PZ13-11 —Application for a Conditional Use Permit —Annette King and Roylene Strout, dba 2 Sisters Alaska Seafood (Internet/Retail Business) — 5455 Kenai Spur Highway — Lot 7A, Block 3, Thompson Park One Stop Replat. City Planner Kebschull reviewed the staff report included in the packet, noting the following criteria needed to be met: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district. 2. The value of the adjoining property and neighborhood will not be significantly impaired. 3. The proposed use is in harmony with the Comprehensive Plan. 4. Public services and facilities are adequate to serve the proposed use. 5. The proposed use will not be harmful to the public safety, health or welfare. 6. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions should be met by the applicant. These may include, but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use. Kebschull recommended approval with the following requirements: 1. A building permit, inspection and approval are required. 2. Remove all old signage from previous business. MOTION: Commissioner Knackstedt MOVED to approve Resolution No. PZ13-11 and Commissioner Arness SECONDED the motion. Twait opened the meeting to public comment. Annette King, 5455 Kenai Spur Highway, Applicant — Ms. King made herself available for questions. Revocation hearing revoking Conditional Use Permit PZ06-26 — Steve & Rick Voth dba Captain Bligh's Beaver Creek Lodge (Lodging & Guide Service) —1045 Angler Drive — Lot 5, Angler Acres Subdivision #3. (Postponed 2/27/13) [Clerk's Note: The revocation was postponed from the February 27, 2013 meeting; motion is on the floor.] Planning Assistant Carver reviewed the staff report included in the packet, noting the business was now in compliance and recommending dismissal of the revocation. Kebschull reviewed the staff report included in the packet, noting the application was complete and conformed with the Comprehensive Plan and zoning. Commissioner Arness revealed a possible conflict of interest. Twait decided there was no conflict and allowed Arness to vote. MOTION: Commissioner Knackstedt MOVED to recommend proceeding with the lease and Commissioner Arness SECONDED the motion. Administration — City Planner Kebschull reported the Kenai Peninsula Borough had approved the easement vacations for the Catholic Church and Anchor Trailer Park. Planning Assistant Carver noted each commissioner had been given a copy of the book "The Planning Commissioner's Guide." 10. PERSONS PRESENT NOT SCHEDULED — None. 11. INFORMATION ITEMS — None. 12. On March 27, 2013, the Commission held a Work Session on the above -referenced resolution proposing amendments to allow accessory structures on residential lots without a principal structure. The amendments will provide an opportunity for property owners to request an exception through the conditional use process. This provides an opportunity to review each request individually. The proposed amendments will: • Allow individuals, through the conditional use process, to place an unoccupied accessory structure on a vacant lot, adjacent to commonly owned property with a main building or use. Conditional Use Permits that are issued under the amendment will automatically expire upon transfer of either parcel to a third party. Structures would be restricted to unoccupied uses and limited to a footprint less than 400 square feet and without a permanent foundation. These restrictions are intended to allow for ease of removal of the structure in the event of transfer of ownership. M CITY OF KENAI PLANNING AND ZONING COMMISSION RESOLUTION NO. PZ13-12 A RESOLUTION OF THE KENAI PLANNING AND ZONING COMMISSION RECOMMENDING THAT KENAI CITY COUNCIL ADOPT AMENDMENTS TO KENAI MUNICIPAL SECTIONS 14.24.200, ACCESSORY STRUCTURES, 14.20.320, DEFINITIONS AND 14.22.010 LAND USE TABLE TO ALLOW UNOCCUPIED ACCESSORY STRUCTURES TO BE PLACED, BY CONDITIONAL USE, ON RESIDENTIAL PARCELS THAT DO NOT HAVE A MAIN BUILDING OR USE IF THE SAME OWNER OWNS AN ADJACENT RESIDENTIAL PARCEL. WHEREAS, accessory structures, such as greenhouses, sheds and other detached buildings or structures are allowed on parcels that have a main building or use but are not allowed on parcels without a main building or use; and WHEREAS, Kenai Municipal Code does not currently provide a process for allowing owners of adjacent parcels to place unoccupied accessory buildings on parcels that do not have a main building or use even if the adjacent parcel does have a main building or use; and, WHEREAS, this ordinance is intended to allow owners of adjacent residential parcels to utilize, through the conditional use process, adjacent commonly owned parcels similarly, with regard to unoccupied accessory buildings, as if the lot line between the properties had actually been vacated; and WHEREAS, allowing full use of property in a responsible manner consistent with applicable planning and zoning ordinances is in the best interest of the public; and, WHEREAS, limiting unoccupied accessory buildings on adjacent residential parcels without a main building or use, to structures without a permanent foundation and with a footprint less than 400 square feet, protects the City and neighbors as the structures are more easily movable in the event of a transfer of ownership, while still allowing a reasonable use of the property; and, NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF KENAI, ALASKA: That the City of Kenai Planning and Zoning Commission recommends Council adopt amendments to Kenai Municipal Code sections 14.24.200, Accessory Structures, 14.20.320, Definitions and 14.22.010 Land Use Table to allow Accessory Structures to be place, by Conditional Use, on residential parcels that do not have a main building or use if the same owner owns an adjacent residential parcel, as follows: Res. PZ13-12 Page 2 of 3 14.20.200 Accessory structures. (a) Yard Requirements for Accessory Structures. Where yards are required, accessory structures shall be subject to the same requirements as principal structures except as follows: (1) In an RR and RS zone, the minimum front yard setback for an unoccupied attached or detached garage or carport shall be ten feet (10'); (2) Covered but unenclosed passenger landings, or storage sheds of not more than one hundred twenty (120) square feet and not more than one (1) story in height may extend into either side yard or rear yard, but such structure shall not be closer than three feet (3) to an adjoining lot; (3) Covered but unenclosed passenger landings, or storage sheds of not more than two hundred (200) square feet, with no side or end longer than sixteen (16) feet, and not more than one (1) story in height may extend into the rear yard, but such structure shall not be closer than five feet (5') to the rear lot line; (4) Unenclosed outside stairways, fire escapes, porches, or landing places as well as cornices, canopies, eaves, and other similar architectural features not providing additional floor space may extend into a required side or rear yard except within three feet (3) of any lot line; (5) Unenclosed outside stairways, fire escapes, porches, or landing places as well as cornices, canopies, eaves, and other similar architectural features not providing additional floor space may extend into a required front yard except within ten feet (10) of any lot line; (6) A detached accessory building may be permitted to occupy a rear yard; provided that, not more than one-third (1/3) of the total area of such rear yard shall be so occupied. Except as provided in KMC 14.20.200(a)(2) and KMC 14.20.200(x)(3), setbacks, per development tables, must be maintained if structure requires a building permit; (7) For purposes of this section one (1) story in height is a maximum of twelve feet (12) high as measured from the ground to the highest point of the subject structure roof. (b) Unoccupied accessory structures may be allowed as a conditional use on a residential parcel that does not have a main building or use of the land only when the parcel on which the unoccupied accessory structure proposed is adjacent to and shares a common lot line with a parcel owned by the same owner and a main building or use is constructed or used on the adjacent parcel. The conditional use for an unoccupied accessory structure on an adjacent parcel shall expire upon transfer of either parcel to a third party and all accessory buildings on adjacent parcels without a main building or main use must be removed (c) Unoccupied accessory structures allowed as a conditional use on residential parcels adiacent to a parcel owned by the same owner with a main structure or use of the land shall be limited to structures without a permanent foundation and less than 400 square feet 14.20.320 Definitions. "Accessory building" means a detached building or structure, the use of which is appropriate, subordinate, and customarily incidental to that of the main building or to the main use of the land and which is located on the same lot as the main building or use, except as allowed by a conditional use permit. On March 27, 2013 the Commission held a work session on the above -referenced sections of the Kenai Municipal Code. The following changes are being recommended: • Change front setbacks from 25 -foot (25') to a 20 -foot (20') setback. The change will provide consistency with the Kenai Peninsula Borough & City of Soldotna while still provide adequate light, air and privacy while protecting the City's interest in health and safety and aesthetics. • To be consistent with the City's building code, accessory structures must be kept five -feet (5') from lot lines. • Amendment removes 14.20.200(1)(5) which permits unoccupied accessory structures be placed within ten -feet (10') of the front property line. • Eliminates KMC 14.24.030 by combining the requirements in the addendum into the footnotes of KMC 14.24.020. This will provide clarity and eliminate potential confusion. Administration is recommending these changes and unless the Commission directs otherwise, a public hearing will be scheduled for the April 24, 2013 Commission meeting. MA CITY OF KENAI PLANNING AND ZONING COMMISSION RESOLUTION NO. PZ13-09 A RESOLUTION OF THE KENAI PLANNING AND ZONING COMMISSION RECOMMENDING THAT KENAI CITY COUNCIL AMEND THE KENAI MUNICIPAL SECTION 14.24.020, GENERAL REQUIREMENTS - DEVELOPMENT REQUIREMENTS TABLE, BY ALTERING SETBACK REQUIREMENTS FOR RESIDENTIAL USES AND MERGING KENAI MUNICIPAL SECTION 14.24.030, ADDENDUM TO DEVELOPMENT REQUIREMENTS TABLES, INTO KMC 14.24.020 AND DELETING KMC 14.24.030 FOR PURPOSES OF CLARITY. WHEREAS, the Development Requirement Table in KMC 14.24.020, General requirements, requires twenty-five foot (25') front setbacks for all zoning districts except RU/TSH; and, WHEREAS, changing the front setback requirements from twenty-five (25) to twenty - foot (20') front setbacks will provide for greater utilization of property while continuing to protect the integrity of zoning districts to provide adequate light, air, and privacy while protecting the City's interest in health and safety and aesthetics; and, WHEREAS, changing the front setback requirements to twenty -foot (20') will also provide for consistency in setback requirements between the City, Kenai Peninsula Borough and the City of Soldotna; and, WHEREAS, KMC 14.20.200, Accessory structures, allows for certain accessory structures to be within ten -feet (10') of the front lot line; and, WHEREAS, accessory structures should be kept back at least twenty -feet (20') from the front property line to maintain health and safety and aesthetic interests of the City, especially when site distance on corner lots is an issue; and, WHEREAS, KMC 14.20.200, Accessory structures, also allows for certain accessory structures to be within three -feet (3') of a side or rear property line however the City's building code requires these structures to be kept five -feet (5') from the lot lines; and, WHEREAS KMC 14.20.200, Accessory structures should be further amended to provide consistency with the City's building code; and, WHEREAS, both KMC 14.24.020 and KMC 14.24.030 provide similar requirements regarding setbacks; and, WHEREAS, combining the setback requirements into one code section will provide clarity and eliminate potential confusion. The apartment complex was built in 1977 and has provided apartment rentals since construction. • KMC 14.20.150(i)(5) "A conditional use permit is not transferable from one (1) parcel of land to another. Conditional use permits may be transferred from one (1) owner to another for the same use, but if there is a change in use on the property, a new permit must be obtained. " PZ13-15 (PZ10-43) Comments • KMC 14.20.158(a) "No conditional use permit issued hereunder shall be transferred until the proposed transferee has made application for transfer in writing filed with the administrative official, which application shall state that he intends to be bound by the plan and statements contained in the application of the permit holder or shall contain the amendments to the plan his proposed operation would mandate. The Commission shall approve the application for transfer and in so doing amend the site plan and statements if such amendments as are contained in the application for transfer would have been approved had they been contained in the original application. General Information: KMC 14.20.150 details the intent and application process for conditional uses. The code also specifies the review criteria that must be satisfied prior to issuing the permit. The criteria are: 1. The use is consistent with the purpose of this chapter and the purposes and intent of the zoning district. The RS Zone is intended to provide for medium density residential development in areas which will be provided with common utility systems. The specific intent in establishing this zone is to separate residential structures to an extent which will allow for adequate light, air, and privacy; and, to prohibit uses which would violate the residential character of the environment and uses that generate heavy traffic in predominantly residential areas. This development is located on a 2.5 acre parcel and is built to provide sufficient off-street parking and public areas. The apartment complex was built in the late 1970's and has been compatible with development in the area. The proposed short-term rentals could be provided so that the adjoining properties are not adversely affected. The use appears consistent with the zone. 2. The value of the adjoining property and neighborhood will not be significantly impaired. The value of the adjoining properties should not be significantly impaired by allowing the short-term rentals. 3. The proposed use is in harmony with the Comprehensive Plan. The Neighborhood Residential district consists of single-family and multi family residential areas that are urban or suburban in character. Typically, public water and sewer services are in place or planned for installation. This land use district may include both single-family and multi family dwellings subject to reasonable density transitions and/or design compatibility. Formal public outdoor spaces (parks) are a critical feature in this district. Small home-based businesses may be accommodated within certain design guidelines. Neighborhood institutional uses such as churches, schools, and day care facilities may be intermixed if they comply with neighborhood design guidelines. The proposed short-term rentals appear to be in harmony with the Comprehensive Plan. 4. Public services and facilities are adequate to serve the proposed use. (POK) seeks to rehabilitate and improve an existing boat ramp in the Kenai River. On behalf of the POK, Travis/Peterson Environmental Consulting, Inc. (TPECI) presents this narrative to supplement the Multi -Agency Permit Packet. PROJECT PURPOSE: The purpose of the project is to rehabilitate and improve an existing boat ramp on POK property. PROJECT LOCATION: The proposed project is located about Mile 1.5 on the Kenai River right bank with the City of Kenai. It is in Township 5N, Range I 1 W, Sections 4 and 9 of the Seward Meridian. The property address is 810 Childs Avenue, a development owned by POK and accessible from Bridge Access Road. The 16.5 acre property currently has five warehouses, some equipment storage, and the existing boat ramp. The project will occur about 900 feet downstream of the City of Kenai Boat Launch and about 1,100 feet downstream of the City of Kenai Dock. PROJECT DESCRIPTION POK has an existing boat ramp on its property on the Kenai River. The river has deposited silt across the boat ramp rendering it inaccessible. Most of the project activities will extend below Port of Kenai LLC 1421-03 Supplemental Narrative for River Center Application ordinary high water (OHW) of the Kenai River. boat ramp. March 28, 2013 POK will rehabilitate and improve the existing POK will dredge accumulated silt from approximately 0,2 acres of surface area of the Kenai River. POK will use a dragline dredge and clam shovels to remove approximately 69,000 cubic feet of silt. POK will place the silt in a loader where it will be permanently disposed behind the fence on the POK property. The disposal area is outside of the Kenai River Center flood zone (please see Sheet 2 of 4). Once the silt has been removed from the existing ramp POK will refurbish existing concrete planks on the downstream side of the ramp (please see Sheet 3 of 4 and Sheet 4 of 4). Additionally new concrete planks will be installed and POK will construct and pedestrian ramp and floating dock. The floating dock will necessitate the installation of six vertical pilings. Baker Hughes operates at a facility located off the Kenai Spur Highway. The aging facility will be demolished and a new facility constructed to meet the business needs and to meet fire and building codes for the industrial uses at the facility. Baker Hughes has been researching options for their business for some time which included repair/renovation of existing facilities, moving from the current location and rebuilding, or as submitted with this project the demolition of the existing facility and rebuilding at their current site. As part of this development, Baker/Hughes plans to construct Seward Avenue to provide efficient ingress and egress for their delivery trucks. The company will also extend the City's water main to the facility. The City's water service ends at approximately Lilac Lane. The construction of Seward Avenue and extension of the water main will require engineered designs and approval of the project(s) by the City. The extension of the City's water main must also be approved by the State of Alaska, Department of Environmental Conservation. The City will require excavation permits to work in the City's right-of-ways and any permits required by the State to work in the Kenai Spur Highway right-of-way must be obtained. This analysis will address the requirements of KMC 14.25, landscape/site plans. The plan, as submitted, should be amended to include any items required by the City's code PZ13-18 Comments Page 2 that are not included with this submittal. The updated plan can be included when the building permit is submitted. Because of the time constraints placed on land clearing by the Migratory Bird Act, the plan was submitted for review and approval so required clearing could be accomplished prior to May Vt. On April 2nd, the property owner and contractor were given verbal approval to begin clearing the site. KMC 14.25 specifies the regulations for landscape/site plans within the City of Kenai. Section 14.25.030 of that chapter details Landscaping/Site Plan submittal requirements. • Scientific or common name or type of planting materials to be used in the project. o Preliminary plan does not include planting materials. • Typical planting details. o Not included in the preliminary plan. • Location of all planting areas and relationship to buildings, parking areas and driveways. o Site plan provides basic information but no landscaping detail. • Identification and location of existing vegetation to be retained. o It appears that the intent is to remove all existing natural vegetation. • Identification of on-site snow storage areas. o Snow storage areas are identified as "snow piles." • Drainage patterns. o It appears that drainage is provided for on the site. • Physical features of the property including location of all buildings, ingress and egress, any unusual features of the property, which may restrict development or drainage. o There do not appear to be any unusual physical features of this property. However, the site includes four separate parcels in the development. The owner/applicant has been informed that the development will require replatting to create one large parcel or cross parking agreement and access easements. If the property is not replatted, an easement must be recorded to bring the water service line to Tract D. If the properties are not replatted into one large parcel, a variance for an off -premise sign will be required. Section 14.25.040 of the code outlines the landscaping plan performance criteria. Perimeter/Buffer Landscaping — involves the land areas adjacent to the lot lines within the property boundary and serves to separate and minimize the impact between adjacent uses. o The site plan shows green areas along the eastern property line and a small area along Seward Avenue. A legend is not included in the plan. It is assumed these "green areas" show areas that will be landscaped in the final design. Interior Landscaping — involves areas exclusive of the perimeter and parking lot areas. o Site plan shows what appear to be trees or shrubs located between the parking area and the office portion of the building. No details are provided. Parking Lot Landscaping — involves areas adjacent to or within parking lots and access drives. o See above. Street -right-of-way Landscaping — intent to soften the impact of land uses along rights-of-way but does not obscure land uses from sight. o No street/right-of-way landscaping is shown on the plan. KMC PZ13-18 Comments Page 3 14.25.040 (e) requires a minimum of ten feet (10) wide landscaping beds along the entire length of the property lines which adjoin street rights-of-way. The following are required in the site plan: • Parking — o This is a mixed use facility. The Site plan identifies areas of the building as "workshop' and "office." The "workshop" is later identified as a "warehouse." • The "workshop" or "warehouse" is 22,400 square feet. KMC 14.20.250 requires 1 parking space for every 2,000 square feet. The warehouse area requires 12 parking spaces. The office area is 5,500 square feet. KMC 14.20.250 requires 1 parking space per 400 square feet. The office area requires 14 spaces. • The site plan provides for 31 total parking spaces; 25 "unsecured vehicles," and 6 "secured truck" parking spaces. • Two (2) of the spaces in the "unsecured vehicle' area are identified as accessible parking spaces which meets the code requirement for accessible parking spaces. (Building Code) • The plan does not provide dimensions of the spaces. • Parking Lot. o Parking areas are identified on the plan. • Snow storage. o Snow storage areas are identified on the plan. • Dumpster. o Dumpster location is not shown on the site plan. Any dumpster on the site must be screened with a sight -obscuring structure made of wood or concrete. RECOMMENDATIONS This plan is being submitted and reviewed as a preliminary plan to meet the requirements of KMC 14.25.015 so that the developer can clear the site prior to the May 1s` deadline of the Migratory Bird Act. The site plan meets the requirements of the Kenai Municipal Code. The landscaping plan must be updated to include details for planting areas, types of planting materials to be included, and to provide the minimum landscaping as required in the Code. This review/approval addresses the landscape/site plan requirements. Other approvals/reviews that must be completed in conjunction with this project include but are not limited to: 1. Seward Avenue Construction: • Prior to clearing in the Seward Avenue right-of-way, the developer must submit a clearing plan to the Public Works Department for review and approval. • Design for and construction of Seward Avenue must be approved by the City prior to construction. • Contractors working in the City's rights-of-way must have a current City of Kenai annual excavation permit. • An individual project permit for working in the City's rights-of-way must be submitted and approved prior to beginning the project. 2. Extension of the City's water main: 0 Design and construction must be approved by the City prior to PZ13-18 Comments Page 4 construction. • The State of Alaska must review and approve extension of the City's water main. • Any permits required for the State of Alaska for construction in the Kenai Spur Highway right-of-way are the responsibility of the developer and must be obtained prior to construction. Building Permit: • An updated landscape plan must be submitted with the building permit application. • The building permit may not be issued until zoning requirements have been met including: o Replatting of the four (4) parcels to one large parcel. o An alternative to replatting would be cross parking agreements and access easements. o If the property is not replatted, an easement must be recorded to bring the water service line to Tract D. o If the property is not replatted, a variance must be applied for an approved for an off -premise sign.
