Stearns, City Attorney DATE: August 13, 2012 ' RE: Resignation Date; Attorney Transition 1992 It has been some weeks since we last discussed a transition in the City Attorney's office and my future plans. In light of recent developments, including very good progress on the City's recruitment for a new City Attorney, 1 have decided that I need to leave the City earlier than October 1, Accordingly, consistent with my contract, this is to let you ]snow that I expect that my last day in the office will be September 5. 1 recognize that it is unlikely that the City would have a new attorney in place by September 5: yet, it is a workable situation that other communities have successfully addressed. I want to do all I can to help the City also be successful. Below I discuss two options that will help the City have continuity of legal services after September 5. The first option is for the City to continue my employment beyond September 5 and permit me to work from a distance, I am happy to continue to work beyond September 5, but because 1 have decided to drive out, I do not feel personally comfortable delaying my trip Outside beyond early September. 1 anticipate that an annangement with me working from afar would be fairly short, perhaps only a few weeks, I could also be available to return for an in- person transition when the n.ew:attorneyis ready to begin their work. 1 would work very similarly to how I work when I am away from the office, such as when I am on vacation, except that I would be in more frequent and studied communication. While I believe it is important for the City in the long-run to have an attorney physically present in the Kenai, municipal legal work lends itself to working at a distance because it involves drafting and reviewing documents, most frequently transmitted to me in electronic form. Much of my communication with department heads is by electronic mail or by telephone since they do not have offices in City Hall. And, because the City Attorney does not provide legal advice to individual citizens, my work requires little personal contact with members of the general public. Resignation; Attorney Transition August 13, 2012 Page 2 of 2 There are many matters that 1 could work on effectively at a distance. I can review and draft contracts, ordinances and regulations (the airport has a large ongoing regulation review project); conduct legal research; oversee outside litigation; and draft pleadings to file in court where litigation is handled in- house. Contracts can continue to be reviewed and approved to help assure that a matter does not get delayed because there is no attorney to approve a contract (City Code requires such approvals in many cases). As the election nears, I would be available for consultation with Ms. Modigh if any unexpected matters arise. Unexpected twists often arise in elections and the issues are nearly always time- sensitive. Another advantage to this arrangement is that I could continue to manage litigation, such as the Gus and Janice Rodes case. Trial in that case is scheduled for the first week in October. There is a pending motion for summary open discovery requests. I expect that there will be motions that the City will need to oppose or file. Today, for instance, the City received a late -filed request for discovery. I intend to file an opposition, but as trial looms, there will be more motions and court involvement required. It would be very difficult for the in- coming attorney to pick up the case at this late stage and conduct a trial in, October, even assuming they could begin work before October I. The second option is for the Council to hire a contract attorney to conduct the day -to -day business affairs of the Legal Department. While some work of this office can be put aside until the new attorney takes office, there are some matters that will need to be triaged and that cannot be done by a legal administrative assistant. The legal assistant cannot legally sign pleadings filed in court or provide legal advice, even on fairly routine matters such as a continuance of a traffic trial. Functions the Council could expect a temporary contract attorney to perform include: monitoring correspondence to determine if any matter requires a response before a new attorney takes over; filing timely motions for continuances and /or oppositions for ongoing litigation. including traffic court; overseeing the City's response to any new lawsuits; addressing personnel matters that might arise; and reviewing /approving /amending time- sensitive contracts. I expect that the hourly fee for any private attomey would be at least $175 per hour; although, in my experience, local attorneys routinely charge at least $200 per hour or more. The overall cost would depend upon what matters arose in the interim and the level of involvement the Council would request. I will be happy to help identify a local attorney who could do this work. If any of you have any questions for me, please let me i rrow. It has been held on the Tuesday before Thanksgiving at the Kenai Senior Center. While the plant /camp kitchen was in operation, the food was brought and served at our facility. After the Agrium closure, Marathon Oil took over sponsoring the event. As they do not have kitchen facilities, they now give our Center the funds to purchase the food and supplies needed for the event. It was sized to accommodate a. population of 11,650 people and an average wastewater flow of 1.3 million gallons per day (mgd). The present population of Kenai is approximately 8,000 and average wastewater flow is 0.90 mgd, or 70% of the plant design capacity. A Wastewater Facility Master Plan was completed in March 2004 by CH2MHi1I. The cost estimate for recommended improvements totaled S 5,198,000 (in 2004 dollars) and were identified as being accomplished in four phases. Estimated costs have been increased by 32% to account for construction inflation. The four phases identified by CH2MHill are not consistent with the proposed phasing as a result of funding constraints and improvements that have already been accomplished. The issues to be addressed by this project are as follows: 1, The City's WWTP APDES permit will he renewed in 2013. Presently the City's permit does not specify a limit for ammonia in the wastewater plant discharge. Our research has shown that recent permit renewals have required relatively low ammonia levels for the effluent (i.e. Palmer). The ammonia levels in the City's WWTP discharge may fail to meet what appears to be the standard required by ADEC. 2. The existing sludge belt press is 25 years old, and while not functionally obsolescent, it requires major maintenance /upgrades in the near future to maintain system reliability and compatibility with control systems. Two of the aeration basins exhibit a structural failure of the concrete wall which separates the basin. There is a breach between the two and as such the two basins must be operated as a single unit. 4. The existing rotary screen has been removed from operation, resulting in excess solids being introduced into the treatment process. The screen has been removed from the process because it often clogged resulting in raw waste flowing onto the floor in the headworks facility. 5. The present system does not provide an efficient method to control. aeration. Blowers provide three to four times the necessary oxygen to the aeration basins. 6. Existing course bubble diffusers are not efficient. 7. Existing system does not effectively manage sludge, The following is a description of improvements proposed under phase I of this project: Sludge Belt Press The installation of a second sludge belt press will provide system redundancy and allow for the existing sludge belt press to be taken out of service for an extended period (4 -6 months) while major maintenance upgrades can be accomplished. A new belt press and conveyer system will address the ADEC observation during the 2009 inspection that the transfer of solids to trucks resulted in solids falling onto the floor in the headworks facility. Solids Removal System The installation of a solids removal system to work in conjunction with the existing grinder will result in solid s removal meeting the EPA paint test and decrease demands on the treatment. plant/system. Activated Sludge System Improvements 1. Upgrade Fine Bubble Aeration Upgrade Aerobic Digester Blower System The blowers currently provide three to four times the necessary oxygen concentration to the aeration basins and there is no way to efficiently control this with the existing equipment. The installation of one small blower with a variable speed motor, the installation of variable speed motors on the existing blowers, the installation of a new control system; and replacing the coarse bubble diffusers with fine bubble diffusers will result in improved treatment and a significant drop in power consumption. City of Kenai ADEC SFY 2014 MMG Questionnaire WWTP Upgrades — Ph.I 10 Upgrade Waste Activated Sludge (WAS) System Upgrade Return Activated Sludge (RAS) System The activated sludge treatment process works best when a steady low flow of sludge is returned to the aeration basin (RAS). The pumps currently in use return too much sludge in too short a time to the aeration basin resulting in system failures, increased maintenance and increased energy consumption. The WAS pumps currently in service are a progressive cavity type that requires frequent service. Replacement with a simple centrifugal pump system would lower maintenance costs and improve treatment efficiency by allowing a steady flow of sludge to the aerobic digestion tank rather than large intermittent flows. The upgrades to the RAS & WAS Systems, and the upgrades to the aeration system will significantly improve the performance of the WWTP in terms of decreasing the costs of aeration, improving the settleability of the sludge, and minimizing /eliminating permit non- compliance incidents. WWTP Control Building Expansion ( +/- 1,000 s.f.) The addition of a second sludge belt press will require the re- location of the W Wl P laboratory. There is not sufficient space anywhere within the existing building to accommodate laboratory operations. The construction of a 1,000 s.f. addition to the WWTP Control Building will provide the room necessary for a fully functioning laboratory sufficient to support the operations of the WWTP. Courtney Stroh, ROC the Kenai -- Fish Waste and Trash on the Kenai Beach, Courtney Stroh addressed Council on behalf of ROC the Kenai, in opposition of the fish waste and trash on the Kenai beach during the dip net fishery season. Miss Stroh requested the City take action on a final solution prior to the 2013 dip net fishery to enforce proper fish waste and camping trash disposal. Additionally, Miss Stroh provided an overview of her and ROC the Kenai volunteer efforts in promoting and educating individuals on preserving the fishery and protecting the environment. The Mayor and Council Members each thanked Miss Stroh for her continued efforts in cleaning up the community's beaches and advised of the City's plan in making next year's season a cleaner fishery. ITEM C. Jim Butler, Kenai AK, spoke in opposition of waste left on the beaches of Kenai due to the dip netting fishery and requested the City enforce KMC Title 9 & 12 regarding littering. Mr. Butler further advised of responsibilities and regulations pertaining to the City acting as a 3rd party collector and disposing of waste. Buck Steiner, Kenai AK, spoke in opposition to individuals cleaning their fish on the beach and suggested taking them home to clean. ITEM D. PUBLIC HEARINGS D -1. Buck Steiner, resident of Vintage Pointe, advised of the volume of turnover within the facility and agreed it may be a good solution to apply the increase to new residents moving in and farther expressed disappointment in no other alternatives being presented by the City. Patricia Bravo, resident of Vintage Pointe, requested Council consider delaying the increase until January 1, 2013, providing residents time to receive social security cost of living increases as well as time to find alternate housing if necessary. Kelly Kelso, Kenai AK, reiterated the need for Council to vote the ordinance down and make this process more clear for the citizens. Noted the neighborhood does not want to be commercialized, Mayor Porter closed public comments. Council Member Molloy spoke in opposition of the ordinance and advised he would not be voting in favor of adoption. Molloy noted the ordinance was no longer valid as changes had been made and further recommended notice to property owners for all work sessions and meeting for public input. Mayor Porter advised she and City Manager Koch will be attending a meeting with representative from Alaska Department of Fish and Game to discuss the City's dip net fishery concerns. Police handled 1158 calls for service (up from 1101 in July 2011). The Communications Center received 360 emergency 9 -1 -1 calls (154 from cell phones). Communications personnel handled 4,347 administrative phone calls during the month of July. Officers made 73 arrests and wrote 252 reports. Traffic enforcement resulted in 181 warnings, 45 speeding tickets, 19 seatbelt tickets, 34 citations for equipment violations, and 55 citations for "other" traffic violations. There were 14 DUI arrests (2 felony). Police investigated 8 vehicle crashes. None of the crashes were DUI - related. From July 10 to July 31, officers, dispatchers and TEOs dedicated a significant amount of time to dipnet operations. Personnel worked busy shifts, and put in extra hours. I am very proud of the hard work and professionalism demonstrated by Police and Communications personnel. Our personnel demonstrate great pride and dedication toward ensuring the City has a positive and optimal operational response to the dipnet fishery. We are in the process of competing the Police draft of the annual dipnet report. Officers handled 142 dipnet - related calls for service (does not include the 169 cash pick -ups from pay shacks). The 142 calls for service is an increase from 121 in 2011, and 62 in 2010. We have the need for every employee to be able to drive every piece of apparatus in our department and these vehicles range from ambulances to Ladder trucks and additionally Airport . Rescue Firefighting vehicles. It takes many hours of driving all these different vehicles and learning how to operate them safely. A. driver's training program that was developed in -house has helped to train employees that may have never driven anything larger than a pick up, to be able to confidently operate very large, very complex vehicles in less than desired road conditions and at anytime of the day. We are proud that we have kept our vehicles in good operating condition. We have been working closely with the Water Department and have curtailed any hydrant testing during these summer months. All of the pumper training has been done the "old fashion" way by drafting water from the float plane basin. This has actually enhanced some of the training by having to rely on alternate water sources for training. The subsistence dip net fishery brought plenty of people to town and the Fire Department saw just a slight increase for run volume. Fortunately through the combined efforts of all City departments, and possibly due to the awareness levels of the patrons of the fishery, we had no serious calls this year. Historically there has always been one tragic incident that has marred the dip net fishery but this year was relatively calm. We are staying involved with Kenai Peninsula. Volunteers provided 780 service hours. Director completed year end grant reports to the State and to the Borough. Administrative assistant saw 10 seniors with senior issues relating to coeds, senior benefits, rental inquiry, etc. July is fundraising month. The seniors sold 56 pies and sold hotdogs at their 4`h of July booth, Even though the day was rainy, we had a very successful booth; sold 350 hot dogs as well as sold out of pies. The seniors had a float in the parade as well as the line dancers danced on the parade route. Our senior center participated in a Seward Senior Center potluck picnic. All the area wide senior centers were invited. We were the only senior center besides Seward who hosted it, that participated. 19 Kenai, seniors attended the picnic. It was a beautiful fun day in Seward. We are fortunate to have Joni Gray and Pat Robinson as volunteers at our center. They provide a special service - "Pet Therapy." They visit once a week, sitting in the fireplace area of the senior center, and seniors enjoy visiting with the dogs and their masters. Both women and their dogs have participated in a "certified dog therapy" training, specific for frail elders, people who are disabled and or ill. Besides visiting our senior center both women take their dogs to visit Heritage Place and the hospital. You are all invited to the "Old Timer's Luncheon, on Thursday, August 16 at noon. Come enjoy the wonderful dinner, as well as visiting with seniors on the Peninsula. Phase 2 is expected to be ready for review in the fall. Tree Obstruction Clearing Project: The bids for this project were all rejected at the August 1, 2012 City Council meeting. Several days were spent finalizing preparation for the dip net fishery, including securing necessary materials & supplies, assigning work schedules, installing signage and meeting with staff from other departments. Maintenance activities such as mowing /trimming, watering flowers, flowerbed maintenance, restroom cleaning, trash hauling, inspections etcetera continued despite exhausted resources. A strong run of sockeye coupled with extremely high participation in this year's fishery kept all staff busy. Most challenges and demands throughout the fishery were met, including raking beach areas, cleaning restrooms, litter control and responding to occasional calls concerning dumping of fish waste. The trail crew continued their work throughout July with minimal interruptions. The section from Airport Way to Granite Point was completed along with the section from Granite Point to the existing Bernie Huss Trail. The trail section behind the Main Street Tap & Grill is currently being constructed. B &B Landscape initiated the construction of raised flower beds in LH Memorial Park and should be completed August 10'". Concrete sidewalks were installed at Blue Star Memorial and our staff will complete the required landscaping, namely seeding and constructing a new flower bed around the sign. New bollards were installed at Cunningham Park around the restroom in an effort to protect the unit from vehicular traffic. Additionally, the trees planted along the boardwalk were pruned in an effort to provide visibility to the river. Pruning activities continued throughout town, including Public Safety, Bluff Overlook, Blue Star Memorial, and Library. Improvements to the Little League Field #3 were initiated in late July. The gardening crew installed a tree at the Bluff Over area near the gazebo and provided new landscaping as well. A couple damaged bollards were also replaced.
