perimeter and parking lot areas. o The plans for this site provide extensive interior landscaping and the hope is to create a park -like setting. In addition to the landscaping, an amphitheater is included. Walking paths around and through the site will encourage pedestrian movement. • Parking Lot Landscaping — involves areas adjacent to or within parking Tots and access drives. o Parking lot landscaping is included in the plans. Landscaping will be used to separate parking spaces. • Street - right -of -way Landscaping — intent to soften the impact of land uses along rights -of -way but does not obscure land uses from sight. o Street right -of -way landscaping is included throughout the plan. The following are required in the site plan: • Parking — o The Dena'ina Wellness Center is 52,000 square feet and is considered a care center (medical /dental clinic) requiring one (1) parking space for every 250 square feet. Because the center is considered a mixed -use facility, the required parking is reduced by 25 %. Required parking for the facility is 156 spaces. o The site provides 139 spaces. (C300) o To meet the required parking, a cross - parking agreement has been executed with the adjoining lot, Lot 16A, Block 5, Townsite of Kenai Kenaitze Addition. This is the location of the Tyotkas Elder's Center. This center is 4,899 square feet and requires one parking space for every 500 square feet — 10 spaces. The elder center has 32 spaces available. (SK02) o With the parking agreement, the development has sufficient parking to meet the required parking. o The architects will be working with the building official to ensure that the required ADA parking is available. There is sufficient space /parking to meet the ADA requirements. • Parking Lot. o The parking must be paved. Because Lot 16A, Block 5, Townsite of Kenai Kenaitze Addition parking lot is needed for overflow parking and included in the site plan for this development, that parking lot must be paved. • Snow storage. o Locations for snow storage are shown on the site plan. An easement with Lot 16A, Block 5, Townsite of Kenai Kenaitze Addition provides additional storage space. If locations provided are not sufficient, the plan is to haul snow from the site. PZ12 -21 Comments Page 4 • Dumpster. o The dumpster location is shown on the site plan. The dumpster must be screened with a sight- obscuring structure made of wood or concrete. RECOMMENDATIONS The plan as submitted meets the intent of KMC 14.25. Plan is approved as submitted with the following requirements: 1. All required landscaping as presented in the approved landscaping plan must be installed within two (2) years of the approved landscaping plan. 2. One hundred percent (100 %) of ground cover of the landscaping beds must be planted and maintained so that there is no exposed soil within three years of the approved plan. 3. The parking lot must be paved within two (2) years of the Certificate of Occupancy. This includes the overflow parking provided for in the parking easement for Lot 16A, Block 5, Townsite of Kenai Kenaitze Addition. If developer finds that on -site parking is sufficient for the use, a modification may be requested as provided for in KMC 14.25.070. 4. Snow storage must be located on the lot and cannot be placed on required parking spaces or the snow must be removed from the site. Snow may be stored on the adjacent Lot 16A, Block 5, Townsite of Kenai Kenaitze Addition as provided for in the snow storage easement and shown on the site plan. No snow may be stored in such a manner that would block visibility for ingress and egress to the lot. 5. The structure for the dumpster must be constructed of wood or concrete. City administration may approve other materials prior to construction. 6. Kenaitze Indian Tribe — Dena'ina Wellness Center 508 Upland Street Tract A, Block 5, Townsite of Kenai Kenaitze Addition 04707130 WHEREAS, the City of Kenai Planning and Zoning Administration finds this plan provides for orderly and safe development within the City commensurate with protecting the health, safety, and welfare of its citizens, and provides adequate and convenient open spaces, light and air in order to avoid congestion of commercial and industrial areas; and, WHEREAS, the plan appears to provide for landscaping and/or the retention of natural vegetation in conjunction with commercial and industrial development within the City; and, WHEREAS, the purpose of landscaping is to visually enhance the City's appearance and reduce erosion and storm runoff, and the plan appears to meet this criteria. NOW, THEREFORE, BE IT RESOLVED, BY THE PLANNING AND ZONING ADMINISTRATION OF THE CITY OF KENAI THAT THE LANDSCAPING /SITE PLAN IS APPROVED WITH THE REQUIREMENTS SHOWN ON PAGE 2: Re iewe ' and approved: Date: July 30, 2012 PZ 1 2-2 1 — Resolution Page 2 1. All required landscaping as presented in the approved landscaping plan must be installed within two (2) years of the approved landscaping plan. 2. One hundred percent (100 %) of ground cover of the landscaping beds must be planted and maintained so that there is no exposed soil within three years of the approved plan. 3. The parking lot must be paved within two (2) years of the Certificate of Occupancy. This includes the overflow parking provided for in the parking easement for Lot 16A, Block 5, Townsite of Kenai Kenaitze Addition. If developer finds that on- site parking is sufficient for the use, a modification may be requested as provided for in KMC 14.25.070. 4. Snow storage must be located on the lot and cannot be placed on required parking spaces or the snow must be removed from the site. Snow may be stored on the adjacent Lot 16A, Block 5, Townsite of Kenai Kenaitze Addition as provided for in the snow storage easement and shown on the site plan. No snow may be stored in such a manner that would block visibility for ingress and egress to the lot. 5. The structure for the dumpster must be constructed of wood or concrete. City administration may approve other materials prior to construction. 6. If the City finds that clients of the Center are parking in the right -of -way, "No Parking" signs may be required in the rights -of -way around the development. 7. If the City finds that the signage provided on the plans do not provide sufficient direction to clients, additional signage on the site may be required. 8. The wind turbine identified on the site plan will require separate permitting including a zoning /building permit application as required in KMC 14.20.235. This will require an amendment to the landscape /site plan. 9. If construction of the project has not started within one year of the approval of the landscaping /site plan, the approval may be revoked by the Administrative Official after providing at least thirty (30) Day notice unless extended for good cause.
