Street Address: 4255 North Dogwood Road KPB Parcel No.: 04906060 Existing Zoning: RR — Rural Residential Current Land Use: Vacant Land Use Plan: Rural Residential ANALYSIS This plat subdivides a large parcel containing over 30 acres into a subdivision resulting in 24 lots. The lots in the subdivision range in size from 1 acre to 1.39 acres and meet the minimum lot size for the zone and Alaska Department of Environmental Conservation (ADEC) requirements for on -site water and sewer. The minimum lot width within the Rural Residential zone (KMC 14.24.020) of 90 feet is met for all lots in the subdivision. The plat also dedicates 60' foot rights -of -way into the subdivision off North Dogwood Road and a 30' right -of -way off North Fern Street. The City of Kenai requires development of dedicated rights -of -way. The 30' foot dedication off North Fern Street is a half - dedication matching the existing dedication of North Fern Street. The primary access for Block 1, Lot 6 will be off the 60' foot dedicated right -of -way off North Dogwood Road. The City will not require development of this portion of North Fern Street. The City will require an installation agreement for the development of the 60' rights -of- way off N. Dogwood Road. According to aerial photographs, there are existing travel ways in the subdivision. These travel ways appear to align with the right -of -ways that will be dedicated with this plat. According to the City's records, in 1970, there was a PZ13 -01 — Comments Page 2 Page 2 preliminary subdivision for this area which was described as Part 46 of Valhalla Heights Subdivision Heights. An agreement signed by the owner at that time and the City, agreed that the roads in part 46 would be marked as private roads and not maintained by the City. (See attached agreement and maps.) The standard to which these travel ways were constructed is unknown. It is possible that the existing travel ways may be upgraded to meet the City's current standards. However, this determination will require an engineer to drill test holes to determine construction materials and depth and a surveyor to certify the travel ways are centered in the dedicated rights -of -way. These possibilities will be discussed with the property owner during development of the installation agreement. City water and sewer has not been extended down North Dogwood Road. Water has been extended across the Kenai Spur Highway but sewer does not cross the highway. The lots are all over 40,000 square feet and meet ADEC size requirements for on -site water and sewer. Kenai Municipal Code 14.10.080(e) and (f) address water and sewer improvements for subdivisions within the City. In subdivisions with lots of ten (10) or more, the code requires an approved public water supply. City administration does not support requiring a public water system for this subdivision and recommends an exception to the requirements. The code (f) requires sanitary sewer lines to serve each lot if the subdivision is service is within 1500 feet of the nearest lot line. City administration does not support this requirement and recommends the Commission grant an exception to the requirement. If the exceptions are granted, the City will not require water and sewer main line extensions to serve the subdivision and the subdivision will be served with on -site water and sewer. RECOMMENDATIONS This is a preliminary plat that subdivides a large parcel into a 24 -lot subdivision. The property is located in the Rural Residential zone. The lots meet the development requirements for the zone. The property is located off North Dogwood Road which is developed and maintained by the City of Kenai. The plat dedicates rights -of -way in the subdivision and will require an installation agreement to construct the rights -of -way to City standards. The installation agreement will be developed after the preliminary plat is approved and improvements must be completed prior to recording of the final plat. The lots in the subdivision meet ADEC standards for on -site water and sewer. The City recommends an exception to KMC 14.10.080(e) and (f) be granted and to allow on -site utilities. If in the future the City should extend water and sewer mains down North Dogwood Road, there will be sufficient room in the rights -of -way place the main lines. Recommend approval of the preliminary plat subject to the following: 1. Grant an exception to KMC 14.10.080(e) (Public Water System) and (e) PZ13 -01 —Comments Page 3 Page 3 (Sanitary Sewer Service). 2. Installation agreement will be required: The City will work with the property owner to develop the Installation Agreement after preliminary plat approval. Improvements may include but not be limited to the following: a. Streets and drainage plans must be designed and constructed to Municipality of Anchorage Standard Specifications (2009 MASS) b. Design must be stamped by an engineer licensed in the State of Alaska. c. Prior to construction, plans must be submitted to the City of Kenai for review and acceptance. d. Streets will require a minimum 24 -foot paved surface, with 2 -foot shoulders and approved excavation and backfill. e. Signage including but not limited to stop signs, speed limit signs and street signs. f Back slopes must be top soiled and seeded. g. After construction, the engineer must submit signed documentation that the road was built to the standards approved in the submitted plans. It. As -built drawings must be submitted to the City in both paper and digital format (Adobe & AutoCAD). 3. PROPOSED - AGREEMENT TO ACCEPT STREETS Iv (VALHALLA HEIGHTS SUBDIVISION) WHEREAS, the OWNERS of Valhalla Heights Subdivision, BASIL'S,- BOLSTRIDGE and ELIZABETH W. BOLSTRIDGE, hereinafter sometimes called OWNER'S; and the City of Kenai, Alaska, hereinafter sometimes called CITY; desire to settle a dispute as to the standard of construction or quality of existing constru- tion of the streets within various parts of Valhalla Heights Subdivision; NOW THEREFORE, this agreement is entered into the dates indicated for signature below, by and between the OWNERS and the CITY as follows: 1. The CITY will accept the streets in the parts or portions of Valhalla Heights Subdivision provided that the terms of this agreement, as outlined below, are complied with piror to the 15th day of September 1971. In the event the terms of this agreement are not fully executed by the 15th, day September 1971, then the OW14ERS agree CITY shall be under no obligation to accept the streets in the said subdivision for maintenance, repair, or im-. provements. 2. OWNERS agree the following improvements are to be made to parts #1, #3, and #5 of said subdivision. (a) The constructed streets found to have less than 42 inches of non - frost susceptible material, and at least 6 inches of the 42 inches of non -frost susceptible material shall be gravel. To the stand- ards set forth in Kenai Code, 1963, as amended, Section 18 -13, Section 18 -14, and Section 18-15. (b) OWNERS acknowledge receipt of a copy of the standards of street construction upon execution hereof. 3. In part #6 of Valhalla Heights Subdivision, the roads will be marked as private roads not maintained by the CITY. 4. Part #2 of Valhalla Heights Subdivision does not have any roads as of the date of preparation of this Agreememt in December of 1970 and is not included in this Agreement. 5. Part #4 of Valhalla Heights Subdivision will be accepted by the CITY as it exists as of the date of signing of this Agreement. 6. OWNERS agree that no lots will be sold in Part #5 of Valhalla Heights Sub- division Heights until the work specified herein is completed and approved by the Public Works Coordinator of the CITY. 7. In addition to the work specified in Paragraph 2 of this Agreement, OWNERS agree (a) No construction or repair shall be accomplished on the streest in ques- tion, nor commenced prior to the 30th day of May 1971. unless earlier notice is directed to OWNERS by the CITY. (b) Work or construction on the roads in question is not considered com- completed until inspected and approved by the CITY prior to acceptance. 8. This Agreement in no way modifies or changes any obligations of OWNERS to the Kenai Peninsula Borough with respect to any platting, or allied matters, on the subdivision, or part thereof, in question. Pitts —Lot IA and Lot 2A1, F.B.O. Subdivision Attached is a memo from Christine Cunningham, Assistant to City Manager, requesting the Commission review proposed lease amendments for the above - referenced airport properties. The amendments would amend the lease for Lot lA from "Freight Facility" to "Freight Facility, Fuel Operations, and Airport Support Operations." The amendment for Lot 2A1 would amend the use from "Freight Facility" to "Freight Facility and Parking and Storage." In addition, the amendment for Lot 2A1 requires that the rates for parking shall not be less than the rates charged by the City for airport parking. These properties are located at 401 and 403 North Willow Street and located in the Airport Reserve. I have reviewed the proposed lease amendments to assist the Commission with the review. The following information addresses the uses proposed in the amendments: ➢ Airport Land Use Plan — The ALP was approved in July, 2009. On sheet 13 of the plan, the property is identified as Aviation Related Activities. Sheet 14 of the approved ALP, identifies the parcels as Commercial Aviation. The Supplemental Plan defines Commercial Aviation as, "Areas used activities requiring taxiway access such as air cargo facilities, hangars, corporate jet support facilities, military facilities, fueling facilities, and airline and air taxi hangar /office complexes." The amendments identify the uses as "Freight Facility, Fuel Operations, Airport Support Operations, Parking, and Storage." It appears the uses conform to the ALP. ➢ Comprehensive Plan — The City of Kenai Comprehensive Land Use Plan Lease Amendments Dan O. Pitts — Lot I and Lot 2A1, F.B.O. Subdivision Page 2 identifies the area as Airport Industrial. The Airport Industrial area is defined as, "The Airport Industrial district identifies airport lands reserved for the Kenai Municipal Airport and its future expansion, and tracts needed for present and future aviation - related uses and activities. The uses conform to the Comprehensive Plan. ➢ Zoning —The property is zoned IL — Light Industrial. Airports and Related Uses and Storage Yards are permitted within the zone. Kenai Municipal Code 14.20.130(f)(2) requires, "Open Storage. No open storage shall be located closer than twenty -five feet (251) to the adjoining right -of -way of any collector street or main thoroughfare. Any open storage visible from a collector street or main thoroughfare shall be enclosed with an eight -foot (8') high fence of good appearance acceptable to the Commission." Based on a recent site inspection, it appears that a portion of the properties used for storage is not screened. Administration will be working with the lessee to ensure the areas used for storage meets code requirements. The proposed lease amendments conform to the ALP, Comprehensive Plan, and Zoning. On May 13, 2009, the Planning & Zoning Commission found that the following proposed Amendment(s) conformed to the ALP, the Comprehensive Plan, and Zoning: 1. Amendment to Lease for Lot 1A changes the use from "Freight Facility" to "Fuel Operations and Aircraft Support Operations." 2. Amendment to Lease for Lot 2A1 changes the use to state: "Parking (automobiles and RV's.) The rate charged for automobile parking shall not be less than the rate charged by the City. No storage will be allowed in the parking area, and the designated storage area must have a site - obscuring fence." On May 14, 2009, the Airport Commission recommended the above Amendments for approval, but did not "support the City telling the leaseholder what could be charged for parking." However, the above Amendments were not executed, pending the City's approval of the existing subleases. (5) The term "hive" as used in this section means the single structure intended for the housing of a single bee colony. Based on my experience, a few chickens can be raised on small lots unobtrusively, as long as certain conditions are met. I believe that the most appropriate method for considering whether chickens or other fowl should be allowed on any particular lot is through the Conditional Use Permit process, which must be enhanced with appropriate conditions for smaller lots. Additionally, I am struggling with how potential bear Irisk should be factored into the permit evaluation. Below are my initial opinions and recommendations for your consideration as we enter into this review process. Henry Knackstedt OPINION /COMMENTS • Chickens can be raised successfully and unobtrusively in residential areas. • The proposed ordinance is limited and should address other fowl including chickens for meat, turkeys, ducks and geese. Other birds are the natural next step for residents once they realize the work involved with egg producing chickens and have the infrastructure for raising fowl. • Hens lay well for about 2 years after which production falls significantly and they need to be culled -out. Since new chicks and hens can't be mixed, the process requires a second coop separated from the original. Egg producing layer hens tend not to brood well, so replacement chicks through this method isn't reliable. Additionally, roosters won't be allowed which won't allow for egg fertilization. The typical city dweller may have difficulty if the purpose of the chicken is strictly for egg production. • Better sustainability through locally- raised foods is a trend across the country, which was presented in public testimony. • Coop and enclosure requirements need to be established to protect adjacent property values. • Property line setbacks need to be evaluated. • Conditional Use Permit (CUP) is already available to raising fowl. • No CUP has been requested in recent memory. • According to testimony, the public did not seem aware that CUP was available. • 1 think the proposed ordinance created an interest in chickens which makes ignorance of the existing CUP process immaterial. • Neighbors potentially affected by a CUP would be made aware of proposed activity through the normal process. • A CUP provides tracking and documentation of the use. • Bear conflicts have been a problem. A CUP would provide monitoring and correlation between the raising of fowl and bear conflicts, • KMC 3.10.070 allows for livestock on lots great than 40,000 sf with the exception of RU, RS1, RS2 or TSA Zones, which cannot have livestock even if they exceed this minimum acreage. This code was recently modified disproportionally for bees, and a similar modification of the code to cover fowl is inappropriate as a band -aid. RECOMMENDATIONS • The CUP process is available for fowl, and guidelines should be established for the review of the application for the CUP. It has not been established that the existing process needs fixing through code modification. • KMC 3.10.070 should only be modified to direct to the CUP process for fowl and to assure the code is in harmony with any CUP recommendations. • Animal Control and other departments should be requested to give an opinion on the CUP request. • Coop dimensions should not exceed 8'x10' (80sf). Minimum area per chicken required is 2sf per bird plus room for water and feeder. This dimensional area is more than adequate for 12 chicken hens as proposed. Many coops will likely be converted into storage sheds in time. • The coop exterior needs to be finished in a similar manner as the residence, or as is common in the neighborhood. • The coop must be wired by a licensed electrician. The coop will need lighting and possibly a heat source. In the winter, coops are typically humid, so a GFI outlet should be required. • A building permit for the coop must be required. • No building setback reductions should be allowed for the coop. A coop is more likely to catch fire than a residence or shed, so separation distance from adjacent properties needs to be maintained. • The enclosure needs to be standard 5' high chicken fencing, supported by neatly installed treated lumber, or an approved alternative. • In no case may chickens be free - range. • No mature roosters will be permitted. • Fowl are limited to 12 chicken hens for egg production, 15 chickens for meat production for 10 weeks maximum, 5 turkeys for 20 weeks maximum, 10 ducks, and 5 geese. Combinations of fowl may be considered. • Conditions need to be placed for butchering. 1 am not sure it is appropriate to butcher in most of our residential areas. Perhaps the recommendation is to butcher in areas that a CUP is not needed ? ? ?? • Feed not in use must be kept in an approved secure location protected from bears and vermin. • The feeder must be inside the coop at all times. • Waste from the coop will be removed from site or composted in a neat composting structure. I am not sure how we address the potential odor ? ?? • The likelihood of bears in the area needs evaluation (I have no suggestions on this, but it is a major concern in our city). I would like input from ADF &G and Administration. • If a coop is raided by bears, the CUP will be revoked immediately. • Installation of an electric fence is optional (I have no experience with them and don't know what is appropriate).
