CALL TO ORDER: Chair Twait called the meeting to order at approximately 7:00 p.m. 1 -a. Pledge of Allegiance Chair Twait led those assembled in the Pledge of Allegiance. 1 -b. City Planner Kebschull reviewed the staff report included in the packet, recommending approval with no contingencies. Twait opened the meeting to public hearing. There being no one wishing to speak, the public hearing was closed. There were no commissioner comments. VOTE: MOTION PASSED UNANIMOUSLY. 4 -b. PZ12 -32 - Preliminary Plat - Lot 3C, Youngblood - Warren Subdivision McKeirnon Addition. Plat submitted by Terry Eastham, 33986 Community College Drive, Soldotna, Alaska. MOTION: Commissioner Bryson MOVED to approve PZ12 -32, including staff recommendations and Commissioner Smith SECONDED the motion. Kebschull reviewed the staff report included in the packet, recommending approval with the following requirements: • If the easements are not vacated, easements must be shown on the final plat. • Correct street name Fourth Avenue instead of 4th Avenue. PLANNING AND ZONING COMMISSION MEETING SEPTEMBER 26, 2012 PAGE 2 Remove Hayes Way from the plat. • Correct the subdivision name to the east to show Lot 1B, Seaman Subdivision 2008 Replat. • List name of property owner. Twait opened the meeting to public hearing. There being no one wishing to speak, the public hearing was closed. Smith requested verification a driveway over an easement was allowed. Kebschull responded yes. VOTE: MOTION PASSED UNANIMOUSLY. 5. PUBLIC HEARINGS 5 -a. PZ12 -30 - An application for a Conditional Use Permit for a professional office for the property known as Lot 13, Block 2, VIP Ranch Estates Subdivision Part 7 (820 Set Net Drive), Kenai, Alaska. Application submitted by Scott & Heather Huff, Integrity Surveys, Inc., 820 Set Net Drive, Kenai, Alaska. MOTION: Commissioner Smith MOVED to approve PZ12 -30, including staff comments and Commissioner Peterson SECONDED the motion. Kebschull reviewed the staff report included in the packet, noting the following criteria must be met: • The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district. • The value of the adjoining property and neighborhood will not be significantly impaired. • The proposed use is in harmony with the Comprehensive Plan. • Public services and facilities are adequate to serve the proposed use. • The proposed use will not be harmful to the public safety, health or welfare. • Any and all specific conditions deemed necessary by the Commission to fulfill the above - mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Kebschull recommended approval with the following requirements: • The permit is limited to the operation of Integrity Surveys, Inc. as described in the application and letter dated August 24, 2012. • The permit is not transferable to another owner /business without review PLANNING AND ZONING COMMISSION MEETING SEPTEMBER 26, 2012 PAGE 3 and approval of the Planning and Zoning Commission. Twait opened the meeting to public hearing. Scott Huff, Applicant - reviewed the application and offered to answer questions. There being no one else wishing to speak, the public hearing was closed. Knackstedt noted he agreed with the staff recommendations. VOTE: MOTION PASSED UNANIMOUSLY. Twait read the 15 day appeal process procedure. 6. UNFINISHED BUSINESS -- None. 7. NEW BUSINESS 7 -a. Discussion /Recommendation -- Lease Renewal- Lot 7A -1, Block 2, FBO Subdivision No. 5 (470 North Willow Street), Federal Aviation Administration, Automated Flight Service Station. Kebschull reviewed her memorandum included in the packet. Bryson asked if the FAA was in agreement. Kebschull reported the lease request came from them. Peterson asked if expenses were usually included in a lease. Kebschull reported each lease was different and required different things. Knackstedt reported he agreed with the City Manager's decision to change the lease, and noted there might be discrepancies that needed clarification. MOTION: Commissioner Knackstedt MOVED to support the lease renewal with consideration of items listed above and Commissioner Peterson SECONDED the motion. VOTE: MOTION PASSED UNANIMOUSLY. 8. Borough Planning - Commissioner Bryson reported on the September 24 Borough Planning Commission meeting. 9 -C. Administration - City Planner Kebschull reminded the commissioners of the October 5 Open House for the Comprehensive Plan and noted she had information for them regarding the November conference. 10. It is the intent of this chapter to permit home occupations which are compatible with other permitted uses and with the residential character of a neighborhood, and which are clearly secondary or incidental to the residential use of the main building. In general, a home occupation is an accessory use so located and conducted that the average neighbor, under normal circumstances would not be aware of its existence other than for a sign as permitted in this chapter. Home occupations are permitted accessory uses only so long as all the development requirements listed in this section are observed. (b) Uses Permitted. Subject to the development requirements of this section, home occupations include, but are not limited to, the following uses: (1) Art studio. (2) Day care of no more than eight (8) children under the age twelve (12), including children related to the caregiver. (3) Dressmaking. (4) Millinery. (5) Beauty parlor. PZ12 -35 Comments Page 2 (6) Tutoring and musical instruction. (c) Uses Prohibited. (1) Commercial auto and boat repair. (2) Commercial kennels or similar uses. (3) Convalescent homes for the care of more than two (2) patients. (4) Mortuaries. (5) Private schools with organized classes. (6) Real estate office. (7) Restaurants. (d) Development Requirements. (1) Not more than one (1) person outside the family shall be employed in the home occupation. (2) No more than thirty percent (30 %) of the gross floor area of all buildings on the lot shall be used for the home occupation. (3) The home occupation shall be carried on wholly within the principal building, or other buildings which are accessory thereto. Any building used for a home occupation shall be wholly enclosed. The applicant would like to operate a children's art/study /play group, twice a week for no more than 5 children, from her home. The applicant describes she will instruct educational arts and crafts during the proposed 2 hour time frame. Ms. Marquis explains the property has two driveways off Linwood Lane to accommodate the drop -off and pick- up of the children. The code provides for up to thirty (30) percent of the residence to be used for the home occupation. The applicant intends to use only the living room, and has included a floor plan of the home. The children will be seen during a specific time of day, 2 times a week, for approximately 2 hours. Due to the limited amount of time for the activity there should be no adverse affect on the neighbors in the area. There will be no employees. There is no plan to advertise the business by signage. The applicant has a business license and is registered with the Kenai Peninsula Borough to collect sales tax. RECOMMENDATIONS Kenai Municipal Code 14.20.230 specifically provides for home -based businesses that can be conducted so that the average neighbor would not know they exist. Guidelines within the code restrict the square footage of the home that can be used for the business and limit the number of employees. The proposed business meets the requirements of KMC 14.20.230. The 2003 Comprehensive Plan classifies the area as Neighborhood Residential. The Plan states, "Small home -based businesses may be accommodated within certain design guidelines." Fire Code Inspection Day care facilities shall be inspected by the Fire marshal for compliance with the fire code (KMC 8.05) prior to approval of the permit. Thereafter, they shall be inspected every other year by the Fire marshal. Failure to comply with the fire code (KMC 8.05) shall be grounds for the suspension or revocation of the facilities' home occupation permit. Forest Drive KPB Parcel No.: 04321015 Existing Zoning: RS — Suburban Residential Current Land Use: Vacant Land Use Plan: Neighborhood Residential ANALYSIS General Information: The City of Kenai has received a building permit application for the Charis Place Assisted Living Facility. As required in KMC 14.25, a landscape /site plan has been submitted for the project. The applicant is in the process of replatting Tract 37 of Killen Estates and Tract C of Northgate Subdivision to combine the parcels into one tract. Tract 37 is approximately 2 acres and located off North Forest Drive. Tract C of Northgate Subdivision No. 1 lies to the south of Tract 37. Tract C is a long, narrow strip of land 30 -feet wide containing approximately .4 acres. This results in almost 2.5 acres for the development of the assisted living facility. The Commission approved a Conditional Use Permit for the facility on August 8, 2012. KMC 14.25 specifies the regulations for landscape /site plans within the City of Kenai. Section 14.25.030 of that chapter details Landscaping/Site Plan submittal requirements. Scientific or common name or type of planting materials to be used in the project. o Plans show grass areas will be a mixture of CadRe Mix, Rye -Blue & Fescue. Green Spruce and existing Birch will be used as barriers. Typical planting details. o Planting details are not included in the plan. However, the plan identifies locations of landscaping and types of materials that will be PZ12 -34 Comments used on the site. Page 2 • Location of all planting areas and relationship to buildings, parking areas and driveways. • Plan shows location of natural vegetation that is being retained. The area between existing developments to the north and south will be landscaped using trees and grass to provide separation. • Identification and location of existing vegetation to be retained. o Natural vegetation is retained on the back part of the parcel and along Forest Drive. • Identification of on -site snow storage areas. o Snow storage areas are identified. • Drainage patterns. o Drainage patterns are shown on the plan. Elevations are not included. The plan includes a storm water collector. It is assumed the plan is to connect to the City's storm water drainage system. Final approval for connection must be obtained from the City's Public Works Director. • Physical features of the property including location of all buildings, ingress and egress, any unusual features of the property, which may restrict development or drainage. o The site plan provides all required information. Section 14.25.040 of the code outlines the landscaping plan performance criteria. • Perimeter/Buffer Landscaping — involves the land areas adjacent to the lot lines within the property boundary and serves to separate and minimize the impact between adjacent uses. • The plan provides natural vegetation along Forest Drive and the back of the property. Landscaped areas are shown along the property line adjacent to the Church to the south and adjacent to the property line to the north. • Interior Landscaping — involves areas exclusive of the perimeter and parking lot areas. o The plan includes grassed areas, raised landscaping beds, and hanging potted plants. • Parking Lot Landscaping — involves areas adjacent to or within parking lots and access drives. o Areas around the driveway are landscaped with grass. The parking lot is limited to parking in front of the building and the layout is not conducive to landscaping within the lot. • Street- right -of -way Landscaping — intent to soften the impact of land uses along rights -of -way but does not obscure land uses from sight. o Street right -of -way landscaping is provided by natural vegetation along Forest Drive. The following are required in the site plan: Parking — PZ12 -34 Comments Page 3 • The Charis Place is a 14,164 square feet Assisted Living Facility with 21 rooms. Parking requirements for an Assisted Living Facility is one (1) space for every two (2) beds. Based on this requirement a minimum of I 1 parking spaces is required. The plan shows 14 parking spaces. • The architects will be working with the building official to ensure that the required ADA parking is available. There is sufficient space /parking to meet the ADA requirements. • Parking Lot. o The parking must be paved. • Snow storage. o Identified on the plan and appears sufficient for the site. • Dumpster. o No dumpster is shown on plans RECOMMENDATIONS The plan as submitted meets the intent of KMC 14.25. Plan is approved as submitted with the following requirements: 1. All required landscaping as presented in the approved landscaping plan must be installed within two (2) years of the approved landscaping plan. 2. One hundred percent (100 %) of ground cover of the landscaping beds must be planted and maintained so that there is no exposed soil within three years of the approved plan. 3. The parking lot must be paved within two (2) years of the Certificate of Occupancy. 4. Snow storage must be located on the lot and cannot be placed on required parking spaces or the snow must be removed from the site. No snow may be stored in such a manner that would block visibility for ingress and egress to the lot. 5. No dumpster is shown on the site plan. If a dumpster is placed on the site, the location must be approved prior to placement and dumpster screening must be constructed of wood or concrete. City administration may approve other materials prior to construction. 6. Approval from the City of Kenai's Public Works Manager must be received prior to connecting to the City's storm drain system. 7. If construction of the project has not started within one year of the approval of the landscaping /site plan, the approval may be revoked by the Administrative Official after providing at least thirty (30) Day notice unless extended for good cause.
