General Information:
Applicant is proposing to open a full- service restaurant in the building known as "Fort
Kenay." The property is located in the Townsite Historic District (TSH). Restaurants
require a Conditional Use Permit in the TSH zone. This property is owned by the
Diocese of Sitka & Alaska Orthodox Church in America. The Church's representative
has provided written permission for the applicant to file the application. The applicant
will be leasing the property from the Church.
KMC 14.20.150 details the intent and application process for conditional uses. The code
also specifies the review criteria that must be satisfied prior to issuing the permit. The
criteria are:
• The use is consistent with the purpose of this chapter and the purposes and intent
of the zoning district.
Administration finds this standard is met.
The property is located in the TSH zone. "The TSH Zoning District is intended to
provide for a mixed, controlled use in a designated area, which will protect and

enhance the historic character of the zone. The goal of the TSH zone is to
manage all new development, reconstruction and alternations within the zone. "
Under KMC 14.20.105(c) (1), "Encourage, whenever possible and compatible
with historic character of the TSH zone, foot traffic, restaurants, gift shops, parks,
etc..... "
The proposed restaurant will be located in "Fort Kenay. " Fort Kenay was built
in 1967 for Alaska's Centennial celebration. Over the years, the building has
been used for various things including a community center and senior center. The
building houses a fully constructed Alaska Department of Environmental
Conservation (ADEC) approved kitchen.
The proposed restaurant meets the intent of the zoning district.
• The value of the adjoining property and neighborhood will not be significantly
impaired.
Administration finds this standard is met.
"Fort Kenay" is located adjacent to the Church's parsonage and across Mission
Avenue from the Church. Across Overland Avenue, there is a commercial
building that has housed a variety of businesses since it was constructed.
The proposed restaurant will not impair the value of adjoining properties.
• The proposed use is in harmony with the Comprehensive Plan.
Administration finds this standard is met.
The 2003 Comprehensive Plan classifies the area as Mixed Use /Townsite Historic
District. The Mixed Use District is defined as, "The Mixed Use district fosters a
compatible mix of retail, service, office, public, institutional recreational and
multi family residential uses. The district does not prescribe specific proportions
for these uses, only that all these uses are desirable within the district. Mixed
uses are particularly desirable in the Townsite Historic District and City Center
overlay zone. "
The proposed restaurant is in harmony with the Comprehensive Plan.
• Public services and facilities are adequate to serve the proposed use.
Administration finds this standard is met.
This property is located on paved, City streets. The streets are maintained by the
City. The property is served with City water and sewer.

• The proposed use will not be harmful to the public safety, health or welfare.
Administration finds this standard is met.
Operation of the proposed restaurant will not be harmful to the public safety,
health of welfare of the adjoining properties.
• Any and all specific conditions deemed necessary by the commission to fulfill the
above - mentioned conditions should be met by the applicant. These may include,
but are not limited to measures relative to access, screening, site development,
building design, operation of the use and other similar aspects related to the
proposed use.
Administration is proposing no additional conditions for the operation of the
proposed restaurant.
RECOMMENDATIONS
The applicant is proposing to operate a restaurant from "Fort Kenay." Fort Kenay is
located in the Townsite Historic zone, a mixed use zone. The zone encourages this type
of development. Fort Kenay is owned by the Russian Orthodox Church. The Church will
be leasing the property to the applicant and has provided written approval for the
applicant to apply for the Conditional Use Permit. The building houses an ADEC
approved kitchen. There is sufficient parking at the site for the proposed use.
Based on the application and a review of the criteria required to approve the permit, it
appears the application meets the intent of the zone and complies with the
Comprehensive Plan. Recommend approval.

Townsite Historic District — Mixed Use
Kenai Municipal Code 14.20.105 (h) requires the Planning and Zoning
Commission review all building permit applications for properties included in the
Historic Preservation Plan. During the 1995 "Kenai Townsite Historic Survey
Report" this property was identified as meeting the criteria for designation and
was issued Alaska Heritage Resource (AHRS) #KEN -048. The Alaska Heritage
Resources Survey (AHRS) is an inventory of all reported historic and prehistoric
sites within the State of Alaska and is maintained by the Office of History and
Archaeology. This inventory of cultural resources includes objects, structures,
buildings, sites, districts, and travel ways, with a general provision that they are
over 50 years old. Information from the Survey regarding this structure is
attached.
The applicant is proposing to open a restaurant in Fort Kenay. The building
already has a State of Alaska, Department of Environmental Conservation
(ADEC) approved kitchen. The applicant plans to include a coffee bar in the
restaurant. Construction of that coffee bar will require a building permit for
plumbing and electrical.

The construction of the coffee bar will not jeopardize the historical integrity of this

Legal Description: That portion of USS 192 leased to the City of
Kenai per lease 25
Date of Construction: 1967 Condition: Good
Description: "Fort Kenay" is a tall, two -story rectangle measuring
31'61, by 601. It is constructed of round machined logs with saddle -
notched ends. An open gable entry is located on the facade (south
elevation). Stairs leading to a second story entrance are attached to
the west end wall. Casement windows are found throughout the
building. Two large frame additions extend to the east. The log
portion of the building sits on a concrete perimeter beam foundation
with a crawl space.
History and Physical Changes: Built in 1967 by local contractors for
Alaska's Centennial celebration, this property is a representation of
the original Fort Kenay (1869). It cannot be considered a
reconstruction since it is built of machined logs and has casement '
windows. Two frame additions were added circa 1980. The building
operated as an historical museum (the original intention behind its
construction) for one year. It now houses the offices and gift shop
of the Kenaitze Tribe, IRA.
outbuildings: The area immediately behind the building on the north
is enclosed with chain link fence and contains four relocated log
cabins. They are the Miller Cabin (KEN -268); the Arness Cabin (KEN -
265); the Three Scandinavians' Cabin (KEN- 266); and Cabin #3 (KEN -
267). These cabins were open to visitors during the year "Fort Kenay"
operated as an historical museum. The area is now closed and can
only be viewed through the fence.
