Alaska Public Entity Insurance (APEI) offers an annual grant of up to $1,000 to be applied to safety training or safety equipment. This year, Administration identified a need for a City- wide training for Department Heads and supervisors specific to the City's responsibilities under the Family Medical Leave Act (FMLA) and the Americans with Disabilities (ADA) Act and identified National Seminars Group as a University-based training program that provides on-site training that will be customized to meet the City's needs. The total cost of the compliance training exceeds the $1,000 APE grant; however, the remaining cost of $4,200 is included in the EY13 Budget. 6 ,oJ CITY OF KENAI IS Al ALASKA RESOLUTION NO. 2 012 -61 Suggested by: Administratio A RESOLUTION OF THE COUNCIL OF THE CITY OF KENAI, ALASKA ADOPTING AN ALTERNATIVE ALLOCATION METHOD FOR THE FY13 SHARED FISHERIES BUSINESS TAX PROGRAM AND CERTIFYING THAT THIS ALLOCATION METHOD FAIRLY REPRESENTS THE DISTRIBUTION OF SIGNIFICANT EFFECTS OF FISHERIES BUSINESS ACTIVITY IN FMA 14: COOK INLET FISHERIES MANAGEMENT AREA. WHEREAS, AS 29.60.450 requires that for a municipality to participate in the FYI3 Shared Fisheries Business Tax Program, the municipality must demonstrate to the Department of Community and Economic Development that the municipality suffered significant effects during calendar year 2011 from fisheries business activities; and WHEREAS, 3 AAC 134.060 provides for the allocation of available program funding to eligible municipalities located within fisheries management areas specified by the Department of Commerce, Community and Economic Development; and WHEREAS, 3 AAC 134.070 provides for the use, at the discretion of the Department of Community and Economic Development, of alternative allocation methods which may be used within fisheries management areas if all eligible municipalities within the area agree to use the method, and the method incorporates some measure of the relative significant effect of fisheries business activity on the respective municipalities in the area; and WHEREAS, the City Council of the City of Kenai proposes to use an alternative allocation method for allocation of FY 13 funding available within FMA 14: Cook Inlet Fisheries Management Area in agreement with all other municipalities in this area participating in the FY13 Shared Fisheries Business Tax Program. Fisheries Business Tax. The City receives revenue from the State of Alaska for fish tax collected by the State in two different methods. The Department of Revenue (DOR) distributes "Raw Fish Tax ", fisheries business taxes, fishery resource landing taxes, sahnon marketing tax, and other seafood taxes from Licensed seafood processors, floating processors, and seafood exporters, to eligible municipalities as prescribed in AS 43.77.060. The City's FY2012 share was $276,547and was based upon 2010 collections by the DOR. The second method the City receives fish tax revenue is through the Alaska Department of Commerce Community and Economic Development (ADCCEO). ADCCED receives 50% of the undistributed Raw Fish Tax from the DOR to distribute through a program know as the Shared Fisheries Business Tax Program. For the Cook Inlet Fisheries 'Management Area, which the City is a part of the amount distributed in FY12 was $83,537. Eight communities received a portion of that amount with the City of Kenai receiving $6,257. There are two methods of allocation for the Shared Fisheries Business Tax. The first method involves a lengthy application process in which the applicants must show the impact to their local community of the fishing industry. Once impact is shown. half of the total amount to be distributed (541,768 for FY2012) s divided equally amongst the communities and the remaining half is distributed based upon the impact shown in their application. The second method permits all communities in Fisheries Management Area to elect an alternate method of allocation. This alternate method eliminates the lengthy community application process, Since inception of the Share Fisheries Business Tax Program in fiscal year 1992, the communities of the Cook inlet Fisheries Management Area have selected the alternate allocation method. A resolution like 2012 -61 has been adopted every year since fiscal year 1992 and is a required step to elect the alternate allocation method. The alternate method elected by the Cook Inlet Fisheries Management Area for FY13 will again include and equal distribution of one -half the total and the rernaining half is distributed based upon population of the community. The contract consists of the following two areas of work: James Street improvements in the amount of 5141,817 Paving of the parking lot at the end of Spurview Drive, the scenic overlook near Vintage Pointe, in the amount of $25,652. The low bid for construction exceeds the estimated costs (Exhibit A) for the project. In the year since the cost estimate was accomplished, prices for asphalt and other construction matterials have increased 10 % -2.0 %. I underestimated the number of culverts that would be required, and there is a natural gas utility relocation that was not known at the time the estimate was performed. The project estimate for construction and engineering was $106,894.48. The actual construction bid and engineering contract total $1.55,227, an increase of $48,33552, or 45 °/L The estimated assessments which were provided to the property owners (Exhibit B) were based on the project estimate. Administration recommends that The City increase its share of the 00 by the amount over the estimates which were provided to the property owners. Based on the estimate, the City and the property owners share would each have been $53,447.24. Based on the construction bid and the engineering contract, and the Administrations recommendation, the City share is estimated to be $87,613.50 (including a 510,000 contingency), arid the property owners share would remain $53,447.24. Proposed Segment 2 of the Shqui Tsatnu Creek Trail would generally follow this existing public trail, Part of that public trail may be on City property and part may be on private property; the public trail may meander around the boundary lines that separate the west side of the City's properfies from the east side of the private properties, In the sucnnne, of 2012, private property KPB Parcel 84304018 was dna/ed, and debris was piled in a way that blocked the public trail throuah that lot and/or through the adjacent City lot (KPB Parcel 04084011). Soms other dsadfall also booked the traP, most ikey on City property and perhaps extending on private property KPB Parcel 04304029 As a result, people started pushing new trails down the steep ravine on the City's property (KPB Parcel 04034011) and also through the middle of private property KPB Parcel 04304010 and elsewhere on private property KPB Parcel 043U4829. The support of Council is respectfully requested to direct Administration to obtain an as-built survey that will iocate the boundary lines that separate the City's properties and the private properties and vvill locate the existing trailt's) in relationship to the parcels and the boundary lines on what is proposed to be Segment 2. The boundary lines are the west property boundary lines of the City's \vvoparcels (KPB Parcels 843O4A11 and 043Q4OU4).which are also the east property boundary lines of four private properties (KPB Parcels 040304010. 04304329. 04804030` and 043004]1). Alaska Statute 8.76.460, Municipal Regulation, specifically limits municipal regulation of pawnbrokers and voids ordinances that conflict with its limitations. Specifically, KMC Chapter 5.40 impermissibly conflicts with the hours of operation allowed under state law and likely the process for police interaction with pawnbrokers. it is the recommendation of Kenai City Police Chief, Gus Saudahl, that KM.0 Chapter 5.40 he repealed. Other options include rewriting the offending parts of KMC Chapter 5.40 and readopting the code provisions, or adopting parts of the state statutes as the City's own. Since state law now provides for uniform licensing and regulation of pawnbrokers throughout the state, 1 recommend repealing KMC Chapter 5.40 as well, unless there is good reason for the City to regulate pawnbrokers locally. 1 spoke with Nathan Vanier of the State Division of Corporations, Business and Licensing and he informed one that he believed that the City of Kenai and the Municipality of Anchorage were the only two municipalities with ordinances regulating pawnbrokers still on the books. The City of Fairbanks repealed its regulations of pawnbrokers effective July 1, 2011. It is my understanding that there currently are no pawnbrokers within Kenai City Limits. The project will focus on the area near the recently completed bird viewing platform near the City ofKenai's boat launch area and provide better pedestrian access to the river while also enhancing bird viewing opportunities. Background In the spring of 2003 a National Science Ocean Bowl team from Skyview High School proposed an economic development plan for the Kenai River estuarine areas. This plan focused on maintaining the estuary and adjacent wetlands in a natural state with infrasteacmre to promote bird and wildlife viewing. Tourist facilities would be created along the waterfront to promote riverside use in the City of Kenai. Concurrent with this effort a group of ;coal citizens were promoting a Kenai. 3'c Wildlife Viewing 'Frail. :il.
